4 Welcome to Mortgage Payment Protection We are delighted to welcome you as a Mortgage Payment Protection customer. This policy is underwritten by Pinnacle Insurance plc. This policy explains: your cover; any exclusions; how to contact Pinnacle Insurance plc to make a claim; and how to contact Wessex Group for any other reason. We strongly recommend that you read your policy to understand the full terms and conditions and keep it in a safe place. If you have not made a claim under this policy your policy will be cancelled and any premium(s) paid will be refunded. Thereafter you may cancel your cover under this policy, however no refund of premium will be payable. If we change your premium and/or vary or waive your terms and conditions and you do not wish to continue your cover you should contact Wessex Group to discuss your options. Depending on the type of policy you have, you may be able to change your monthly benefit or change your type of cover. Alternatively you can cancel without notice and without penalty. Any cancellation will take effect at the end of the period for which you have already paid your premium. 5 Important 1 Schedule This shows the premium, monthly benefit and specific details about the cover you have selected. 2 Changing circumstances and incorrect information If any information on which this insurance is based is incorrect or your circumstances change you must contact Wessex Group as soon as possible. Failure to do so may result in your insurance no longer being valid and claims not being met. If you are in doubt about any change, please inform Wessex Group. If your policy is amended as a result of any change, we will be entitled to vary the premium and terms for the rest of the period of insurance. You will be notified of any variation in premium or policy terms and you should keep a record (including copies of letters) of all information supplied to Wessex Group in connection with this insurance. Examples of changes of circumstances are: changes to your occupation or type of work changes to your employment status changing your address 3 Understanding the cover It is important you understand your insurance cover. You will have chosen one of the following benefit payment options when applying for cover: (i) Standard cover; or (ii) Back to Day One cover. Please see your schedule for details of the cover you have selected. Also, please read carefully the What we insure Section on page 5 and the Meaning of words Section on pages 3 and 4. 6 Meaning of words Certain words in your policy are important or have a specific meaning, which we print in italics. Accident Any bodily injury which prevents you from doing your normal occupation (or any job which you are reasonably able to do, given your experience, education or training) and for which you are receiving treatment from a doctor. If you are self-employed, you must not be receiving any form of payment or be helping, managing or carrying on any part of the running of the business whilst you are claiming. Ceased Trading Where you as a self-employed person find it impossible to continue trading as you have insufficient assets to meet your debts and liabilities and close your accounts through appointing a Chartered or Certified Accountant or Insolvency Practitioner. Your accounts include all your personal, sole trading, partnership and company accounts. You will also be asked whether final accounts have been placed with the HM Revenue & Customs. Condition Any sickness, disease or injury (or symptoms of any of these) whether or not it results in a diagnosis. Consultant A medical specialist registered under the Medical Act 1983 (as amended) who is a member of a Royal College (for example, the Royal College of Surgeons) and is recognised by that Royal College to be a consultant. It does not include your spouse, civil partner, a relative or someone who lives with you. Doctor A qualified Medical Practitioner registered with the General Medical Council and practising in the United Kingdom. A doctor who confirms your accident or sickness during your claim cannot be you, a spouse or registered civil partner, a relative or someone who lives with you. Employment or Employed Working for remuneration under a PAYE contract of service for an employer, which has no fixed finish date other than retirement. Existing Borrower If you applied for this insurance more than 60 days after your mortgage completion date. Fixed-term Contract Any paid work which has a fixed finish date. Hospital An institution providing 24-hour medical and surgical treatment and nursing care for ill or injured people (excluding rest, nursing or convalescent homes). Hospitalisation or Hospitalised A period of time when you are admitted to hospital, because of an accident or sickness. Immediate Family Your spouse, civil partner, partner of the same or opposite sex who you currently live with and have lived with for a continuous period of at least 1 year, parent or child. Monthly Benefit The monthly benefit shown in your schedule. This monthly benefit cannot be more than 2,000. If you are joint insured, the monthly benefit payable will be the amount shown in your schedule. New Borrower If you applied for this insurance when taking out your mortgage or within 60 days of your mortgage completion date. Normal Pregnancy Symptoms which normally accompany pregnancy which are of a minor and/or temporary nature (such as morning sickness and dizzy spells) and which do not represent a significant medical hazard to mother or baby. Period of insurance From the start date to the date your cover ends as set out in the Duration of cover Section. Premium The amount you pay each month shown in your schedule. Schedule The document accompanying this policy which confirms your insurance cover and shows the monthly benefit. Self-employed You are self-employed if you are working: as a sole trader; as a partner in a partnership and liable to pay tax under Schedule D; in a Company where you can control the affairs of that Company because either you or a connected party, relative or spouse, individually or jointly, hold a majority of the voting rights in that Company; in a Company where you are able to ensure the Company you work for conducts its affairs according to your wishes. 3

