I understand that upon the Bank's approval and acceptance of my application for the f inancing, the Bank shall issue an Approval Letter and credit the approved amount into my indicated account notwithstanding that the f inancing remains unused in the said account. It shall be deemed an agreement to me and the Bank and the f inancing facility has been concluded subject to the Terms and Conditions stated in this application and the terms stated in the Approval Letter. / Saya faham bahawa atas kelulusan dan penerimaan permohonan saya oleh pihak Bank terhadap pembiayaan ini, pihak Bank akan mengeluarkan satu Surat Kelulusan dan mengkredit jumlah pembiayaan yang diluluskan oleh pihak Bank ke dalam akaun pilihan saya tanpa mengambil kira pembiayaan tersebut tidak diguna pakai dan kekal di dalam akaun tersebut. Ianya akan dianggap sebagai satu perjanjian kepada saya dan pihak Bank dan bahawasanya kemudahan pembiayaan tersebut telah dimeterai tertakluk kepada Terma dan Syarat dinyatakan di borang permohonan ini dan terma yang dinyatakan di Surat Kelulusan. 5

I understand that I shall be bound by the Terms and Conditions stated in this application and the terms stated in the Approval Letter and no other formal documents are required to be executed between the Bank and I. In the event the Bank in its absolute discretion approves a lower amount of the f inancing than the amount stated in this application, I hereby acknowledge that the reduced amount approved and credited into the indicated account is the total amount of the financing facility applied for and granted to me by the Bank and shall not af fect the validity of the Terms and Conditions stated in this application and terms stated in the Approval Letter. / Saya faham bahawasanya saya akan terikat dengan Terma dan Syarat yang dinyatakan di borang permohonan ini dan terma dinyatakan di Surat Kelulusan dan tidak ada lagi dokumen-dokumen rasmi yang lain diperlukan untuk dipelaksanakan antara pihak Bank dan saya. 7 MAYBANK PERSONAL LOAN TERMS & CONDITION The approval of the Maybank Personal Loan (hereinafter referred to as "Facility" by Malayan Banking Berhad hereinafter referred to as "the Bank" to the Customer ( Customer ) shall be subject to the following terms and conditions made known to the Customer at the time of application of the Facility. These terms and conditions shall be binding on the Customer immediately upon approval of the Facility by the Bank. Customer Eligibility 1. This Facility is available to all eligible Customer aged between 21 years of age to 60 years of age. Interpretation 2. These terms and conditions, along with the Approval Letter and any other documents pertaining to any of the Customer's current account or savings account ( Deposit Account ) maintained with the Bank, constitute an agreement that establishes the terms and conditions in respect of the Facility. 3. The terms and conditions set forth herein are in addition and supplemental to and not in substitution for or in derogation of any other terms and conditions binding upon the Customer from time to time. 4. In the event of any conflicts, discrepancies or variances between the provisions, the Bank's decision as to which provision(s) should prevail shall be conclusive. Facility 5. The Facility is an unsecured term loan facility. 6. The Insurance coverage for Customer is optional, to cover the outstanding f inancing during the period of financing and/or term of coverage. If Customer opted for Insurance coverage, the Customer agrees to pay and authorises the Bank to deduct the Insurance premium amount upfront from the Facility prior to disbursement. The Customer may take up and maintain Insurance coverage with Etiqa or with the Bank s panel of Insurance companies or other Insurance companies of the Customer s choice approved by the Bank on such terms and conditions as the Bank may stipulate. 7. The Bank shall in addition to the Deposit Account establish a separate facility account ( Personal Loan Account ) for the Customer. The full amount ( Facility Amount ) of the Facility shall be debited from the Personal Loan Account and credited into the Deposit Account (whereupon full release of the Facility to the Customer shall be deemed to have taken place) and the Customer shall be entitled to withdraw the monies from his/her account. 