In default of paym ent of balance am ount of purch ase price before 15 days from the date of confirm ation of sale by the Secured C reditor or such extended period as m ay be m utually agreed upon betw een the parties, the deposit of 25% o f th e am ount o f sale price m ade shall be forfeited and the property shall forthw ith be sold again and the defaulting p u rch aser shall forfeit all claim on the property or to any p a rt of the sum for w hich it m ay be subsequently sold. 16. On confirm ation of sale by the secured creditor and if the term s of paym ent have been com plied w ith by the successful tenderer / bidder, the A uthorised Officer shall issue a certificate of sale of immovable property in favour of the p u rch a se r in Appendix-V to the Security Interest (Enforcement) Rules, 2002.

The A uthorised Officer m ay, w here the property sold is subject to any encum brances, if he th in k s fit, allow the p u rch aser to deposit w ith him the m oney required to discharge the encum brances and any in terest due thereon together w ith su ch additional am o u n t th a t m ay be sufficient to m eet the contingencies or fu rth er costs, expenses and in terest as m ay be determ ined by him. 18. On su ch deposit of m oney for discharge of encum brances, the A uthorised officer m ay issue or cause the p u rch aser to issue the notices to the persons interested in or entitled to the m oney deposited w ith him and take steps to m ake the paym ent accordingly 19. Legal charges for conveyance, stam p duty and registration charges as applicable will be borne by the successful bidder. 20. The A uthorised Officer will deliver the property to the p u rch a se r free from encum brances, know n to the Secured Creditor on deposit of m oney by the p u rch aser tow ards the discharge of such encum brances. 21. The certificate of sale will be issued specifically m entioning w hether the p u rch aser h as p u rch ased the im m ovable/m ovable secured asse ts free from any encum brances know n to the secured creditor or not. 22. The u n su ccessfu l B idders who have deposited EMD shall be entitled to have the sam e refunded w ithout any interest im m ediately after the confirm ation of sale by the A uthorised Officer. 23. If the Borrower were to pay to the A uthorised Officer the entire am ount due, with the up-to-date expenses including the expenses in taking possession and conducting the sale, to the secured creditor before e- Auction, the sale by E auction m ay be cancelled by the A uthorised Officer. 24.