7 Sickness Any illness or sickness which prevents you from doing your normal occupation (or any job which you are reasonably able to do, given your experience, education or training) and for which you are receiving treatment from a doctor. If you are self-employed, you must not be receiving any form of payment or be helping, managing or carrying on any part of the running of the business whilst you are claiming. Start date The date your insurance cover begins as shown in your schedule. Temporary Work Any period of paid work undertaken while you are claiming under this policy for which you have a contract for up to a maximum of 365 days. Unemployed or Unemployment If you were previously employed means: not having paid work; and being available for work and registered as such with the Department for Work and Pensions Jobcentre Plus or equivalent in Northern Ireland; and providing material proof to us during the claim that you are available for and actively looking for work. This is a requirement over and above that of the Department for Work and Pensions Jobcentre Plus. If you were previously self-employed means: having permanently ceased trading (as confirmed to us by your Accountant and HM Revenue & Customs); and not having any paid work; and being available for work and registered as such with the Department for Work and Pensions Jobcentre Plus or equivalent in Northern Ireland; and providing material proof to us during the claim that you are available and actively looking for work. This is a requirement over and above that of the Department for Work and Pensions Jobcentre Plus. Wait Period The number of consecutive days at the beginning of a claim, shown in your schedule, which you must wait before you are eligible for any benefit. We, our or us Pinnacle Insurance plc is the underwriter and claims administration provider of this policy. Wessex Group Wessex Group is a trading name of WIMS Limited, a company registered in England and Wales with registered number and registered office Jewry House, Jewry Street, Winchester, Hampshire SO23 8RZ, who is our administration provider for policy queries, amendments and cancellations. You or your The person or persons named in the schedule as the insured. Eligibility You are eligible for this insurance if, at the start date, you meet the following conditions (the start date appears on your schedule): you have a mortgage agreement for property you occupy as your home; you work and live in the United Kingdom (including working for a UK registered company in other European Union countries for not more than 180 days a year); you must have the right to live in the United Kingdom; you are in employment or self-employment and have been continuously for the last 6 months at least 16 hours each week; you are at least 18 and less than 65 years old; and you comply with other eligibility requirements* which may apply at the time of your application and will be explained at that time. These requirements will not affect you if you are already covered under this policy. *This may include extending the length of time you must have been working for, prior to the start date, to beyond that stated in the 4 th bullet point above. 4

8 The cover...what we insure Accident and Sickness Cover Your schedule will show if you have chosen this cover and whether you have chosen Standard or Back to Day One cover. Standard cover If you are unable to work due to an accident or sickness for longer than the wait period, we will pay 1/30 th of your monthly benefit for each further day that you are still unable to work. Back to Day One cover If you are unable to work due to an accident or sickness for longer than 30 consecutive days, we will pay one monthly benefit after the first 30 days of accident or sickness. Thereafter, we will pay 1/30 th of your monthly benefit for each further day you are unable to work due to an accident or sickness. You will receive this monthly in arrears, until: you return to employment; you are certified by a doctor as being fit to work; we have paid the maximum number of monthly benefits shown in the schedule for any claim; the cover finishes as described in the Duration of cover Section; whichever is the earlier. Pregnancy and Childbirth - we will pay benefit for any accident or sickness resulting from any symptom(s) of, or complication(s) of pregnancy and childbirth which a doctor certifies prevents you from working, and which is not excluded under any other exclusions listed in this policy. However no benefit will be payable for normal pregnancy and childbirth related conditions. We will treat periods of accident or sickness caused by the same, underlying or directly attributable medical condition, separated by less than 3 months, as one continuous period of accident or sickness. Hospitalisation Cover If at the start of your accident or sickness you are hospitalised as an in-patient for longer than 3 consecutive days, we will pay 1/30 th of your monthly benefit for each further day that you are still hospitalised. You will receive this monthly in arrears until: you return to employment; you are certified by a doctor as being fit to work; we have paid the maximum number of monthly benefits shown in the schedule for any claim; the cover finishes as described in the