3 In return for payment of the premium shown in the schedule, we agree to insure you, subject to the terms and conditions contained in or endorsed on the document, against loss or damage you sustain or legal liability you incur for accidents happening during the period shown in the schedule for which you have paid, or agreed to pay, the premium. When drawing up this document, we have relied on the information and statements which you have provided in the proposal form (or declaration) on the date shown in the schedule or in any subsequent schedule issued to you. The insurance relates ONLY to those sections of the document which are shown in the schedule as being included. The contract does not give, or intend to give rights to anyone else. No-one else has the right to enforce any part of this contract. We may cancel or change any part of the contract without getting anyone else s permission. The written authority (which number is shown in the schedule) allows Anglo Pacific Consultants (London) Ltd to sign and issue this document on our behalf. Unless we have agreed otherwise with you, this contract is governed by English Law. If at any time you have any concerns regarding your contract of insurance, you should in the first instance refer to your insurance broker/intermediary or advisor, if any. However your complaint may require further investigation. If so, they will send you a written acknowledgment within 5 working days stating: How your complaint will be handled Who will handle your complaint What you need to do, if anything Your complaint will be investigated by one of their trained staff. You will be sent a detailed response within 4 weeks of receiving your complaint. If Anglo Pacific Consultants (London) Ltd cannot respond in this time they will write to you to explain and let you know when you should expect to receive a response. If you have any concerns in the meantime, you can contact the person identified on the acknowledgment letter. Further details will be provided at the appropriate stage of the complaints process. This complaint procedure is without prejudice to your right to take legal proceedings. About the Financial Ombudsman Service (FOS) Eligible complainants are: private individuals; and micro-enterprises. Micro-enterprises will be able to bring complaints to the ombudsman as long as they have an annual turnover of under EUR2 million and fewer than ten (10) employees. charities with an annual income of less than GBP1million; or a trustee of a trust with net assets of less than GBP1million. 4 The FOS will only consider a complaint if you are an eligible complainant and if: we have been given an opportunity to resolve it and we have sent you a final response letter and you have referred your complaint to the FOS within six (6) months of our final response letter or we have not responded to your complaint with a decision within eight (8) weeks. If you are unsure whether the FOS will look at your complaint please contact them directly for further information. You are entitled to contact the FOS at any stage of your complaint. Following this complaints procedure does not affect your legal rights. Financial Services Compensation Scheme (FSCS) Lloyd s and other London Company insurers, including DAS are covered by the Financial Services Compensation Scheme. You may be entitled to compensation from the Scheme if the insurer is unable to meet its obligations under this contract. Entitlement to compensation under the Scheme depends on the type of business and circumstances of the claim. Disclosure Clause (UK): The Parties are free to choose the law applicable to this Insurance Contract. Unless specifically agreed to the contrary this insurance shall be subject to English Law. Contracts (Rights of Third Parties) Act 1999 Clarification Clause: A person who is not a party to this contract has no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of this contract but this does not affect any right or remedy of a third party which exists or is available apart from that Act. Data Protection Act 1998: It is understood by you that any information provided to us by you will be processed by us, in compliance with the provisions of the Data Protection Act 1998, for the purpose of providing insurance and handling claims, if any, which may necessitate providing such information to third parties. Sanction Limitation and Exclusion Clause No insurer shall be deemed to provide cover and no insurer shall be liable to pay any claim or provide any benefit hereunder to the extent that the provision of such cover, payment of such claim or provision of such benefit would expose that insurer to any sanction, prohibition or restriction under United Nations resolutions or the trade or economic sanctions, laws or regulations of the European Union, United Kingdom or United States of America Important Information for Employers: The Employers Liability (Compulsory Insurance) (Amendment) Regulations 2008 lay down certain obligations for employers and, in particular, you should be aware of the following: Display of Certificates This insurance will provide you with a Certificate of Employers Liability Insurance and this will state clearly the companies covered by the policy. You can display an original copy of the Certificate at each business premises, where your employees can see it easily or you can keep an electronic copy. If you choose to display your Certificate of Employers Liability Insurance as an electronic copy you need to ensure that your employees know how and where to find the certificate and have reasonable access to it. Retention of Certificates There is no legal requirement for you to keep copies of out of date certificates however you are strongly advised to keep, as far as possible, a complete record of your Employers liability insurance. This is because some