IMFRP funds can only be used to purchase instructional materials the State Board of Education has certified as standards aligned, grades K-8, or materials that have been certified by the local board as aligned with State Content Standards, grades Currently, those restrictions have been suspended due to the fiscal constraints of the State. However, instructional materials will continue to be brought to the Board for certification and adoption. Gunn High School has proposed to use IMFRP funds to purchase the following mathematics book: Algebra 2, Common Core Edition Prentice Hall, 2011 In accordance with requirements of legislation, the Board of Education must certify that this book is aligned with the State Mathematics Content Standards. A careful review of this book by Math Department teachers and instructional supervisors indicates it satisfies this condition. The book is currently on display in the Educational Services Department. FISCAL IMPACT Cost of the purchase will be $9, from the State Instructional Materials Funding Realignment Program. RECOMMENDATION It is recommended the Board of Education certify and adopt these books. Attachment

11 BOARD OF EDUCATION Attachment: Discussion 3 PALO ALTO UNIFIED SCHOOL DISTRICT Date: TO: FROM: SUBJECT: Kevin Skelly, Superintendent Scott J. Bowers, Ed.D., Assistant Superintendent, Human Resources Memorandum of Understanding with Palo Alto Management Association BACKGROUND The Palo Alto Management Association (PAMA) is comprised of the school-site and district certificated administrators, classified managers and psychologists in PAUSD. As with all employee groups, we strive to maintain positive working relationships and effective communication. In that spirit, the District and Palo Alto Management Association have worked together to develop a Memorandum of Understanding (MOU) between the two parties. The Memorandum of Understanding covers the policies and procedures that guide the interactions between the management group and the District. Included in the MOU are statements about the rights, responsibilities, and principles of PAMA. The MOU also contains descriptions of the management work year, salary, benefits, leaves, assignment and selection, evaluation, and grievance procedures. The Board first approved the MOU on October 28, 2008, with an effective date through to June 30, The Board has approved subsequent annual MOUs with minor or no changes. The MOU for is presented with no changes from the MOU. RECOMMENDATION It is recommended the Board approve the Memorandum of Understanding between the District and the Palo Alto Management Association, effective July 1, 2011 through June 30, 2012.

12 BOARD OF EDUCATION Attachment: Discussion 4 PALO ALTO UNIFIED SCHOOL DISTRICT Date: TO: FROM: SUBJECT: Dr. Kevin Skelly, Superintendent Bob Golton, Co-CBO and Bond Program Manager Authorization to Bid a Six Modular Building Installation at Jordan Middle School STRATEGIC PLAN INITIATIVE Budget Trends and Infrastructure BACKGROUND In December 2010, construction documents were submitted to DSA (Division of the State Architect) for Jordan Middle School. Construction is expected to start late this fall. Some of the classrooms are needed for swing space. Also, additional classrooms are needed for site programs. Architects have an appointment to obtain DSA approval and bid documents are ready to be advertised. PROPOSAL It is proposed the Board of Education authorize staff to solicit bids for the installation of six modular classrooms at Jordan Middle School. FISCAL IMPACT The work for the modular installations at Jordan Middle School is funded by Strong Schools Bond funds appropriated for the Jordan Project. RECOMMENDATION Pending the results of discussion at this meeting, it will be recommended at the next meeting that the Board of Education authorize staff to solicit bids for the modular building installations at Jordan Middle School.