8. The minimum Facility Amount is RM5,000 and in any case is subject to the Bank's sole and absolute discretion and may be varied by the Bank from time to time. The Customer may apply and maintain only one Facility at all time. The existing Facility needs to be fully settled should the Customer wishes to apply the Facility again. Payment 9. The Customer shall commence payment of the monthly instalment ( Facility monthly instalment ) within 30 days from the date of disbursement of the Facility and subsequent Facility monthly instalment shall be payable at successive intervals of one (1) month each thereafter or on such other date as shall be fixed from time to time by the Bank. 10. During the repayment period ( Facility instalment period ), the principal amount together with the interest amount shall be paid by way of equal Facility monthly instalments as set out in the Approval Letter which also sets out the Facility instalment period, monthly repayment amount and other information sent to Customer upon approval of the Facility. 11. If Customer fails to pay any Facility monthly instalment when due, or the sum owing under the Facility when demanded, the Bank shall be entitled to charge, and the Customer shall be liable to pay, additional interest charges of one percent per annum (1% p.a) on the amount in arrears calculated from overdue date till date of full monthly payment as late payment fee. 12. The Facility instalment period shall be specified by the Bank and at the selection of the Customer. The Facility monthly instalment and Facility instalment period may not be altered. 13. The Customer undertakes to make satisfactory arrangement for payments of his/her Personal Loan account in accordance with these terms and conditions in the event of his/her absence abroad. 14. The Bank shall be entitled at its absolute discretion to withdraw or terminate the Facility and demand the repayment of all sums of money owing under this Facility or vary or amend the Facility on such terms as may the Bank in its absolute discretion determine by giving twenty-one (21) calendar days prior notice to the Customer. In the event the Bank shall demand repayment of the Facility, the Customer shall be liable to pay additional default interest on the Facility amount outstanding and unpaid Facility monthly instalments after demand for repayment at such interest rate as shall be imposed by the Bank at its absolute discretion. Default interest shall accrue on a daily basis (after judgment or court order as well as before) and remaining unpaid, shall be debited to the account of the Customer at the end of every calendar month and be liable thereupon to interest at the default interest as therein provided. Default 15. The Facility is repayable upon demand by the Bank. Without prejudice to the Bank's right to recall the Facility on demand, the Bank shall have absolute discretion to recall the Facility on demand, and/or demand for full payment within (number of days stipulated as per the Bank s existing policy) days if any of the following event or events of default(s) including but not limited to the following shall occur:- (a) Default in paying the principal and/or interests and/or other monies when due and payable; (b) Presentation of a bankruptcy petition against the Customer; (c) If the Customer should become insane or deceased; (d) If the Customer commits a default under any provision of the terms and conditions governing the use of the Facility or any agreement, or security documents, or (as the case may be) relating to other accounts or credit facilities granted by the Bank; (e) If any information provided by the Customer whether in the course of making the application for the Facility or otherwise is incorrect or misleading or does not present an accurate representation of the relevant facts in a material particular as of the date at which it was provided; (f) If in the absolute opinion of the Bank, the Personal Loan Account or any other accounts the Customer may have with the Bank is not being or has not been operated satisfactorily; (g) Any other event or series of events whether related or not including but without limitation to any material adverse change in the business, assets or f inancial condition the Customer of any person providing security for the facility, act of violence, terrorism, hostility of war, national emergency, rebellion, revolution, insurrection, usurpation or occurrence of any epidemic/pandemic of whatsoever description or other calamity (whether occurring within or outside or directly involving Malaysia or any other place where the Bank may now or from time to time hereafter conduct or carry on business and whether of a national or international nature of otherwise) or other change in circumstances whatsoever has or have occurred