2 WHAT IS WORKERS COMPENSATION? No-fault system State mandated and regulated Exclusive Remedy Limited amount worker can recover REVIEW WHEN ARE WORKERS COVERED? Designed to cover only injuries arising out of and in the course of employment. ARISING OUT OF Refers to causal relationship between the event and disability. IN THE COURSE OF Refers to connection of the event with employment. 2

3 EXAMPLES A custodian falls off a ladder while changing a light bulb in the school hallway covered? A teacher walks down the school hallway and trips over his own feet covered? A parapro lost her footing while descending the steps that lead to the break room-covered? EXAMPLES A teacher is traveling to work in the morning, stops at a red light in front of the school and is rear ended by another car-covered? A business manager leaves the MSBO conference, stops at a convenience store and falls in the store parking lot covered? A school nurse is traveling from one school to another and is in a car accident covered? 3

4 REVIEW BENEFITS FOR COMPENSABLE WORK-RELATED INJURIES Medical benefits Wage loss benefits Rehabilitation benefits Death benefits MEDICAL BENEFITS Employees are entitled to all reasonable and necessary medical care for work related injuries or diseases First 28 days after beginning medical care, employers direct treatment. After 28 days, employees may elect to see a doctor of their own choice The responsibility to provide medical care continues indefinitely as long as the need for care is related to the worker s injury 4

5 HOW LONG ARE WAGE BENEFITS PAID? No wage loss for first seven days- waiting period Wage loss benefits begin on the eighth day Waiting period waived if disabled longer than 14 consecutive days Wage loss benefits continue as long as employee is disabled CALCULATING WAGE LOSS BENEFITS How is a person s average weekly wage calculated? Highest 39 of the last 52 individual weeks paid before the injury Not taxable income by IRS guidelines Defyimpossible.com 5

11 Three Basic Elements of RTW Programs 1. Written Job Description 2. Policies and Procedures 3. Communication and Training Benefits of a RTW Program A Return-To-Work Program is beneficial to both management and employees. Allows an injured employee to be productive and to contribute to the district. Maintains communication between the injured employee s physician and management. Reinforces the district s interest and concern for an injured employee. Discourages malingering. Reduces the disability associated with an injury and its related costs. Helps districts comply with the Americans with Disabilities Act. 11

12 Other Considerations Alternative job assignments do not have to be the most interesting or desirable. Job assignments must be reasonable employment. Job offers must be in writing. The school district does not have to pay an employee the same rate of pay if they are returning to work with restrictions. Coordinate Worker s Comp Some regulations for federal and state leave statutes include: Consolidated Omnibus Budget Reconciliation Act (COBRA) Family and Medical Leave Act (FMLA) Americans with Disabilities Act (ADA) TIP Half of all ADA claims involve injured employees, so refer to ADA Guidelines or work closely with legal counsel to coordinate your transitional duty policy with ADA requirements. 12
