2 Chapter 25 MEMBERSHIP CREDIT SUBCHAPTER A SERVICE ELIGIBLE FOR MEMBERSHIP DEFINES EMPLOYMENT FOR TRS MEMBERSHIP ELIGIBILITY PURPOSES AND ESTABLISHES A STANDARD FOR FULL-TIME EMPLOYMENT THAT IS ELIGIBLE FOR MEMBERSHIP IN TRS. Full-time Service Change RULE 25.1(e) Changed School Year If there is no equivalent full-time position of a given position, the minimum number of hours required per week that will qualify the position for TRS membership is 15. The requirement in this subsection applies to all positions, including bus drivers. 2
3 Full-time Service Change RULE 25.1(e) (Continued) Deletes the distinction between certified and noncertified positions and sets a 15-hour per week minimum for all positions to establish membership eligibility in TRS. Full-time Service Change RULE 25.1(b) Full-time employees hired late in the school year who otherwise meet TRS membership eligibility requirements (i.e., half-time or more; expected to work indefinitely or for a definite period of 4½ months or longer) must be reported even though they may not establish a year of service credit for the school year in which they are hired. Eliminates the requirement that the employment criteria be met in one school year. 3
4 Bus Drivers RULE 25.2 Repealed School Year Eligibility for bus drivers is no longer based on driving a minimum of one route per day that complies with TEA guidelines; The one route requirement will be discontinued after the current school year. Substitutes RULE 25.4 TRS will no longer require a member to purchase credit for substitute service once it has been verified. 4
5 Part-time or Temporary Employment RULE 25.6 Part-time (employment that is less than one-half the standard work load), irregular, seasonal, or temporary employment (employment for a definite period of less than four and 1/2 months) is ineligible for membership unless, if such employment, when combined with other employment in Texas public educational institutions, qualifies as service eligible for membership or if such other employment in itself qualifies as service eligible for membership. Eliminates the phrase in one school year from this rule. Chapter 25 MEMBERSHIP CREDIT SUBCHAPTER B COMPENSATION DEFINES COMPENSATION THAT IS ELIGIBLE AND NON ELIGIBLE FOR TRS PURPOSES 5
6 Compensation Subject to Deposit and Credit RULE States additional types of compensation that are excluded from TRS-creditable compensation. Additionally, the rule now addresses differential pay (the difference between civilian pay and military pay that some employers pay to employees who leave to perform military service.) Compensation Subject to Deposit and Credit RULE (Continued) (1) Cell phone allowances; (2) Signing or retention bonuses that are offered to entice a person to enter into an employment arrangement or to stay for a period of time in an employment arrangement. (3) Payments received under relevant parts of the educator excellence awards program, that do not represent payments for service rendered by the member. (4) Amounts paid pursuant to a Settlement Agreement if the employer has not obtained a written determination from TRS concerning the eligibility of the payment. Additionally, differential pay that is at least 50% of the compensation for full-time service in the membership eligible position may be reported to TRS and deposits submitted at the discretion of the employer. 6
7 Performance Pay RULE Changed School Year Performance pay will be credited to the year in which it is paid. Currently, it is credited to the year in which it is earned. Performance pay paid after a member has retired will not be eligible to be reported to TRS. Required Deposits RULE The rule change clarifies that if a member is employed in multiple ineligible positions that, when combined, qualify as service eligible for membership, the member must make contributions on all eligible compensation received from all TRScovered employers. 7
8 Payroll Report Dates RULE An employer paying amounts to a member pursuant to a settlement agreement must obtain a written determination from TRS that the amounts are creditable compensation before reporting such amounts to TRS as compensation. In the absence of the written determination from TRS, amounts paid pursuant to a settlement agreement are not creditable compensation for TRS purposes and will not be included in determining the amount of benefi ts payable by TRS. Percentage Limits on Compensation Increases RULE Changed School Year This rule was amended to provide that, for non- grandfathered members, the last five years before retirement will be subject to the 10%/$10,000 limits on compensation increases. All compensation increases will be subject to the limit, without exceptions. VERY IMPORTANT NOTE: All eligible compensation must be reported to TRS, even if it exceeds the 10% limit on increases. At the time of retirement, TRS will adjust any salary that exceeds the allowable percentage of increase. 8
9 Chapter 25 MEMBERSHIP CREDIT SUBCHAPTER C UNREPORTED SERVICE OR COMPENSATION PERSONS WHO HAVE BEEN REQUIRED BY LAW TO BE MEMBERS OF THE TEACHER RETIREMENT SYSTEM OF TEXAS OR WHO HAVE SERVICE OR COMPENSATION ON WHICH CONTRIBUTIONS WERE REQUIRED. Verification of Unreported Compensation or Service RULE Members who claim unreported service or compensation after the school year in which it was received must verify the claim on a form prescribed by the Teacher Retirement System and must present such evidence as the staff of the system may require to provide clear and convincing proof of the existence and amount of such service or compensation. In no event shall verification, salary reports, or member contributions for additional compensation or service credit be accepted 1)after a member has retired from the system and the first monthly annuity payment has been issued, 2)after the effective date of a member's participation in the Deferred Retirement Option Plan, or 3)after the payment of a death benefit. 9