Duration of cover Section; whichever is the earlier. Hospitalisation Cover Cont\... Pregnancy and Childbirth - we will pay benefit for any hospitalisation resulting from any symptom(s) of, or complication(s) of pregnancy and childbirth which a doctor certifies prevents you from working, and which is not excluded under any other exclusions listed in this policy. However no benefit will be payable for normal pregnancy and childbirth related conditions. Unemployment Cover Your schedule will show if you have chosen this cover and whether you have chosen Standard or Back to Day One cover. Standard cover If you are working or on statutory maternity leave and become unemployed for longer than the wait period, we will pay 1/30 th of the monthly benefit for each further day that you remain unemployed. Back to Day One cover If you are working or on statutory maternity leave and become unemployed for longer than 30 consecutive days, we will pay one monthly benefit after the first 30 days of unemployment. Thereafter, we will pay 1/30 th of your monthly benefit for each further day you remain unemployed. You will receive this monthly, in arrears until: you return to employment; we have paid the maximum number of monthly benefits shown in the schedule for any claim; the cover finishes as described in the Duration of cover Section; whichever is the earlier. If you are unemployed as the result of you becoming a carer, we will consider an unemployment claim if you can provide evidence that you are/were: required to care for a member of your immediate family; in receipt of Carer s Allowance; and not aware that it is a possibility that you will have to leave paid employment to become a carer prior to the start date. If you return to work and become unemployed or cease trading within 3 months we will treat this as one continuous claim. We will not pay for any time when you are working between these periods. If the two periods are separated by more than 3 months you must return to work for a total of 3 continuous months before you make another claim. 5

9 The cover...what we do not insure Specific Accident, Sickness and Hospitalisation exclusions You will not receive any monthly benefit unless you get written proof from a doctor that you are unable to work. You will not receive any monthly benefit for any accident, sickness or hospitalisation for any condition: which you knew about (or ought reasonably to have known about) on the start date; for which you sought or received advice, treatment or counselling from any doctor during the 12 months immediately before the start date. However, this exclusion will not apply and we will pay the monthly benefit if: you have been continuously insured under this policy; and you have been symptom free and have not consulted a doctor or received treatment for the condition in the 12 months immediately prior to your claim. You will not receive any monthly benefit for any accident, sickness or hospitalisation which arises while you are working outside the United Kingdom (unless working for a UK registered company in other European Union countries for not more than 180 days a year). Specific Unemployment exclusions You will not receive any monthly benefit for any unemployment: that arises or you are notified of within 60 days of the start date if you are a new borrower or 120 days of the start date if you are an existing borrower. If, immediately prior to the start date, you have an existing policy providing cover in the event of accident, sickness or unemployment with a company other then us, and that policy is cancelled in place of this one, this exclusion will not apply; which, before the start date, you knew was going to happen or which was likely to happen; which is normal or seasonal in your line of work; which arises while you are working outside the United Kingdom (unless you were working for a UK registered company in another European Union country for not more than 180 days a year); where you have not been working continuously for the 6 months immediately before the start of any period of unemployment; where you have not been working for at least 16 hours each week; that arises because of you: accepting voluntary redundancy; resigning or retiring; being dismissed for any reason which your employer was entitled to dismiss you for without giving notice; that arises because of you coming to the end of a fixed-term contract, except as shown on page 8; that arises because of you coming to the end of seasonal work or a casual, temporary or temporary agency contract other than as set out under the Temporary work Section; that arises where you were self-employed and you cannot produce satisfactory proof that you have ceased trading; for which you have received payment instead of notice; that arises where you were self-employed and you voluntarily wound up your business affairs or voluntarily ceased trading. 6

10 General exclusions You will not receive monthly benefit for any accident, sickness, hospitalisation or unemployment caused by: any deliberate or reckless act which results in you injuring yourself; alcohol abuse or being under the influence of alcohol; being under the influence of drugs (unless the drugs are prescribed by a doctor, other than for treating drug addiction); any crime for which you are convicted; any riot or disturbance which you take part in, or any strike, labour dispute or industrial action you are involved in; war, revolution, act of foreign enemy, terrorism, or any similar event; the radioactive toxic explosive or other dangerous properties of any nuclear assembly or any part of it, ionising radiation or contamination by radioactivity from any nuclear waste or from the combustion of nuclear fuel; any condition of a mental or nervous origin including