13 BOARD OF EDUCATION Attachment: Discussion 5 PALO ALTO UNIFIED SCHOOL DISTRICT Date: TO: FROM: SUBJECT: Dr. Kevin Skelly, Superintendent Bob Golton, Co-CBO and Bond Program Manager Establishment of Tax Rate for District Bonds for the Fiscal Year BACKGROUND The ballot proposition for the June 3, 2008, Strong Schools Bonds stated bond tax rates estimated not to exceed the current rate. The combined tax rate for the bonds during the fiscal year was $44.50 per $100,000 of assessed value ($44.50/$100K AV). The first series of bonds was issued in 2008, prior to the major financial downturn and this has affected the tax rate. However, through last year, the calculated tax rate each year was less than $44.50/$100K AV. In the last two years, the Board took action to authorize setting the combined bond tax rate for at exactly $44.50/$100K AV. The reason for this was that the District s investment advisor projected that the rate, due to the downturn in the economy, will rise beyond $44.50/$100K AV in future years. These actions created additional reserve amounts that could be applied to future year s payments. We want to continue this practice. We are therefore seeking authorization to continue to fund a reserve by setting the rate at $44.50/$100K AV, if the calculation shows a lower tax rate. PROPOSAL It is proposed the District request that, in the event that the SSCCT s calculated bond tax rate for is less than $44.50/$100K AV, the SSCCT set the rate for the bonds issued at $44.50/$100K AV for The additional dollars collected will be used to fund a reserve for future years. RECOMMENDATION Pending discussion at this meeting, it will be recommended at the next meeting that the District request that, in the event that the SSCCT s calculated bond tax rate for is less than $44.50/$100K AV, the SSCCT set the rate for the bonds issued at $44.50/$100K AV for The additional dollars collected will be used to fund a reserve for future years.

14 BOARD OF EDUCATION Attachment: Action 6 PALO ALTO UNIFIED SCHOOL DISTRICT Date: TO: FROM: SUBJECT: Dr. Kevin Skelly, Superintendent Bob Golton, Co-CBO and Bond Program Manager Termination of the Lease of the Garland Site to Stratford Schools, Inc., Effective June 30, 2014 STRATEGIC PLAN INITIATIVE Budget Trends and Infrastructure BACKGROUND The District currently has leased the Garland Site to Stratford Schools, Inc. with an end date of June 30, 2015.The lease provides that the District may terminate the lease upon 36 months advance written notice, subject to various timelines. In particular, a termination notice served by the District after December 31, 2010, but on or prior to June 30, 2011, will result in a termination date of June 30, On March 8, 2011, the Board of Education held a study session on elementary enrollment and facilities planning. There are the following key points regarding enrollment data: Enrollment has been rising for many years. Elementary enrollment growth for the five year period was at a compounded rate of 2.1%. Elementary enrollment growth in 2010 was 4.5%. Right now, our best estimate is the growth next Fall will again be about 4.5%. The District wishes to hold elementary class size at close to the current level. Therefore, additional elementary classrooms need to be put in service. At the meeting of March 8, 2011, the Superintendent suggested a target of 40 additional elementary classrooms. At current staffing levels, this would provide space for approximately 900 additional elementary students. The demographer, Lapkoff & Gobalet, has their highest forecast scenario of 577 elementary students over the next five years and a total of 1,299 elementary students over the next ten years. It makes sense to move toward providing for this level of enrollment, and the 40 additional classrooms will do that. At present, the construction program has 7 additional classrooms under construction or planned for construction as soon as they are approved by the Division of the State Architect (Ohlone and Fairmeadow). In addition, the Board will consider in the future approving schematic designs for Duveneck Elementary. As part of the modernization and improvements at this site, another 3

15 classrooms at Duveneck Elementary will be added. This potentially leaves a target of 30 classrooms. Staff has reviewed numerous scenarios for adding strands of classrooms (a strand is 6 classrooms, one room for each elementary grade). Four of these strands would add to 24 classrooms. Our analysis suggests the project cost for 4 of these individual strands is considerably more than the project cost of using Garland as a 4-strand school. Placing an additional strand at these sites also would increase the number of students per acre of play space and the size of the schools. While future enrollment is unknown, and the Board and staff need to do considerable work in the coming months to decide the best path forward in terms of the location for additional classrooms, staff believes giving notice at this time allows the District maximum flexibility for planning. PROPOSAL It is proposed a notice to terminate the Garland lease be given to the lessee prior to June 30, This will result in a termination date of June 30, FISCAL IMPACT There are the following impacts to the General Fund: 1. A total rent reduction over three years of $250,000 over the last three years of the lease, , , and The loss in rental income for of $852,000 (assuming a 3% increase per year). 3. The tenant may serve an 18 month termination notice on the District that will result in a further reduction of rental income. 4. The annual marginal cost of operating a new school is approximately $705,000 based on current costs. Regarding cost to the Strong Schools Bond, the amount of $21,897,265 has been budgeted as the cost to proceed from schematic design to completion of construction. This budget will have to be reexamined and made current if it is decided to move forward with this termination. RECOMMENDATION It is recommended that the Board of Education direct the Superintendent to transmit a notice to terminate the Garland lease to the lessee prior to June 30, This will result in a termination date of June 30, 2014.