10 Chapter 25 MEMBERSHIP CREDIT SUBCHAPTER J CREDITABLE TIME AND SCHOOL YEAR ESTABLISHES THE AMOUNT OF TIME A MEMBER MUST SERVE IN AN ELIGIBLE TRS POSITION IN ORDER TO RECEIVE A YEAR OF SERVICE CREDIT. Percentage Limits on Required Service RULE Changed School Year (1) Except as provided in paragraph (3) of this subsection, a member must work in a TRS eligible position or receive paid leave from a TRS eligible position at least 90 days during the school year to receive a year of service credit. (2) A substitute as defined in 25.4 of this title (relating to Substitutes) will be qualified for membership and granted a full year of service credit by working 90 or more days as a substitute in a school year and verifying the work as provided in of this title (relating to Employer Verification) and paying deposits and fees for the work as provided in of this title (relating to Fee on Deposits for Unreported Service or Compensation). (3) In the last school year of service before retirement, a member serving in an eligible position who worked or received paid leave for less than 90 days in the school year but worked or received paid leave for a full fall semester in accordance with the employer's calendar will receive a year of service credit. If the employer's calendar does not provide for semesters, a member must work in an eligible position or receive paid leave from an eligible position for at least ninety days in order to receive a year of service credit for the school year before retirement. (4) Days that the employer is scheduled to be closed for business are not included in the 90 days of work required to receive a year of service credit unless the day(s) are paid holidays by the employer or the employee was charged with paid leave during the closing. Holidays that are not included in the required number of work days for an employee are not counted as paid holidays or days of paid leave. 10
11 Paid Leave Time RULE An additional statement was added to clarify that days in which the employer is closed for business and the days are not included in the employee s required number of work days are not considered as service in determining a creditable year of service. Paid Leave Time RULE (Continued) VERY IMPORTANT NOTE: Beginning with the school year, as early as July 2011, reporting entities will be required to report the number of days each employee worked or was on paid leave. Holidays that are not included in the employee s required number of work days are not to be included. 11
12 Chapter 25 MEMBERSHIP CREDIT SUBCHAPTER M OPTIONAL RETIREMENT PROGRAM OPTIONAL RETIREMENT PROGRAM ADDRESSES THE OPTIONAL RETIREMENT PROGRAM (ORP), WHICH IS A DEFINED CONTRIBUTION RETIREMENT PLAN AVAILABLE IN LIEU OF TRS TO ELIGIBLE EMPLOYEES OF TEXAS HIGHER EDUCATION INSTITUTIONS. ORP And TRS RULE A person who makes a valid ORP election, then becomes employed in a state agency that is not a TRScovered employer, and then later becomes employed in an institution of higher education may not use the intervening state employment as grounds to become a TRS member when returning to higher education employment. The change clarifies how a person who elected ORP and participated in that program may again become a TRS member. 12
13 Chapter 31 Employment after Retirement SUBCHAPTER B EMPLOYMENT AFTER SERVICE RETIREMENT THIS CHAPTER APPLIES TO RETIRED PERSONS UNDER TRS WHO ARE RECEIVING A SERVICE RETIREMENT ANNUITY AND MAY BE EMPLOYED IN ANY CAPACITY IN TEXAS PUBLIC EDUCATION. Substitute Service RULE 31.13(d) Changed School Year The combination i of the number of days of substitute service and days of work on a one-half time basis in the same calendar month cannot exceed the number of days available that month for work on a one-half time basis. Work for any part of a day as a substitute or on a one-half time basis will count as a full day. The change addresses the way substitute service and one-half time service in the same month is to be counted so that the retiree does not exceed one-half time. 13
14 One-half Time Employment RULE 31.14(d) Changed School Year The exception for substitute service under section and the exception for one-half time employment under this section may be used during the same calendar month without forfeiting the annuity only if the total number of days that the retiree works in those positions in that month does not exceed the number of days available for that month for work on a one-half time basis. A retiree who reports for duty during any day and works any portion of that day shall be considered to have worked one day. One-half Time Employment RULE 31.14(e) Changed April 1, 2011 The change clarifies that paid time off, including sick leave, vacation leave, and compensatory time for overtime worked, is employment for the purpose of this rule. The paid time off must be included in determining the amount of time available to work in a calendar month and must be reported to TRS as employment for the calendar month in which it is taken. 14
15 Bus Driver Exception RULE Changed April 1, 2011 A retiree who retired before September 1, 2005 under Government Code, (a) without reduction for retirement at an early age and who actually drives each day at least one bus route that complies with the guidelines established by the Texas Education Agency (TEA) will be considered eligible for the bus driver exception under Government Code, (a)(7) and may work as much as full-time on other work. 15