which in the opinion of the Bank (which opinion shall be f inal and binding on the Customer):- (i) Would or might render it inadvisable or impractical for the Bank to make, maintain or fund the Facility or to continue to do so or to allow any utilization for further utilization of the Facility; or (ii) Could or might affect the ability or willingness of the Customer or any surety of person(s) providing security for the Facility to observe or comply with any obligation on the part of the Customer, such surety, any person providing security or other person(s) to be observed or complied in relation to the Facility or any other security document(s) or make it improbable that the Customer or such surety or person(s) providing security or other person(s) would be able or willing to do so. (h) If legal proceedings, suit for action of any kind whatsoever be instituted against the Customer and; (i) If any indebtedness of the Customer of any other security party referred to in clause (g) (ii) above becomes due and capable of being declared due before its stated maturity or if the Customer or any such security party goes into default under or commits a breach of any instrument or agreement relating to any such indebtedness. 7

8 Rights of Bank 16. The Bank has the right at its absolute discretion to do the following at any time whatsoever whether or not the Facility herein have been drawn down or utilized: - (a) Review the Facility at any time and from time to time irrespective of whether or not an event of default has occurred and any review, if conducted, shall be in the manner determined solely by the Bank. Any delay or omission to conduct a review shall not be construed as a waiver of the Bank's right to review nor prejudice the Bank's right to recover all monies owing. (b) At any one time hereafter to withdraw or not make available the Facility or any part thereof upon the happening of any event which in the Bank's opinion would af fect in any way the Customer s financial position and/or hinder the carrying on of the Customer s business af fairs in accordance with sound f inancial, industrial or commercial standards and practices and/or would jeopardise the Bank's position and/or which is a default in respect of any of the requirements of the Bank whatsoever at any time and from time to time and the decision of the Bank shall be final and conclusive. The Bank has the absolute discretion to decide on the implementation of this condition (whenever deemed applicable) (c) The Bank has the absolute right and discretion not to release or make available the Facility or any part thereof or to withdraw, terminate and/or recall the Facility therein granted to the Customer immediately upon the Bank becoming aware that the Customer is/are or has/have been investigated or is/are alleged to be involved and/or had committed any illegal activities or criminal of fences of any nature whatsoever or will be or have been allegedly subjected to any criminal prosecution and/or conviction and/or any security in respect of the Facility held by the Bank is subjected to or at risk of freezing, seizure and forfeiture by the Federal Government and/or other relevant authorities or regulatory bodies. In all events, the Bank s decision shall be final and conclusive. Interest Charges 17. The Bank reserves the right to vary the prescribed interest rate and the default interest rate at any time and from time to time at its absolute discretion by giving twenty-one (21) calendar days prior notice to the effective date of revision. The Bank's notice of variation may take any form, and may be given via letter to the Borrower or via Bank s website or any other manner as the Bank may deem fit. The variation shall take effect from the date specified in the Bank's notice and the decision of the Bank as to the variation in the above said rates and the date from which such variation shall take effect shall be final and conclusive. Fees and Charges 18. The Customer agrees to pay and authorises the Bank to debit the Personal Loan Account and/or Deposit Account with the following fees and charges :- (a) Late payment fee under Clause 11 above. (b) Service charges as the Bank shall at its discretion determine for its services rendered and cost and expenses incurred in respect of or arising from: (i) Customer s cheque being dishonored for payment; or (ii) A service charge of RM for each post-dated Cheque returned. (c) Legal fees (on a Solicitor and Customer basis) and other expenses incurred by the Bank in the enforcement of its rights and entitlements under this Terms and Conditions and the recovery of monies owed by the Customer to the Bank under his/her Personal Loan Account. (d) Any other reasonable fees and charges imposed by the Bank for services and facilities rendered to the Customer. 