3 Licence is being granted under the attached conditions for the time span declared hereunder. However, the licence fee shall be payable annually as prescribed in article 11 of the aforesaid Regulations. The Authority reserves the right to amend, modify, replace add or delete the conditions of the licence as prescribed in article 22 of the aforesaid Regulations. Any changes in the information submitted to the Authority in relation to the granting of the licence must be submitted to the Authority upon payment of the annual fee or earlier. Definitions In the licence and for the purpose of these conditions (except in so far as the context otherwise requires) the following expressions shall have the meanings respectively assigned to them. The definitions of any other terms used in this licence are the same as those used in the Petroleum for the Inland Fuel Market Regulations, (Legal Notice XXX of 2006) 1.1 Approved Arrangements means those arrangements relating to the design, construction and operation of the licenced premises, which are in accordance with the plans and specifications approved by the Malta Resources Authority, hereinafter referred to as the Authority. 1.2 Attendant Operated means a petroleum filling station where an attendant directly operates and controls the dispensing equipment and the discharge nozzle. 1.3 Attended Self-Service means a petroleum filling station where a user operates the dispensing equipment which is activated, supervised and may be shut off in an emergency by an attendant at a control point. 1.4 Site Operator means an operator approved by and registered with the Authority possessing adequate qualifications as approved by the Authority, suitable training and sufficient knowledge, experience and skill to carry out and supervise tasks related to the day to day running of the station safely and effectively. 1.5 Unattended Self-Service means a petroleum filling station where dispensing equipment is activated and operated by the user without supervision by an attendant. 6 2. LIMITATIONS, VARIATIONS AND AMENDMENTS 2.1 Limitations Nothing in the licence or conditions attached thereto is in any way intended or deemed to absolve the licencee or any other person or persons from liability to observe, comply with or carry out any requirement or provision of any law or bye-law or other legal requirement for the time being in force. 2.2 Variations and Amendments Any special condition, exemption or variation applicable to any specific case shall be read together with, and taken as, part of these conditions, unless otherwise specified. Any general or special condition may be amended or varied at the discretion of the Authority, giving where practicable due notice to the licencee. 3. GENERAL CONDITIONS 3.1 The licencee shall comply with the requirements of the Petroleum for the Inland Fuel Market Regulations (Legal Notice xxx of 2006), and other applicable legislation/regulations in force at the time. 3.2 The licence authorises the licencee to store and retail petroleum products and, or biofuels, conforming to national legislation excluding Autogas, unless a special provision for doing so is granted by the Authority. 3.3 The granting of the licence may be subject to additional special conditions attached to the licence. 3.4 The licencee and all persons employed on the licenced premises shall act in accordance with, and observe the conditions attached to the licence. 3.5 The licence, including the granting form duly issued by the Authority and any special licence conditions issued, shall be produced to an inspector upon demand. 3.6 The quantity of petroleum and, or biofuels kept at any one time on the licenced premises, excluding petroleum and, or biofuel in the tanks of motor vehicles used for their own propulsion and stationary plant (e.g. fire engines, generators etc.) shall not exceed the amount specified in the special conditions of the licence. 7 3.7 During periods when the licenced premises is open for business as an attendant operated or as an attendant self-service, the licenced premises and all operations occurring at the licenced premises shall be under the responsibility of a registered site operator who shall not be under the age of 18 years. Other employees of the petroleum filling station shall be under the supervision of the site operator. 3.8 The licencee shall take all reasonably practicable, necessary steps to prevent persons under the age of 16 from having access to petroleum and, or biofuel on the licenced premises or any equipment associated with the dispensing of vehicle fuel. 3.9 The licencee shall communicate to the Authority the names and particulars of the site operator/s responsible at the licenced premises when an application for the granting and, or renewal of a licence is submitted to the Authority. The licencee shall also be responsible to promptly inform the Authority whenever there is a change in site operator/s employed The licencee is responsible that the station is at all times retailing products of the right quality, conforming to all regulations that may be in force at the time, an that sufficient records are kept to ensure traceability of consignments. Such records are to be made available for inspection as and when required Operations associated with this licence must comply with the guidelines issued by the Authority. The Authority reserves the right to amend, vary, add or remove conditions (including general and special) attached to this licence in terms of article 22 of the Petroleum for the Inland fuel Market Regulations (Legal Notice XXX of 2006). The licencee undertakes to accept directions in the form of letters intended to explain or amplify the conditions attached to this licence or otherwise improve the general conduct of activities regulated by this licence 3.12 The licencee shall accept at all reasonable times inspections carried out by officers of the Authority or persons on its behalf for the purposes of ascertaining the condition of the licenced premises, its equipment and operational standards The licencee shall take all reasonably practical steps to protect the environment in the course of operations associated with this licence, including but not only, those specified in environmental legislation currently in force and not specifically related to petroleum-filling stations. 