stress, anxiety, depression (unless a suitably qualified consultant certifies that the condition prevents you from working, or you have been referred to, and receive ongoing treatment from an appropriate medical specialist on the recommendation of your doctor); backache or a related condition where there is no physical or radiological evidence (for example an MRI) of a medical abnormality (unless a suitably qualified consultant certifies that the condition prevents you from working, or you have been referred to, and receive ongoing treatment from an appropriate medical specialist on the recommendation of your doctor). You will not be entitled to receive monthly benefit while you are living outside the United Kingdom. If we make any payments to you as a result of your dishonest or exaggerated behaviour (or the dishonest or exaggerated behaviour of someone acting on your behalf) you will no longer be entitled to any benefits under this policy and we may demand that any payments you have received from us are paid back. We may take legal action against you for the return of such monies and we may demand that you reimburse us for any investigation costs reasonably incurred. Making a claim If you have a claim, tell us as soon as you can and we will send you a claim form. The address and telephone number are: Cardif Pinnacle* Claims Department PO Box 563 Borehamwood Hertfordshire WD6 2YQ Telephone: When you contact us about a claim, you will need to tell us: your name, address and telephone number(s); your policy number; details about the claim. 1 In the claim form there are important declarations for you to sign and return, please do so as soon as possible. These will include permission to approach your employer, Jobcentre Plus or doctor. 2 A delay, in submitting a claim of more than 4 months may seriously prejudice our ability to manage a claim properly. 3 You must let us have original supporting documentation, policies or medical information that we ask you for. Refusing to provide originals may seriously prejudice our ability to manage a claim properly. We reserve the right to decline such claims without such information. 4 If we want you to have a medical examination we will pay the cost. If you do not have the examination without good reason we will not pay any further benefit, and you will become responsible for any cancellation charge incurred. 5 Please ensure that you read the declaration on the claim form. 6 We may ask to visit you to assess whether we are able to help in your return to work or rehabilitation from your accident or sickness. 7 You must continue to pay the monthly premiums during the period of the claim. 8 You must continue to provide evidence as requested by us of your continuing accident, sickness or unemployment during the period of the claim. 9 We have a regulatory obligation to prevent fraud. Insurers share information with each other to prevent fraudulent claims via a register of claims. A list of participants is available on request. In the event of a claim, any information you have supplied relevant to this insurance and on the claim form, together with other information relating to the claim, will be provided to the register of claims. 7

11 Settling a claim We will consider the first day of accident or sickness to be the day the doctor first certifies your accident or sickness and confirms you are unfit to work. We will consider the first day of unemployment to be the day you first register as unemployed (if you were employed, we will not treat you as unemployed for the time you are receiving payment in lieu of notice). Accident, sickness and hospitalisation benefit cannot be claimed at the same time. We will only pay up to the maximum number of monthly benefit payments, shown in the schedule. You can transfer between an accident, sickness or hospitalisation claim and an unemployment/ carer cover claim (or vice versa) without interruption (i.e. no additional wait period will be applied), provided you do not receive more than 12 monthly benefits in total. Both claims must be valid and you will still need to have been in employment or self-employment before the first of these claims. All other terms of this policy still apply and before you can make another claim, you must satisfy the re-qualification periods specified earlier. We may delay or suspend paying your monthly benefit if we do not receive all the documents we need to manage your claim. You can cover just your basic monthly mortgage payments, or you can choose to extend your cover to include other additional expenses such as insurance premiums, utility bills or any other regular outgoings. The limit for the additional cover is up to 50% of your monthly mortgage payment. The maximum benefit we will pay each month is 2,000. If two people are on the schedule as the insured, the conditions of this policy will apply to each person separately and each person will only be covered for the amount shown in the schedule. If you have another insurance policy covering the repayments of your mortgage we will not pay more than our proportionate share of the total claim. You can cancel this insurance by contacting Wessex Group. If you do this while you are making a claim we will continue to pay the monthly benefit provided that the claim was made prior to the date on which you cancelled this insurance. You will not, however, be covered for any new claim made on or after that date. Fixed-term contract working If you work on a fixed-term contract and your contract is not renewed you will only be entitled to claim for unemployment cover if you meet one of the following criteria: you have been on a contract with the same employer for at least 12 months and had the contract renewed at least once; you have worked continuously