1 TOWN OF JACKSON TOWN COUNCIL AGENDA DOCUMENTATION PREPARATION DATE: April 29, 2010 MEETING DATE: April 5, 2010 SUBMITTING DEPARTMENT: Public Works DEPARTMENT DIRECTOR: Larry Pardee PRESENTER: Shawn O Malley, Asst Director/Town Engineer SUBJECT: An Ordinance Updating the Flood Insurance Study for Teton County to the 2010 Version STATEMENT/PURPOSE The Town Council approves all ordinances amending the Municipal Code. BACKGROUND/ALTERNATIVES The Flood Insurance Study for Teton County needs to be updated from the 2006 version to the August 5 th 2010 version. This ordinance updates the reference in the Municipal Code for this study. This change is needed to reflect the revised Flood Insurance Study which carries the 2010 date which is driven by the Flat Creek Restudy project. This project only impacts unincorporated Teton County. However, since the countywide Digital Flood Insurance Rate Maps are derived from the Flood Insurance Study, Jackson must adopt the revised Flood Insurance Study to be compliant. It is a required administrative action. To remain in good standing in the NFIP program administered by FEMA, this action needs to be completed in advance of the August 5, 2010 date. Once completed, staff will then forward a photo copy of the signed ordinance to Kim Johnson, Emergency Preparedness Specialist, NFIP State Coordinator in the Wyoming Office of Homeland Security. Kim will then provide a copy to FEMA's regional office in Denver. The ordinance is listed for first reading later on in the meeting. ALIGNMENT WITH COUNCIL S STRATEGIC INTENT Passage of this ordinance keeps the Town current and in compliance with regulations. This is a municipal service that enhances the quality of life in the community and supports the Town of Jackson Purpose and Mission. ATTACHMENTS Ordinance Amending and Reenacting Section of the Municipal Code. FISCAL IMPACT There is no fiscal impact other than advertisement of the ordinance prior to taking effect. STAFF IMPACT The staff impact of adopting this ordinance is minimal. It would require recodification of this section of the Municipal Code. LEGAL REVIEW Complete
2 RECOMMENDATION I recommend the Town Council direct staff to place the ordinance on the agenda for first reading for the May 3, 2010 Town Council Meeting agenda. SUGGESTED MOTION I move to direct staff to place this ordinance on the agenda for the May 3 regular Town Council meeting for first reading and subsequent readings thereafter. 3 ORDINANCE C AN ORDINANCE AMENDING AND REENACTING SECTION 2 OF TOWN OF JACKSON ORDINANCE NO. 830, SECTION 1 OF TOWN OF JACKSON ORDINANCE NO. 392 AND SECTION OF THE JACKSON MUNICIPAL CODE OF THE TOWN OF JACKSON BY UPDATING THE FLOOD INSURANCE STUDY FOR TETON COUNTY TO THE 2010 VERSION; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF JACKSON, WYOMING, IN REGULAR SESSION DULY ASSEMBLED THAT: SECTION I. Section 2 of Town of Jackson Ordinance No. 830, Section 1 of Town of Jackson Ordinance No. 392 and Section of the Municipal Code of the Town of Jackson, Wyoming, are hereby amended and reenacted to read as follows: Basis for establishing the areas of special flood hazard. The areas of special flood hazard identified by the Federal Emergency Management Agency in a scientific and engineering report entitled The Flood Insurance Study for Teton County, dated August 5, 2010, with an accompanying Flood Insurance Rate Map (FIRM) are hereby adopted and declared to be a part of this chapter. The Flood Insurance Study and FIRM are on file at the office of the Town of Jackson Planning & Building Office, 150 East Pearl Avenue, Jackson, Wyoming. SECTION II. All ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION III. If any section, subsection, sentence, clauses, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate and distinct and independent provision and such holding shall not affect the validity of the remaining portions of the ordinances.