8 3.14 The licencee must provide assistance and facilitate the work of the various Authorities instituted by law, in so far as, and in the carrying out of their duties in accordance with their legislative remit and relevance to the licence concerned. Dispensing of Petroleum 3.15 Except as otherwise instructed by the Authority, petroleum and, or biofuel shall only be dispensed into the fuel tanks of a motor vehicle or into a suitable container, which has been designed and constructed for the holding of petroleum and, or biofuel. Any container used for this purpose shall immediately be securely closed and removed from the licenced premises or kept in a safe place. Safety at the licenced premises 3.16 It is the responsibility of the site operator employed at the licenced premises to secure that all practicable steps necessary to prevent fires, explosions, leaks or suspected leaks and spills at the licenced premises are taken In this regard the site operator shall take all practicable steps necessary to prevent: a) accident by fire or explosion; b) the escape of petroleum and, or biofuel; c) any petroleum and, or biofuel entering any drain, sewer or waterway; d) any naked light, fire, flame or any other source liable to ignite flammable vapour occurring or present within a hazardous area; e) smoking taking place in any hazardous area where petroleum and, or biofuel is kept, handled or exposed; f) the operation of radio transmitting equipment, including Citizens Band radios and mobile telephones in the hazardous area; and g) the dispensing of petroleum and, or biofuel unless the safe operation of the licenced premises can be ensured No electric light, electrical apparatus or appliance likely to ignite surrounding flammable vapour shall be used in any hazardous area where petroleum is kept, handled or exposed Save as otherwise approved by the Authority, no substance of a flammable, corrosive or explosive nature shall be kept at a distance less than 4m near a place where petroleum products and, or biofuel are kept, handled or exposed. 9 incompatible with the need to avoid fires and explosions from petroleum and, or biofuel e.g. explosive substances shall not be offered for sale at licenced premises Reasonable and efficient fire-fighting equipment together with means for summoning the Fire Brigade as the Authority may approve or require, shall be provided at all times by the licencee. All such equipment shall be situated in a position approved by the Authority and shall be at all times, when the premises are open for business, both accessible and unobstructed. The equipment shall be maintained in good condition and be capable of efficient operation at all times and in all weather conditions Appropriate steps shall be taken to prevent leaks and spills and to detect the sources of any leaks, including leaks indicated as a result of monitoring petroleum and, or biofuel stocks or excessive petroleum and, or biofuel odours at or in the vicinity of the licenced premises. Any leaks or spills shall be prevented from escaping from the licenced premises. Small leaks or spills shall be cleared up promptly by the application of dry sand or other absorbent material. All sand or other material used for clearing or containing leaks or spills shall not be exposed to a source of ignition and shall be disposed of as approved by the authority responsible for the environment. Petroleum products soaked sand or other absorbent material is considered to be a hazardous waste and must be handled as such The licencee shall immediately take all practicable steps necessary to remedy any defect or condition likely to cause accident, fire, explosion or leak and to investigate and report to the Department of Civil Protection any suspected leak, and thereafter within seven (7) days from noticing the condition, he shall at his own expense commission a competent person to do such tests and works of demolition, alteration, extraction, retrieval or construction as may be required by the Authority Adequate and unobstructed means of escape from all parts of the licenced premises shall be provided and maintained to the satisfaction of the Department of Civil Protection. The parking of vehicles shall not be permitted in such a manner as to impede the safety of the licenced premises. Waste Disposal 3.24 All effluents from tank cleaning have to be disposed in a manner approved by the Authority in accordance with any scheme that may be in place at any time. Official Draft 04/06 9

