This document does not form part of the contract between us. English law applies to the contract. The contract is made up of:- the policy, which gives full details of the terms and conditions; the schedule, which shows the period of insurance, sections and sums insured that apply to the policy; the statement of insurance, which details the information provided to us that has been used to determine the terms and conditions of your insurance. Our Commercial Combined policy offers cover for those risks that do not readily fit into our standard package policies, such as multi premises and warehouse risks. You choose the covers that are needed for the risk concerned. Cover is available for Stock, Trade Contents, Buildings, Employer s Liability, Public, Products and Property Owners Liabilities, Business Interruption, Glass, Money, Goods in Transit, Deterioration of Stock, Loss of Licence and Book Debts. You choose the sums insured; it is your responsibility to ensure that all the sums insured are adequate. In the event of a claim, if the sums insured are inadequate, then we may not be able to meet all of your claim. All Premises should at least meet our minimum level of security or other security measures agreed by us. The policy is subject to special conditions being met in respect of risk improvements, alarms, safes and keys. The policy is subject to 250 excess unless otherwise stated.
2 Features, Benefits and (Cover) Material Damage Provides cover for your stock, business contents, buildings or tenant s improvements for accidental loss or damage at the premises. Buildings are the buildings of your premises, including shop front and living rooms, fixtures, fittings and fixed sanitary ware, terraces, driveways, forecourts, footpaths, patios, boundary walls, gates, fences and hedges belonging to you or for which you are responsible. Tenant s Improvements are tenant s improvements which you are legally liable as tenant (not owner), landlord s fixtures and fittings, interior decorations and shop front being your property or property for which you are responsible. All risks cover including damage due to fire, flood, theft and escape of water to:- Stock; Fixtures and Fittings; Buildings; Tenant s Improvements. Architects, surveyors, consulting engineers and legal fees. The cost of removing debris, demolishing and shoring up. Replacement of locks and external doors following theft of keys. Payable where liability has been accepted under the Material Damage, or Glass section, or where liability has been accepted by the buildings insurers. We will not pay for fines or damages for breach of contract for late or non completion of order or any penalties of whatever nature. Erasure, loss, distortion or corruption of information on computer systems caused by deliberate acts by rioters or malicious persons. Accidental erasure, loss, distortion or corruption of information on computer. Glass and Sanitary Fittings Damage to fixed external or internal glass or fixed sanitary ware at your premises. Damage to glass and sanitary fittings, including damage to framework, replacing window alarm foil, lettering and embossing resulting from the breakage of glass. Cost of boarding up and provision of a temporary door consequent on the breakage of glass. Damage arising directly from repairs or alterations to the premises. Scratching or chipping of glass unless it extends through the complete fabric of the glass. External name signs. Money Loss or damage to money, cheques or other non-negotiable instruments. Money in transit, in a bank night safe, in a locked safe or in your premises during Business Hours. Money in a locked safe in your premises outside Business Hours. Delay, loss of market or any other loss arising as a consequence of loss or damage. Clerical or documentary error or omission or delivery to the wrong consignee. 100 Deterioration of Stock To cover stock in any frozen food cabinet, deep freezer, cold room, cold store, refrigerator or chilled unit. Cover against deterioration due to breakdown, failure of thermostatic device or failure of public electricity supply. Damage caused by the deliberate act or wilful neglect by you, any partner, director or employee of yours. Maintenance any claims will be subject to the appliance being inspected at least once every six months and a record of such examinations being kept. Loss of Licence Cover for the depreciation in the value of your premises as a result of the forfeiture of your licence or the refusal to renew your licence. Depreciation in value of the premises. Forfeiture or refusal to renew as a result of planning improvement, redevelopment or compulsory purchase order surrendered, reduction or redistribution of licences. Any alteration in the law regarding the issuing of licences. Any cause in your control or if you are entitled to obtain compensation under the provision of any Act of Parliament. Any extension to the licence to operate outside the standard hours for the district. Book Debt To cover the event of the insured s books or other business records being damaged whilst at the premises. Money owed to you by customers which cannot be collected following damage at your premises. The reasonable charges payable to your auditor or professional accountant for producing and certifying particulars of a claim required by us. Payable where liability has been accepted under the Material Damage section. Covering amounts for which you are legally liable to pay an employee as damages for accidental injury within the Geographical Limit. Compensation and Costs Legal Liability arising out of accidental injury to an employee. 10,000,000. Any liability for which you had or should have had motor insurance. Any claim relating to an offshore oil or gas installation or any associated vessel or structure. Public & Products Liability To cover the legal liabilities of the Business resulting from accidental injury to any person other than an employee or accidental damage to property belonging to other people. Compensation and Costs Public Liability Legal liability arising out of accidental Injury to any person other than an employee. Product Liability Sums which you become legally liable to pay as compensation for accidental injury to any person or accidental Damage to property, caused by any products supplied from Great Britain, Northern Ireland, the Isle of Man or Channel Islands and occurring in connection with the business. In respect of both public and product liability the following apply. We will not pay for any claim arising out of: Ownership, possession or use of Railway, water craft, aircraft or hovercraft. 7 Insurance Act 2015 This policy is compliant with the principles of the Insurance Act 2015 law reforms. It also incorporates an opt out which aims to promote good customer outcomes. We have opted-out of the proportionate reduction of claim remedy available to insurers under the Act. This means that in cases of non-disclosure or misrepresentation which are neither deliberate nor reckless, if we would have charged an additional premium had we known the relevant facts, we will charge that premium and pay any claims in full rather than reducing claims payments in proportion to the amount of premium that would have been charged. We believe that our additional premium approach should, in most situations, be more favourable to our customers when compared to the proportionate reduction of claim remedy. Our additional premium approach does not affect our right to apply the other remedies available under the Act for non-disclosure or misrepresentation. Cancellation Rights If you do not wish to accept your new cover, you may cancel the cover in writing within 14 days of receiving the policy or amendment to an existing policy, and you will receive a full refund provided no claim has been made.
