3 Posted January 18, 2018 With the announcement of an increase in the Equal Employment Opportunity is the Law posting penalty, the maximum fine for federal posting violations rises to $34,169. The Equal Employment Opportunity Commission (EEOC) published an updated penalty level for the EEO is the Law posting in the Federal Register on January 18. The penalty increases by $11, to $545 for each separate offense. The increases is the result of an adjustment for inflation, as required by the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015.The law requires federal agencies to adjust penalties for inflation each year by January 15. On January 2, the Department of Labor (DOL) announced penalty increases for three postings: Family and Medical Leave Act (FMLA) $169 Job Safety and Health: It s the Law $12,934 Employee Polygraph Protection Act $20,521 The DOL s posting revised fines apply to penalties assessed after January 2, The EEO is the law posting penalty increase takes effect February 20, Posting Penalty Summary Posting Name 2017 fine 2018 fine Family and Medical Leave Act $166 $169 Job Safety and Health: It s the Law Employee Polygraph Protection Act $12,675 $12,934 $20,111 $20,521 EEO is the Law $534 $545 Total $33,486 $34,169 Updated federal contractor minimum wage poster needed on January 1 Posted December 5, 2017 The United States Department of Labor (DOL) has made a mandatory change to the federal contractor minimum wage posting to show the 2018 rate of $10.35 per hour. 3

4 The Worker Rights Under Executive Order posting applies to employers with new and replacement contracts covered by the executive order. The posting shows the federal minimum wage for contractors, which is adjusted annually for inflation. J. J. Keller & Associates will update its all-in-one Federal Contractor poster and federal contractor minimum wage stand-alone poster to show the new rate. Employers with the Update Service will automatically receive the updated version of the poster. Customers without the Update Service will be able to order the revised Federal Contractor all-in-one poster or the stand-alone Federal Minimum Wage for Contractors Poster. Who is required to display the federal contractor minimum wage poster? Employers with new and replacement contracts covered by Executive Order are required to notify workers of the applicable minimum wage rate under the executive order. The executive order applies to new and replacement contracts issued on or after January 1, 2015, that fall into four major categories: Procurement contracts for construction covered by the Davis-Bacon Act (DBA); Service contracts covered by the Service Contract Act (SCA); Concessions contracts, including any concessions contract excluded from the SCA by the DOL s regulations at 29 CFR 4.133(b); and Contracts in connection with federal property or lands and related to offering services for federal employees, their dependents, or the general public. With respect to workers performing work on or in connection with a covered contract whose wages are governed by the Fair Labor Standards Act (FLSA), the contractor must post a notice in a prominent and accessible place where it can be readily seen by workers. Displaying the current Worker Rights Under Executive Order poster meets this requirement. DOL proposes update to tip regulations Tip credit not slated to change; mandatory posting change possible but unlikely Posted December 14, 2017 The Department of Labor (DOL) is proposing changes to the tip regulations under the Fair Labor Standards Act (FLSA), but it is unlikely that this will bring a mandatory change to the FLSA poster. The FLSA poster includes a Tip Credit section, which explains that employers of tipped employees may pay these workers a cash wage of $2.13 per hour. If the employee s tips plus the cash wage do not equal the minimum hourly wage, the employer must make up the difference. 4

5 The DOL s proposed rule change leaves that part of the law intact. The rule change impacts employers who elect not to take the tip credit. These employers pay workers at least the minimum wage. The proposed regulation seeks to allow these employers to share tips between a larger pool of employees. Employers have until February 5, 2018, to comment on the proposed rule. Comments were originally due on January 4, but the deadline was extended on December 14. The DOL will then consider those comments and will issue a final rule. No date has been set for the publication of the final rule. STATE and LOCAL POSTING NEWS Bernalillo County releases updated minimum wage poster Posted March 21, 2018 Bernalillo County, New Mexico, has made mandatory change to its minimum wage poster to show the 2018 rate of $8.85 per hour. The bilingual Bernalillo County minimum wage poster is a specialty poster and is not part of the Update Service. However, employers in Bernalillo County can purchase this specialty poster to stay in compliance with posting requirements. Spokane sunsets Earned Sick and Safe Leave law Posted February 27, 2018 Spokane, Washington, no longer has an Earned Sick and Safe Leave law, and employers no longer need to display the Spokane Earned Sick and Safe Leave poster. The city s law sunset on December 31, A statewide Paid Sick Leave law took effect in Washington on January 1, 2018, and Spokane employers are now covered by the state law. The Spokane earned sick leave poster (50990) will be dropped from J. J. Keller s line of specialty posters. 5