16 BOARD OF EDUCATION Attachment: Discussion 7 PALO ALTO UNIFIED SCHOOL DISTRICT Date: TO: FROM: Kevin Skelly, Superintendent Cathy Mak and Bob Golton, Co-Chief Business Officers SUBJECT: Renewal of Student Nutrition Services Consultant Contract for STRATEGIC PLAN INITIATIVE Budget Trends and Infrastructure BACKGROUND The District has contracted with Sodexo America, LLC since to provide consulting services in the operation of the PAUSD Student Nutrition Services program in the schools. Sodexo provides services in a number of areas including program operation, staff development, menu planning, procurement, nutrition, safety, sales, and marketing. The current contract, approved by the Board of Education on June 22, 2010, ends June 30, Staff is pleased with their services. PROPOSAL It is proposed the Board renew the contract for the school year. The proposed amendments to the contract include: The term of Agreement is one (1) year, from July 1, 2011, to June 30, 2012, and is subject to renewal for one (1) additional one (1) year terms upon mutual agreement of the parties; and Fixed price of meals to be charged by Sodexo will be increased from $1.872 to $1.931 to incorporate the increase in food costs. Proposed Fees Sodexo proposed a fixed price per meal of $1.931 compared to the $1.872 for the current year, an overall increase of 3%. This increase reflects a 5% increase in food costs and no increases to all other fixed costs. This price is based on a projected 478,028 meals. The fixed price per meal includes a 60% consultant, food, supplies, signage and marketing materials, equipment, fees, and other miscellaneous Sodexo expenses. The budget and detailed cost breakdown are shown on Exhibit B of the amendment. The projected deficit is $106,491, about the same as the current year. Program Guarantee This is an agreement for a Fixed Price arrangement. A Fixed Price arrangement is calculated based on Sodexo assuming the risk for the performance of the Student Nutrition Services operation. If expenses incurred for the Student Nutrition Services operation exceed the Fixed Price, Sodexo cannot charge the District more than the Fixed Price. Inherent in this arrangement is the 1

17 need for Sodexo to drive participation since the Fixed Price is paid per meal served. This arrangement benefits the District in several ways: (i) there is no risk of inflation for food and supplies to the District, (ii) the District is able to easily budget for the Food Service operation, and (iii) any increased revenue generated by Sodexo is retained by the District. Projected meal sales Total projected meals and equivalent meals for the contract is 478,028. Sales improved significantly in the past two years. For , the latest estimate is 476,305 meals which is 7% increase over In , the increase was 17%. The total meals and equivalent meals served in and were 445,867 and 382,167. FISCAL IMPACT Based on the projected 478,028 meals, the proposed contract is $922,874, which includes all costs except District labor and District miscellaneous operating costs, for the Student Nutrition Services program. This amount is included in the Student Nutrition Services budget. RECOMMENDATION It is recommended at the meeting of June 28, 2011, that the Board of Education approve the amendments to the consulting contract with Sodexo per the attached agreement. 2