10 3.25 All licencees are obliged to participate in any scheme approved by the Authority meant to collect waste or spent petroleum products other than those collected form their own tanks. Operating and Emergency Procedures 3.26 The licencee shall make available to persons working at the licenced premises, written procedures for normal operating and emergency procedures as approved by the Authority. Unattended licenced premises 3.27 Except where the licenced premises are authorised by the Authority for use as an Unattended Self Service Petroleum Filling Station, the licenced premises when left unattended, shall have all electrical power to the dispensing equipment switched off and the dispensers, all petroleum and, or biofuel storage tanks and associated equipment adequately secured to prevent unauthorised access. Notification Requirements 3.28 The licencee shall immediately notify the Authority and confirm in writing the details of any fire, explosion, significant spillage of vehicle fuel on the licenced premises, any actual or suspected leak or loss of vehicle fuel on the licenced premises, any actual or suspected leak or loss of vehicle fuel from the storage tanks and pipework installation on the licenced premises, or other significant incident. Inspection, testing and certification 3.29 When applying for the granting of a licence to operate a petroleum filling station, the applicant must commission an electrical engineer, which engineer should be a warranted; engineer as defined in the Engineering Profession Act or having the equivalent professional qualification as provided under the Mutual Recognition of Qualifications Act, and also previously approved by the Authority, to inspect, test and certify that all electrical equipment and parts of the electrical installation on the licenced premises relevant to the delivery, storage and dispensing of petroleum and, or biofuel and to those areas of the licenced premises where an explosive atmosphere may occur, comply with existing legislative requirements. Thereafter, every 2 years from the day of the granting of the licence, the licenced premises must be inspected and certified by a competent person When applying for the granting of a licence to operate a petroleum filling station, the Official Draft 04/06 10

11 applicant must commission a competent person, to inspect, test and certify that the storage facility complies with existing legislative requirements and approved codes of practice. Thereafter, every 3 years from the day of the granting of the licence, the licenced premises must be inspected and certified by a competent person Inspection, testing and certification must comply with the guidelines issued by the Authority. Maintenance & Records 3.32 The licenced premises shall be maintained in such a condition that all approved arrangements, including all relevant safety-related features remain in place and function effectively The licencee shall maintain, in a form acceptable to the Authority and to be produced to an inspector upon being requested, a record documenting the details of all maintenance, repair, staff training and audit inspections relevant to the prevention of fire and explosion, on the licenced premises 3.34 The licencee shall undertake and record, in a manner and to a level of accuracy acceptable to the Authority, the monitoring and reconciliation of all stocks of petroleum and, or biofuel, the escape of which could affect the safe storage and dispensing of petroleum and, or biofuel, delivered to, stored in and dispensed from the licenced premises. Daily records of the Litres Totaliser and Money Totaliser of each dispensing outlet must be accurately kept. These records shall be retained for at least 2 years and shall be made available for examination by an inspector on demand. The licencee shall notify the Authority forthwith of any apparent losses or gains of petroleum identified, which are outside normal operational patterns The licencee shall maintain a customer complaint register and proceedings, in a form approved by the Authority, which shall be made available for examination by an inspector on demand The licencee shall maintain and produce to an inspector on demand, documentary evidence that all electrical equipment and parts of the electrical installation on the licenced premises relevant to: the delivery, storage and dispensing of petroleum and, or biofuel; and to those areas of the licenced premises where an explosive atmosphere may occur have been tested as described in section Official Draft 04/06 11

12 Autogas 3.37 The licencee may apply with the Authority for his special licence conditions to be widened so as to permit him to keep and retail Autogas provided that the necessary safety requirements are met Permission and subsequent approved arrangements for the keeping and retail of Autogas will be subject to guidelines and conditions issued by the Authority and any other relevant authorities. Biofuels 3.39 Retail of biofuel is permitted provided that: (i) in the case of a percentage of biofuel above 5% by volume, the percentage of biofuel contained in the product is clearly indicated on the pump or dispenser, provided that this is not required for blends up to 5% by volume; (ii) in the case of Biodiesel or other fatty acid methyl esters it shall comply with the latest issue of MSA EN standard; (iii) in the case of a percentage of biofuel above 5% by volume, there must be clear indication that the customer should enquire with his car s official representative agent to check whether his car is biofuel-compliant to a percentage of more than 5% by volume; and (iv) in the case of a percentage of biofuel above 5% by volume, the fuel must be contained in a separate tank and dispensed through a separate pump. Road Tanker Deliveries 3.40 At any filling station with a vapour balancing system, care shall be taken to prevent release of petrol vapour at ground level. When connecting hoses prior to delivery of petrol, the vapour hose shall be connected before the delivery hose. On completion of the delivery operation, the vapour hose shall not be disconnected until the delivery hose has been discharged and disconnected. At such sites, the dipping of a road tanker compartment is not permitted whilst the transfer of petrol is actually taking place from any compartment of the road tanker, unless approved by the Authority Simultaneous road tanker deliveries of petrol and LPG to any petroleum filling station shall not be made. Notices 3.42 The licencee shall keep displayed a notice setting out the conditions of the petroleum Official Draft 04/06 12