19. Notwithstanding the above provisions, the Bank may at its discretion vary the rate of such fees and charges by giving twenty-one (21) calendar days written notice to the Customer. Modification of Instalments 20. The Customer shall not be allowed to vary the Facility monthly instalment commencement date, Facility monthly instalment and Facility instalment period stipulated in the Approval Letter unless prior written approval granted by the Bank or may be given subject to such terms and conditions as the Bank may decide and impose. The decision of the Bank whether to give its approval or otherwise shall be f inal and conclusive and shall not be challenged on any grounds whatsoever. 21. If and whenever the rate of interest payable on the Facility shall be varied, the Bank may at its absolute discretion make the necessary adjustment consequent upon such variation either:- (a) by varying the Facility monthly instalment amount; or (b) by varying the number of the remaining Facility instalment period; or (c) by varying in any other manner as the Bank may deem f it. Prepayment/Cancellation 22. The Customer may pre-pay the Facility amount in part at any time. Any amount prepaid shall be considered as advance installment(s), the Bank is not liable to pay any interests on advance instalment(s). Notwithstanding that pre-payments are made the Customer shall continue to make the relevant Facility monthly instalment regularly and promptly and the Bank reserves the right at any time to recall the Facility in the event of default as stipulated in clause 15. All pre-payments made will not reduce the full Facility instalment period or interest charged. 23. If the Customer pre-pays in full or fully settles the Facility amount before first half of the expiry of the Facility instalment period, the Bank is entitled to charge RM or a sum equivalent to 3% of the outstanding balance of the Facility amount, whichever is higher as an early settlement fee. 24. Unless otherwise agreed to by the Bank, any amount prepaid may not be redrawn and shall be applied towards the Customer's payment obligation in inverse order of maturity. In the event that the amount prepaid at any time exceeded the amount drawn on the Facility, the Bank shall not be liable to pay any interest to the Customer. 25. Upon the Bank s approval of the Customer's application, the Bank will disburse the Facility amount to the Customer s individual/personal Deposit Account. Joint accounts are not allowable for this Facility. Disclosure 26. The Customer hereby authorises the Bank and/or its of f icers to:- (a) make use of, disclose, divulge or reveal any information relating to his/her Personal Loan account for purposes of or in connection with any action or proceeding taken for the purpose of recovery of monies due and payable by the Customer to the Bank under this terms and conditions. (b) the disclosure of any information pertaining to the credit standing of the Customer to any other Bank and/or financial institution(s) as is necessary in such manner and to such extent as the Bank shall consider necessary in connection with such queries and to the disclosure of the account number(s) to any other interested person(s) /party(ies). (c) disclose information to Bank Negara Malaysia regarding the Customer s Facility or the Customer's account, as may be required, whether pursuant to law or otherwise. The Bank shall not be liable whether directly or indirectly to the Customer or any other person(s) for such disclosure. Right to Set Off and Consolidate 27. The Bank may set off or transfer any monies standing to the credit of the Customer s account with the Bank of whatever description and wherever located towards the reduction and/or discharge of any sum due to the Bank under this terms and conditions without assigning reason, by giving seven (7) calendar days prior notice on its intention to set off a credit balance. Cross Default 28. The Bank has the right to cancel and recall and demand repayment of all sums due and payable in respect of other facilities granted to the Customers by the Bank including but not limited to existing Credit/Charge Card facility with the Bank if an event of default has occurred or declared against the Customer pursuant to clause (14) here of regardless of whether or not such other