18 G:CONTRACT\AMD\AMEND#14.SCH\PALOALTOUSD11-12.DOC (GAO/ja) 5/6/ AMENDMENT PALO ALTO UNIFIED SCHOOL DISTRICT AND SODEXO AMERICA, LLC THIS AMENDMENT, dated June 28, 2011, is between PALO ALTO UNIFIED SCHOOL DISTRICT ("District") and SODEXO AMERICA, LLC ("Sodexo"). W I T N E S S E T H: WHEREAS, District and Sodexo entered into a certain Agreement, dated October 29, 2008, as amended ("Agreement"), whereby Sodexo consults and advises on the management and operation of District's Food Service operation located in Palo Alto, California; WHEREAS, the parties now desire to further amend the aforesaid Agreement; NOW, THEREFORE, in consideration of the promises herein contained and for other good and valuable consideration, the parties hereto agree as follows: 1. Any and all references to the " " school year shall be changed to " " school year. 2. Section 3.1 is deleted in its entirety and the following substituted therefor: "3.1 Term of Agreement. The term of the Agreement is one (1) year, commencing on July 1, 2011, and continuing until June 30, 2012, and is subject to renewal for one (1) additional one (1) year terms upon mutual agreement of the parties, unless terminated earlier as hereinafter provided. During the second half of each school year, District and Sodexo agree to participate in an Annual Expectations Meeting throughout the term of this Agreement in accordance with Exhibit D. Sodexo shall present no less than biannually a verbal and written program update to the School District." 3. Section 7.4(A) is deleted in its entirety and the following substituted therefor: "A. Sodexo shall invoice District $1.931 per Pattern Meal and Meal Equivalent each Accounting Period for the services provided to District pursuant to this Agreement, including, without limitation, the food, supplies, consultant, Insurance/workers compensation, signage/marketing materials, other miscellaneous, General Support Services Allowance and Consulting Fee (collectively the "Fixed Price"). 19 4. Section 7.7 is deleted in its entirety and the following substituted therefor: "7.7 Assumptions. Financial terms of the Agreement are based upon existing conditions and the following assumptions. If there is a change in conditions, including, without limitation, changes to the following assumptions, the financial terms of the Agreement, including the Guarantee, shall be adjusted to compensate for such change. - Changes in District's policies, practices, and service requirements may result in the need for an appropriate adjustment. - Average daily attendance ("ADA") for the contract year shall meet or exceed ten thousand nine hundred eighty five (10,985). - Legislation, regulations and reimbursement rates that create changes in the school lunch program shall remain consistent throughout the year. - Usable commodities, of adequate quality and variety are available for Sodexo's proposed menu cycle, valued at $ per Pattern Meal for the contract year. - The government reimbursement rates in effect as of July 1, 2011 shall remain consistent throughout the year. - Changes to meal components and quantities required by the National School Lunch Act or the National School Lunch Program may result in the need for an appropriate adjustment. - There shall be no competitive sales during the lunch period unless as otherwise agreed upon by the parties in writing. - Service hours, service requirements, type or number of facilities selling food and/or beverages on District's Premises shall remain consistent throughout the contract year. - Milk vendor prices shall increase or decrease as authorized by the California Department of Food and Agriculture, Milk Stabilization Board. Adjustments may be made only after notification of any price adjustment has been made in writing to the District from the provider. Price changes shall become effective on the Monday following written notification to the District. (180). - The projected number of school days shall remain at one hundred eighty - Sodexo programs and/or recommendations shall be implemented as proposed and agreed upon by the District in writing in a timely manner. - District costs for labor and benefits, equipment, indirect and other miscellaneous costs shall not exceed amounts as budgeted for the period of July 1, 2011 through June 30, 2012." 20 5. Exhibit B is hereby deleted in its entirety and replaced with Exhibit B attached hereto. 6. This Amendment is effective July 1, 2011, and thereafter, unless amended. 22 BOARD OF EDUCATION Attachment: Action 8 PALO ALTO UNIFIED SCHOOL DISTRICT Date: TO: FROM: SUBJECT: Dr. Kevin Skelly, Superintendent Bob Golton, Co-CBO and Bond Program Manager Bid Award for Voice over IP (VoIP) Project STRATEGIC PLAN INITIATIVE Budget Trends and Infrastructure BACKGROUND On April 26, 2011, the Board authorized staff to solicit bids for a VoIP system to replace the District s current phone system along with a Network Upgrade to facilitate VoIP implementation and to enable other services for the District. After bids were solicited, staff identified structural problems with the Network Upgrade bid. Therefore, that bid was cancelled and staff will be soliciting new bids and anticipate a bid award at the first Board meeting in August. However, staff is ready to proceed with the VoIP award. Delaying the Network award will not impact the VoIP schedule, as the pilot site is the only site in the District that is VoIP ready. PROPOSAL Bids were received and opened on May 31, 2011, at 3pm. Five bids were received for this project. Staff recommends that the District proceed with a four-phase implementation over the course of one year. The bids shown above reflect that four-phase implementation. The lowest bid was the same for the one-time implementation and the four-phase implementation over the course of one year. Packet Fusion, a ShoreTel reseller, was determined to be the lowest responsible, responsive bidder. Packet Fusion and ShoreTel meet the District s technical requirements. ShoreTel has over 400 K-12 education customers, including 42 in California. Several of these Districts are Packet Fusion customers as well. Staff recommends that the contract be awarded to Packet Fusion. Staff further recommends that the Board set aside 10% of that budget or $32,552 for change orders during implementation.

