1 BOARD OF TRUSTEES December 12, 2016 PRESENT: Mayor Monachino Lapey Trustee Annunziata Trustee McLaughlin Trustee Cataldi DeLillo Trustee Senerchia Attorney Cornachio Manager Pierpont PLEDGE OF ALLEGIANCE AND FIRE SAFETY ANNOUNCEMENT Mayor Monachino Lapey led those assembled in the Pledge of Allegiance and notified those in attendance where the fire exits were located. The Mayor said that Town Supervisor Peter DiPaola s sister passed away and he s in Florida. She said that this is a very hard time for his family and she thanked him for his diligence during this difficult time. The Mayor said that the Fire Department held its annual inspection and dinner and asked if Fire Commissioner McLaughlin would like to say a few words. Fire Commissioner McLaughlin said that it was a splendid evening all around. The Mayor also mentioned that Kate Douglass, a sophomore at Pelham High School, is a tremendous swimmer and a fighter like no other. She recently won a National Title at the U.S. Winter Junior Championships in Columbus, Ohio. Mayor Monachino Lapey also spoke about the rate increase in water bills and said that the increases are outside the norm. DPW Commissioner Cataldi DeLillo said that the escalation doesn t seem to be across the board, and it seems that this is not just happening in Pelham Manor. The increases are happening in Pelham and New Rochelle. She said that she is in contact with Amy Paulin s office and is trying to set up a meeting with that office and Suez. Trustee Annunziata said that it s the usage. He said that the usage at his house is forty two thousand gallons. That is up three fold. He said that he is not using that much and thought that it might be that the meters are being misread. DPW Commissioner Cataldi DeLillo said that it seems that it is systemic, but it is not across the board. Mia Homan, the contact from Amy Paulin s office for Suez water company, is away and this issue will be discussed when she returns. - MINUTES FROM THE REGULAR MEETING ON NOVEMBER 28, 2016 The Mayor asked if there were any comments, questions or corrections on the minutes. Trustee McLaughlin said that on page one in the third paragraph there is a typo which should be corrected to read as well as. RESOLVED, that the minutes from the Regular Meeting on November 28, 2016 be and hereby are approved as amended. -

2 REPORTS Police Commissioner Annunziata discussed the monthly Police report with Chief Carpenter. It was a relatively routine month. It was noted that two automobiles were stolen on the same night and both were left unlocked with the keys in the cars. One car has been found. It was double parked and it was left running. It was also noted that three hundred people have registered for Nixle alerts. The Mayor said that it was the holiday weekend, and people were jockeying cars around and may not have been paying as much attention as they normally would have. The Police Commissioner spoke about a disturbing incident involving a bullet that was fired and was caught in a screen. He asked the Chief if there was any way of tracking it and was told no. The Chief said that it could have traveled a half mile. The window broke. The glass stopped the bullet. It didn t go through the screen. The Mayor thanked the Chief for his Nixle alert on child luring attempts in Mount Kisco and the City of Rye. Trustee Senerchia said that the alerts generate awareness and are much appreciated. He spoke about good police work involving an unresponsive one year old child. The paramedic was on another call and the officers took the infant to the hospital and probably saved her life. He commended Sergeant Lewis and Police Officer Carcaterra. Trustee Cataldi DeLillo spoke about a dog that was not being controlled by its owner. If this is habitual, or a nuisance, the police can take action. Trustee McLaughlin said that it was the second time this dog was aggressive, but there was no documentation for the first incident at Shore Park. The action has to be habitual to take action. The Police Commissioner said that the owner agreed to muzzle the dog and pay all bills connected to the injury caused by its dog. The Mayor and Board thanked the Police Chief for his report. Fire Commissioner McLaughlin said that it was a routine month for the Fire department. Chief Ruggiero said that it was a busy month with a lot of runs. He said the department was at the Larchmont fire on Chatsworth Avenue. Businesses were on street level and apartments were above the businesses. It was a big fire and Pelham Manor was originally supposed to cover the fire house. On the way to the fire house, they were directed to help fight the fire. The building, including businesses and apartments, was totaled. The Village still had an engine in service in Pelham Manor, and the The Village of Pelham would have covered for Pelham Manor s ladder truck if needed. The Department also went to New Rochelle for a kitchen fire. The Mayor and Board thanked the Fire Chief for his report. The Treasurer said that expenditures and revenues are tracking well this year. On page twenty two of the report it shows that the second sales tax payment was received. This accounts for fifty point four percent of payments. The Village is working to improve its reserves for sewer and paving and to improve the unreserved balance as well. The goal is to work toward the State Comptroller s recommendation of having ten to fifteen percent fund balance. The Mayor and Board praised the Treasurer for his excellent work. The Village Clerk said that the building permits continue to run high. There were forty five building permits for the month. The DPW Superintendent said that the monthly report for October showed an increase in organic waste. He said that tomorrow the Village will start again on Pelhamdale Avenue, go under the bridge and up the other side of Pelhamdale toward Manor Ridge Road. It will be the eighth trip around the Village to collect leaves. The last day for unbagged leaf collection is December

