1 Alberta Regulation 176/2004 Alberta Housing Act MANAGEMENT BODY OPERATION AND ADMINISTRATION AMENDMENT REGULATION Filed: August 18, 2004 Made by the Minister of Seniors (M.O. H:024/2004) on August 5, 2004 pursuant to section 34 of the Alberta Housing Act. 1 The Management Body Operation and Administration Regulation (AR 243/94) is amended (a) by striking out or and substituting on in every place where or was substituted for on pursuant to section 20 of the Miscellaneous Correction Regulation (AR 108/2004); (b) in section 1(3) by striking out management body on and substituting management body or Alberta Regulation 177/2004 Wildlife Act WILDLIFE AMENDMENT REGULATION Filed: August 19, 2004 Made by the Minister of Sustainable Resource Development (M.O. 33/2004) on July 26, 2004 pursuant to sections 12, 23 and 103 of the Wildlife Act. 1 The Wildlife Regulation (AR 143/97) is amended by this Regulation. 2 Section 3(xx) is amended by striking out passes in front and substituting extends beyond the anterior edge. 3 Section 29(1.1) is amended by striking out and at the end of clause (b) and adding the following after clause (b): (b.1) falls within a category of persons established in writing by the Minister as eligible to be designated to hold a partner special licence,

2 AR 177/2004 WILDLIFE (b.2) has not, during the course of the fiscal year in which that licence is obtained or held, both applied for and been approved to obtain a special licence that has the same item number in Part 1 of Schedule 8 as the principal special licence with which the partner special licence would be or is associated, and 4 Section 30(17) is amended (a) by adding 250, after 228, ; (b) by striking out and 542 and substituting, 542 and Section 31 is amended (a) in subsection (3) by repealing clause (g) and substituting the following: (g) more than one recreational licence authorizing the hunting of antelope, (g.1) if that resident is a youth, a partner special licence authorizing the hunting of (i) antlered mule deer if the youth also holds a resident youth mule deer licence, or (ii) antlered white-tailed deer if the youth also holds a resident youth white-tailed deer licence, (b) by adding the following after subsection (15): (16) A person is not to be treated as contravening section 15 of the Act merely by the fact of applying for 2 or more licences referred to in subsection (3)(g), notwithstanding the ineligibility to hold more than one such licence. 6 Section 99 is amended by adding the following after subsection (2): (2.05) An individual may hunt wildlife other than game birds in a game bird sanctuary if that individual is authorized by this Regulation to hunt wildlife of that kind generally in a wildlife management unit in which that game bird sanctuary is located. 7 Section 120(2) is amended by striking out to 527, 535, 537 and substituting, 522, 525, Section 130 is amended (a) in subsection (2) by striking out a grizzly bear, ; (b) in clause (b) repealing subclause (i); (c) by adding the following after subsection (4):

3 AR 177/2004 WILDLIFE (4.1) A person who has killed a grizzly bear shall personally (a) submit a report to the Service, and (b) deliver the skull and skin to an appointed officer, not later than the end of the 4th business day of the Service after the day on which the animal was killed. 9 Part 6 of Schedule 10 is amended (a) in Item 35 by striking out the land description in the last column and substituting that portion of WMU 438 lying north of the Drinnan Creek, Gregg River drainage. ; (b) in Item 36 by striking out the land description in the last column and substituting those portions of WMU 438 that are shown outlined in red on a plan of survey on file in the Department at Edmonton as (i) No M.S. Item E plus legal subdivisions 3 and 6 of section 23, township 47, range 24, west of the fifth meridian and known as the Cardinal River Coal Lease Area, and (ii) No M.S. Item B and known as the Gregg River Resources Ltd. 15 year Coal Lease Area. ; (c) by adding the following after Item 36: 36.1 Non-trophy Sheep that portion of WMU 438 Hunting Area 438C: lying south of the Drinnan Creek, Gregg River drainage and north of the north boundary of the Whitehorse Wildland Park, excluding Non-trophy Sheep Hunting Area 438B Non-trophy Sheep that portion of WMU 438 Hunting Area 438D: lying south of the north boundary of the Whitehorse Wildland Park. 10 Schedule 15 is amended (a) by repealing section 5(h) and substituting the following: (h) to hunting on a Sunday, except in WMUs 357, 358, 359, 360, 521, 522, 523, 526, 527, 535 and 537 and in the Green Area portions of WMUs 326, 328, 347, 349, 350, 351, 352, 353, 354, 355, 356, 416, 417, 418, 420, 422, 426, 428, 429, 430, 432, 434, 436, 437, 440, 441, 442, 444, 445, 446, 503, 511, 512, 514, 515, 516, 517, 518, 519, 520, 524, 525, 528, 529, 530, 531, 532, 534, 536, 539, 540, 542, 544 and 841, (b) in section 5(m)