under contract with the same employer for at least 24 months; you were originally employed on a permanent basis but were transferred to a fixed-term contract by the same employer without a break in employment; or you have been with the same employer and are under a contract which is not regularly renewable but is individually negotiated, and which has: been in force for at least 6 months; been renewed at least twice; and your contract was terminated before it was due to naturally expire. If this is the case, we will restrict payments to the period up to the original contract expiry date, subject to the terms of the policy. When making a claim you will be asked to provide documentary evidence of any fixed-term contract work and temporary work that you undertake or have undertaken. Temporary work If you undertake temporary work during an unemployment claim you must tell us: the type and length of the temporary work; and the employer s name and address. An unemployment claim may be suspended for a period of temporary work provided: you notify us before your temporary work starts; and your temporary work lasts for at least one week and no longer than 12 months, whether as one contract or a series of contracts. Once your temporary work has ended, we will continue to pay your claim as a continuation of your earlier claim up to a maximum of 12 monthly benefit payments in total, subject to the terms and conditions of this policy. If you are in temporary work with the same employer for 12 months or more and you are made unemployed, we will pay unemployment benefit as set out under the Unemployment cover Section above, subject to terms and conditions of this policy. If you have an unemployment claim but you do not submit your claim because you take temporary work, you may submit your claim once the temporary work has ended. We will then assess your claim, subject to the terms and conditions of this policy, as if you had submitted it following your initial unemployment. 8

12 Multiple Employment If you are working with more than one employer and you are made unemployed from one or more of your jobs, you will be able to claim for unemployment benefit if you are no longer working 16 hours a week or more in total. You must fulfil the definition of unemployed, however you do not have to be entirely without paid employment but you must not undertake any work other than that which you were doing prior to your claim. Claims Support Programme If you have an unemployment claim we will provide you with a Job Finder Guide and access to our Claims Support website ( which will help you in your job search. You may also be offered access to a CV rewriting service, a CD ROM, employment workshops and telephone support service. If you have an accident or sickness claim we will provide you with our Claimant Health Guide. You will also have access to our Claims Support website ( which will assist you with health updates and general information on your condition. Premiums Each premium covers you for one month. At the start of your insurance cover more than one premium may be collected to ensure you are covered for the correct period. This policy has reviewable premiums, which means that your premium may change subject to us giving you 30 days notice. When reviewing your premiums, we will only consider any future impact to one or more of the following: changes due to new information arising from our own experience suggesting that our future claims experience is likely to be better or worse than previously assumed. This information includes changes to the number of claims we expect to pay, changes to the average expected duration of our claims payments or changes to the average expected amount paid per claim; changes due to new information arising from external sources such as general industry, population or reinsurer experience suggesting that our future claims experience 9 is likely to be better or worse than previously Duration of cover The cover and your right to any monthly benefit will end if: you permanently retire from your employment or reach 65, whichever is earlier; the date you die; you pay off your mortgage or the mortgage agreement ends; a court judgment is enforced against you because you have not met your mortgage obligations; the date we cancel your insurance due to dishonest or exaggerated behaviour, misrepresentation or failure to disclose a material fact as set out under the terms of this policy; or the date you or we cancel your insurance as set out under the terms of this policy or you do not pay the premium when due. However, if you are already making a successful claim, we will continue to pay the monthly benefit provided that the event leading to your claim occurred prior to the date you cancelled your policy or the date the premium was not paid when due and cancellation was not due to dishonest or exaggerated behaviour, misrepresentation or failure to disclose a material fact. You will not be covered for any new claim arising on or after that date. You should advise us if you permanently retire before you are 65 or if you pay off your mortgage so that we may cancel this policy. assumed. Any changes to your premium we make will not: be made as a result of any reason other than changes in the assumptions mentioned above; be based on whether you have made a claim; or be made to recover any previous losses. We will review your premium at least annually and you will be given at least 30 days written notice, at your last known address, of any alteration to the premium rates under this policy