6 Please note that city-specific paid sick leave laws remain in effect in Seattle and Tacoma. Employers in those cities must post the applicable city-specific paid sick leave law poster in addition to the Washington state poster. Portland, Maine, releases updated minimum wage poster Posted February 19, 2018 The city of Portland, Maine, has made a mandatory change to its minimum wage poster to show the new rate of $10.90 per hour which takes effect on July 1, The poster must be displayed by employers in Portland. Employers must also post the city s minimum wage ordinance, which is included on the Portland, Maine, employment law poster from J. J. Keller & Associates. The Portland minimum wage poster is a specialty poster and is not part of the Update Service. However, employers can purchase the poster as a stand-alone poster to remain in compliance with city posting requirements. Maryland reveals new Earned Sick and Safe Leave Employee Notice Posted February 16, 2018 The Maryland Department of Labor, Licensing, and Regulation has released a new Earned Sick and Safe Leave Employee Notice poster that employers can use to comply with the notice requirement of the Healthy Working Families Act. The poster explains how sick and safe leave time is accrued and when it may be used. Employers are to provide employees with a written statement of earned sick and safe leave and are prohibited from taking adverse action against an employee who uses sick and safe leave. Employees may not bring an action in bad faith. The poster also includes information about filing a complaint or obtaining additional information about the law. The new Sick and Safe Leave Employee Notice will be added to the Maryland posters from J. J. Keller & Associates. Subscribers to the Update Service will automatically receive the new version of the poster. Wyoming makes mandatory change to Health and Safety posting Posted February 13, 2018 The Wyoming Department of Workforce Services has made a mandatory change to the state s Health and Safety Protection on the Job posting to show new fine levels. 6

7 The department s Occupational Safety and Health Administration (OSHA) division has adjusted the penalties for inflation. The poster now lists the following maximum penalty levels: Serious violation: Mandatory penalty up to $12,675 Non-serious violation: Optional penalty up to $12,675 Failure to correct a violation: Up to $12, 675 per day Willful violation: $126,749 The Wyoming poster from J. J. Keller & Associates will be updated with the mandatory change to the OSHA posting. Subscribers to the Update Service will automatically receive the new version of the poster. Another update on the way? The Wyoming OSHA Commission is proposing to increase penalty levels again later this year. The state is looking to make the penalties equal to federal penalty levels that took effect on January 2, Employers have until March 28, 2018, to comment on the proposed changes. After the comment period ends the changes will be referred to the commission for a vote, and then to the governor s office. It is estimated that the earliest these penalties would take effect would be the end of June. If the state makes another mandatory change to its OSHA poster, employers with the Wyoming Update Service will automatically receive a new poster. Santa Fe Living Wage poster updated Posted February 13, 2018 The City of Santa Fe has made a mandatory change to the Living Wage Ordinance poster to show the new rate of $11.40 per hour which takes effect on March 1, The poster must be displayed by businesses required to have a business license or business registration from the city, contractors for the city, and businesses receiving assistance relating to economic development. The bilingual Santa Fe Living Wage poster is a specialty poster and is not part of the Update Service. However, employers can purchase the updated Living Wage poster as a stand-alone poster to remain in compliance with city posting requirements. California makes mandatory change to cosmetology posting Posted January 29,

8 The California Department of Industrial Relations has made a mandatory change to the Required Workplace Posting for All California Barbering and Cosmetology Licensees. The revised poster lists the 2018 minimum wage rate of $10.50 per hour for employers with 25 or fewer employees and $11 per hour for employers with 26 or more employees. The new rate took effect on January 1. The poster is required for California businesses licensed by the Board of Barbering and Cosmetology. The California Barbering and Cosmetology specialty poster from J. J. Keller & Associates will be updated with the mandatory change. This specialty poster is not part of the Update Service, so subscribers will not automatically receive a revised version of the poster. However, they can purchase the updated poster from J. J. Keller to remain in compliance with posting requirements. Emeryville issues new Fair Workweek Ordinance posting Posted January 17, 2018 Emeryville, California, has released a new Fair Workweek Ordinance posting for employers in the retail and fast food industries. The posting requirement applies to: Retail firms with 56 or more employees globally, and Fast food firms with 56 or more employees globally and 20 or more employees in Emeryville. Employers must provide employees with at least two weeks advance notice of schedules and must pay time-and-a-half for any hours worked between closing and opening shifts that are separated by less than 11 hours. The law took effect July 1, 2017, and the city will begin full enforcement, including all fines and penalties for violations, on January 1, A bilingual specialty Fair Workweek Ordinance poster will be available from J. J. Keller & Associates, Inc. This specialty poster is not part of the Update Service. However, employers in Emeryville can purchase this specialty poster to stay in compliance with employment laws. District of Columbia releases 2018 Living Wage posting Posted January 17, 2018 The District of Columbia Department of Employment Services has made a mandatory change to the Living Wage Act of 2006 specialty poster. 8

