1 Tradesman Policy Summary Tradesman Insurance Policy Summary v2 Policy Summary This document provides a summary only of the significant aspects of cover (including restrictions) provided by our standard Contractors Policy. For full details, please refer to the Policy itself which is available to download from our website ( or by contacting your broker. Introduction The cover provided by the Contractors Insurance Policy has been developed to accommodate a wide range of businesses. No two businesses have the same needs so with the wide choice of optional covers available we are able to provide a tailor-made cover that will fulfil the needs of the majority of commercial clients. The insurance is normally for a period of 12 months unless shown differently on the Policy Schedule. Please note that One Commercial Limited reserves the right to alter the capacity providers under this contract from the time of the quotation until these covers are bound with us. Covers Material Damage (including Theft) - where selected This section covers damage to material property belonging to the business insured caused by one of the following events: Fire Lightning Explosion Aircraft Riot, Civil Commotion Malicious Persons Earthquake and Subterranean Fire Storm Flood Escape of Water from fixed apparatus Impact by own and third party vehicles or animals Theft Fixed Glass Sprinkler Leakage Accidental Physical Damage Subsidence, ground heave or landslip (optional) Terrorism (optional) Pollution unless caused by a specified event, and vice versa Property more specifically insured Damage to fences, gates and moveable property in the open caused by storm or flood damage to stock in basements by escape of water unless on stillages 15cm or more above floor level Subsidence caused by new structures, bedding down or newly made-up ground settling Theft from coin operated machines Theft of money Theft from the open or outbuildings Theft not involving forcible or violent entry or exit Terrorism, unless extended to include Superficial damage to glass Damage whilst premises are unoccupied unless by fire, lightning, aircraft or explosion Condition of Average Notification of unoccupancy or part unoccupancy of buildings Fire break doors and shutters conditions Felt roof Fire extinguishment maintenance condition Fire alarms maintenance and testing condition Minimum physical standards of security Intruder alarm installation Commercial Combined Tradesman Policy Summary v2
2 Automatic sum insured reinstatement (for an additional premium) Capital additions up to 10% of the sum insured (maximum 500,000) except by Theft or Robbery Contract price for goods sold but not delivered Buildings damaged during a contract for sale Debris removal Cost of replacement locks following loss of keys 1,000 limit Debris removal Damage to underground pipes or cables Drain clearance Property at exhibitions up to 5,000 Refilling fire safety equipment Resetting fire / intruder alarms Emergency services costs following fire Damage to grounds &gardens by emergency services up to 1,000 Accidental discharge of metered water, oil or LPG up to 10,000 Trace and access up to 10,000 Non invalidation for acts unknown to you or beyond your control Other interests Emergency services costs following fire Professional fees including architects, surveyors and legal fees Additional costs in complying with EU and Public Authorities requirements Subrogation waiver for the Insured s subsidiary companies Temporary removal of property (other than stock) for cleaning, renovation, repair, etc. Up to 10% of sum insured Temporary removal of documents (excluding computer records) Workmen carrying out minor repairs at the insured premises Water losses occurring within 72 hours are deemed one loss Day One reinstatement (where selected) Theft damage to buildings Glass in showcases and counters Sanitary ware fixed blinds and canopies Reasonable costs of boarding up and replacement of window frames up to 1,000 Window displays following theft or attempted theft up to 1,000 Lettering, ornamentation or alarm foil on windows up to 1,000 Business interruption where selected This section covers financial compensation following interruption to the business insured following an insured loss under the Material Damage section: Cover is available for Gross Profit, Gross Revenue, Gross Fees, Increased Cost of Working, Rent Receivable and Additional Increased Cost of Working. Declaration Linked to Profit or Revenue is also available. Where financial arrangements such as under the Insolvency Act or winding up or receivership are made Automatic sum insured reinstatement (for an additional premium) A wide range of optional Cover Enhancements are available including: Prevention of access Public utilities where the interruption exceeds 24 hours Full failure of public utilities where the interruption exceeds 24 hours Specified or unspecified suppliers and customers Closure of the premises insured by a Public Authority due to vermin, pests, or defective sanitation Property stored at third party premises Goods in transit Terrorism Commercial Combined Tradesman Policy Summary v2
