S t u d y o f a m o c k c a s e u n d e r t h e I C C A r b i t r a t i o n R u l e s Arbitrators In-house legal counsel Lawyers Legal directors Litigators Legal practitioners advising international trading companies B a c k g r o u n d / W o r k i n g g r o u p m e t h od This study of a mock arbitration case aims to meet the practical needs of those involved in international trade and investment and will simulate an ICC arbitration proceeding, highlighting differences in cultures and legal practices and giving valuable insight views into the do s and don ts of international arbitration practice. Every truly international arbitration practitioner is well advised to acquaint himself/herself with the ICC Rules of Arbitration and their practical, hands-on application. This specialized workshop and the mock case will be based on the new 2012 ICC Arbitration Rules. While maintaining the traditional advantages of ICC arbitration, the new 2012 ICC Arbitration Rules brought about considerable changes and innovations to the ICC s arbitral proceedings in particular regarding multiparty scenarios, the initiation phase & the ability to obtain interim measures of relief from an emergency arbitrator even before the Arbitral Tribunal is constituted. Increased efficiency, reduction of cost, enhanced protection of fundamental procedural rights, & the electronic handling of arbitration are key issues in focus. The working group method: Study of a mock case within small working groups The mock case will be sent to participants before the training - so that they can read the facts, prepare for the working in groups - and identify the contractual clauses which cover the events mentioned in the facts. Technical and practical presentations with international arbitration practitioners -. There will be opportunities to debate amongst participants and speakers during interactive plenary sessions. 3 S u p p o r t e d b y Organized by: S p e a k e r s Henrik Fieber is a partner with Roschier and heads the dispute resolution practice in Stockholm. He has extensive experience acting as counsel in arbitration proceedings in Sweden and abroad both institutional (SCC, CCCF and ICC) and ad hoc as well as before the Swedish courts. He has been involved in disputes related to a wide range of different areas, including agency and distribution agreements, insurance arrangements, sale and purchase agreements, joint ventures, M&A transactions, shareholders agreements and enforcement of judgments and arbitral awards. In addition to his counsel work, Henrik also acts as arbitrator. His previous experience includes working for the Swedish court system as a judge in the District Court and the Court of Appeal. Henriette Gernaae, Partner at Gorissen Federspiel works in Dispute Resolution and Insurance & Reinsurance. Henriette's primary practice areas are litigation and arbitration, international procedural law, insurance and reinsurance, construction law and supply. She is member of The Danish Bar and Law Society, International Bar Association (IBA), Young Arbitrators Stockholm (YAS), The Danish Association of Arbitration Law and LCIA Young International Arbitration Group. Gustav Flecke-Giammarco is a Counsel at the International Court of Arbitration. He heads the case management team dealing mainly with cases from Germany, Austria, Switzerland, Italy, Benelux and Nordic countries and supervises up to 220 pending arbitration cases at any given time. He lectures at the Swiss Arbitration Academy and is a frequent speaker at international arbitration conferences. Gustav is a member of the Organizing Committees of the ICC International Mediation Competition and the ICC Willem C. Vis Pre-Moot. Gisela Knuts is a partner in the Dispute Resolution practice of Roschier, Attorneys Ltd. Her practice includes litigation, arbitration and alternative dispute resolution. She has been involved in disputes relating to, e.g. construction, energy, distribution, M&A and anti-trust damages. Gisela practices in both Finland and Sweden. Gisela also frequently acts as arbitrator under a variety of arbitration rules as well as in ad hoc proceedings. In addition to an LL.M. degree, Gisela holds an LL.D. from the University of Helsinki and has been a visiting scholar at the University of Uppsala. She has also trained at the Bench. Maria Hauser-Morel, Counsel at the International Court of Arbitration, where she is in charge of the case management team that handles matters involving parties mainly from Central and Eastern Europe. Prior to joining the ICC, Dr Hauser-Morel was an associate in law firms in Paris and Poland, and a Deputy Counsel at the ICC Secretariat. She holds a doctorate from the Wroclaw (Poland) University and a Master of European & International Business Law at the University of Saint Gallen.
4 S p e a k e r s Georg Lett is especially engaged in litigation and arbitration proceedings and in the law of tort, insurance law and EU law. Georg Lett provides extensive assistance to the insurance and the finance industries. Apart from conducting lawsuits before the Danish courts, Georg Lett also appears before arbitration tribunals as well as the European Court of Justice. Georg Lett is partner in Lett Lawfirm P/S. Gustaf Möller, Of Counsel at Krogerus Attorneys and Independent Arbitrator. Former member of the Finnish Supreme Court and the ICC International Court of Arbitration. Former Chairman of the Board of the Arbitration Institute of the Finland Chamber of Commerce Bo G.H. Nilsson Partner of Lindahl in Stockholm has more than thirty years of experience in dispute resolution, arbitration and litigation, internationally and domestically, largely also as arbitrator or chairman of arbitral tribunals. He is past president of Swedish Arbitration Association, the Swedish member of the ICC Court and is a Member of the Board Stockholm Center of Commercial Law, Section for Dispute Resolution (at Stockholm University) Jan Heiner Nedden, M.M. worked as Counsel at the International Court of Arbitration for seven years and was in charge of the case management of over a thousand arbitrations before joining Hanefeld Rechtsanwälte ( in Heiner primarily acts as counsel and arbitrator in domestic and international arbitration proceedings. He advises on general & specific issues of arbitration law and strategy and also represents clients in enforcement proceedings. He acts as party-appointed German law expert in proceedings before foreign courts. He is a trained mediator and teaches domestic and international arbitration law at the Summer Academy on International Dispute Resolution at the University of Heidelberg & the Swiss Arbitration Academy in Zurich/Geneva. Anders Ryssdal, Partner of Wiersholm is an expert in competition law and litigation and holds more than 20 years of experience in litigation, arbitration and private action/enforcement action. He has represented several Norwegian and foreign clients in connection with major litigation and notifications of contracts, mergers and acquisitions. Anders has litigated cases within all fields of civil law. He is also used as an arbitrator in domestic and international disputes. Anders Ryssdal is admitted to the Supreme Court.