23 FISCAL IMPACT The Strong Schools Bond budget includes $3,251,818 for IT Infrastructure. This project will be funded from that budget. The combined budget estimate for the Network upgrade and VoIP equipment purchase is $2,000,000. An expenditure of $358,069 for this project leaves $1,641,931 of that amount for the Network upgrade. That amount is expected to be adequate for that project. Annual maintenance for the new VoIP system is expected not to exceed $23,665 and will likely be substantially less. This amount is budgeted in the IT operating budget. RECOMMENDATION It is recommended the Board of Education authorize staff to award a contract for VoIP equipment to Packet Fusion in the amount of $325,517. Staff further recommends that the Board authorize the Superintendent or his designee to execute change orders in an amount not to exceed 10% of the contract amount or $32,552.

24 BOARD OF EDUCATION Attachment: Action 9 PALO ALTO UNIFIED SCHOOL DISTRICT Date: TO: FROM: SUBJECT: Dr. Kevin Skelly, Superintendent Bob Golton, Co-CBO and Bond Program Manager First Amendment to the Lease Agreement by and between PAUSD and Creative Center of Los Altos (Pinewood School) STRATEGIC PLAN INITIATIVE Budget Trends and Infrastructure BACKGROUND The District s current lease with the Creative Center of Los Altos (Pinewood School) extends from September 1, 2003, to June 30, This lease includes a requirement that the parties negotiate rent for the ten years extending from July 1, 2013, to June 30, These negotiations have now been completed and have resulted in agreements not only to rent, but also to the term of the lease and the recapture rights of the District. The current lease is attached. The proposed First Amendment to the Lease Agreement is also attached. The following are the main provisions for the period from July 1, 2013, to June 30, o The rent calculation will remain the same. The annual rent will be adjusted by the Consumer Price Index with the requirement that the annual adjustment shall be at least 3%, but no greater than 6% of the annual rent payable. This provision has served the District well, since six years out of the first eight years had CPIs less than 3%. The future is unknown but the conservative course is to want this minimum to stay in place. o In the current lease, the District has no ability to recapture the site during the first ten years. After that, it can recapture the site with two year s notice for public school purposes. In the amendment, the recapture right is maintained for PAUSD public school purposes, but with four years notice. o If the parties have not agreed in writing to the rent amount for years twenty-one (21) through thirty (30) by the commencement of year twenty (20) of this Lease, for any reason or no reason at all, this Lease shall terminate effective June 30, 2023, without any notice requirement and notwithstanding any other provision of this Lease, subject only to any provision of this Lease expressly surviving termination. o It updates the provision for extending the Lease consistent with the new Lease term.

25 PROPOSAL It is proposed the District execute the attached first amendment to the Lease agreement by and between PAUSD and Creative Center of Los Altos dba Pinewood School. FISCAL IMPACT This amendment retains the annual Consumer Price Index calculation in the Lease and also the requirement that the annual adjustment shall be at least 3%, but no greater than 6% of the annual rent payable. The annual rent currently is $1,190,285. RECOMMENDATION It is recommended that Board of Education approve the attached First Amendment to Lease Agreement by and between PAUSD and Creative Center of Los Altos dba Pinewood School.