3 Specified All Risks where selected This section covers loss of or damage to specified property pertaining to the business insured whilst anywhere in the United Kingdom (or other countries if agreed) up to the limits specified in the Policy Schedule. Wear and tear Mechanical or electrical breakdown Loss from an unattended vehicle or trailer Fraud by the Insured s employees Unexplained disappearance Pollution unless caused by a specified event, and vice versa Terrorism, unless extended to include Condition of average Intruder alarm installation Money where selected This section covers loss of or damage to money pertaining to the business insured anywhere in the United Kingdom up to the limits specified in the Policy Schedule. Loss from gaming or amusement machines is limited to 100 Loss from automated teller machines or cash dispensing machine Loss in transit by unregistered post Loss from unattended vehicles Reasonable precautions to prevent the loss of money including: - maintaining a record of all money in transit or at the premises insured - carefully selecting responsible employees - controlling the custody of keys Intruder alarm installation condition Protections condition Minimum standards of physical security Money carrying condition Non-negotiable money up to a maximum of 250,000 any one loss Dishonesty or fraud by any partner, director or employee discovered with 7 days of such act up to 2,500 Cover includes loss of or damage to: - cases, bags, etc. whilst being used to transit money - cash registers up to a limit of 1,000 any one occurrence Damage to personal effects up to 750 per person Personal accident (assault) benefits for any person injured during a theft or attempted theft of money including: - death - loss of one or more limbs - loss of sight - permanent total disablement - temporary total disablement Commercial Combined Contractors Policy Summary
4 Book Debts where selected This section covers loss sustained for Book Debts due to damage to your books of account, other business books or records. Loss due to misfiling or mislaid records Loss due to fraud Failure to collect traced and established debts Where the business is wound up or in liquidation or receivership Where the business is discontinued or your interest ceases Condition of Average Debit recording Goods in Transit where selected This section provides cover for Stock and Contents whilst in transit in a vehicle owned by you or whilst being conveyed by a haulage contractor. Fraud by the Insured s employees Unexplained disappearance or inventory shortage Loss due to temperature variations unless involving a road traffic accident Theft or attempted theft from unattended vehicles or trailers: - unless securely locked - overnight unless securely garaged and locked Loss of or damage to china, glass, earthenware or scientific instruments unless caused by fire, theft, actual collision or overturning Loss of or damage to theft attractive goods such as jewellery, watches, precious metals and stones, wines, spirits, perfumes, tobacco products, furs and computer equipment unless specified in the Policy Schedule Loss of or damage to livestock, explosive goods, bullion, money, stamps, deeds or documents Loss of or damage to property in soft-topped, open-topped, open sided or curtain sided vehicles or trailers by storm, flood, theft (unless the vehicle/trailer is stolen at the same time) or malicious damage Reasonable precautions to ensure vehicles are roadworthy and secure Security precautions Retention of damaged goods Additional expenses incurred for the transfer to property to another vehicle, reloading, removal of debris following damage ( 2,500 limit) Damage to clothing and personal effects ( 500 limit) Damage to tarpaulin, sheets, ropes, etc. ( 500 limit) Damage tools and travellers samples ( 250 limit) Fidelity where selected This section covers loss of or damage to specified property pertaining to the business insured whilst anywhere in the United Kingdom (or other countries if agreed) up to the limits specified in the Policy Schedule. Losses not discovered within 24 months of the period of insurance in which the act of theft was committed Consequential loss of any kind Unexplained shortages Compliance with the Minimum Standards of control detailed in the Policy Schedule Employee references Termination of service Amounts owed to an employee who has committed theft will be deducted Cessation of cover Recoveries of further monies Commercial Combined Tradesman Policy Summary
5 The costs of auditors fees The reasonable cost of rewriting or amending computer software to improve security Cover for trustees of any pension fund or other employee benefit scheme Cover includes theft by temporary agency staff Employers Liability where selected This section provides protection for legal liability world-wide for damages and legal costs of up to 10 million (restricted to 5 million in respect of terrorism) for injury to your employees: Excluding cover in respect of travel to or work undertaken offshore Liquidated damages, penalty clauses, fines and punitive and exemplary damages Excluding cover where compulsory insurance is required under the Road traffic Act 1988 Cover includes death, illness, disease, injury, mental injury, mental anguish or shock but not defamation Covers employees temporarily engaged in work overseas Unsatisfied court judgements Cost of court attendance Legal costs incurred in the defence of criminal proceedings under the Health & Safety at Work Act 1974 Indemnity to other persons including directors, employees and principals Public and Products Liability where selected This section provides protection for legal liability world-wide for damages and legal costs of up to the limit of liability shown in the Policy Schedule (indemnity up to 5 million is available): Contractual liability in respect of Products Liability Damage to property held in trust other than where a policy extension applies The Excess stated in the Policy Schedule Terrorism Advice, design or specification provided for a fee Travel to or work undertaken offshore Carrying out work on or Products Supplied which could affect aircraft, airports, nuclear installations, marine vessels, motor vehicles or rail vehicles Exposure to, inhalation of, fears of the consequences of exposure to/inhalation