1 Annexure-I ANNUAL PLAN OF OPERATION (APO) FOR IMPLEMENTATION OF COMPENSATORY AFFORESTATION, CAT PLAN, WILDLIFE CONSERVATION & PROTECTION PLAN AND NPV SCHEMES UNDER STATE-CAMPA-FUND In pursuance of the orders of the Hon ble Supreme Court in interlocutory application (IA) No.2143 dated in Writ Petition (C) No.202/1995 and further directives of the Ministry of Environment & Forest, GOI, vide their letter No.5-1/2009-FC (Pt) dated 9 th June 2009 and recent DO letter No.1-58/09/MoS/IC/E & F dated 15 th July 2009, the State Government constituted the State-CAMPA (State Compensatory Afforestation Fund Management and Planning Authority) by Notification No.107/Home/GOS/2009 dated with the powers & functions to be performed by their functional bodies as per the guidelines prescribed therein. 2. PREPARETION OF APOs As per the Guidelines prescribed under Para No.5 (ii) of the said Notification, the Executive committee of State-CAMPA met on and finalised the APOs, giving breakup of the proposed activities and estimated cost, in conformity of the direction received from the MoEF GOI vide their letter No.5-1/2009-FC dated and subsequent letter No.5-1/2009 FC dated to release the fund very soon. The APOs has been prepared as per the approved Schedule of Rates-2009 (forestry activities) for implementation of pre-determined site specific schemes during the year (1) APO FOR IMPLEMENTATION OF COMPENSATORY AFFORESTATION SCHEME (CAs) CAs is one of the mandatory conditions being stipulated by the MoEF GOI while according forest clearance under section 2 of Forest (Conservation) Act 1980 for diversion of forest land for non forestry purposes of User agency. As per the Rules & Guidelines under the Act, the site specific CAs was prepared initially by the respective Forest Division and submitted along with the proposal in complete set which was subsequently forwarded to the Ministry with the prior approval of the State Government on case to case basis. A progressive detail of the approved cases together with the CAs stipulated in the individual cases and their relative achievement is enumerated as under:- (i) Total Number of approved cases as on Nos (ii) Total Forest land diverted under the project (iii) Total Compensatory afforestation stipulated (iv) Total Compensatory afforestation achieved In the past (v) Total Compensatory afforestation proposed to be achieved as per APO (vi) Total balance of Compensatory afforestation To be achieved in successive year ha ha ha ha ha
2 All the approved cases are being taken up for raising CAs on first come first basis as prescribed under Para 8(2) of said Notification, and the remaining approved cases are in the pipe line for achieving the target of ha of CAs in the successive year as per programme Accordingly, provision of Rs Lakh has been incorporated in the APO (Annexure-IV) with a target of Ha of block plantation to be achieved in 64 cases only. Rs Lakh (2) NET PRESENT VALUE (NPV) SCHEMEs As per the directives of the MoEF GOI in compliance of order of the Hon ble Supreme Court in writ petition No 202 in IA No.566 dated and subsequent order dated / in IA No.826, Net Present Value is being charged against the diversion of forest land and simultaneously recovered from the User agency in regular basis. The funds are to be utilised for natural assisted regeneration, forest management, forest protection, forest infrastructure development and allied activities as per the guidelines prescribed under the State-CAMPA Notification. Accordingly, NPV scheme has been prepared on priority basis and simultaneously incorporated in the APO (Annexure-V) for its implementation as under:- ( i) Natural Assisted Regeneration Rs Lakh ( ii) Forest Management Rs Lakh (iii) Forest Protection (iv) Infra-structure Development Rs Lakh Rs Lakh ( v) Wildlife Protection & Management Rs Lakh (vi) Allied activities Rs Lakh SUB - Add: 2% Monitoring & Evaluation, contingencies Rs Lakh Rs Lakh Rs Lakh (3) CATCHMENT AREA TREATMENT PLAN (CAT Plan) CAT Plan is a part of the Environment Management Plan usually prepared by the Experts from the relevant disciplines after doing extensive Environment Impact Assessment of the hydro power project and catchment areas in particular. The entire CAT plan was simultaneously approved by the MoEF GOI with the concurrence of the State Government while conveying the Environment Clearance for construction of hydro power project at different
3 Locations under the Environment Protection Act Accordingly, the fund has already been recovered from the Power Developer and transferred to the Ad Hoc Campa in the MoEF GOI respectively. Four CAT Plans particularly for construction of (i) 96MW Chujachen HEP in East District by Gati Infrastructure Ltd., (ii) Teesta Low Dam HEP in South/West District by NHPC, (iii) Jorethang Loop HEP in West/South District by Dans Energy Ltd. and (iv) Ramam HEP in West Sikkim by NTPC have been brought into operation with the release of fund by the MoEF GOI since last year. Three more CAT Plans are proposed to be implemented from this year and shall be continued together with the on-going CAT Plans till their completion as per the programme. The details of the fund position projected in the APO (Annexure-VI) are as follows:- ( i) Chuzachen HEP in East Sikkim (by Gati Infrastructure) Rs Lakh ( ii) Jorethang loop HEP in S/W Sikkim (by Dans Engery) Rs Lakh (iii) Teesta Low Dam Project in West Bengal ( by NHPC) (a) Highly degraded type (East Sikkim) Rs Lakh (b) Very highly degraded type (South Sikkim) (iv) Ramam HEP in West Sikkim (by NTPC) Rs Lakh Rs Lakh ( v) Rangit HEP-IV in West/South ( by Jal Power) Rs Lakh (vi) Teesta HEP-VI in South/East Sikkim (by Lanco) (vii) Teesta HEP-III in North