5 Definitions 1. In this Act, COLLABORATION FOR POVERTY REDUCTION ACT INTERPRETATION "five year poverty reduction action plan" means the five year poverty reduction action plan prepared by the Roundtable under the Memorandum of Understanding and required by The Makimaniq Plan; (plan d action quinquennal sur la réduction de la pauvreté) "Memorandum of Understanding" means the Memorandum of Understanding on the Nunavut Roundtable for Poverty Reduction entered into by the Government of Nunavut and Nunavut Tunngavik Inc. on October 24, 2012; (protocole d entente) "Minister" means the Minister Responsible for Poverty Reduction; (ministre) "Roundtable" means the Nunavut Roundtable for Poverty Reduction established by the Memorandum of Understanding; (Table ronde) "The Makimaniq Plan" means The Makimaniq Plan: A Shared Approach to Poverty Reduction, released on February 24, 2012 by the Government of Nunavut and Nunavut Tunngavik Inc. (Plan Makimaniq) Purpose 2. The purpose of this Act is to affirm in law the commitment of the Government of Nunavut to participate as a partner with Nunavut Tunngavik Inc., Inuit organizations, other governments, non-government organizations and businesses on the Nunavut Roundtable for Poverty Reduction to implement The Makimaniq Plan and the five year poverty reduction action plan in a manner consistent with Article 32 of the Nunavut Land Claims Agreement. Posting of The Makimaniq Plan 3. (1) The Minister shall make The Makimaniq Plan available to the public by posting it on the Government of Nunavut's website. Posting of five year poverty reduction action plan (2) The Minister shall make the five year poverty reduction action plan available to the public by posting it on the Government of Nunavut's website once it is received from the Roundtable. Available on request (3) The Minister shall provide copies of The Makimaniq Plan and the five year poverty reduction action plan, once available, to a person on request. 1
6 NUNAVUT ROUNDTABLE FOR POVERTY REDUCTION Minister 4. The Minister is the principal representative of the Government of Nunavut on the Roundtable. Premier and Minister shall attend 5. (1) The Premier and the Minister shall attend all meetings of the Roundtable. Cooperation and collaboration (2) The Premier and the Minister shall encourage cooperation and collaboration with respect to poverty reduction initiatives among members of the Roundtable, in support of the Roundtable, taking into account members' respective responsibilities, authorities, priorities and capacities. Principal supporting official (3) The Minister may designate a member of the public service as his or her principal supporting official with respect to the Roundtable. Public service (4) The Minister may designate one or more members of the public service to (a) provide administrative and research support to the Roundtable; and (b) participate on behalf of the Government of Nunavut with representatives of other members of the Roundtable on subcommittees and working groups established by the Roundtable. Attendance (5) The Premier or the Minister may require a department or agency of the Government of Nunavut to send a representative to a meeting of the Roundtable. POVERTY REDUCTION ACTION PLAN Poverty reduction action plan 6. The Minister shall collaborate with other members of the Roundtable in a public engagement process to develop the five year poverty reduction action plan. Definition of poverty 7. (1) As part of the five year poverty reduction action plan, the Minister shall develop, in collaboration with other members of the Roundtable, a definition of poverty in Nunavut. 2
7 Development (2) The definition of poverty must (a) be developed using a public engagement process; (b) include consideration of the resources and strengths inherent in Inuit culture and decision-making processes and the objective of encouraging self-reliance and the cultural and social well-being of Inuit; and (c) include consideration of the resources, means, opportunities and power necessary for economic self-sufficiency and social inclusion. Indicators 8. (1) As part of the five year poverty reduction action plan, the Minister shall develop, in collaboration with other members of the Roundtable, indicators to be used to measure progress in reducing poverty. Monitoring (2) The Minister shall monitor whether budget measures, programs, policies and initiatives of the Government of Nunavut (a) are consistent with The Makimaniq Plan and the five year poverty reduction action plan; and (b) result in poverty reduction according to the indicators developed under subsection (1). POVERTY REDUCTION FUND Poverty Reduction Fund 9. (1) The Poverty Reduction Fund is established as a special purpose fund in the Consolidated Revenue Fund. Purposes (2) The assets in the fund must be used only for the following purposes: (a) to promote collaboration for the implementation of The Makimaniq Plan and the five year poverty reduction action plan; and (b) to support community-driven initiatives and initiatives of local networks of community organizations engaged in poverty reduction that accord with the The Makimaniq Plan and the five year poverty reduction action plan. Credits (3) Donations, bequests and all other payments directed to the fund must be credited to the fund. 3
8 Conditional donations (4) The Minister may (a) accept donations, bequests or payments that are subject to conditions if the conditions are, in the opinion of the Minister, appropriate to the purposes of the fund; or (b) refuse to accept a conditional donation, bequest or payment. Compliance with conditions (5) Where the Minister accepts a donation, bequest or payment that is subject to conditions, the Minister is bound to comply with those conditions. Assignment of authority (6) The Minister may assign the persons necessary to assist the Minister in the administration of the fund. Investments (7) The Minister shall invest money standing to the credit of the fund in accordance with section 57 of the Financial Administration Act. Interest and income (8) Interest or income earned by the fund accrues to and becomes part of the fund. Disbursement (9) The Minister may, on the recommendation of the Roundtable, make disbursements from the fund in accordance with subsection (2). No deficit (10) The fund must not incur a deficit balance. Fiscal year (11) The fiscal year of the fund is the same as for the Government of Nunavut. Accounts (12) The Minister shall ensure that complete and accurate financial records are maintained separately for the accounts of the fund for each fiscal year. Financial Administration Act (13) Sections 96 to 100 of the Financial Administration Act apply to the Poverty Reduction Fund as if it were a public agency. GRANTS AND CONTRIBUTIONS Grants and Contributions 10. The Minister may make grants and contributions for purposes consistent with subsection 9(2). 4
9 REPORTS Annual report 11. (1) The Minister shall table an annual report in the Legislative Assembly containing (a) a summary of the Government of Nunavut's participation on the Roundtable; (b) a description of budget measures and government programs, policies and initiatives to reduce poverty; (c) the results achieved from budget measures and government programs, policies and initiatives to reduce poverty according to the indicators developed in collaboration with the Roundtable; (d) the annual report of the Poverty Reduction Fund prepared pursuant to section 96 of the Financial Administration Act; (e) (f) a summary of projects funded by the Poverty Reduction Fund; and a description of initiatives funded by grants and contributions made under this Act. Roundtable Reports (2) The Minister shall table in the Legislative Assembly any report received from the Roundtable on the implementation of the The Makimaniq Plan or the five year poverty reduction action plan within seven days of the commencement of the first sitting of the Legislative Assembly after the report is received. Five year poverty reduction action plan (3) The Minister shall table the five year poverty reduction action plan in the Legislative Assembly within seven days of the commencement of the first sitting of the Legislative Assembly after it is received.