diseases can appear decades after exposure to its cause and former or current employees may decide to make a claim against you for the period they were exposed to the cause of their illness. Employers Liability Tracing Office Notice Certain information relating to your insurance policy including, without limitation, the policy number(s), employers names and addresses (including disclosed subsidiaries and any relevant changes of name), coverage dates, employer s reference numbers provided by Her Majesty s Revenue and Customs and Companies House Reference Numbers (if relevant), will be provided to the Employers Liability Tracing Office, (the ELTO ) and added to an electronic database, (the Database ). This information will be made available in a specified and readily accessible form as required by the [Employers Liability Insurance: Disclosure By Insurers Instrument 2010]. This information will be subject to regular periodic updating and certification and will be audited on an annual basis. The Database will assist individual consumer claimants who have suffered an employment related injury or disease arising out of their course of employment in the UK for employers carrying on, or who carried on, business in the UK and who are covered by the employers liability insurance of their employers, (the Claimants ): to identify which insurer (or insurers) was (or were) providing employers liability cover during the relevant periods of employment; and to identify the relevant employers liability insurance policies. The Database will be managed by the ELTO. The Database and the data stored on it may be accessed and used by the Claimants, their appointed representatives, insurers with potential liability for UK commercial lines employers liability insurance cover and any other persons or entities permitted by law. By entering into this insurance policy you will be deemed to specifically consent to the use of your insurance policy data in this way and for these purposes. 5 Definitions These definitions apply throughout the policy booklet. Where we explain what a word means that word will be highlighted in bold print and will have the same meaning wherever it is used in the policy (unless stated otherwise). Application of heat Loss or damage to property arising out of the use of blow lamps blow torches flame guns hot air guns electric oxy-acetylene or other welding or cutting equipment and angle grinders. Asbestos Asbestos or asbestos fibres or derivatives of asbestos or any material containing asbestos. Bodily injury A physical injury caused by an identifiable accident which within 12 months of the accident results in death disability or loss described under. Business The activities set out in your policy schedule under Business Description conducted by you at or from premises in Great Britain Northern Ireland the Channel Islands or the Isle of Man and in respect of sections one and two only shall include: a) the provision and management of canteen sports social or welfare organisations for the benefit of employees and fire security first aid medical and ambulance services b) private work undertaken with your prior consent by employees for any of your directors or senior officials c) the ownership maintenance and repair of such premises. Contract Any contract or works undertaken by you in the course of the business where the estimated original contract price or original cost of works does not exceed the sum insured by item 1 in the section. Employee a) any person under a contract of service or apprenticeship with you b) any person who is hired to or borrowed by you c) any person engaged in connection with a work experience or training scheme d) any labour master or person supplied by them e) any person engaged by labour only sub-contractors f) any self-employed person working on a labour only basis under your control or supervision g) any voluntary helper while working for you in connection with the business. Enclosed premises A locked building or compound bounded on each side by a substantial wall fence or similar structure and having a locked gate. Excess The amount which you must pay as the first part of each claim made. Hacking Unauthorised access to any computer or component or system or item which processes stores transmits or retrieves data. Injury Bodily injury death illness disease or nervous shock. Insured person Each of your principal s partners or directors aged 16 to 70. Loss of limb Total loss by physical separation or permanent loss of use at or above the wrist or ankle. Loss of sight Total and irrecoverable loss of sight in one or both eyes. Offshore From the time of embarkation onto a conveyance at the point of final departure from land to any offshore rig or any offshore platform and until such time of disembarkation from a conveyance onto land upon return from any offshore rig or any offshore platform. Permanent total disability Disability which having lasted for a continuous period of 2 years prevents the insured person from doing any work and that in the opinion of an independent medical referee will not improve. Policy This policy booklet, schedule, statement of fact, Proposal form, Employers Liability Certificate, and any endorsements attached or issued. Pollution or contamination a) Pollution or contamination of buildings or other structures or of water land or the atmosphere, and b) Loss damage or injury directly or indirectly caused by such pollution or contamination. Product(s) Goods or other material property sold supplied delivered installed hired out erected processed repaired altered treated or tested by you or on your behalf in the course of the business. Property applicable to Section five only Goods and tools belonging to you or for which you are responsible relating to the business shown in the schedule except for any goods specifically