9 The revised poster lists the 2018 rate of $14.20 per hour, which took effect on January 1. It also merges the lists of exemptions and exceptions into a single section on the poster. The poster is required for recipients of covered contracts and government assistance from the District of Columbia. The District of Columbia Living Wage specialty poster from J. J. Keller & Associates will be updated with the mandatory change. This specialty poster is not part of the Update Service, so subscribers will not automatically receive a revised version of the poster. However, they can purchase the updated poster from J. J. Keller to remain in compliance with posting requirements. Hawaii makes mandatory change to Safe and Healthful Workplace posting Posted January 11, 2018 The Hawaii Occupational Safety and Health Division has made a mandatory a change to its Safe and Healthful Workplace posting to remove penalty information and include details about injury reporting. Employers must report all work-related fatalities within eight hours, and all hospitalizations, amputations, and losses of an eye within 24 hours. The time limit for filing a discrimination complaint has also changed. Private sector employees must file a discrimination complaint with the OSHA regional office within 30 days of the discriminatory act or they lose their right to pursue a federal claim. In addition, contact information has been updated. This is the second mandatory change for Hawaii within a month. In December, the state made a mandatory change to its Wage and Hour Laws posting to update the Family Leave Law section. The state has also made minor changes to other postings. The disability compensation, unemployment insurance, dislocated workers and discrimination postings have been updated to correct grammatical errors and change the revision date and contact information. The Hawaii employment law posters from J. J. Keller & Associates are being updated with the mandatory Safe and Healthful Workplace posting change and the minor changes to the other postings. Employers with the Update Service will automatically receive a revised poster. Vermont releases new pregnancy accommodation posting Posted January 10, 2018 The Vermont Department of Labor has released a new pregnancy accommodation posting that all employers must display. The posting explains employer obligations and employee rights relating to accommodations for 9

10 pregnancy and related conditions. The posting will be added to the all-in-one Vermont poster from J. J. Keller & Associates, Inc. Employers with the Update Service will automatically receive a new poster that includes the new mandatory posting. Rhode Island releases new postings, updates minimum wage posting Posted January 8, 2018 The Rhode Island Department of Labor and Training has released a new Healthy and Safe Families and Workplaces Act posting that employers are required to display. The concise posting states that employees are entitled to sick and safe leave to address their own health and safety needs and the needs of their family. The leave may be paid or unpaid. The state has also released a Ban-the-Box posting. As of January 1, it is unlawful for an employer to include questions about arrests or convictions on a job application. Both postings will be added to the Rhode Island Employment Law Poster from J. J. Keller & Associates, Inc. The revised poster will also include a mandatory update to the Minimum Wage posting showing the 2018 rate of $10.10 per hour. The rate is $9.09 per hour for full time students under age 19 who work in certain jobs, and $7.58 for minors 14 and 15 years old. The rate for employees who receive gratuities is $3.89 per hour. In addition, the Rhode Island Employment Law poster from J. J. Keller & Associates, Inc., will be updated with minor changes to the unemployment insurance, workers compensation, right-to-know, and Parental and Family Medical Leave Act postings. New York posting for nail salons updated with mandatory change Posted January 8, 2018 The New York Bill of Rights for Nail Workers posting has been updated with a mandatory change to show updated minimum wage rates. The posting must be displayed in nail salons in the state of New York. The New York nail salon specialty poster from J.J. Keller & Associates, Inc., will be updated with these mandatory changes. Customers may post this specialty poster to comply with local posting regulations. Maryland makes mandatory change to unemployment insurance poster Posted January 5,

