The contractor shall utilize creative and aggressive approaches to provide equal opportunity for employment and contracting. No contract over $50,000 shall be awarded until the contractor submits an affirmative action plan and written notification of any subcontractor or tier contractor and the value of the subcontract to the Commission On Equal Opportunities prior to commencing work on any project. The subcontractor(s) must submit an Affirmative Action plan, comply with affirmative action goals, and submit an EEO package before beginning work. Further, no contract shall be awarded until the Contract Compliance Director or his designee has had a reasonable time to review and approve contractor, subcontractor(s), or vendor submissions and convene a pre-award conference. No major subcontractor on a construction project over $50, shall arrive on a project until the necessary preconstruction compliance information has been submitted and reviewed by the Contract Compliance Director or his designee. Failure to submit such information shall prohibit the awarding authority from authorizing such subcontractor to begin work. Suppliers, vendors and services shall provide equal opportunity assurances and/or affirmative action that are acceptable to the Contract Compliance Director. During the performance of any contracts for the construction of the above-captioned development assisted by the City of New Haven, the undersigned contractor further agrees: 1. To abide by the provisions of Executive Order and incorporate the Order in all nonexempt contracts entered into by the Contractor. 2. To abide by the City of New Haven Code of Ordinances Article II, Section through 33 and adopt the minimum minority, female and resident workforce utilization requirements prescribed below: Minority Requirements Female Requirements 25% of workforce, per craft/trade 6.9% of total workforce hours, per craft! trade

Not to discriminate against any employee or applicant for employment because of race, color, religious creed, age, marital status, national origin, ancestry, sexual orientation, sex or any other classifications protected by state and federal law in connection with performance of work under this Program, or other classifications protected by state or federal law. The aforesaid provisions shall include, but not be limited to, the following: advertising, recruitment, layoff, termination, rates of payor other forms of compensation, conditions or privileges of employment, and selection for apprenticeship. 4. In the performance of any contracts for construction or development, and prior to completion of such contracts, not to discriminate in hiring or employment on grounds of race, color, creed, national origin, ancestry, sex or sexual orientation or on grounds of any other classitlcations protected by state or federal law, or to discriminate on such grounds in the selection or retention of subcontractors, or in the procurement of materials or services or rentals of equipment. 5. To post in conspicuous places available to employees and applicants for employment, notices setting forth non-discrimination clausesand living wage rates. 6. To utilize city sponsored manpower programs and state labor department, and/or any other training program as a source of recruitment. 7. To adopt and use such appropriate and applicable living wage rate determinations and labor standards requirements as have been made by the cr Department of Labor and/or the Secretary of Labor. Including the City of New Haven Living Wage Ordinance, Section 2-224, Chapter 2, Article XVII. 8. On HUD-assisted projects to abide by Section 3 of the HUD Act of 1968 and include provisions for compliance with contracts that are $100, and over, with respect to employment and other economic opportunities to low income persons within the City of New Haven. 9. To ensure that each mechanic, laborer or workman on the projects is covered by a workers' compensation insurance policy for the duration of his employment, which shall be demonstrated by submitting to the Commission on Equal Opportunities the name of the workers' compensation insurance carrier covering each such employee, the effective and expiration dates of each policy and each policy number. 10. To keep, maintain, preserve and provide access to such records relating to the wages and hours worked by each employee and a schedule of the occupation or work classification at which each mechanic, laborer or workman on the project is employed during each work day and week in such manner and form as the Commission On Equal Opportunities, state and federal labor departments establish to assure the proper payment due to such employees or employee welfare funds as prescribed by law. 11. That no contract shall be awarded to persons or firms that have been barred from state or federal government contracts and included on lists provided by the cr Labor Commissioner or to any firm, corporation, partnership, or association in which such persons or firms have an interest.

That the contractor assumes full responsibility for compliance with appropriate city, state, and federal nondiscrimination and labor standards regulations, and designates as our Affirmative Action officer, to ensure the company's EEO Policy is executed and submit reports as required by the Commission on Equal Opportunities. 5 CONTRACTOR ELIGIBILITY' Prior to awarding any contract, third party recipients must contact city of New Haven project staff to verify contractor eligibility and that contractor is not included on HUD list of debarred contractors. PRECONTRUCTION CONFERENCE The City of New Haven representatives shall hold a mandatory conference with principal contractor and all available subcontractors prior to the start of construction at which any time they are advised of their responsibilities and obligations regarding the labor standards provisions and the wage determination contained in the contract documents. City of New Haven Policy clearly states: If a contractor starts work prior to a mandatory pre-construction meeting, a fine of $2,000 for each contractor will be levied against each contractor, to be paid within five (5) days business days of the notice on the noncompliance violation. CONSTRUCTION START The City of New Haven project staff must be advised in advance of the construction start date. WEEKLY LIVING WAGE REPORTS Each contractor and subcontractor and any lower-tier subcontractor must submit (through the prime contractor) weekly living wage reports for each work week from the time work is started on the project until it is completed.
