Jonathan has a broad practice across chambers main practice areas. It encompasses, pensions, property (including landlord and tenant), domestic and international commercial work, and trusts. He deals with professional negligence, company and insolvency issues arising out of these core areas. As well as being regularly led in the High Court, Court of Appeal and internationally, Jonathan acts as sole counsel in the High Court (Chancery Division, Commercial Court, QBD and TCC) and county court. Outside court, Jonathan appears before tribunals (such as the FTT or Pensions Regulator DP) and at mediations or settlement meetings. Recent successes in his own name include appearing in the Court of Appeal (Matchmove v Dowding [2015] EWCA Civ 313), winning a heavily-fought 11-day county court trial, and a reported High Court case (Dany Lions v Bristol Cars [2014] 2 All ER (Comm) 403.) His cases have been referred to in leading texts such as Chitty, Lewison and the White Book. Other highlights include: Phillips v Francis [2015] 1 WLR 741. Jonathan acted with Jonathan Seitler QC for the successful appellant on the leading case on the meaning of works for landlord and tenant consultation purposes. One of the Lawyer s Top 20 Cases of 2015 : Caliendo v Mishcon de Reya (awaiting judgment). Jonathan, led by Ian Croxford QC and Clare Stanley QC, acts for the defendant firm in relation to a professional negligence claim brought arising out of the sale of QPR football club to Flavio Briatore and Bernie Ecclestone in Appearing before the Pensions Regulator Determination Panel as sole counsel (against Jonathan Evans QC and Fenner Moeran QC), acting for the Original Trustee who had been removed by the Regulator facing allegations of misconduct and pensions liberation. Damac Park Towers v Ward (CA 006/2015, 14 December 2015.) Jonathan was led by Rupert Reed QC on the appeal in the DIFC Courts in Dubai. Rupert and Jonathan, having been brought in for the appeal, overturned the trial judge s decision on the construction of a reservation agreement for the purchase of off-plan property in Dubai. Matchmove v Dowding (permission [2015] EWCA Civ 313; full appeal forthcoming.) The dispute concerns constructive trusts, proprietary estoppel and section 2 of the 1989 Act. Jonathan, having obtained permission as sole counsel, is led by Jonathan Seitler QC for the appeal.

2 Jonathan Chew page 02 Professional Liability Jonathan s principal professional liability work arises out of his property, commercial and pensions work. This involves acting for and against a wide range of professions: accountants, solicitors, construction professionals and trustees. He has also appeared in the Privy Council in a veterinary professional negligence claim (RCVS v Holmes [2011] UKPC 48). Examples of Jonathan s professional liability work include: One of the Lawyer s Top 20 Cases of 2015 : Caliendo v Mishcon de Reya (awaiting judgment). Jonathan, led by Ian Croxford QC and Clare Stanley QC, acts for the defendant firm in relation to a professional negligence claim brought arising out of the sale of QPR football club to Flavio Briatore and Bernie Ecclestone in The heavily-contested three-week trial focussed on whether the claimant had retained the defendant at all and the market for purchasing distressed football clubs. Acting with Joanna Smith QC on a FRC investigation into a major audit firm arising out of the collapse and restructuring of an AIM-listed company. (Twintec v Volkerfitzpatrick [2014] BLR 150.) A construction professional negligence claim which is one of The Lawyer s Top 20 Cases of 2014 where a tenant was claiming over 100m against its landlord, with contribution claims against contractors and subcontractors. Jonathan was led by Joanna Smith QC in the dispute relating to a wine factory in the South West and successfully obtained an interim injunction in that case restraining adjudication. Successfully defending a solicitors firm in a county court trial arising out of the inheritance tax consequences of a sale of property and distribution of proceeds.