13 filling station licence to be observed by persons employed at the licenced premises. The notice shall be installed where it is readily accessible and easily readable by all employees likely to be at the licenced premises at any time. Franchising 3.43 The licence holder, exclusively supplied by a licenced source, shall have the trademark of the aforesaid licenced source fixed/suspended at a conspicuous site in his licenced premises. Otherwise the licence holder shall fix/suspend a sign reading Independent Petrol Station. Such signs must be visible upon entry of vehicle into the Petroleum Filling Station: Provided that in the case of an Independent Petrol Station, petroleum supplies from different suppliers must be kept in distinct tanks. In such cases petroleum and, or biofuels from the different licenced persons must be unloaded in an empty tank. Otherwise the licencee can opt to store petroleum and, or biofuels from different licenced sources in the same tank provided that the licencee keeps a sealed sample of at least two litres of the last five consignments unloaded in the tank. Opening Hours and mode of operation 3.44 The licencee may operate in any of the following mode of operations, without regard to the time of day and/or week, and regardless of any other thing said in any other law to the contrary: Attendant Operated; or Attended Self-Service; or Unattended Self-Service When applying for a licence, the licencee must notify the Authority the hours in which he will be open for business and submit a weekly schedule on how he is going to operate The hours when the licenced premises are operating as an attendant operated or as an attendant self-service must be clearly indicated at a conspicuous site in the licenced premises. Pricing 3.47 Prices showing the cost of the petroleum products and, or biofuel shall be displayed Official Draft 04/06 13

14 at all entries to the licenced premises and on each and every pump as indicated in the Consumers Affairs Act (Pricing Indications Regulations 2002). Signs at station entries are to be clearly legible to motorists driving on the adjacent road The licencee must ensure that when the petroleum filling station is operating as an Unattended Self-Service the automated equipment dispensing petroleum and, or biofuels is supplying a valid invoice showing the transaction number. Insurance 3.49 The licencee shall insure and keep insured throughout the duration of the licence the licenced premises in their full value against loss or damage including malicious damage resulting from fire and/or explosion, including fire and/or explosion that may be attributed to negligence, and damage to third parties or third party property surrounding the petroleum filling station boundary. Performance Bond & Guarantee 3.50 When applying for the granting of a licence, the applicant must submit a bond in the form of a bank guarantee to cover his application form. This guarantee has to be payable on demand in favour of the Malta Resources Authority (the Authority), and in a form defined by it, for an amount of Malta Liri (Lm ). The bond is intended to ensure an applicant s commitment towards the application process. In the case of unsuccessful applicants, the bond will be released at the end of the application process whilst in the case of a successful applicant, the bond will be maintained as a performance guarantee No application for the granting of a licence to operate a petroleum filling station shall be processed unless accompanied by a valid bond The bond must be in conformance with the conditions as laid out in Section 6 of the document If, at any stage of the application process, the applicant withdraws the application, for a reason considered by the Authority as being in the circumstances insufficiently justified or unreasonable, a penalty of Lm. will be retained from the bond The performance guarantee will, from the day of the granting of the licence and thereafter, be intended to guarantee that the licencee should honour the licence Official Draft 04/06 14

15 conditions listed in the grant of rights of use document The performance guarantee will have to be issued in a manner as to be valid for the duration of the licence and any renewals thereof The bond and subsequently the guarantee shall be issued by a bank, investment bank, financial institution, or insurance company, which neither controls, nor is effectively controlled by, the applicant, nor is controlled by a person who controls the applicant, and which is registered in the European Economic Area and has a minimum long-term debt A rating from Standard & Poors or A from Moody s Investors Service Limited. Transfer of Licence 3.57 Licences shall be transferable: Provided that whenever a licencee desires to transfer his licence he shall follow the procedure prescribed in Article 24 of the Petroleum for the Inland fuel Market Regulations, (Legal Notice XXX of 2006) The Authority shall treat an application for the transfer of a licence as a new application in terms of Schedule 1 of the Petroleum for the Inland fuel Market Regulations (Legal Notice XXX of 2006) Official Draft 04/06 15
