PART- I MANAGING COMMITTEE S REPORT: The MC takes pleasure in presenting the 48 TH ANNUAL REPORT on the working of the society together with statements of Income and Expenditure and Balance Sheet for the year ending 31 st March A copy of the statutory Auditor s report and the statement of the Fixed Deposits held by the society with various Banks are also annexed to this report. COMMITTEE MEETINGS: The MC met on 21 occasions. All the meetings were well attended. All decisions were taken unanimously after free and frank expression of opinions and views by the members of the committee. Besides the MC meetings, AGM of the society was held on 14th August Independence Day and Republic Day were celebrated as usual and members and children attended the same in large numbers, On Republic Day after flag hoisting ceremony, following members of the society were felicitated with a Shawl and Shrifal on their completing 75 years of age on or before 26 th Jan MEMBERSHIP: 1. 2 ACCOUNTS: A. The AGM held on appointed Mr. Shashikant Kadam (C-2/1) and Mr. Manoj Lotankar (A-1/2) as the internal Auditors of the society to carry out internal audit for the year under report i.e Ever sincere, they both are, meticulously carried out the internal audit of the society on regular basis and submitted their report well in time. We are thankful to them for their co-operation, guidance and suggestions which are duly taken note of. We expect and hope that they would continue their co-operation in future as well. The Internal Auditors very much appreciated the assistances rendered voluntarily by Shri. P.K.V. Nathan (B-5/2) in maintaining the accounts of the society, and specifically thanked him for the co-operation given by him at the time of audit. The Managing Committee also keeps on records its sincerest thanks to Shri. P.K.V. Nathan for the exemplary voluntary service he has been rendering to the society in preparing and maintaining accounts of the society. B. Statutory Auditors M/s Rajesh Patel and Co. completed the Audit for the year and we thank them for the timely audit. The audited statements of accounts and Auditors Report are attached with this report. Our Society has been classified by the Auditors as falling under A Class for the year Our Society has been maintaining Audit classification of A Class continuously for past several years. RECOVERY OF DUES: The recovery of dues from the members during the year is satisfactory due to persistent follow up by the Managing committee. The outstanding dues are Rs.75,443/- as on Of these, maintenance charges due for the month of March 2012 amounting to Rs. 69,832/- were received in the month of April The last year s outstanding dues were Rs. 93,973/- as on MAINTENANCE ACTIVITIES: a. The MC of the society is making all efforts to keep and maintain society buildings and surroundings clean and tidy. The cleanliness drive for clearing the surroundings of the buildings, SW drains, roads is taken up before the start of the monsoon and after monsoon every year. So also water tanks-underground tanks and overhead tanks are thoroughly cleaned twice every year. All water pumps are also well maintained. b. A new water meter was installed by replacing faulty old water meter and the society has incurred expenditure of Rs.29,300/- for installing this new meter. c. Temporary waterproofing treatment by applying waterproofing chemicals (Dr. Fixit) to the terraces and external walls of the buildings is given wherever necessary. The report of the treatment is satisfactory. During the financial year society had paid Rs. 4,83,000/- on temporary water proofing treatment to the buildings. However during current monsoon session till the date of this report, society has paid over Rs. 6,20,000/- (including cost of materials and labour charges) in view of the complaints received from the members is estimated that similar amount would be required amount would further be required for attending to these complaints. Year after year, conditions of the buildings are deteriorating and simultaneously the cost of materials & labour are also increasing. This being the case more and more amount will be required for such temporary measures till the new buildings are constructed. d. Debris lying in the society premises and garbage collected at some corners are removed periodically to keep the society clean and tidy. However in the course of Redevelopment of the society some inconvenience is being caused to the members and they would certainly bear with us for such inconvenience. The construction area is being maintained by the Developers. They are also keeping all storm water drains falling under construction area well maintained. LEAVE AND LISCENSE CASES: Despite requests & reminders the following members who have let-out their flats are not complying with the requirements called for to avoid complications at later stage for non compliance of such requirements. We once again request them through this report to comply with the requirements shown against their names 2

Shri Shankar Jadhav B-9/3 All requirements as per bye-laws & Govt. requirements MATTERS PENDING BEFORE LOCAL AUTHORITIES: The matter relating to the correction to be carried out in the revenue record in respect of C.T. S No.1084 [pt] is still pending at the Revenue Department, who has carried out the initial inquiry in this regards. The further course of action will be initiated by the office and they will submit their report to the collector MSD for further action. ISSUE OF SINKING FUND CERTIFICATES TO MEMBERS: Under the able guidance of Shri R S Sawant [M C Member] and with the active assistance given by Shri A D Adwani (A-5/4), we have been able to prepare and print sinking fund certificates covering the period upto 31 st March, 2012 for all members of the society. These certificates will be issued to the members in due course. JEEVAN NAGAR UTSAV MANDAL: Around last year Ganeshostav, we came to know that JNUM failed to convene the regular AGM by issuing notice and circulating statement of Income & Expenditure and Balance Sheet of the Mandal to the members of the society. The Managing Committee being the principal body responsible for activities in the colony thought it advisable to call the office bearers of JNUM to discuss their genuine difficulties and constraints if any, in not holding the AGM and circulating the accounts statement and also to find out the ways and means to regularise the functioning of JNUM. Accordingly office bearers of the society had a meeting with the office bearers of the JNUM on 18 th September 2011 in the society s office. The above issues were discussed at length. There upon the office bearers of the JNUM assured that they would call AGM of JNUM and issues would be sorted out within a time frame of one month. But there seems to be no action from JNUM to regularise the functioning of the Mandal. MILK SCHEME: The milk scheme officially became non functional with effect from 1/4/2009. However till date the milk committee has not been able to finalize the accounts of the milk scheme pending receipt of deposit amount and release of bank guarantee from Mothers Dairy Kurla. The office bearers of the society met the milk committee for several times. The last meeting took place on 19 th September 2011 when the Incharge of the Milk Scheme, Shri. C.A. Jadhav and committee members Shri. S.C. Gadre and Shri. M.S. Phanse were present. In this meeting Shri. C.A. Jadhav assured that he would definitely obtain release letter for the bank guarantee from the mother s dairy, Kurla within a week s time. The matter is still pending. NOTICE RECEIVED FROM INCOME TAX DEPARTMENT A notice Dt: 28/03/2012 U/sec 272 A (1)(C) of Income Tax Act 1961was received from Income Tax Officer [ HQ], Mumbai calling upon Vice Chairman, Shri. Shivalkar, Secretary Shri. Abhijit Sawant, and Treasurer Shri Padmanabhan to make them present in person with relevant documents on 10/04/2012 in their office. The above office bearers accordingly met the Income tax officer on the specified date and presented the officer with the relevant documents as asked for and clarified the position with regard to the development agreement. The secretary made it clear that the redevelopment is based on the area allocation to the members and no corpus fund is generated from the development. After scrutiny of the documents the income tax office 3