11 The Maryland Department of Labor, Licensing and Regulation has made a mandatory change to its unemployment insurance poster. The poster updates contact information and includes information about Maryland Relay, which provides communication services for people who are deaf, hard of hearing, or who have difficulty speaking. In a mid-december letter to employers, the Division of Unemployment Insurance indicated that employers must replace their current unemployment insurance poster with the new version. Because only contact information had changed on the poster, we originally called this a minor change. As soon as we learned that the state required employers to post the new version, we changed the status to mandatory. The Maryland employment law posters from J. J. Keller & Associates have been updated with the revised posting and subscribers to the Update Service will automatically receive the new version of the poster. The posters will also be updated with minor changes to the child labor and minimum wage postings. Rhode Island releases minimum wage posting with mandatory change Posted January 2, 2018 The Rhode Island Department of Labor and Training has released an updated Minimum Wage posting showing the 2018 rate of $10.10 per hour. Colorado makes mandatory change to Minimum Wage Order Poster Posted January 2, 2018 The Colorado Department of Labor and Employment has released an updated minimum wage posting showing the 2018 rate of $10.20 per hour. The Colorado Minimum Wage Order 34 Poster also lists the tipped employee minimum wage of $7.18 per hour. The Colorado Employment Law poster from J. J. Keller & Associates, Inc., will be updated with the revised posting and subscribers to the Update Service will automatically receive the new version of the poster. 11

12 Tacoma revises paid sick leave notice with a mandatory change Posted January 2, 2018 The city of Tacoma, Washington, has made a mandatory change to paid sick leave notice to reflect updates that have been made to align with state law. Workers are eligible to use paid sick leave 90 days after hire. Up to 40 hours of unused paid sick leave can be carried to the following year. One hour of paid sick leave is earned for every 40 hours worked, with no cap on accrual. The city has also updated its minimum wage poster to reflect the 2018 rate of $12 per hour. The Tacoma minimum wage and paid sick leave poster from J.J. Keller & Associates, Inc., will be updated with these mandatory changes. Customers may post this specialty poster to comply with local posting regulations. Flagstaff updates Minimum Wage Law posting Posted December 22, 2017 Flagstaff, Arizona, has made a mandatory change to its Minimum Wage Law posting to show the 2018 rate of $11 per hour. The bilingual Flagstaff Minimum Wage Law poster is a specialty poster. It is not included on the Arizona poster, and is not part of the Employment Law Poster Update Service. However, employers can purchase the updated minimum wage poster as a stand-alone poster to remain in compliance with posting requirements. Mandatory change made to Broward County Living Wage Ordinance posting Posted December 22, 2017 Broward County, Florida, has made a mandatory change to its Living Wage Ordinance posting to show the 2018 rates. The rates are: $12.38 per hour with qualifying health benefits amounting to at least $1.61 per hour. $13.98 per hour without health benefits. The bilingual Broward County Living Wage poster is a specialty poster. It is not included on the Arizona poster, and is not part of the Employment Law Poster Update Service. However, employers can purchase the updated minimum wage poster as a stand-alone poster to remain in compliance with posting requirements. 12

13 New York makes mandatory change to industry minimum wage posters Posted December 15, 2017 The New York Department of Labor has made a mandatory change to minimum wage posters for farm workers and the building service, apparel, and hospitality industries to show the new rates in effect from December 31, 2017 to December 30, The revised posters list the following minimum wage rates: $13 per hour for employers with 11 or more employees $12 per hour for employers with 10 or less employees $11 for employers on Long Island and in Westchester County $10.40 for employers in the remainder of New York State The following New York specialty posters will be updated with the new information: New York Minimum Wage - Building Service Industry New York Minimum Wage and Wage Order Summary - Farm Workers New York Minimum Wage - Hospitality Industry (Fast Food, Service, Food Service) The posters were formerly called Wage Orders. However, the state no longer requires employers in these industries to post a wage order table. Only the industry-specific minimum wage poster is required. In addition, a new specialty minimum wage poster for the apparel industry (New York Minimum Wage - Apparel Industry) has been created. These specialty posters are not part of the Update Service, so subscribers will not automatically receive a revised version of the poster. However, they can purchase the updated poster from J. J. Keller to remain in compliance with posting requirements. Arizona makes mandatory change to minimum wage posting Posted December 15, 2017 The Industrial Commission of Arizona has made a mandatory a change to its minimum wage poster to show the 2018 rate of $10.50 per hour. The updated poster also includes revised wording relating to exemptions. The Arizona employment law posters from J. J. Keller & Associates will be updated with the mandatory change. Employers with the Update Service will automatically receive a revised poster with the new information. 13

