1 Date: June 30, 2016 To: From: County Executive Office, Campaign Finance Staff Ventura County Clerk Subject: Report # of Apparent Violation of the Ventura County Campaign Finance Reform Ordinance (No. 4471) In accordance with Section 1304(e) of the Ventura County Campaign Finance Reform Ordinance (No. 4471), the Ventura County Clerk is hereby reporting to the County Executive Office an apparent violation of Section 1286(a), (c) and (d) of Ordinance #4471, by the Kelly Long for Supervisor 2016 Committee. Section 1286(a) states: On the same dates and in the same manner as required by the Political Reform Act, Article 2 of Chapter 4 of Title 9 of the Government Code (Section et seq.), County candidates or the controlled committee of such candidates shall disclose each contribution that individually or cumulatively totals 50 or more per contributor. Section 1286(c) states: Contributions of goods and services shall be reported at the fair market value of the contribution and covered by the contribution limits of this ordinance. Section 1286(d) states: Contributions received between the final filing period prior to an election and the election day, in excess of two hundred fifty dollars (250), must be reported to the Clerk within twenty-four (24) hours of receipt of the contribution but shall not be deposited until the committee has the name, address, occupation and employer of the contributor. The YouTube video is also not reported as an expenditure of 100 or more on Schedules E or F of the above California Forms 460. The attached PDF of California Form 497, filed May 25, 2016, is the only Form 497 filed by the Kelly Long for Supervisor 2016 Committee between May 22, 2016 and June 7, 2016, and does not report the YouTube video as a contribution in excess of 250. The Ventura County Clerk has determined that the May 31, 2016 YouTube video entitled Kelly Long for Supervisor, District 3 Ventura County is not disclosed on the California Forms 460 filed by the Kelly Long for Supervisor 2016 Committee, either as an expenditure of 100 or more, or as a contribution of goods and services at fair market value in the amount of 50 or more. The Ventura County Clerk has further determined that the YouTube video entitled Kelly Long for Supervisor, District 3 Ventura County, listed as being published on May 31, 2016, was not reported, as a contribution in excess of 250 received between the final filing period prior to an election (May 22, 2016) and the election day (June 7, 2016), to the Clerk within 24 hours of receipt of the contribution. The date of the receipt of

3 contribution appears on its face to be May 31, 2016, which is the date the video indicates it was published. As such, the nondisclosure of this YouTube video appears on its face, based on the title, content and credits listed in the video, to be a violation of Section 1286(a), (c) and (d) of the Ordinance. It should be noted that, if the Kelly Long for Supervisor 2016 Committee paid for the YouTube video after May 21, 2016, that expenditure would not be reportable until the next California Form 460 report which is due on August 1, Similarly, if an in-kind contribution for this YouTube video valued at less than 250 were made to the Kelly Long for Supervisor 2016 Committee after May 21, 2016, that in-kind contribution would not be reportable until the next California Form 460 report which is due on August 1, Notwithstanding those two possibilities, the Ventura County Clerk is reporting these apparent violations of the Ordinance to the County Executive Office at this time to promote the timely release of the campaign finance information related to these apparent violations that has been reported to date.
