2 REQUIRED DOCUMENTS AND INFORMATION ON PROCESSING APPLICATIONS FOR PENSIONER RESIDENTS OR ANNUITANT RESIDENTS 1. Written request on legally stamped paper, duly authenticated by a Notary. 2. Documents that guarantee enjoyment of stable and permanent monthly income, generated abroad, of no less than US$ (Four Hundred Dollars), plus US$ (One Hundred Dollars) for each family member who is a dependent of the applicant. 3. Birth certificate. 4. Photocopy of the applicant and dependents passports. 5. Certificate of good conduct or criminal record, issued by the competent office, from the place where he lived for the last six (6) months. 6. Health certificate. 7. Description of household goods. 8. Specifications of the automobile to be imported. 9. All documents must be presented to the Secretary General of the Nicaraguan Institute for Tourism with three (3) copies, translated into Spanish, and duly authenticated.
3 By the authority invested upon it, LAW FOR PENSIONER RESIDENTS OR ANNUITANT RESIDENTS DECREE N 628 THE CONSTITUENT NATIONAL ASSEMBLY OF THE REPUBLIC OF NICARAGUA DECREES Art. 1 Art. 2 Art. 3 Art. 4 Entry into the country is hereby authorized for persons under the category of PENSIONER RESIDENTS or ANNUITANT RESIDENTS. For the purposes of this law, the following terms will be understood as follows: PENSIONER RESIDENT - all persons pensioned or retired by governments, authorized organizations or private companies in their respective countries; and ANNUITANT RESIDENT all those persons who enjoy other types of stable and permanent income generated abroad. For migratory purposes, the category of Pensioner Resident or Annuitant Resident is extensive to the spouse, children and other dependents of whoever acquires the condition of a Pensioner Resident or Annuitant Resident. To obtain the residency categories mentioned in the previous article, the interested parties must prove that they are over forty-five years of age, and attest that they are in either of the two categories referred to in Article 1, and that they enjoy stable and permanent monthly income generated abroad, in the amount of no less than FOUR HUNDRED DOLLARS, in currency of the United States of North America or its equivalent in any other foreign currency, plus ONE HUNDRED DOLLARS per month for each dependent family member, for their subsistence in this country. Nicaraguans who permanently resided abroad for more than TEN YEARS and can prove that they enjoy income generated abroad under the conditions stipulated in the preceding article, can obtain the benefits set forth in this law. Nationals in the country, who receive a pension or retirement income from other governments, foreign official organizations, or foreign companies established in the country, can also opt for the status of Pensioner Residents, as long as said income is generated abroad. Art. 5 Persons protected under the terms of this law will enjoy exemptions from current or future customs duties and other import taxes, for a single time and for the amount of TEN THOUSAND DOLLARS (US$ 10,000.00) to import their household items. They can also protect their dependents in their application, for migratory purposes. They will also enjoy income tax exemptions encumbered
4 on declared amounts coming from abroad, in order to be credited with the rights granted in this law. In the event the goods referred to in this Article are reassigned within three years following their entry into the national territory, taxes that were exempted must be cancelled. Art. 6 In addition, beneficiaries may also import an automobile for personal or general use, free from import taxes, customs duties, sale taxes and economic stabilization taxes. Any vehicle brought into the country in this manner, may be sold, assigned or transferred to another person, exempt from said taxes, once five years have elapsed from the date it was imported. Once the previously mentioned period has elapsed, automatically, the beneficiary has the right to import another vehicle, and so forth, successively, every five year. In the event the vehicle is lost due to theft or total loss owing to fire, collision or an accident occurring during any five-year period, beneficiaries may purchase another vehicle, tax free. In either case, the corresponding amount shall not be taken into account for the exemption set forth in the previous article. 1 Art. 7 Art. 8 If the beneficiary waives his status as Pensioner Resident or Annuitant Resident, within the time frames pointed out in Articles 5 and 6, he must pay all taxes from which he was exempted. Pensioners who enter the country as Pensioner Residents or Annuitant Residents in compliance with the requirements set forth in this law, can remain for indefinite time in the national territory; nonetheless, they cannot dedicate themselves to any type of industrial or commercial activity, nor perform any type of work paid with national funds, except for public office as set forth in Article 30 of the Constitution. Pensioner Residents or Annuitant Residents who own registered real estate in Nicaragua for a minimum value of one hundred thousand dollars in foreign currency, and who make investments that are useful to the country according to criteria by the Ministry of Development, Industry and Commerce, are exempt from this prohibition. When dealing with married couples, the prohibition referred to in this Article is extensive to both spouses. 1 Decree No Published by the Official Bulletin La Gaceta No. 136, dated Friday, July 18, Article: 1: In compliance with Article 6 of the Law on Pensioner Residents or Annuitant Residents, the unit value of the vehicle will be up to US$ 10, (Ten Thousand Dollars) CIF. In case it exceeds this amount, the taxes corresponding to the excess amount of the above-mentioned value shall be payable.
