While attending Kean University, Mr. Rinaldo worked in a law firm in Elizabeth, New Jersey, where he gained invaluable experience in the practice of law and the importance of a lawyer s obligations to his clients. After completing law school, he continued to work for Rinaldo and Rinaldo Law Group LLC until 2005, eventually opening his own practice with offices in Brooklyn and the Bronx and, in 2006, in Union, New Jersey. 3 Every day, people are injured through no fault of their own, suffering pain, disability, and impairment due to the negligence or harmful acts of others. These victims have the right to file claims to recover what they lost through those injuries. In addition, the ability to recover damages in a personal injury case helps to protect others from negligent acts and dangerous conditions. The following sections describe why personal injury lawsuits are filed, which may include auto accidents, faulty or harmful products, dog bite injuries, construction accidents, slip and fall, medical malpractice, and wrongful death claims. AUTO ACCIDENTS Auto accidents are the leading cause of death for Americans under the age of thirty-four and cause a total of more than 35,000 deaths per year. Almost everyone is likely to be involved in an auto accident at least once in their lifetime. Auto accidents frequently cause injuries such as whiplash, head and brain injuries, paralysis, and joint, bone, and muscle injuries. To successfully show an injury was caused by the accident, it is important to seek treatment as soon as possible after the accident occurs. The longer you delay, the more difficult it may be to prove the accident caused the injury. Most auto accidents are promptly handled by the insurance company of each party. But when there are serious injuries or extensive property damage, it may be necessary to file a lawsuit to recover the additional costs of medical treatment, loss of property, and lost wages. The sooner you receive legal advice after an accident, the better. PRODUCTS LIABILITY People are injured and even killed by unsafe products every day, causing tens of millions of dollars in losses and damage every year. The manufacturer of a product may be held liable when: The product injures someone or causes damage to property, especially when the injury was caused by flawed manufacturing or a poor design. A manufacturer or distributor fails to warn users about potential dangers in the product, or about how to use the product properly and safely. DOG BITE INJURIES Of the 4.7 million people injured by a dog bite each year, approximately 800,000 require medical treatment often involving an average hospital stay of more than three days. Each year, an average of ten to twenty people, including a number of children, actually die due to serious dog bite injuries. Dogs will bite for any number of reasons, including fear and territorial instincts, mistreatment, or aggressiveness. More than half of all fatal dog bites involve pit bull and Rottweiler breeds.

4 CONSTRUCTION ACCIDENTS The most common construction accidents are due to falls, usually related to scaffolding, faulty ladders, or improper flooring. Other accidents involve electrocution, being struck by falling materials or equipment, or floor or roof collapses. Your legal position as a victim of a construction accident will depend on the circumstances. If you were injured as a bystander, you could file a claim against the general contractor of the project. If you were a worker, you generally will file a workers compensation claim, unless you were an employee of someone other than the responsible general contractor. Workers compensation laws are designed to protect workers who are injured on the job, by providing a way for the injured worker to be compensated for the losses caused by his injury. If you are injured at work, you must follow certain workers compensation procedures to protect your rights under the law, and to improve your chances of recovering damages in full for your injury. Under certain circumstances, in addition to workers compensation benefits, you may also be able to file a lawsuit to seek damages for your injuries. SLIP & FALL INJURIES Studies show that slipping or tripping in some way causes more than half of all falls. Tripping can be due to an object or debris on the walking surface, a design flaw in sidewalk or floor materials, or a surface made slippery by weather or a spill. In a large percentage of slips and falls outside the home, other parties can often be held responsible for the unsafe conditions in some way. If your accident occurred on public property, you must usually notify the appropriate governmental entity, such as the city, within a short time period. If you fail to do so, you could forfeit your right to recover damages. Since slip-and-fall lawsuits are so subjective, they are usually decided by common sense. It may also be difficult to prove responsibility if several parties such as tenants, managers, landlords, and custodians are involved. To win a slip-and-fall injury case, it s necessary to show that the owner of the premises caused the damage to the walking surface, knew of the danger and ignored it, or should have known about and corrected the danger as a reasonable person would have. MEDICAL MALPRACTICE A medical malpractice suit is a legal claim filed against a doctor or other medical professional who causes injury to a patient in any of several ways, including: Failing to diagnose or treat a condition properly Not following standard procedures and practices Using defective drugs or equipment Administering or prescribing the wrong medication Causing an injury during birth Making a surgical error Willful and malicious abuse, as in a nursing home To recover compensation in a medical malpractice suit, it s necessary to prove: The physician or medical professional actually had a duty to provide care to the injured person The physician failed to provide care, according to accepted standards The improper care directly caused the injury to the patient The extent and nature of the injury WRONGFUL DEATH CLAIMS Wrongful death claims seek compensation for losses resulting from the death of a family member, such as a spouse, parent, or child.