excluded by Section five. Statement of fact The information provided at the time of quotation or mid term alteration, any information given by you or on your behalf and any other information detailed on the proposal form. 6 Definitions (continued) Temporary total disability Disability which temporarily prevents the insured person from pursuing their normal occupation. Territorial limits A) Great Britain Northern Ireland the Channel Islands or the Isle of Man other than offshore B) member countries of the European Community other than offshore in connection with temporary visits undertaken in the course of the business by any person normally resident in the territories described in a) above C) elsewhere in the world other than offshore in respect of business journeys which do not involve manual labour or the supervision thereof. Terrorism An act of terrorism shall mean an act including but not limited to the use of force or violence and or threat thereof of any person or group(s) of persons whether acting alone or on behalf of or in connection with any organisation(s) or government(s) committed for political religious ideological or similar purposes including the intention to influence any government and or put the public or any section of the public in fear. Underground services Loss or damage to underground pipes cables or services. Vehicle Motor vehicle articulated vehicle trailer semi-trailer. Virus or similar mechanism Program code programming instruction or any set of instructions intentionally constructed with the ability to damage interfere with or otherwise adversely affect computer programs data files or operations whether involving self replication or not including but not limited to trojan horses worms and logic bombs. 7 Section one: Public and products liability 1 Indemnity We will indemnify you against all sums that you shall become legally liable to pay as damages and costs and expenses of claimants in respect of accidental: injury to any person loss of or damage to material property nuisance or trespass obstruction loss of amenities or interference with any right of way air or water wrongful arrest detention imprisonment or eviction of any person or invasion of the right of privacy occurring within the territorial limits during the period of insurance and happening (a) in connection with the business, or (b) caused by products. Limit of indemnity Our liability for all damages payable to any claimant or number of claimants as a result of any one occurrence or all occurrences of a series consequent upon or attributable to one source or original cause shall not exceed the amount stated in the schedule for any one event. Our liability for all compensation payable in respect of all claims arising out of pollution or contamination which is deemed to have occurred during the period of insurance shall not exceed in the aggregate the amount shown in the schedule as the limit of indemnity for any one event. Our liability for all damages costs and expenses payable in respect of all occurrences of terrorism and/or products during any one period of insurance shall not exceed in the aggregate the amount shown in the schedule. Costs We will in addition: pay all other costs and expenses incurred with our written consent in respect of any claim which may be the subject of indemnity under this section. pay solicitors fees incurred with our written consent for a) defence in any Court of Summary Jurisdiction of any proceedings brought against you in respect of breach or alleged breach of any statutory duty resulting in injury b) representation at a Coroners Court or Fatal Accident Inquiry in respect of any death which may be the subject of indemnity under this section. indemnify you and at your request any of your directors or employees in respect of legal costs and expenses incurred with our written consent and costs awarded against you or any director or employee arising in connection with a prosecution (including an appeal against any conviction resulting from a prosecution) as a result of an alleged offence occurring during the period of insurance under the Health and Safety at Work etc Act 1974, the Construction (Design and Management) Regulations 1994 or similar safety legislation of Great Britain Northern Ireland the Channel Islands or the Isle of Man providing that a) the proceedings relate to the health safety or welfare of persons other than employees b) we will not indemnify you in respect of i) fines or penalties ii) costs and expenses insured by any other policy. indemnify you in respect of legal costs and expenses incurred with our written consent in the defence of any criminal proceedings brought or in an appeal against conviction arising from such proceedings in respect of a breach of Part II of the Consumer Protection Act 1987 or Part II of the Food Safety Act 1990 or of Part II of the Food Safety (Northern Ireland) Order 1991 provided that a) the proceedings relate to an offence alleged to have been committed in the course of the business during the period of insurance b) we will not indemnify you in respect of i) fines or penalties ii) costs and expenses insured by any other policy. The excess as shown in the schedule. The indemnity will not apply to legal liability: 1. Injury to employees In respect of injury to any employee. 2. Property under your control In respect of loss of or damage to: property belonging to you property which is leased let rented hired or lent to or which is the subject of a bailment to you. This exclusion does apply to premises leased let rented hired or lent to you provided that the indemnity will not apply to legal liability in respect of a) loss or damage arising under agreement less liability would have attached to you in the absence of such agreement b) loss of or damage to premises caused by fire or any other peril against which a tenancy or other agreement stipulates that insurance shall be effected by or on your behalf. property comprising the permanent or temporary works undertaken by you in the course of any contract or agreement and is under your control or for which you are responsible. 