35 AR 182/2004 MARKETING OF AGRICULTURAL PRODUCTS (d) by adding the following after clause (j): (j.1) processor means a person who is in the business of buying bison and bison products for the purpose of slaughtering or otherwise processing bison; 4 Section 3 is renumbered as section 3(1) and the following is added after subsection (1): (2) On and after September 1, 2004, the name of the plan established under subsection (1) is changed to the Bison Producers of Alberta Plan. 5 Section 5 is amended (a) in subsection (1)(b) by adding or market after produce ; (b) by adding the following after subsection (1): (1.1) Section 9(a), (b) and (f) apply additionally to all dealers and processors in Alberta. (c) by adding the following after subsection (2): (2.1) If a person is a producer and is also a dealer or processor, this Plan applies to that person (a) as a producer, and (b) as a dealer or processor, as the case may be. 6 Section 7 is renumbered as section 7(1) and the following is added after subsection (1): (2) On and after September 1, 2004, the name of the commission established under subsection (1) is changed to the Bison Producers of Alberta. 7 Section 9 is amended by adding the following after clause (d): (e) requiring producers engaged in the marketing of the regulated product to register their names and addresses with the Commission;

36 AR 182/2004 MARKETING OF AGRICULTURAL PRODUCTS (f) requiring any person who receives the regulated product from a producer (i) to deduct from the money payable to the producer any service charges payable by the producer to the Commission, and (ii) to forward the amount deducted to the Commission. 8 Section 10 is repealed and the following is substituted: Financing of plan 10 In accordance with the regulations, (a) this Plan is to be financed by the service charges and any other money payable to or received by the Commission; (b) every producer engaged in the production or marketing of the regulated product must pay a service charge per animal of the regulated product sold by the producer; (c) the amount of the service charge is to be initially established by the Commission in an amount that is approved by the Council; (d) the Commission may, from time to time, change the amount of the service charge, but the change is not effective until it has been approved by the eligible producers at an annual Commission meeting or a special Commission meeting. 9 Section 11 is repealed and the following is substituted: Payment of service charge 11(1) In accordance with the regulations, all persons or dealers who (a) purchase regulated product from a producer, or (b) acquire regulated product from a producer for sale on the producer s behalf must deduct from any proceeds payable to or on behalf of the producer the amount of the service charge. (2) Any person who receives proceeds on behalf of the producer in respect of the sale by the producer of the regulated product

37 AR 182/2004 MARKETING OF AGRICULTURAL PRODUCTS must deduct from the proceeds payable to or on behalf of the producer the amount of the service charge. (3) Any person who collects a service charge must pay the amount of the service charge to the Commission. (4) All persons required under this Plan to collect and pay to the Commission the service charge payable by a producer must (a) pay the service charge to the Commission, and (b) provide to the Commission for each producer a summary detailing (i) the number of animals obtained from the producer, (ii) the amount of service charge being paid on behalf of the producer, and (iii) the name and address of the producer. 10 Section 12 is amended (a) in subsection (1) (i) by repealing clause (a) and substituting the following: (a) the service charge must be refundable to a producer on the request of the producer; (ii) in clause (b) by repealing subclause (ii)(e); (iii) by repealing clause (c) and substituting the following: (c) requests for refunds must be received by the Commission at its official office prior to the end of the 25th day of the 2nd month following the month in which the service charge was collected; (b) by adding the following after subsection (2): (2.1) Despite subsection (2), no plebiscite may be held pursuant to subsection (2) with respect to the year 2004 or Section 17 is amended

