3 SOMALILAND MINING REGULATIONS SECOND SCHEDULE: Royalty 1. Royalty on all minerals, other than building minerals, sepiolite and hydrocarbon, shall be payable at a rate of not less than 5 % of net value thereof. The purpose of this paragraph shall mean the gross value of the mineral or mineral product less such deduction at Minister my reasonably allow in respect of expenditure on transport, insurance, assaying, melting or refining, where these are born by the producer of such mineral or mineral product. 2. Royalty on hydrocarbon produced an saved from a lease area shall be payable quarterly within (30) thirty days of the end of the quarter in which production occurs as follows: a. On crude oil at a rate of not less than ten percent (10%) of the wellhead value, and b. On natural gas at a rate of not less than eight percent ( 8%)of the wellhead value i. (iii) the financial structure of the applicant and its parent company, if any including annual report together with audited balance sheets and profit and loss statements for the past three years, and any reports which the applicant or its parent company may have filed with Government agencies responsible for securities regulation during that period. (iv) how exploration and development activities would be financed if the application is successful and how performance would be guaranteed. And (v) the applicant s previous experience in exploration for, and development of, hydrocarbons. When an application is submitted by a group of two or more companies, the above information shall be submitted for each company in the group. The operating agreement shall be submitted. 5.