facilities including but not limited to the Credit/Charge Card(s) are performing facilities. Amendments of Terms and Conditions 29. The use of the Facility is subject to the terms and conditions herein contained. The Bank reserves the right at any time and by giving notice twenty-one (21) calendar days, prior or otherwise to the Customer to add, alter, delete, modify, change or vary all or any of those terms and conditions or to replace wholly or in part the Facility by another scheme, whether similar or not, or to withdraw it altogether. If any, the communication of such variations may take any form, and may be given via letter to the Customer s or via Bank s website or any other manner as the Bank may deems f it. 8

9 Approval of Facility 30. The approval of the application is conditional upon the execution, delivery and perfection of the documents required by the Bank. The Bank may refuse the application for the Facility without assigning any reason therefore. 31. The Bank may at its sole discretion approve the application for the Facility amount and the Facility instalment period specified by the Customer or such lower Facility amount and/or shorter Facility instalment period as the Bank shall sees deem fit. The Bank is not obliged to inform or notify the Customer on the lower Facility amount and/or shorter Facility instalment period prior to approval of the Facility. 32. The Customer acknowledges that the acceptance of the Facility by the Bank is completed upon the Bank issuing the Approval Letter upon the terms therein contained and crediting the approved Facility amount into the Deposit Account indicated by the Customer notwithstanding that the Facility amount remains unused in the said Deposit Account. Any differences in the Facility amount and/or Facility instalment period applied for and as finally approved shall not af fect the validity of the terms and the Customer shall be deemed to have accepted the f inancing for the Facility amount as approved by the Bank. It shall be deemed that the submission of the application for the Facility and the issuance of the Approval Letter that an agreement on the part of the Customer to borrow and for the Bank to make available the Facility has been concluded subject to the terms in the application, Approval Letter and the terms herein contained and no other formal documents are required to be executed further between the Customer and the Bank. Instalment Calculation 33. Facility Monthly Instalment is derived based on the formula:- [(P*I*N)+P]/n, Where, P = Principal Amount Borrowed, I = Interest Rate per annum, N = Total Number of Instalment in Years, n = Total Number of Instalment in Months Service of Legal Process 34. The Parties hereby agree that the service of any Writ of Summons or any legal process in respect of any claim arising out of or connected with this terms and conditions may be ef fected by forwarding a copy of the same by prepaid registered post and a copy of the same by ordinary post to the Customer's address(es) stated in the Facility application form or to such other address(es) notif ied by the Customer to the Bank from time to time. Certificate of Indebtedness 35. A certificate signed by the of f icer of the Bank as to the monies for the time being due and owing to the Bank from the Customer shall be conclusive evidence or proof that the amount appearing therein is due and owing and payable by the Customer to the Bank. Appointment of Agent(s) 36. In amplification and not in derogation of its rights under this terms and conditions, the Bank shall have the right at its sole discretion, and when it deems it necessary by giving seven (7) calendar days notice to Customer s to appoint and authorise an agent of its choice and on its behalf for the sole purpose of recovering any or all monies due and payable from the Customer to the Bank under this terms and conditions. The Customer hereby authorises the Bank to disclose any information concerning the Customer and his Personal Loan Account to any of its agents duly appointed for the purpose of recovering any or all monies due and payable from the Customer to the Bank under this terms and conditions. Indemnity 37. The Bank will not be responsible for and disclaims all liability to any actions, claims, loss, damages, costs, charges and expenses which a Customer may suffer, sustain or incur by his/her participation in the Facility. Law Applicable 38. The Facility shall be governed by and construed in accordance with the laws of Malaysia and the parties hereto hereby agree to submit to the