Unitary patent and unified patent court, trade secret protection and personal data protection Special Interest Group on Intellectual Asset Management (SIG-IAM) June 2017, Berlin, Germany Hotel Berlin, Berlin Summary 2018 will show some major changes in EU law that will affect IP. First, the EU regulations 1257/2012 and 1260/2012, both concerning the unitary patent (UP), and the agreement on a unified patent court (UPC) will (most likely) enter into force in Dec 2017, including UK and with the sunrise period starting as early as September This will be a jumping start of a completely new unified European patent system that is an alternative to the classical European bundle patent and includes in particular a European patent court litigation system that is going live as of day one and that applies eventually for 26 EU member states. Second, in June 2017 the EU-Directive 2016/943 on the protection of trade secrets (undisclosed know-how and business information) entered into force whose content has to be implemented into national law of the EU member states by 9 June 2018 and that, for the first time, creates EU-wide legal standards on the protection of such trade secrets and its enforcement and that will cause major changes in the legislation and court practice of the EU member states. Third, in April 2016 the General Data Protection Regulation 2016/680 entered into force (together with EU-Directives 2016/679 & 2016/681) that aims for to give citizens back control over their personal data and to simplify and unify the regulatory environment for business within the EU and that enters into application on 25 May These three new laws within the EU will have a considerable impact onto the way how IP issues, trade secrets and personal data (e.g. of inventors) are handled by and within the companies and will force them to review their strategies, policies, guidelines and working procedures connected with IP. In 2017, the two SIG-IAM meetings will focus on these three late-breaking topics: in June, we will explore the situation in the EU, but we will also address the current practice of Patent Prosecution Highway (PPH). In November, we will focus on the US and other major economic areas outside Europe in order to understand the commonalities and differences and how to turn these findings into practice. This session will discuss the different possibilities available for accelerated examination in the PPH when seeking patent protection in multiple jurisdictions, whether claiming priority from an earlier national application or on entry to the national phase of the Patent Cooperation Treaty (PCT), including the advantages and disadvantages for the applicant. The session will also provide an update on recent developments in the PCT System. The Unified Patent Court is expected to open for business on 1 December 2017, which means that unitary effect can apply to patents that are granted as of that day. Starting the 1st of September, there will be a sunrise register to opt out non-unitary European patents of the jurisdiction of the UPC and probably also for filing applications for unitary effect. The names of the legal judges should also be available by then. It therefore has become very urgent to prepare for this new system going live. In this session you will be updated on the main characteristics of the new system, the latest developments, the steps you need to take to be prepared and the possible effects of the Brexit.