3. Aircraft and watercraft Arising out of the ownership possession or use by or on your behalf of any aircraft watercraft (other than watercraft not exceeding 8 metres in length or any hand propelled boat or pontoon). 4. Vehicles Arising out of the ownership possession or use by or on your behalf of any mechanically propelled vehicle or trailer attached thereto in circumstances where compulsory insurance or security is required or where insurance is provided by another policy. 5. Rectification costs in respect of the cost or value of any works executed or replacement repair removal rectification or reinstatement thereof where legal liability arises from a defect in or the unsuitability of such works executed for the costs of remedying any defect or alleged defect in land or premises sold or disposed of by you or for any reduction in the value thereof. 6. Products/recall/refunds loss or expenditure incurred by anyone in recalling modifying disposing of or making a refund in respect of any product loss of or damage to any product or for the costs of recall removal repair alteration replacement or reinstatement of such product caused by any defect therein or the unsuitability thereof for its intended purpose any product which to your knowledge is for use in or on any aircraft missile or for aviation or aerospatial purposes or for the safety or navigation of marine craft of any sort any product which is in your custody or control loss of or damage to or the cost of removing reinstating replacing or rectifying any product under a separate previously completed contract. 7. Liability under agreement Assumed by you under agreement unless the conduct and control of claims is vested in us but indemnity shall not in any event apply to: liquidated damages fines or penalties an agreement to arrange insurance under the terms of clause of the JCT Conditions of Contract or any other Contract condition requiring insurance of a like kind liability which attaches solely by reason of an agreement relating to the performance of work outside Great Britain Northern Ireland the Channel Islands or the Isle of Man. 8. Design and advice Arising from advice instruction consultancy design formula specification inspection certification or testing undertaken or given for a fee or in circumstances where a fee would normally be charged. Pollution and contamination In respect of all pollution or contamination other than caused by a sudden identifiable unintended and unexpected incident which takes place in its entirety at a specific time and place during the period of insurance. All pollution or contamination which arises out of one incident shall be deemed to have occurred at the time such incident takes place. 10. Asbestos In any way arising from or contributed to by: inhalation or ingestion of asbestos exposure to or fear of the consequences of exposure to asbestos the presence of asbestos in any property or on land investigating managing removing controlling or remediation of asbestos. 11. Hazardous locations Arising in connection with work undertaken in or on: aircraft or watercraft airport or aerodrome runways maneuvering areas or aprons or those parts of airports or aerodromes to which aircraft have access railways or railway installations docks piers or harbours quarries mines or collieries chemical or petro-chemical works oil refineries gas works or fuel storage facilities power stations or nuclear plant bridges viaducts tunnels dams chimney shafts blast furnaces towers or steeples unless otherwise agreed by us and noted in the statement of fact. 1. Additional persons insured In the event of the death of any person entitled to indemnity under this section we will indemnify in the terms of this section the deceased s legal personal representatives but only in respect of liability incurred by such deceased person. at your request we will indemnify in the terms of this section a) any principal in respect of liability arising out of your performance of any agreement entered into by you with the principal to the extent required by such agreement b) any of your directors or employees in respect of liability arising in connection with the business provided that you would have been entitled to indemnity under this section if the claim had been made against you c) any of your officers committees or members canteen sports social or welfare organisations fire security first aid medical or ambulance services in their respective capacities as such d) any of your directors or senior officials in respect of private work undertaken by any employee for such director or senior official provided that i) each such person shall as though they were you observe fulfil and be subject to the terms of this section insofar as they can apply ii) we shall retain the sole conduct and control of all claims iii) where we are required to indemnify more than one party the total amount of indemnity payable to all parties in respect of damages shall not exceed the limit of indemnity. 2. Defective premises act We will indemnify you for legal liability in respect of injury loss or damage arising solely by reason of Section 3 of the Defective Premises Act 1972 or Article 5 of the Defective Premises (Northern Ireland) Order 1975 in respect of any premises previously owned for purposes pertaining to the business and since disposed of by you is included within the terms of the indemnity provided in this section. Indemnity will not apply if you are entitled to indemnity under any other insurance. Contractors Policy Wording