13 unless the change is due to legislative, tax or regulatory requirements. If your premium is changed due to legislative, tax or regulatory requirements which are outside our control, then we may not be able to give you 30 days notice. We may review your premium more frequently than annually if it becomes necessary due to significant changes in any of the assumptions referred to above. Except where your premium is changed due to legislative, tax or regulatory requirements, the minimum period between consecutive premium changes will be 180 days. As a result of the premium review, your premium may go up, stay the same or go down, and there is no limit to the amount of any change. If we change your premium and you do not wish to continue your cover you should contact Wessex Group to discuss your options. Depending on the type of policy you have, you may be able to change your monthly benefit or change your type of cover. Alternatively you can cancel as set out in the Your right to cancel Section above. You must continue to pay your premium while you are making a claim under this policy to ensure that cover can continue after your claim has ended. If, during a claim, you cancel your policy or fail to pay the premium when due, we will continue to pay the monthly benefit provided that the claim was made prior to the date on which you cancelled or first failed to pay the premium when due. You will not, however, be covered for any new claim made on or after that date. Increasing the benefit If you wish to increase your monthly benefit please notify Wessex Group. Any changes will apply from the date we accept your application for the increase. You cannot increase the amount of monthly benefit while you are making a claim. The following exclusions will apply to the increase in monthly benefit. You will not receive any increased monthly benefit for: any period of unemployment which happens within 60 days, or if you are self-employed, which starts within 60 days of the date of the increase in monthly benefit. Please refer to your new schedule for details; any period of unemployment which you knew, before the date of the increase in monthly benefit, was going to happen; any period of accident and sickness, or any underlying or directly attributable medical condition for which you received medical treatment or medical advice during the twelve months before the date of the increase in monthly benefit; or any period of accident and sickness, or any underlying or directly attributable medical condition, which you were aware of or should reasonably have been aware of during the twelve months before the date of the increase in monthly benefit. Our right to cancel We may cancel your insurance cover immediately: where there is evidence of your dishonest or exaggerated behaviour (or dishonest or exaggerated behaviour by someone acting on your behalf) in relation to the cover provided under this policy; where you have failed to make disclosure of a material fact which, if disclosed at the time of application, would have caused us to decline you for cover; where you have misrepresented a material fact which, if correctly represented at the time of application, would have caused us to decline you for cover; or where necessary to comply with any applicable laws or regulations. We may cancel your insurance cover by giving not less than 90 days written notice: in the unlikely event that for any of the reasons listed in the Premiums Section above we expect to experience unsustainable losses for the particular country or market sector that applies to your policy; or if we decide for reasons of strategy or cost that it is no longer viable for us to continue to provide cover within the particular country or market sector that applies to your policy. Except in cases of dishonest or exaggerated behaviour, misrepresentation or failure to disclose a material fact, any decision to cancel cover will not be made at an individual level and will not be based on whether you have made a claim. 14 Terms and conditions We may vary or waive the terms and conditions of this policy to reflect changes in the assumptions set out in the Premiums Section above which we use to design and price your cover. Such changes may have the effect of increasing or reducing the cover previously provided under this policy. When changing your terms and conditions we will only consider any future impact of changes in assumptions due to the reasons set out in the Premiums Section above. In addition, we may also vary or waive your terms and conditions to: improve your cover; comply with any applicable laws or regulations; reflect any changes to taxation; correct any typographical or formatting errors that may occur. You will be given at least 30 days written notice to your last known address of any alteration to the terms and conditions of cover under this policy unless the change is due to legislative, tax or regulatory requirements. If your cover is changed due to legislative, tax or regulatory changes which are outside our control, then we may not be able to give you 30 days notice. Except where the terms and conditions of cover under this policy are changed due to legislative, tax or regulatory changes, the minimum period between consecutive changes will be 180 days. The parties to this policy agree to irrevocably submit to the jurisdiction of the courts of England and Wales unless you live in Scotland or Northern Ireland, in which case you will be entitled to commence legal proceedings in your local courts. Unless agreed otherwise, we will communicate to you in English. The rights given under this policy cannot be transferred to anyone else. When your cover under this policy ends it will not have a cash value. To improve the quality of our service, we will be monitoring and recording telephone calls. We are covered by the Financial Services Compensation Scheme (FSCS). If we are unable to meet our liabilities you may be entitled to compensation from the FSCS.