4 informed the Secretary that notice in this regards stands withdrawn. There has been no further reference from the I.T. department in this regards. :: REDEVELOPMENT OF THE SOCIETY:: 1. CONSTRUCTION WORK: During the year under report i.e.2011, 2012 we all have witnessed virtual stoppage of the construction work by the Developers. The reasons are varied and many. Certain obstacles and hurdles were created by a small group of our members who are opposing the Re-development of the society from inception. This group still continues to file complaints with various authorities and departments to halt the construction work. There was delay in obtaining permission of High Rise Committee due to the re-constitution of the said committee by the State Government. The Managing Committee followed up with the developers for expediting the construction work. M.C. had interactive meetings with the directors of MIPL. So also M.C. had arranged interactive meetings of the members with the developers on 9/08/2011 and 26/11/2011. The developers assured the members in these meetings that all the necessary steps would be taken by them to speed up the construction work on site but nothing concrete took place till date. Delay was also due to the amendment made by the State Government in the DC Regulation 1991, granting 35% Fungible Area to the existing members of the society or tenants of the buildings that have gone in for re-construction. This notification was issued by the government on 6 th Jan.2012, but without clarification in respect of utilization of 35% fungible area. Pending clarifications on several points the developers architects could not finalize their plans for giving effect to 35% fungible FSI to the existing members. Now after receipt of the clarifications from the authorities the developers and their architects have started resetting the plans to adjust fungible FSI. The Managing committee and our appointed architects Architectural Associates have since had three sessions with the developers on the issue of fungible area and its adjustment in the light of administrative instructions issued by the authorities in this regards. The Managing Committee is actively scrutinizing the proposals alterations and suggestions received from the developers with the assistance and help from our appointed architect. Report of the architect along with the recommendations of the managing committee will be circulated to the members for their consideration in due course. All the same, the members are rest assured that the final approval for any proposal will remain only with the Special General Body of the members that would be convened for the said purpose. 2. ON THE LEGAL FRONT: The cases/disputes filed by the disputants before the co-operative court no II, Mumbai and appellate co-operative court, Mumbai, as mentioned below are continue to be pending for final disposal by the respective Hon ble courts. 1. Original dispute being dispute no CC/II/347 of 2010 filed by Mr Sitaram Bhiva Mhatre and seven others verses Jeevan Nagar CHS. 2. The appeal dated 27/09/2010, against the order dated 21/06/2010 of Hon ble Co-operative Court rejecting the interim relief sought for by the disputants is pending in Co-op. appellate court, Mumbai. 3. The amendment application for amending original dispute CC/II/347 is pending before the Hon ble co-operative court II, Mumbai. 4. Eviction proceedings filed by the society against the 38 disputant members is also pending in Co-operative Court II, Mumbai. All the above cases are coming up before the respective of Hon ble courts practically every month but they are adjourned for some reasons or other. This group has also preferred an appeal against the Environment Clearance granted by the Environment department of Government of Maharashtra for our re-development project, before Hon ble National Green Tribunal, New Delhi. Mr. Satish Prabhu has also issued notices for criminal proceedings against all the members of the managing committee and several officers of state Government and officers of M.C.G.M. and all the Directors of MIPL u/sec. 19(b) of Environment Protection Act

5 Recently on he had filed an application with the Dy. Registrar of Co-Op. Societies, T ward, Mulund for appointment of Administrator for our Society. Discount on the advance payment of maintenance charges: A suggestion was received at the last 47th AGM from few members to consider giving some discount to the members who would be paying the maintenance charges in advance. The managing committee considered the suggestion and recommends granting discount at 4% per annum on the payments of maintenance charges received in advance for the period of six months and above. 2. Election of the Managing Committee: Five years Term of the present Managing committee will be over in February In keeping with the election rules appended to the Bye Laws, the Managing Committee proposes to conduct election in the month of January In order to conduct the election we will be required to appoint Returning Officer. Accordingly the resolution to the above effect is put up before this Annual General meeting for its approval. 3. Deposit for debris removal: We have been collecting a deposit of Rs. 1,000/- from the member to be utilized for clearing the debris in case he fails to remove the same immediately after carrying out the work. This amount of deposit is refunded to the consent member within 15 days from the date of self declaration of debris clearance given by the member. Unfortunately it is observed that some of these members do not collect the deposit and left the debris to be cleared by the society. Whereas some of the members carry out the repairs in their flat without paying the deposit amount. To avoid this situation/nuisance we propose to increase the deposit charges to Rs. 2,500/- and materials for repair works will be allowed on the site, only after receipt of the deposit amount.