non-exclusive jurisdiction of the Courts of Malaysia at Kuala Lumpur or the courts of such other competent jurisdiction as the Bank may in its sole discretion elect to submit and further agree that service of any legal process may be effected in the manner set out herein. SYARAT-SYARAT DAN TERMA-TERMA PINJAMAN PERIBADI MAYBANK Kelulusan untuk Kemudahan Pinjaman Peribadi Maybank (kemudian dari ini dirujuk sebagai "Kemudahan") oleh Malayan Banking Berhad, yang (kemudian dari ini dirujuk sebagai "Bank") kepada Pelanggan ( Pelanggan ) adalah tertakluk kepada terma dan syarat berikut yang telah dimaklumkan kepada Pelanggan semasa permohonan untuk Kemudahan dibuat. Terma dan syarat ini akan mengikat Pelanggan dengan serta-merta setelah Kemudahan diluluskan oleh Bank. Kelayakan Pelanggan 1. Kemudahan ini tersedia untuk semua Pelanggan yang layak, berumur antara 21 hingga 60 tahun. Tafsiran 2. Terma dan syarat ini, berserta Surat Kelulusan dan apa-apa dokumen lain berkaitan dengan mana-mana akaun semasa atau akaun simpanan Pelanggan ( Akaun Deposit ) yang dikendalikan dengan Bank, merupakan perjanjian yang menetapkan terma dan syarat berhubung dengan Kemudahan ini. 3. Terma dan syarat yang dinyatakan dalam perjanjian ini adalah tambahan kepada dan melengkapkan dan bukan untuk menggantikan atau menjejaskan mana-mana terma dan syarat lain yang mengikat Pelanggan dari semasa ke semasa. 4. Jika berlaku apa-apa percanggahan, perselisihan atau perbezaaan antara peruntukan tersebut, keputusan Bank berkaitan dengan peruntukan yang akan digunakan adalah muktamad. Kemudahan 5. Kemudahan ini ialah kemudahan pinjaman bertempoh tidak bercagar. 6. Perlindungan Insurans adalah pilihan, untuk melindungi jumlah baki pembiayaan yang belum dijelaskan semasa tempoh pembiayaan dan/atau tempoh pelindungan. Sekiranya Pelanggan memilih perlindungan Insurans, Pelanggan adalah bersetuju untuk membayar dan membenarkan pihak Bank menolak jumlah Insuran premium terlebih dahulu daripada Kemudahan sebelum pengeluaran dibuat. Pelanggan boleh mengambil dan mengekalkan perlindungan Insurans dengan Etiqa atau dengan panel syarikat Insurans Bank atau lain-lain syarikat Insuran pilihan Pelanggan yang diluluskan oleh Bank mengikut terma dan syarat seperti yang boleh tetapkan oleh Bank. 7. Sebagai tambahan kepada Akaun Deposit, pihak Bank hendaklah mewujudkan satu akaun kemudahan yang berasingan ( Akaun Pinjaman Peribadi ) untuk Pelanggan. Jumlah penuh ( Jumlah Kemudahan ) bagi Kemudahan akan didebitkan daripada Akaun Pinjaman Peribadi dan dikreditkan ke dalam Akaun Deposit (maka pengeluaran penuh Kemudahan kepada Pelanggan hendaklah dianggap telah berlaku) dan Pelanggan berhak untuk mengeluarkan wang daripada Akaunnya. 8. Jumlah minimum Kemudahan ialah RM5,000 dan dalam apa jua keadaan tertakluk kepada budi bicara tunggal dan mutlak Bank dan boleh diubah oleh Bank dari semasa ke semasa. Pelanggan boleh memohon dan mengekalkan hanya satu Kemudahan pada setiap masa. Kemudahan yang sedia ada perlu dijelaskan sepenuhnya jika Pelanggan ingin memohon Kemudahan tersebut sekali lagi. 9

10 Bayaran 9. Pelanggan hendaklah mula membuat bayaran ansuran bulanan ( ansuran bulanan Kemudahan ) dalam tempoh tiga puluh (30) hari dari tarikh pengeluaran Kemudahan, dan ansuran bulanan Kemudahan berikutnya perlu dibayar setiap satu (1) bulan berturutan selepas itu atau pada tarikh lain seperti yang akan ditetapkan oleh Bank dari semasa ke semasa. 10. Dalam tempoh pembayaran balik ( tempoh ansuran Kemudahan ), jumlah pokok berserta jumlah faedah mestilah dibayar secara ansuran bulanan Kemudahan yang sama, seperti yang ditetapkan di dalam Surat Kelulusan yang turut menetapkan tempoh ansuran Kemudahan, Jumlah pembayaran bulanan dan maklumat lain yang dihantar kepada Pelanggan setelah Kemudahan diluluskan. 11. Jika Pelanggan gagal untuk membayar mana-mana ansuran bulanan Kemudahan apabila ia tertunggak, atau jumlah terhutang di bawah Kemudahan tersebut apabila pembayaran dituntut, pihak Bank berhak untuk mengenakan kadar faedah tambahan pada kadar satu peratus setahun (1% p.a) dan Pelanggan bertanggungjawab membayar caj faedah ke atas jumlah tertunggak yang dikira dari tarikh bayaran tertunggak sehingga tarikh penyelesaian penuh yang dikira sebagai fi pembayaran lewat. 12. Tempoh ansuran Kemudahan akan ditetapkan oleh Bank dan atas pilihan Pelanggan. Ansuran bulanan Kemudahan dan tempoh ansuran Kemudahan tidak boleh diubah. 13. Pelanggan mengaku janji untuk membuat pengaturan yang memuaskan bagi pembayaran Akaun Pinjaman Peribadinya menurut terma dan syarat ini jika beliau berada di luar negara. 