of, costs incurred in repairing, removing, replacing, recalling, rectifying, reinstating, or managing any property arising out of the presence of Asbestos. Use of Heat precautions Underground Services precautions Excess increased to 1,000 for damage to optical fibre cables Cover includes death, illness, disease, injury, mental injury, mental anguish or shock but not defamation Obstruction, trespass, nuisance Wrongful arrest or detention Loss of or damage to third party property Damage caused by products anywhere in the world Covers employees temporarily engaged in work in any member country of the EU or non-manual work anywhere in the world Contingent motor liability cover applies Overseas Personal liability Cost of court attendance Cross liabilities Cover includes liability incurred in connection with: - Corporate Manslaughter & Corporate Homicide Act - Health & Safety at Work Act Data Protection - Consumer Protection Act 1987 Leased or rented premises Indemnity to other persons including directors, employees and principals Commercial Combined Policy Summary
6 Contract Works & Plant where selected This section covers loss or damage to temporary and permanent works executed by the insured including materials supplied or used in connection with the contract and loss or damage to plant tools equipment hired in or owned by the Insured. The Excess/Excesses as stated in the Policy Schedule Repair to or replacement of any item of Your Plant or Hired in Plant caused by its own mechanical or electrical breakdown, failure, breakage or derangement other than in respect of Hired in Plant and for which You are responsible under the terms of a hire agreement not being a leasing or hire purchase agreement. Damage to Existing Structures. Money. any mechanically propelled vehicle, including any trailer attached, licensed for road use and for which a certificate of motor insurance is required, other than a vehicle used solely as a tool of trade. any aircraft or waterborne vessel. property for which You are relieved of responsibility by the conditions of the Contract. The theft of unfixed non-ferrous metals of any description unless at the time of theft An authorised Employee or agent of The Policyholder is actually on site, or such property is contained in a securely locked container or building. Damage to any part of the permanent Works (a) for which a certificate of completion has been issued, or (b) which has been completed and handed over to Your employer, or (c) taken into use unless the Damage occurs (i) during the Maintenance Period but is caused before the beginning of the Maintenance Period, or (ii) while You are carrying out Your obligations under the Maintenance Period, or (iii) within 14 days of the issue of a certificate of completion but only to the extent You are responsible under the conditions of the Contract. Terrorism, unless extended to include Indemnity to Sub Contractors Off site storage of goods or materials for use on the contract works Damage to show properties Overtime and other expenses incurred to expedite the reinstatement of the works following damage Speculative building Damage to security devices Incidental hiring of plant Loss of keys Business Equipment where selected This section provides cover for Loss of or damage to business and office equipment used in connection with the business and kept at the insured s home or business premises. 7 Cancelling Your Policy We hope that You are happy with the cover this policy provides. However, You have the right to cancel Your policy during a period of 14 days after either the purchase or renewal of the contract or 14 days after the day on which You receive Your policy documentation, whichever is the later. We will return the premium in full if cancellation occurs within the 14 day period. If We pay any claim, in whole or in part, during the 14 day period then no refund of premium will be allowed. If You wish to cancel Your policy after cooling off period You will need to give notice in writing (including by ). We will cancel Your policy from the date upon which notice is dispatched to us. You are entitled to a return of premium which will be based upon the length of time remaining for the Period of Insurance less a deduction of a minimum premium of 100 plus the administration costs in providing this insurance. The amount is shown in the Schedule. If We pay any claim, in whole or in part, during the current Period of Insurance then no refund of premium will be allowed. If a claim is made after the policy has been cancelled for an incident which occurred before the cancellation date We will deduct any premium owed to Us from the settlement of the claim. Our Right to Cancel Your Policy We shall not be bound to accept any renewal of this policy. If this happens We will ensure that You are notified accordingly. If We do not receive the premium and Insurance Premium Tax We may cancel this policy by sending You at least 7 days written notice of cancellation to Your Insurance Broker subject to the provisions of the Consumer Credit Act where applicable). We may cancel this policy at any other time by sending 14 days notice of cancellation, giving details of the reason for cancellation, in writing to Your Insurance Broker. In the event of such a cancellation You shall be entitled to the return of a proportionate part of the last premium paid in respect of the unexpired Period of Insurance. If We pay any claim, in whole or in part, during the current Period of Insurance then no refund of premium will be allowed. If a claim is made after the policy has been cancelled for an incident which occurred before the cancellation date We will deduct any premium owed to Us from the settlement of the claim.