Cross liabilities If more than one insured is referred to in the schedule this section shall apply to each one as if a separate policy had been issued to each provided that the total amount of indemnity payable to all parties in respect of damage shall not exceed the limit of indemnity. 4. Compensation for court attendance In the event of any of the undermentioned persons attending court as a witness at our request in connection with a claim in respect of which you are entitled to indemnity under this section we will provide compensation to you at the following rates per day for each day on which attendance is required: a) any of your directors or partners 250 b) any employee Contingent Motor Liability Notwithstanding what is not covered 4 of Section 1 we will indemnify you in the terms of this section against legal liability in respect of injury loss or damage arising out of the use in connection with the business of any motor vehicle not owned or provided by you. The indemnity will not apply to legal liability: a) in respect of loss of or damage to any such vehicle or to goods conveyed therein or thereon b) in respect of injury loss of or damage arising whilst such vehicle is being i) driven by you ii) driven with your or your representatives general consent by any person who to your or your representatives knowledge do not hold a licence to drive a vehicle unless such person has held and is not disqualified from holding such a licence iii) used elsewhere than in Great Britain Northern Ireland the Channel Islands or the Isle of Man c) in respect of which you are entitled to indemnity under any other insurance. 6. Data protection act We will indemnify you in respect of liability arising under the Data Protection Act 1998 or any subsequent legislation amending revising or replacing such act. Provided that: a) the process of registration under the above Act has been commenced or completed by you and the application has not been refused or withdrawn b) no liability arises as result of the provision by you of the services of a computer bureau Our total liability including all costs and expenses in this respect shall not exceed 250,000 during any one period of insurance. We shall not be liable in respect of: the recording or provision of data for reward or for determining the financial status of any person any liability which arises as a result of a deliberate act or omission by you and which could reasonably have been expected by you having regard to the nature and circumstances of such act or omission. 7. Overseas personal liability We will indemnify you and if you so request, any of your directors, partners or any employees or their spouse against legal liability incurred in a personal capacity whilst temporarily outside Great Britain, Northern Ireland, the Channel Islands, or the Isle of Man in connection with the business. 8. Manslaughter costs We will indemnify you and if you ask any director or partner of yours or any employee against legal costs and expenses we approve in a) the course of an investigation leading to a charge of b) defending you and if you ask any director or partner of yours or any employee against criminal proceedings in connection with an offence of c) an appeal against any conviction resulting from a prosecution for manslaughter corporate manslaughter corporate homicide or culpable homicide as a result of any death happening during the period of insurance which may be the subject of indemnity under the policy prosecution costs awarded as a result of any conviction for such an offence. The maximum amount we will pay in total during any one period of insurance is 1,000,000. The indemnity will not apply to legal liability: arising out of the ownership or occupation of land or buildings. in respect of which any person referred to above is entitled to indemnity under any other insurance. We shall not be liable in respect of: the fees of any solicitor or counsel appointed by or on behalf of any person entitled to indemnity unless consent to the appointment has been agreed by us fines or penalties or the cost of implementing any remedial order or publicity order costs and expenses of an appeal unless advice has been obtained from a Queen s Counsel that such appeal has strong prospect of success costs and expenses of an appeal against any fine penalty remedial order or publicity order costs and expenses incurred as a result of the failure to comply with any remedial order or publicity order costs and expenses insured by any other policy costs and expenses of any investigation or prosecution brought other than under the laws of Great Britain Northern Ireland the Channel Islands or the Isle of Man. 10 Section two: Employers liability 1 Indemnity We will indemnify you against all sums that you shall become legally liable to pay as damages together with costs and expenses shown below in respect of injury sustained within the territorial limits during the period of insurance by any employee arising out of their employment by you in the course of the business. Limit of indemnity Our liability under this section for damages costs and expenses payable in respect of any one claim against you or series of claims against you arising out of one event shall not exceed the amount stated in the schedule or 5,000,000 in respect of claims arising from terrorism. Costs and expenses shall be deemed to mean: a) costs and expenses of claimants for which you are legally liable b) other costs and expenses incurred with our written consent in respect of any claim which may be the subject of indemnity under this section c) solicitors fees incurred with our written consent for i) defence in any Court of Summary Jurisdiction of any proceedings brought against you in respect of breach or alleged breach of any statutory duty resulting in injury ii) representation at a Coroners Court or Fatal Accident Inquiry in respect of any death which may be the subject of indemnity under this section d) legal costs and expenses incurred by you and at your request of any of your directors or employees with our written consent and costs awarded against you or any of your directors or employees arising in connection with a prosecution (including an appeal against any conviction resulting from a prosecution) as a result of an alleged offence occurring during the period of insurance under the Health and Safety at Work etc Act 1974 or similar safety legislation of Great Britain Northern Ireland the Channel Islands or the Isle of Man provided that: i) the proceedings relate to the health safety or welfare of employees ii) we will not indemnify you in respect of a) fines or penalties b) costs and expenses insured by any other policy. 