3 Fifteenth. After that, the street sweeper will sweep the whole Village. RESOLVED, that the Police, Fire, Village Treasurer, Village Clerk and DPW reports be and hereby are approved. - INTRODUCTION OF LOCAL LAW 1 OF 2017 AMENDING THE USES PERMITTED BY SPECIAL PERMIT IN THE BUSINESS 2 ZONING DISTRICT This proposed Local Law that would allow an additional use in the Business 2 Zone. The Village has a vacant warehouse in the area and there is also some vacant land in the district. Currently school buses and new cars are stored in the area. The Village has been approached by a scaffolding company. Manager Pierpont said that he reviewed the aesthetics and said that the traffic impact is minimal. He said if the Board of Trustees is of a mind to amend the uses, it could be an interim opportunity for the Village to use the vacant warehouse. Mayor Monachino Lapey said that it was a clean use and would not disturb soil. She said the company is rather significant. They have scaffolded the Washington Monument and Saint Patrick s. One of the principals is a Pelham resident. Trustee Senerchia said that there is low impact on traffic, not a strain on the Village s services, and they are willing to screen the property. The trucks would be out early in the morning and back late at night especially if they re working in Manhattan. Everything would have to be put in and stacked properly. Trustee Cataldi DeLillo said that she thought it was a great use. She said that a lot of Village services go to this area and this use would not do that. She said that screening is important too RESOLUTION SCHEDULING A PUBLIC HEARING ON LOCAL LAW 1 OF 2017 RESOLVED, that a Public Hearing on Local Law 1 of 2017 be and hereby is scheduled for January 9, RESOLUTION AUTHORIZING THE VILLAGE MANAGER TO SIGN LETTER OF ENGAGEMENT WITH JACKSON LEWIS TO PROVIDE LEGAL SERVICES This letter of engagement is part of an Inter municipal Agreement with the City of New Rochelle, the Village of Bronxville, and the Village of Pelham Manor. The contract with Jackson Lewis is to have the firm work with the Public Service Commission to allow the municipalities to receive water usage data from Suez. The cost will be divided by the number of municipalities participating in this agreement. The water rates are escalating and the next rate cycle begins early next year. RESOLVED, that the Village Manager be and hereby is authorized to sign a Letter of Engagement with Jackson Lewis to provide legal services.

4 RESOLUTION IDENTIFYING THE POLLING PLACE AND THE HOURS THE POLLS WILL BE OPEN FOR THE VILLAGE ELECTION WHEREAS, the next General Village Election will be held on Tuesday, March 21, 2017, and WHEREAS, The Board of Trustees must designate by Resolution the polling place and state the hours the polls will be open, NOW THEREFORE BE IT RESOLVED, That The Board of Trustees designates the Fire Headquarters, 4 Penfield Place, Pelham Manor, New York as the polling place and that the polls will be open between the hours of 6:00 a.m. and 9:00 p.m. - - RESOLUTION AUTHORIZING THE MAYOR TO SIGN ABSTRACT OF VOUCHERS NUMBERS RESOLVED, That the Mayor be and hereby is authorized to sign Abstract of Vouchers Numbers PUBLIC COMMENT - The Mayor asked if there were any comments or questions from the public. Gianni Magnani, 435 Carol Place, said that the water rates have skyrocketed, the new leaf truck is good, but the clam shell bucket does not pick up as much debris as the vacuum truck, and he wished everyone a Happy Holiday Season and New Year. Manager Pierpont said that the street sweeper will be out after the leaf pick up is completed to remove some debris. Anthony Marrella, 103 Iden Avenue, spoke about the water rates. He said that Suez has to go to Albany to get its increases. He suggested that the Village needs more power upstate. Manager Pierpont said that the Village has participated in challenging rate increases, and that the Village has had moderate success in challenging the increases. He said that The Public Service Commission is supposed to protect the public interest. Maggie Klein, the PelhamPlus, asked if the Board was not anticipating any development for some time in the Canal Road area. The contracts would be for at least a year. The Mayor said that the Board is not foreclosing any other options. Trustee Annunziata said that there has been no interest shown by the property owners in the area. The Village was having meetings, but the property owners do not seem interested in having any more meetings. Trustee Cataldi DeLillo said that the Village Board is responsible for entertaining whatever is in front of us. We re considering whatever is real. We would entertain all options before us. Trustee Annunziata said that the Village had two major proposals and the owners could not get on the same page.

5 Mayor Monachino Lapey said that the Board is all for responsible development. Trustee Senerchia said that the Village is taking an asset and turning it into revenue. This proposal does not lock the Village into anything long term. The Mayor wished everyone Happy Holidays and a Happy New Year. EXECUTIVE SESSION RESOLVED, That the Board be and hereby is authorized to conduct an Executive Session to discuss the following: Personnel Matter No action was taken in Executive Session. RESUMPTION OF REGULAR MEETING SALARY ADJUSTMENT RESOLVED, That the following salary adjustments be and hereby are approved: Village Manager $ 165, Effective January 1, 2017 Village Clerk $ 32, Effective January 1, 2017 To be paid in equal weekly payments with an additional payment of $30, in the first pay period of January 2017 and a longevity payment of $30,050 in the first pay period of June 2017, and be it further RESOLVED, That the Village Manager s annual housing allowance of $7, be paid on June 1, ADJOURNMENT There being no further business to come before the Board, the meeting was adjourned. - - Clerk