5 Nicaraguan beneficiaries dedicated to any of the activities contemplated in this Article, cannot continue to enjoy the benefits granted by this law. Art. 9 Art. 10 The Ministry of Development, Industry and Commerce, through the General Office for Tourism, will be the agency in charge of hearing and deciding on applications for protection under the terms for benefits granted by this law. All persons interested in obtaining benefits of this Law, must request it from the Ministry of Development, Industry and Commerce, at the General Office for Tourism, or with authorized Nicaraguan consular officials accredited abroad, by submitting the documentation which provides evidence of the conditions set forth in Article 2 of this Law, of their nationality, their good standing and a certificate of health, attesting that the applicant does not suffer from mental illness nor any infectious or contagious diseases. The General Office for Tourism will issue the corresponding Resolution within fifteen days after receiving the application, and shall make it known to the Ministry of Foreign Affairs and the Department of Immigration, in order to issue the Residency Identity Card for a Pensioner Resident or Annuitant Resident. Once the application has been accepted, the Ministry of Development, Industry and Commerce, through the General Office for Tourism, will officially give notice to the Ministry of Finance and Public Credit and to the General Customs Office, recommending issuance of the corresponding tax exemptions and exemptions from customs duties granted to the applicant. Art.11 Art. 12 Interested parties can process their applications before Nicaraguan Consular Officials accredited in the country where they reside, abiding by the statutes set forth herein. Once the procedure has ended, said officials will send the respective file to the Ministry of Development, Industry and Commerce, General Office for Tourism, for study and resolution, which will be communicated to the remitting office. All applications must be filed on legally stamped or taxed paper worth fifty cents of a Cordoba, and duly authenticated by a notary or foreign service official for cases referred to in the above article, and will provide the following documents: a) Certification of the pension, retirement or income stated on the application, issued by the respective organization, expressly stating the monthly amount, its permanent nature, stability and conditions to which it is subject. When the party issuing said certification is a private entity with an unknown or dubious financial solvency, it must also be accompanied with a certification from a Certified Public Accountant attesting that, after reviewing the accounting records of the private entity in question, he can sign that said entity is in a financial position to pay out the corresponding pension or income, for a minimum of five years;
6 b) Certification of the applicant s nationality or passport and his dependents; c) Valid passport or travel document to provide due evidence of his status as a foreigner; d) Certification issued by the competent Office, Registry or Record from the place where he resided for the last six months, attesting the personal background of the applicant and his spouse. In qualified cases, and according to criteria by the Ministry of Development, Industry and Commerce, this certification may be substituted by a sworn statement from three Nicaraguan nationals, with recognized standing, who attest that they know the applicant, and guarantee that he has been a person of good conduct in the past; and e) A list of the items that the interested party will import. All documents must be submitted with two copies. Passports must be submitted along with two photocopies. The Office for the General Division of Tourism in charge of processing applications, shall immediately proceed to compare the photocopies with the original, and, if so, shall return the passports to the interested party at the same time. Art.13 All documents suitable to prove, which must be submitted on the basis of this law, should be extended in conformity with the legal requirements foreseen in the respective legislation and written in the Spanish language. Any documents written in any other language must be legally translated into Spanish. For such documents to be valid in Nicaragua, it is essential that they be properly authenticated. Art. 14 Art. 15 Art. 16 Information proven to be false in documents or reports submitted for granting benefits conferred by this law will be subject to penalty and immediate payment of tax exemptions plus a 10% fine, as well as cancellation of the credential extended by the corresponding entities, in conformity with this law. Foreigners who enter the country with Pensioner Resident or Annuitant Resident status and who participate in it for industrial purposes involving an amount of no less than one hundred thousand dollars may receive the benefits provided in Article 19, Paragraph 1) of the Political Constitution. The current law repeals any other previous provisions which are inconsistent with it, and will enter into effect upon publication in the Official Bulletin, La Gaceta.
