Govt allocates TZS 700bn for Stiegler s Gorge power project By TPJ Reporter Minister for Energy Dr. Medard Kalemani The Government has allocated TZS 700 billion in the /19 financial year for implementation of the 2,100- megawatt Rufiji Hydro Power Project, commonly known as Stiegler s Gorge project. This was revealed by the Minister for Energy Mr. Medard Kalemani in recently when tabling in Parliament his ministry s budget estimates. Dr. Kalemani said tender evaluation has been completed and that preliminary work was scheduled to start in July this year to be followed by the main project works which are expected to be concluded within 36 months. Implementation of this major project is an important catalyst to drive the country towards achieving its middle income target by 2025, said the minister. 6 6 Tanzania Journal Makala Matumizi ya Utaratibu Mpya wa Zabuni Unaoanisha Bajeti kwa Wazabuni na Changamoto Zake... bali, na kiwango cha faida kinachoridhisha kwa mkandarasi Labda, nieleze kufurahishwa kwangu kwa kuingizwa utaratibu huu wa National, International and restricted competitive tendering on fixed budget kwenye Kanuni za Manunuzi za Mwaka 2013 zikisomwa pamoja na marekebisho yake ya mwaka Mwaka 2014 niliandika mada ya Je, ni Kosa Kisheria Taasisi Kutangaza Bajeti iliyotengwa kwa ajili ya Ununuzi, iliyochapishwa katika Tanzania Journal Number 45, Toleo Namba VII la tarehe 14 Novemba 2014 (pata nakala yako kupitia Tovuti ya PPRA www. ppra.go.tz). Ninanukuu sehemu ya mada hiyo: Kwa maoni yangu kuwasilisha bei inayokaribianana bajeti iliyotengwa sio tatizo bali husaidiakuongeza ushindani hasa pale ambapo makadirio ya bajeti hiyo yamefanywa na wataalamu kwa umakini na kwa kuzingatia ukubwa wa zabuni,ubora wa bidhaa au huduma na bei ya soko. Aidha,kwa kuwa bajeti hiyo imewekwa wazi kwa wazabuni wote, kila mmoja atajaribu kuwasilisha zabuni yenye ushindani ili amshinde mwenzake.pia, ikumbukwe kuwa pamoja na bajeti kutowekwa wazi, wapo baadhi ya wazabuni ambao wamekuwawakizipata hizo bajeti kwa mlango wa nyuma kupitia watumishi wa taasisi nunuzi wasio waadilifu,kitendo ambacho ni kinyume na taratibu za ununuzi. Hivyo, bajeti zisipowekwa bayana hutoa mwanya wa vitendo vya rushwa na udanganyifu katika jitihada za kuitafuta hiyo bajeti. Aidha, usiri wa bajeti huweza kuchangia ushindani potofu kwani kuna wazabuni ambao watakuwa wanajua bajeti na hivyo kuleta bei zao zikiwa zinakaribiana na bajeti na wapo ambao wataleta bei zao kulinganana tathimini ya kile kinachotakiwa kufanyika bila kuwa na fununu yoyote kuhusu bajeti. Iwapo suala la uvujaji wa siri ya bajeti iliyotengwa halitajulikana,taasisi nunuzi itaona kwamba mzabuni ambaye anakaribia bajeti iliyotengwa anafaa na hivyokumuacha mzabuni ambaye amefanya tathimini sahihi kuhusu ukubwa, ubora wa kazi na bei halisi ya soko kwa kuwa zabuni yake iko nje ya bajeti ya taasisi. Hasara ya kuweka wazi bajeti kwa wazabuni inaweza kujitokeza pale ambapo makadirio yaliyofanywa na taasisi hayakufanywa kitaalamu na kwa kuzingatia ukubwa, ubora na bei halisi ya soko. Hali hiyo inaweza kufanya bajeti iliyotengwa na taasisi kuwa kubwa au ndogo. Bajeti iliyotengwa kama itakuwa kubwa kuliko hali halisi ya bei ya bidhaa au huduma kwenye soko, basi taasisi inaweza kupata hasara ya kumchagua mzabuni ambaye bei yake inaonekana kuwa inakaribiana na bajeti lakini ukilinganisha na hali ya bidhaa na huduma kwenye soko, bei yake ni ya juu. Pale ambapo bajeti iliyotengwa ni ndogo ukilinganisha na bei ya bidhaa au huduma kwenye soko, wapo wazabuni ambao bila kujali gharama zao halisi wataleta zabuni zenye bei zinazokaribia bajeti, na iwapo watapewa mkataba watashindwa kuleta vifaa au kutoa huduma zenye ubora unatotakiwa. Kwa hiyo, pale ambapo taasisi imefanya makosa katika makisio yake na hivyokufanya makisio hayo kuwa makubwa au madogo ukilinganisha na bei ya soko, kwa kutoainisha bajeti yake kwa wazabuni itapata faida ya kupata ushindani kulingana na bei ya soko. Apparently, MSD was suspicious that while the power of attorney submitted as per tender document requirements identified Mr. Christian Sonelo as the signatory, the appellant s statement of appeal had been signed by the same Mr. Christian Sonelo and that the attached brief facts and the grounds supporting the appeal had also been signed by Mr. Christian Sonelo who, had earlier been identified as finance director but later identified himself as the managing director of the appellant s firm. This, argued MSD, raised doubt as to what position the person held. The appellant, on his part, argued that the letter notifying him about cancellation of tender from the entity did not contain reasons which had led to the rejection of all tenders and that with such omission, it was impossible for the appellant to file a complaint on the grounds that were not known. Regarding incompetency of the appeal for want of grounds and remedies sought, the appellant submitted that the appeals rules provide that the proceedings before PPAA are to be conducted with as little formality and technicality as possible and that even the opening statement on stated clearly that If the space is not adequate attach as many additional pages as needed for the statement. He argued that it was undisputed that the attachment of additional pages with respect to the facts supporting the appeal as well as the reliefs was allowed. The appellant contended further that, the entity s act of referring to the statement of facts supporting the appeal indicated that he clearly admitted the presence of those grounds and reliefs sought, and that therefore, assertion that the appellant failed to comply with appeal rules was misleading and weak. Regarding the power of attorney, the appellant submitted that it was true that in the said tender process, tenderers were required to submit power of attorney and his company appointed Mr. Christian Sonelo to be the lawful attorney. Therefore, the issue of what position did Mr. Christian Sonelo hold in the company was irrelevant since the power of attorney was not issued to the title of a person in the office; instead, it was issued to an individual in his personal capacity. In determining the preliminary objection raised, PPAA observed that, the appellant was required to file his application for administrative review within seven working days but he did so three days after expiry of the stipulated time and that therefore, the appeal was indeed not properly before it, as it failed to comply with the review procedures provided for under the procurement law. The Appeals Authority also observed that it was clear that the grounds/reasons of appeal as well as reliefs sought were not written on the prescribed form but were instead on the additional pages which were attached to the said form and concluded that the grounds and remedies sought were indeed provided in the appellant s statement of appeal. On the issue of power of attorney, the Appeals Authority was of the view that, the office title of a person with power of attorney could be changed at any time without invalidating the legal powers granted to the person, unless it was stated otherwise. Therefore, the Appeals Authority ruled that indeed the appeal had been filed by a person who was legally authorized to represent the appellant. Consequently, the Appeals Authority upheld the objection that the appeal was not properly before it, rejected all others and dismissed the appeal without ordering costs.
