1 Guidelines for Application for Permission to Connect Computer Systems Used in Trading to TFEX Trading System Procedures 1. The member must submit the application made in the specified form, together with supporting documents as required, to TFEX. TFEX may request additional information or supporting documents from the member or specify additional conditions in granting permission as it deems appropriate. 2. The member may participate in the test at the time specified by TFEX by submitting the application no less than seven (7) days prior to the date of the test. 3. In case of a system test, the member must conduct the test in accordance with the details and schedules specified by TFEX. The member must pass the test or submit the test results (as the case may be) as required. 4. TFEX will notify the member of its decision approximately 10 days after the receipt of full and accurate information or documents as requested. 5. The member must confirm the commencement date of the system for which permission is sought with TFEX within seven (7) days from the date of notification of the decision as mentioned above. 6. In the event that the member fails to operate the system within three (3) months after receiving the results of the test, TFEX reserves the right to cancel such test results at its discretion. In addition, TFEX may designate other organizations, such as the SET, to be responsible for the tests and details of the foregoing procedures. The Computer System Used in Trading for Which Permission Must Be Sought The member is required to apply for permission to use an In-house Application and/or a software of an independent software vendor or service provider in accordance with the details below. 1. First Application for Permission 1.1 to connect the computer programs used in trading for use as Front Office Application Front Office Application with Back Office Function Internet Trading Application Internet Trading Application with Back Office Function Back Office Application 1.2 to connect the computer programs used in trading via the DMA system 1.3 to connect the computer programs for Program Trading. Changes and Amendments In the following cases, the conformance test must be passed prior to commencing use of the programs: provider; 2.1 change of system developer ( independent software vendor ) or service 2.2 change in the technology of the computer programs; 2.3 change in the functional specifications of the member s computer system, with respect to the member s trading activities connected to the Trading System. In the following cases, the member may submit the test results for examination: 2.4 change in the member s network architecture connected to the Trading System; 2.5 change of the server of the member s computer system connected to the Trading System. 3. TFEX may require an application for permission in other cases as it deems necessary and appropriate. Submission of Documents Supporting documents to be submitted together with the application are as follows: 1. MO-Member 1 Form, to be attached to the initial application and to every application for change; 2. DMA 1 Form, to be attached to the application with respect to a client who makes the connection through the DMA system; 3. MO-ISV 1 Form and the certificate of qualifications of the independent software vendor or service provider, to be submitted as additional documents where the member uses services of the independent software vendor or service provider. 6 The Company hereby certifies that the Company s computer system, which is connected with the trading system and/or the settlement system operates without disruption, in accordance with the requirements of TFEX and/or TCH, and does not cause any damage to the trading system and/or settlement system. Where this representation becomes inaccurate, and/or any damage is incurred to TFEX and/or TCH due to the connection with such computer system, the Company shall be responsible for all such damage incurred to TFEX and/or TCH. The Company certifies that all the information, data, and documents attached herewith are true and accurate in all respects. The Company shall deliver any information relating to trading or futures transactions of the Company and the customers, or other documents as may be required by TFEX. In this regard, the Company understands and shall comply with the law governing derivative contracts, regulations, procedures, circulars and orders of TFEX, including all other conditions prescribed by TFEX. 10 The Company agrees and consents to allow TFEX and/or affiliated companies of the SET (hereafter referred to as the Agency ), or the person designated by the Agency, to test the software of the Company to ensure that such software will meet the standards as required by the Agency. If the Company s software fails the test, the Company agrees to remedy and comply with the order of the Agency. If TFEX and/or the affiliated companies of the SET, find that certain information appearing in this document is inaccurate and/or incomplete, and if the Company s software test does not meet the required standards, TFEX and/or affiliated companies of the SET have the right to prohibit the members from using the service of the Company, and to withdraw the name of the Company from the list of independent software developers or service providers which passed the test, as notified to the members.