1. Vehicles Indemnity in respect of any liability for which compulsory motor insurance or security is required under the Road Traffic Act 1988 as amended by the Motor Vehicles (Compulsory Insurance) Regulations 1992 and the Road Traffic (Northern Ireland) Order 1981 as amended by the Motor Vehicles (Compulsory Insurance) Regulations (Northern Ireland) 1993 or other compulsory road traffic act legislation. 2. Radioactive contamination So far as concerns the liability of any principal or liability assumed by you under agreement and which would not have attached in the absence of such agreement this section shall not apply to any liability of whatsoever nature directly or indirectly caused by or contributed to by or arising from: a) ionising radiations or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel b) the radioactive toxic explosive or other hazardous properties of any explosive nuclear assembly or nuclear component thereof. 3. Offshore Injury arising in connection with any employee while offshore. 4. Hazardous locations The indemnity will not apply to legal liability arising in connection with work undertaken in or on: aircraft or watercraft airport or aerodrome runways maneuvering areas or aprons or those parts of airports or aerodromes to which aircraft have access railways or railway installations docks piers or harbours quarries mines or collieries chemical or petro-chemical works oil refineries gas works or fuel storage facilities power stations or nuclear plant bridges viaducts tunnels dams chimney shafts blast furnaces towers or steeples unless otherwise agreed by us and noted in the statement of fact. 2 Additional persons insured In the event of the death of any person entitled to indemnity under this section we will indemnify in the terms of this section the deceased s legal personal representatives but only in respect of liability incurred by such deceased person. At your request we will indemnify in the terms of this section a) any principal in respect of liability arising out of your performance of any agreement entered into by you with the principal to the extent required by such agreement b) any of your directors or employees in respect of liability arising in connection with the business provided that you would have been entitled to indemnity under this section if the claim had been made against you c) any of your officers committees or members canteen sports social or welfare organisations fire security first aid medical or ambulance services in their respective capacities as such d) any of your directors or senior officials in respect of private work undertaken by any employee for such director or senior official provided that i) each such person shall as though they were you observe fulfil and be subject to the terms of this section insofar as they can apply ii) we shall retain the sole conduct and control of all claims. 11 Section two: Employers liability (continued) 3 Compensation for court attendance In the event of any of the undermentioned persons attending court as a witness at our request in connection with a claim in respect of which you are entitled to indemnity under this section we will provide compensation to you at the following rates per day for each day on which attendance is required: a) any of your directors or partners 250 b) any employee Unsatisfied court judgements In the event of injury to an employee sustained during the period of insurance and arising out of their employment by you in the course of the business which results in a judgement for damages being obtained by such employee or their personal representatives and which remains unsatisfied in whole or in part six months after the date of such judgement we will at your request pay to the employee or their personal representatives the amount of any such damages and any awarded costs to the extent that they remain unsatisfied provided that: a) the judgement for damages is obtained i) in a court of law within Great Britain Northern Ireland the Channel Islands or the Isle of Man ii) against a company partnership or individual other than you conducting a business at or from premises within the territories described in (a) (i) above b) there is no appeal outstanding c) if any payment is made under the terms of this clause the employee or their personal representatives shall assign the judgement to us. 5 Manslaughter costs We will indemnify you and if you ask any director or partner of yours or any employee against legal costs and expenses we approve in a) the course of an investigation leading to a charge of b) defending you and if you ask any director or partner of yours or any employee against criminal proceedings in connection with an offence of c) an appeal against any conviction resulting from a prosecution for manslaughter corporate manslaughter corporate homicide or culpable homicide as a result of any death happening during the period of insurance which may be the subject of indemnity under the policy prosecution costs