Sikkim (by Teesta Urja) Rs Lakh Rs Lakh Rs Lakh (4) WILDLIFE CONSERVATION & PROTECTION PLAN UNDER TEESTA HEP III Similarly, the Conservation of Wildlife & Protection works is also a part of the EMP of the Teesta HEP Stage-III and its fund of Rs Lakh was recovered from the Power Developer. This scheme has now been prioritised to be implemented from this year keeping in view of urgent requirement for conservation and habitat improvement of the wildlife of this zonation. The 1 st year physical target with its provision of Rs Lakh has been incorporated in the APO (Annexure-VII). Rs Lakh (5) WILDLIFE CONSERVATION & PROTECTION PLAN IN PAs Out of 266 cases, 4 cases are related to the diversion of forest land from PAs as already been approved by the MoEf GOI under section 2 of FCA 1980 with the permission of the Hon ble Supreme Court. These are the special cases stipulated with a condition to make the fund available by the User agency for Wildlife Conservation & Protection Plan to be implemented inside the PAs only as
4 per the order of the Hon ble Court. The concerned User agency deposited the fund to the extent of Rs lakhs only and immediately transferred to the Adhoc Campa in the Ministry as per the directives. Two cases have been taken up for implementation of scheme within Barsey Rhododendron Sanctuary since last year and being continued to be completed as per the programme. Accordingly, the physical target along with the requisite provision has been incorporated in the APO (Annexure-VIII) for implementation of the scheme, as under: ( i) WL Conservation & Protection Plan for Barsey Rhododendron Sanctuary (related to the diversion of forest land for Hee Khola under Barshey/PA to Sangadorjee, Kaluk- Rinchenpong for water supply Scheme by RMDD) (ii) -do- -do- (related to water supply from Chakmakey-Ringyang/PA to Soreng Sub Division for water supply Scheme by RMDD) Rs Lakh Rs Lakh Rs Lakh GRAND (1) TO (5) Rs Lakh (RUPEES TWENTY ONE CRORE THIRTEEN LAKH AND THRITY THOUSAND) ONLY 3. STATE CAMPA FUND As per the earlier directives of the MoEF GOI and recent Guidelines prescribed under State-CAMPA Notification, the fund are being recovered from the concerning User agency in forest land diversion cases under the Act and transferred to the Ad Hoc Campa in the Ministry in a regular basis. The State Government through the Forest Department has already transferred the fund to the extent of Lakh (139 crore) till and credited into Sikkim CAF A/c of the Ad Hoc Campa in the Ministry (Annexure-IX). Last year, Ministry had released the fund of Rs.8,00,92,000/ directly to the Union Bank of India, Gangtok Branch, M.G.,Marg, Gangtok (Sikkim) by RTGS mode which was credited into State-CAMPA-Fund for implementation of the schemes. An interest amount for Rs lakhs was also accrued out of the deposited fund till and credited into the State-CAMPA-Fund thereby making the total deposits of Rs lakhs thereof. It is submitted that fund of Rs lakhs has been utilized for implementation of CAs, NPV scheme, CAT Plan, Wildlife activities and other allied activities during the year , and balance fund of Rs lakh is available under State-CAMPA-Fund as on 31 st March All the expenditure has been incurred as per the approved APOs and guidelines notified for utilisation/disbursement of fund under Para No 7 and 8 of the State-CAMPA Notification. It is further submitted that balance fund of Rs lakhs together with the fund receivable from the Ministry under State-CAMPA-Fund shall be utilised for the implementation of pre-approved schemes as per the APO

IMPLEMENTATION OF SCHEME The scheme shall be implemented by the Executive Committee through the Circle/Divisions with their supportive officials posted at various places and involvement of JFMCs/EDCs and local Panchayat under their respective jurisdiction. Application of sound forestry practices and modern technology inputs are the primary concern to maintain the quality standard of the works being executed under the State-CAMPA. All the precautionary measures and guidelines shall be taken into consideration while implementing the schemes individually. 5. MONITORING & EVALUATION OF THE WORKS An independent system for concurrent monitoring and evaluation of the works implemented in the State utilizing the funds available shall be evolved and implemented to enable to ensure effective and proper utilization of fund. Accordingly, a State Level Monitoring Committee has been constituted by the State Government by Notification No.17/Home/2010 dated Timely monitoring is being done with the involvement of the Committee Members from different Department, and their Report submitted shortly in this respect. 6. SUBMISSION OF THE APO It has been observed that more than 25 lakh of fund will be recovered out of the seedlings cost supplied from the forest nurseries for afforestation programme. As per the recent directives of FRED, this will be parked separately to meet up the expenditure for wages and maintenance of the existing nurseries for eventual production of seedling stock at different places. These are invariably required for planned afforestation programme in the successive year. In view of considering the overarching objectives of the State-CAMPA to be achieved in a progressive direction for the conservation, protection and management of forests & Wildlife in particular, the Annual Plan of Operation (APOs) amounting to Rs Lakhs (Rupees twenty one crore thirteen lakh and thirty thousand) only is submitted for consideration and approval of the Steering Committee under the Guidelines/Para (iii) of the State-CAMPA Notification for onward submission of the same to the Ad Hoc Campa in the MoEF GOI for release of fund accordingly.