14 Mandatory minimum wage change made in Missouri Posted December The Missouri Division of Labor Standards has made a mandatory a change to its Minimum Wage poster to show the 2018 rate of $7.85 per hour. The updated poster also includes the tipped employee minimum wage of $3.925 per hour. In addition, explanations relating to overtime compensation, exceptions to the minimum wage, and employee rights have been simplified. Sections on recordkeeping and penalties have been removed. Potential Discrimination posting change: J. J. Keller & Associates is checking with the state to see if a second mandatory change will be coming for Missouri. The state s Human Rights Act was modified by Senate Bill 43, effective August 28, It is possible that this law will bring a change to the Discrimination posting. If a mandatory change is made, we will include both the Minimum Wage and Discrimination poster revisions in the same poster update. The Missouri employment law posters from J. J. Keller & Associates will be updated with the mandatory Minimum Wage change. If a change is made to the Discrimination posting, that update will be made as well. Employers with the Update Service will automatically receive a revised poster with the new information. San Francisco makes mandatory updates to two postings Posted December 15, 2017 The San Francisco Office of Labor Standards Enforcement has made mandatory changes to the Health Care Security Ordinance (HCSO) and Paid Parental Leave (PPL) postings. The updated Health Care Security Ordinance posting shows the new rates for As of January 1, the health care expenditure rate will be $2.83 per hour for large businesses, with 100 or more employees, and $1.89 per hour for medium-sized businesses, with 20 to 99 employees. The city has also made a mandatory change to the Paid Parental Leave Ordinance poster. The change relates to which employers are covered by the law and the amount of benefits paid by the city. A multilingual specialty poster containing the updated postings will be available from J. J. Keller & Associates, Inc. This specialty poster is not part of the California all-in-one or state employment law posters, and is not part of the Update Service. However, employers can purchase this specialty, cityspecific poster to stay in compliance with employment laws. New York makes mandatory minimum wage posting change Employers will receive new Paid Family Leave posting from their insurance carrier 14

15 Posted December 14, 2017 The New York Department of Labor has updated its minimum wage posting to show the rates in effect from December 31, 2017, to December 30, This is a mandatory change. The posting, titled Attention Miscellaneous Industry Employees, shows the following minimum wage rates: $13 for employers in New York City with 11 or more employees $12 for employers in New York city with 10 or less employees $11 for employers on Long Island and in Westchester county $ for employers in the remainder of the state The poster also lists overtime rate and rates for tipped workers. The New York employment law posters from J. J. Keller & Associates will be updated with the mandatory change. Paid Family Leave posting information included The poster will also include a new yellow text box explaining that employers need to post a Paid Family Leave notice that they must obtain from their insurance carrier. The state does not make this posting text public. Self-insured employers can contact the Workers Compensation Board for more information. The Paid Family Leave posting requirement takes effect on January 1, Minimum Wage poster updated in Maine Posted December 14, 2017 The Maine Department of Labor has made a mandatory change to its Minimum Wage poster to show the 2018 rate of $10 per hour. The poster also shows the new minimum salary requirement of $ per week for exemption from overtime. The Maine employment law posters from J. J. Keller & Associates will be updated with the mandatory change. The posters will also include minor updates to the child labor and video display terminal postings. Alaska makes mandatory changes to two postings Posted December 14,

16 The Alaska Department Labor and Workforce Development has made mandatory changes to its Wage and Hour Act and Safety and Health Protection on the Job postings. The Summary of Alaska Wage and Hour Act posting shows the new minimum wage rate of $9.84 per hour, which takes effect on January 1, The Safety and Health Protection posting updates injury reporting information to add amputation and loss of an eye. Discrimination complaint information has also been revised. The Alaska employment law posters from J. J. Keller & Associates will be updated with the mandatory changes. Employers with the Update Service will automatically receive a revised poster with the new information. New Jersey updates three wage orders with mandatory change Posted December 14, 2017 The New Jersey Department of Labor and Workforce Development has made a mandatory change to three wage orders to show the 2018 minimum wage of $8.60 per hour. The state has updated the following wage orders with the new rate: Hotel and motel occupations Food service occupations Seasonal amusement occupations Employers in these industries must post the updated wage order that applies to their workplace. As of January 1, 2018, employers with 501 or more employees must pay a rate of at least $15 per hour if the employer pays toward employee medical benefits. Employers who do not pay toward medical benefits must pay a minimum wage of $15.45 per hour. Small employers (with 500 or fewer employees) must pay a minimum wage of $11.50 per hour if the employer pays at least $2.50 per hour toward medical benefits, or the employee makes at least $2.50 per hour in tips. A small employer who does not meet the medical benefit or tip threshold must pay $14 per hour. The updated Seattle poster also includes a revised list of wage theft pay requirements. In addition, information about services for employees and employers has been reworded. The bilingual Seattle labor standards poster from J. J. The postings now indicate that a person cannot be discriminated against for service in the U.S. Armed Forces. This protection was added by Senate Bill 726, which expanded the full protections of the Law Against Discrimination.