26 FIRST AMENDMENT TO LEASE AGREEMENT This First Amendment to Lease Agreement ( First Amendment ) is entered into as of, 2011 ( Effective Date ), by and between PALO ALTO UNIFIED SCHOOL DISTRICT, a California public school district ( Landlord ) and CREATIVE CENTER OF LOS ALTOS dba Pinewood School, a California non-profit corporation ( Tenant ). All capitalized terms used in this First Amendment shall have the same meanings given such terms in the Lease Agreement (as hereinafter defined), unless expressly superseded by the terms of this First Amendment. RECITALS WHEREAS, Landlord and Tenant are parties to that certain Lease Agreement dated September 24, 2002 ( Lease Agreement ), pursuant to the terms of which Landlord leases to Tenant and Tenant leases from Landlord those certain premises located at Fremont Road, Los Altos Hills, California, and as more particularly described in the Lease Agreement. WHEREAS, Landlord and Tenant now desire to enter into this First Amendment for the purposes as hereinafter set forth. AGREEMENT NOW, THEREFORE, IN CONSIDERATION OF THE FOREGOING RECITALS AND THE MUTUAL COVENANTS CONTAINED HEREIN, AND FOR OTHER GOOD AND VALUABLE CONSIDERATION, THE RECEIPT AND SUFFICIENCY OF WHICH ARE HEREBY ACKNOWLEDGED, THE PARTIES HERETO AGREE AS FOLLOWS: 1. Section 2C of the Lease Agreement is hereby deleted in its entirety and replaced with the following: At the Landlord s sole discretion, the term of this Lease may be extended beyond the 29 year, 10 month term on mutually agreed upon terms and conditions. 4. Rent. The parties hereto agree and acknowledge that the Lease Agreement is currently in its eighth year. This eighth year began on July 1, 2010, and shall end on June 30, The current annual rent payable by Tenant in monthly installments under the Lease Agreement is One Million One Hundred Ninety Thousand Two Hundred Eighty Five Dollars ($1,190,285), which amount is subject to annual adjustment pursuant to Section 3B of the Lease Agreement. 5. Section 3C. Section 3C of the Lease Agreement is hereby deleted in its entirety and replaced with the following: Landlord and Tenant hereby agree that Tenant s annual rent for year eleven (11) of the Lease (i.e., July 1, 2013 through June 30, 2014) shall be in an amount equal to the annual rent payable by Tenant for year ten (10) of the Lease, increased by the Consumer Price Index calculation pursuant to Section 3B of the Lease; provided, however, that such increase shall be at least 3% but no greater than 6% of the annual rent payable by Tenant in year ten (10) of the Lease. For lease years twelve (12) through twenty (20), the monthly rent shall be adjusted annually based on the Consumer Price Index calculation pursuant to Section 3B of the Lease, subject to the same minimum increase of at least 3% but no greater than 6%. 6. Section 3D. The following new Section 3D shall be added to the Lease Agreement. As a result, the current Section 3D of the Lease Agreement shall become Section 3E and the current Section 3E of the Lease Agreement shall become Section 3F. Rent for years twenty-one (21) through thirty (30) (i.e., July 1, 2023 through June 30, 2033) shall be in an amount agreed upon in writing by the parties prior to the commencement of year twenty (20) of the lease on July 1, If the parties have not agreed in writing to the rent amount for years twenty-one (21) through thirty (30) by the commencement of year twenty (20) of this Lease, for any reason or no reason at all, this Lease shall terminate effective June 30, 2023, without any notice requirement and notwithstanding any other provision of this Lease, subject only to any provision of this Lease expressly surviving termination. This provision shall be construed not to require any formal or informal process for negotiating future rent. Either party may choose, in its sole and absolute discretion, not to negotiate or not to enter into a written agreement regarding future rent for years 21 through Amendment. 28 altered, amended, modified, or otherwise changed in any respect, except by a writing executed by an authorized representative of the parties hereto. 8. Authorization. Time of Essence. Time is of the essence in this First Amendment and each of its respective provisions. 10. Illegality or Unenforceability. If any provision of this First Amendment shall be determined to be illegal or unenforceable, such determination shall not affect any other provision of this First Amendment or the Lease Agreement. When these projects are completed, savings from these projects, if available, can be transferred back to reserve funds. PROPOSAL The purpose of this proposal is to approve transfers of project savings to reserve funds for future allocation to new high priority projects. A description of the transfers follows. The numbering references the note numbering on the attached budget spreadsheet. Strong Schools Bond Fund Palo Alto High School 1. Palo Alto High School Master Plan. Transfer balance of $2,003 to the Palo Alto High School Reserve fund. 2. Palo Alto High School Multi-Use Field Project. Transfer balance of $ 392,383 to the Palo Alto High School Reserve fund. It is necessary to relocate two modular classrooms to accommodate a new classroom building at JLS Middle School. Bids were received for the JLS Middle School modular relocation project with the following results: Coulter Construction $212,943 Designed Building Systems $223,000 Rodan Builders $247,000 Coulter Construction has performed work for the District on many projects over the past several years, and their work has been very satisfactory. PROPOSAL It is proposed the Board of Education authorize the award of the contract for the relocation of two modular classroom buildings at JLS Middle School and the associated site work and infrastructure to Coulter Construction in the amount of $212,943. A 10% change order allowance in the amount of $21,294 is also recommended, for a total authorization amount of $234,237. FISCAL IMPACT The relocation of these portable classrooms at JLS will be funded by the school s building project budget, as part of the Strong School Bond program. RECOMMENDATION It is recommended that the Board of Education authorize staff to award the relocation of two modular classroom buildings at JLS Middle School and the associated site work and infrastructure to Coulter Construction in the amount of $212,943. It is also recommended that the Superintendent or his designee be authorized to execute change orders in an amount not to exceed 10% or $21,294.

