5 AN BILLE UM IONADAÍOCHT CHEARDCHUMAINN (FORÁLACHA ILGHNÉITHEACHA), 2017 TRADE UNION REPRESENTATION (MISCELLANEOUS PROVISIONS) BILL 2017 Bill entitled An Act to amend the Trade Union Act 1941 and the Industrial Relations (Amendment) Act 2001 to confer on authorised unions the right to have their representative duties to their members for collective bargaining and disciplinary matters recognised by employers and to provide for related matters. Be it enacted by the Oireachtas as follows: 5 10 Amendment of Trade Union Act The Trade Union Act 1941 is amended (a) in section 2 by the insertion of the following definitions: authorised trade union means a trade union in possession of a negotiation licence issued by the Minister under section 5 of this Act; collective bargaining extends to all negotiations which take place between an employer, a group of employers, or one or more employers organisations, on the one hand, and one or more authorised trade unions or excepted bodies to which this act applies on the other, for determining wages, working conditions, and terms of employment; and/or regulating relations between employers and workers; and/or regulating relations between employers or their organisations and one or more authorised trade unions or excepted bodies;, (b) in section 5(1) by the deletion of for the fixing of wages or other conditions of employment and substitution of for the purposes of collective bargaining ; and (c) in section 10 by the insertion of the following after such licence. : (2) The right of an authorised union to represent its members for the purposes of collective bargaining, including grievance and disciplinary issues, shall be recognised by an employer, and/or group of employers, and/or one or more employers organisations

6 Amendment of Industrial Relations (Amendment) Act The Industrial Relations (Amendment) Act 2001 is amended by the substitution of the following for section 1A: 1A. For the purposes of this Act, collective bargaining has the meaning assigned to it by section 2 of the Trade Union Act Short title and commencement 3. (1) This Act may be cited as the Trade Union Representation (Miscellaneous Provisions) Act (2) This Act shall come into operation no later than three months after the date of its passing. 10 4
