Contingent Commitments The Company has given Centerfield Capital Partners II, L.P., a limited partnership organized to make equity investments in a variety of corporations, a standby equity commitment of $00,000. Other Disclosures The Company s ultimate parent, Conseco, Inc. ( Conseco ) received a letter from the Congressional Committee on Energy and Commerce (the Committee ) dated May 3, 007 indicating the Committee is conducting an investigation of companies that underwrite, market, and sell long-term nursing home and home health care insurance policies. In that letter, the Committee requested various documents from Conseco with regard to long-term care insurance. Representatives from Conseco subsequently met with the Committee staffers and reached an agreement on the scope of the documents requested.