38 AR 182/2004 MARKETING OF AGRICULTURAL PRODUCTS (a) in clause (a) by adding annual region meetings, after attend ; (b) by repealing clause (d) and substituting the following: (d) to vote in any election for directors of the region at any meeting of eligible producers at which an election is held for the region in which the eligible producer carries on production of the regulated product; 12 The heading following section 19 is repealed and the following is substituted: Division 2 General and Region Meetings of Eligible Producers 13 The following is added after section 21: Annual region meeting 21.1 The annual region meeting in each region (a) must be organized and financed by the Commission, and (b) must be held not more than 120 days and not less than 10 days prior to the commencement of the annual Commission meeting. 14 Section 22 is amended (a) in subsection (1) by adding annual region meeting, after date of any ; (b) in subsection (2) by adding the following after clause (b): (c) in the case of an annual region meeting, notify the eligible producers of the region of the annual region meeting at least 21 days before that meeting is to be held. 15 Section 23 is repealed and the following is substituted:

39 AR 182/2004 MARKETING OF AGRICULTURAL PRODUCTS Quorum 23 The quorum necessary for the conduct of business is, (a) at an annual Commission meeting or special Commission meeting, 20 eligible producers, or (b) at an annual region meeting, 5 eligible producers from the region. 16 Section 24 is renumbered as section 24(1) and the following is added after subsection (1): (2) Of the 9 directors referred to in subsection (1), 3 must be elected from each region. 17 The following is added after section 24: Regions 24.1(1) For the purposes of this Plan, Alberta is divided into 3 regions. (2) The area included in each region is as set out in the Schedule. 18 Section 26 is amended (a) in subsection (1) by adding and must carry on production in the region for which the person wishes to be elected after producer ; (b) in subsection (2) by adding to before serve ; (c) by adding the following after subsection (2): (2.1) Where an eligible producer fills a vacancy under section 30 or 39, the filling of the vacancy is not to be considered to be one of the permitted terms of office under subsection (2) if that person serves an unexpired term of 18 months or less. 19 Section 31 is amended (a) in subsection (1) by striking out Commission meeting and substituting region meetings ; (b) by repealing subsection (4) and substituting the following:

40 AR 182/2004 MARKETING OF AGRICULTURAL PRODUCTS (4) Nominations for the position of director must be, (a) where made prior to the annual region meeting, (i) filed at the Commission s official office in writing by a date fixed by the Commission, (ii) signed by at least 2 eligible producers, and (iii) accompanied by the written consent of the eligible producer nominated for the position of director, or (b) where made at the annual region meeting, (i) moved and seconded by 2 eligible producers who produce the regulated product in the region for which the election is to take place, and (ii) accompanied by written or verbal consent of the eligible producer nominated for the position of director. 20 Section 32 is repealed and the following is substituted: Mail ballot 32(1) If the eligible producers in a region fail to elect a director for that region, the election of a director for that region may be carried out at the next annual Commission meeting following the date on which the election of the director was to have occurred. (2) Where an election is to be held pursuant to subsection (1), nominations may be received (a) prior to the annual Commission meeting, or (b) from the floor at the annual Commission meeting. (3) The eligible producer nominated for the position of director of a region must carry on production of the regulated product in that region. (4) Notwithstanding any other provision of this Plan, all eligible producers in attendance at the annual Commission meeting are eligible to vote in the election of a director under this section. 21 Section 35(2) is repealed and the following is substituted:

41 AR 182/2004 MARKETING OF AGRICULTURAL PRODUCTS (2) An eligible producer is eligible to vote on any question put to a vote at an annual region meeting if the eligible producer (a) carries on production in the region, and (b) is present at the meeting at which the vote is held. (2.1) An eligible producer is eligible to vote in an election for a director (a) if the eligible producer carries on production in the region in respect of which an election is being held, and (b) in the case of an election that takes place at an annual Commission meeting under section 32, if the eligible producer is present at the meeting. 22 The following is added after section 35: Eligibility to vote in adjacent region 35.1(1) Where an eligible producer (a) does not carry on production in the region in which the producer wishes to vote for a director, but (b) carries on production in a region that is adjacent to the region in which the producer wishes to vote for a director, the producer may apply in writing to the Commission, not less than 10 days prior to the day of the election in which the producer desires to cast a ballot, to be registered for the purpose of voting in the adjacent region. (2) On receipt of the written approval of the Commission of an application under subsection (1), the eligible producer is eligible, subject to subsections (3) and (4), (a) to vote in the adjacent region in any election or other matter held subsequent to the approval being received by the producer, and (b) during the time that the producer is eligible to vote in the adjacent region, to nominate persons to hold office and to hold office as a director for the adjacent region in the same manner and under the same conditions as if that producer carried on production in the adjacent region