Stanford Middle School STRATEGIC PLAN INITIATIVE Budget Trends and Infrastructure BACKGROUND On August 26, 2008, the Board of Education authorized a master contract with AEDIS Architecture and Planning for planning and design services. Subsequently, on September 22, 2009, the Board authorized staff to execute an addendum to AEDIS s contract to provide design services for Jordan, J.L. Stanford (JLS), and Terman Middle Schools. During design development and construction document phases for the JLS project staff approved the shifting of the new classroom building s short wing closer to Fairmeadow ES in order to increase the size of the student courtyard area. For AEDIS to re-site the building, the structural and civil engineers in conjunction with the landscape architect had to modify documents, requiring work and administrative time for the design team. AEDIS has proposed a fee of $21,751 for this effort. JLS staff also requested the addition of permanent storage to the Cafetorium Wing to replace various sheds scattered on the campus. This addition requires the design of a fire sprinkler system for which AEDIS has proposed a fee of $5,156. PROPOSAL It is proposed the Board of Education authorize staff to execute Addendum No. 6 with AEDIS Architecture and Planning for additional design services for the J.L. Stanford Middle School project in the total amount of $26,907 plus 10% for reimbursables for a total authorization amount of $29,598. AEDIS fee proposals are attached to this item. FISCAL IMPACT The project affected by the above addendum will be funded with Strong Schools Bond funds at JL Stanford Middle School.

New & Modernization Construction Projects Reason: DSA required Fire Sprinkler Design at new storage building Phase: Design Project #: Dear Bob: The site staff has requested a new storage building be constructed next to the restroom facility of the existing cafeteria to replace cargo containers that will be removed from the site. Our office has been directed to add this storage building to the JLS project scope and in order for this building to be located as planned we will need to include a fire sprinkler system in order to meet current code. You may recall DSA now requires a fully integrated fire sprinkler design packet submitted to DSA prior to their final approval. Deferred approval of fire sprinkler systems is no longer acceptable. In order to comply with this new DSA regulation we are requesting a fee increase to provide the necessary design documents as this is not covered under our basic services.