awarded as a result of any conviction for such an offence. The maximum amount we will pay in total during any one period of insurance is 1,000,000. We shall not be liable in respect of: the fees of any solicitor or counsel appointed by or on behalf of any person entitled to indemnity unless consent to the appointment has been agreed by us fines or penalties or the cost of implementing any remedial order or publicity order costs and expenses of an appeal unless advice has been obtained from a Queen s Counsel that such appeal has strong prospect of success costs and expenses of an appeal against any fine penalty remedial order or publicity order costs and expenses incurred as a result of the failure to comply with any remedial order or publicity order costs and expenses insured by any other policy costs and expenses of any investigation or prosecution brought other than under the laws of Great Britain Northern Ireland the Channel Islands or the Isle of Man. 12 Section three: Contractors all risks Your schedule will show you if this cover applies. 1 Indemnity We will indemnify you by payment or at our option by reinstatement or repair in respect of loss or damage to the property insured in connection with the business. The property insured is: Item 1 - Contract works The permanent or temporary works executed in performance of the contract and materials for use in connection therewith whilst on the site of the contract or in transit by road rail or inland waterway within the territorial limits to the extent that you are responsible under the contract. Item 2 - Own plant Constructional plant tools equipment site huts or caravans including the contents thereof belonging to you for use in connection with the contract whilst on the site of the contract or in transit by road rail or inland waterway or elsewhere within the territorial limits. Item 3 - Hired in plant Constructional plant tools equipment site huts or caravans hired in by you for use in connection with the contract whilst on the site of the contract or in transit by road rail or inland waterway or elsewhere within the territorial limits. Item 4 - Employees tools Employees tools and other personal effects (not being motor vehicles precious metals precious stones or articles made therefrom or money) for an amount not exceeding 500 any one employee after the application of the excess whilst on the site of the contract and whilst in transit by road rail or inland waterway within the territorial limits. Maximum amount payable Our liability shall not exceed in respect of each Item in the schedule the limit of liability or sum insured thereon together with any escalator provision applying to such limit of liability. The excess as shown in the schedule. 1. Excluded property loss of or damage to the following: a) any mechanically propelled vehicle intended for conveyance of persons materials or plant and for which compulsory insurance or security under the Road Traffic Acts is necessary but this exclusion does not apply to any vehicle mainly intended for use at contract sites nor any vehicle used solely at contract sites and which is not licensed for road use. b) i) any aircraft ii) any watercraft (other than watercraft of less than 8 metres in length or any hand propelled boat or pontoon). c) deeds bonds bills of exchange promissory notes money stamps securities or documents of title d) any vehicle or item of plant or machinery caused by its own breakdown or its own explosion e) any existing property including any existing property being altered or repaired. 2. Defective workmanship/design The cost necessary to replace repair or rectify: a) property insured which is in a defective condition due to a defect in design plan specification materials or workmanship of such property insured or any part thereof b) property insured lost or damaged to enable the replacement repair or rectification of property insured excluded by (a) above. Exclusion (a) above shall not apply to other property insured which is free of the defective condition but is damaged in consequence thereof. For purpose of this section and not merely this exclusion the property insured shall not be regarded as lost or damaged solely by virtue of the existence of any defect in design plan specification materials or workmanship in the property insured or any part thereof. 3. Wear and tear a) loss or damage due to wear and tear or gradual deterioration rust wet or rot contamination vermin and insects b) the cost of normal upkeep or normal making good. 4. Completed works Contractors Policy Wording Loss of or damage to the permanent works or any part thereof in respect of which a certificate of completion has been issued or which has been completed and handed over to the employer/principal unless such loss destruction or damage be occasioned: i) during the period of Maintenance or Defects Liability Period and arises from a cause occurring prior to the commencement of such period ii) is in respect of materials or other insured property on site for the purpose of carrying out remedial works during the Maintenance or Defects Liability Period specified in the contract and for which you are responsible under the terms of the contract during the said Maintenance or Defects Liability Period iii) within 14 days of the time of issue of such certificate of completion and which you are required by the terms of the contract to insure. 5. Occupancy/responsibility of others Loss or damage: a) due to the use or occupancy of any portion of the permanent works by any owner tenant or occupier b) for which you are relieved of responsibility by conditions of the contract. 6. Theft and damage Theft or attempted theft or damage: a) from any unattended vehicle unless all doors windows boot and other points of access have been closed and securely locked b) from any unattended vehicle unless between the hours of 20:00 and 07:00 such vehicle is garaged within enclosed premises which are securely locked or have a watchman in constant attendance. It will be up to you to prove that any theft or attempted theft occurred before 20:00 or after 07:00. c) of tools left unattended on any site or premises where you or any employee are carrying out work in connection with the business unless the tools are stored in a securely locked building. d) of tools by any insured person or any of your employees.

