INTRODUCTION This report provides information to the Electronic Municipal Market Access (the EMMA ) in order to comply with the provisions contained in the Continuing Disclosure Agreement (the CDA ) executed and delivered by the City of Alameda (the City ) in connec tion with the issuance, by the Alameda Public Financing Authority (the Authority ), of the Alameda Public Financing Authority Local Agency Refunding Revenue Bonds, Series 2010A and Subordinate Series 2010B (Harbor Bay CFD and Marina Village AD) in the aggregate principal amounts of $10,675,000 and $8,020,000 respectively (collectively the Bonds ). The CDA was executed and delivered by the City for the benefit of the holders and beneficial owners of the Bonds and in order to assist the Participating Underwriters in complying with S.E.C. 5 2. CONTENT OF ANNUAL REPORT 2.1 Audited Financial Statements The Audited Financial Statements were not available at the time of writing this report. They will be disseminated to EMMA under separate cover when they become available. 2.2 Principal Amount of Bonds Outstanding The following table shows the principal amount of the Bonds outstanding: Series Principal Amount As of 2010A $8,815,000 June 30, B 4,215,000 June 30, Reserve Fund The Reserve Fund for the bonds is not held at the Authority. The underlying local issues have a reserve fund for the Special Tax Bonds and a delinquency maintenance fund for the Improvement Bonds. Reminder and/or Demand Letters have been sent to all delinquent property owners within the Districts. The City is currently working with their consultants and attorneys to begin foreclosure on parcels that remain delinquent. 2.8 Property Ownership Appendix A shows each parcel within the Reassessment District 10-1 (Marina Village) including the ownership, assessed value and value-to lien. 2.9 Occupancy Status The total commercial vacancy rate for properties in Reassessment District 10-1 (Marina Village) is not known to the Authority. However, the vacancy rate for all properties owned by Legacy Partners was 36.43% as shown in the table below. 22 APPENDIX C: SENATE BILL 165 Senate Bill 165, filed with the Secretary of State on September 19, 2000, enacted the Local Agency Special Tax and Bond Accountability Act. This Act requires that any local special tax or local bond measure subject to voter approval contain a statement indicating the specific purposes of the special tax, require that the proceeds of the special tax be applied to those purposes, require the creation of an account into which the proceeds shall be deposited, and require an annual report containing specified information concerning the use of the proceeds. The Act only applies to any local special tax measure or local bond measure adopted on or after January 1, 2001 in accordance with Section or Section of the California Government Code. Some of the requirements of the Act are handled at the formation of the Special Tax District and others are handled through annual reports.