13 Section three: Contractors all risks (continued) 7. Consequential loss a) liquidated damages or penalties for delay or non-completion b) consequential loss of any kind or description. 8. Shortages Loss of any property by disappearance or by shortage where such loss is revealed only by the making of an inventory or a periodic stocktaking or is not traceable to an identifiable event. 9. Pressure waves Loss destruction or damage directly occasioned by pressure waves caused by aircraft and other aerial devices travelling at sonic or supersonic speeds. 10. Terrorism Loss damage cost or expense of whatsoever nature directly or indirectly caused by resulting from or in connection with: i) any act of terrorism regardless of any other cause or event contributing concurrently or in any other sequence to the loss ii) any action taken in controlling preventing suppressing or in any way relating to any act of terrorism If we allege that by reason of this exclusion any loss damage cost or expense is not covered by this section of the policy the burden or proving the contrary shall be upon you In the event any portion of this exclusion is found to be invalid or unenforceable the remainder shall remain in full force and effect. 11. Northern Ireland Loss destruction or damage in Northern Ireland occasioned by or happening through or in consequence directly or indirectly of: i) civil commotion ii) terrorism 12. Confiscation risks Confiscation or loss of or damage to property by or under the order of any government or public or local authority. 13. Computers and systems Loss of or damage to any computer or other equipment or component or system or item which processes stores transmits or retrieves data or any part thereof whether tangible or intangible (including but without limitation any information or programs or software) and whether your property or not where such loss destruction or damage is caused by programming or operator error virus or similar mechanism or hacking including where this results from the actions of malicious persons or thieves. 14. Hazardous locations The indemnity will not apply to legal liability arising in connection with work undertaken in or on: work in or on aircraft work in or on airport or aerodrome runways maneuvering areas or aprons or those parts of airports or aerodromes to which aircraft have access railways or railway installations docks piers or harbours quarries mines or collieries chemical or petro-chemical works oil refineries gas works or fuel storage facilities power stations or nuclear plant bridges viaducts tunnels dams chimney shafts blast furnaces towers or steeples unless otherwise agreed by us and noted in the statement of fact. 14 Section three: Contractors all risks (continued) 2 Work overseas In respect of contracts outside Great Britain, Northern Ireland and the Channel Islands and the Isle of Man: a) cover by this section is limited to contracts or works where the estimated original contract price or original cost of works does not exceed 50,000 b) our maximum liability under the property insured shall not exceed 50, Debris removal / professional costs We will also reimburse costs and expenses necessarily incurred by you with our consent for: 1) a) removing debris b) dismantling and/or demolishing c) shoring up propping and fencing off d) clearing and/or repairing drains and service mains on site 2) architects surveyors and consultants fees in connection with the reinstatement of the property insured by Item 1 of the section consequent upon its destruction or damage but not for preparing any claim. 4 Sub-contractors In respect of any contract awarded under the JCT Standard Form of Building Contract incorporating the 1986 Amendment to Insurance and Related Liability provisions (or equivalent thereof) and insured under this section the following alterations to this section shall apply but only in respect of the property insured in Item 1 of the section. In respect of loss or damage to the property insured in Item 1 of the section by any of the specified perils defined in the contract it is agreed that so far as is required by the said contract we will not pursue any rights of subrogation against subcontractors provided that the sub-contractor shall as if they were you observe fulfil and be subject to the terms exclusions and conditions of this policy. 5 Indemnity to principals The section extends to include the interest of your employer/principal solely to the extent required by the conditions of the contract in force between you and your employer/principal provided always that such employer/principal shall as if they were you observe fulfil and be subject to the terms exclusions and conditions of this policy. 6 Automatic reinstatement In consideration of the sums insured not being reduced by the amount of any loss or damage you must pay an additional premium at a rate to be agreed on the amount of each claim from the date loss or damage occurs to the date of the expiry of the period of insurance such additional premium to be disregarded for the purpose of adjustment of premium in accordance with Policy Condition Immobilised plant The section extends to include the cost of recovery or withdrawal of unintentionally immobilised constructional plant or equipment whilst being used in connection with the contract.