14. Bank adalah berhak atas budi bicara mutlaknya untuk menarik balik atau menamatkan Kemudahan dan menuntut pembayaran balik kesemua jumlah wang yang terhutang di bawah Kemudahan ini atau mengubah atau meminda Kemudahan atas terma-terma menurut budi bicara mutlak yang boleh diputuskan oleh Bank dengan memberikan notis dua puluh satu (21) hari kalendar sebelum tarikh berkuat kuasa kepada Pelanggan. Dalam keadaan di mana Bank menuntut pembayaran semula Kemudahan, Pelanggan adalah bertanggungan untuk membayar faedah ingkar ke atas jumlah Kemudahan tertunggak dan ansuran bulanan Kemudahan yang masih belum dibayar setelah tuntutan pembayaran balik dibuat pada kadar faedah yang ditentukan oleh Bank atas budi bicara mutlaknya. Faedah ingkar akan terakru atas dasar harian (selepas penghakiman atau perintah Mahkamah dan juga sebelumnya) selama mana belum dibayar, akan didebitkan ke dalam akaun Pelanggan pada akhir setiap bulan kalendar dan Pelanggan akan bertanggungan kepada faedah pada kadar faedah ingkar seperti yang diperuntukkan. Kemungkiran 15. Kemudahan perlu dibayar balik apabila dituntut oleh Bank. Tanpa menjejaskan hak Bank untuk menarik balik Kemudahan apabila diminta, Bank mempunyai budi bicara mutlak untuk menarik balik Kemudahan apabila diminta, dan/atau meminta bayaran penuh dalam tempoh (bilangan hari yang ditetapkan mengikut polisi Bank yang sedia ada) beberapa hari jika mana-mana kejadian atau kejadian mungkir berikut berlaku, termasuk tetapi tidak terhad kepada yang berikut:- (a) Mungkir dalam membayar jumlah pokok dan/atau faedah dan/atau wang lain apabila genap tempoh dan perlu dibayar; (b) Petisyen kebankrapan dikeluarkan terhadap Pelanggan; (c) Jika Pelanggan menjadi tidak siuman atau meninggal dunia; (d) Jika Pelanggan melakukan kemungkiran di bawah mana-mana peruntukan terma dan syarat yang mengawal penggunaan Kemudahan atau apa-apa perjanjian, atau dokumen sekuriti, atau (mengikut mana-mana yang berkenaan) yang berkaitan dengan akaun atau kemudahan kredit lain yang diberikan oleh Bank; (e) Jika apa-apa maklumat yang diberikan oleh Pelanggan, sama ada semasa membuat permohonan untuk Kemudahan ini atau selainnya, adalah tidak benar atau mengelirukan atau tidak merupakan pernyataan yang tepat berhubung dengan fakta berkaitan tentang butiran yang penting pada tarikh ia disediakan; (f) Jika pada pendapat mutlak Bank, Akaun Pinjaman Peribadi atau mana-mana akaun lain Pelanggan dengan Bank tidak dikendalikan dengan memuaskan; (g) Apa-apa kejadian atau rentetan kejadian lain sama ada berkaitan atau tidak, termasuk tetapi tidak terhad kepada apa-apa perubahan yang teruk dan ketara dalam perniagaan, aset atau kedudukan kewangan Pelanggan atau mana-mana orang yang menyediakan sekuriti bagi Kemudahan ini, tindakan kekerasan, keganasan, permusuhan, peperangan, darurat, penentangan, revolusi, pemberontakan, perampasan kuasa atau berlakunya apa-apa epidemik/pandemik walau apa jua jenis atau bencana lain (sama ada yang berlaku di dalam atau di luar negara atau secara langsung melibatkan Malaysia atau mana-mana tempat lain yang Bank pada masa ini atau dari semasa ke semasa selepas ini mengendalikan atau menjalankan perniagaan dan sama ada bersifat dalam negara atau antarabangsa atau selainnya) atau perubahan lain dalam apa jua keadaan sekali pun yang telah berlaku yang pada pendapat Bank (yang pendapatnya adalah muktamad dan mengikat Pelanggan):- (i) Akan atau mungkin menyebabkannya tidak wajar atau tidak praktikal bagi Bank untuk menyediakan, mengekalkan atau membiayai Kemudahan itu atau untuk terus berbuat demikian atau untuk membenarkan apa-apa penggunaan untuk penggunaan Kemudahan seterusnya; atau (ii) Akan atau mungkin menjejaskan keupayaan atau kesediaan Pelanggan atau mana-mana penjamin atau orang yang menyediakan sekuriti bagi Kemudahan ini untuk mematuhi atau menurut apa-apa obligasi di pihak Pelanggan, penjamin tersebut, mana-mana orang yang menyediakan sekuriti atau orang lain, yang perlu dipatuhi dan dituruti berkaitan dengan Kemudahan atau apa-apa dokumen sekuriti lain atau membuatkan Pelanggan atau penjamin tersebut atau orang yang menyediakan sekuriti atau orang lain tidak mungkin boleh atau bersedia untuk berbuat demikian. (h) Jika prosiding undang-undang, tuntutan mahkamah walau apa jua jenis pun diambil terhadap Pelanggan; dan (i) Jika apa-apa keterhutangan Pelanggan atau mana-mana pihak sekuriti lain yang dirujuk dalam fasal (g)(ii) di atas menjadi terhutang dan boleh diisytiharkan sebagai terhutang sebelum tempoh matangnya yang dinyatakan atau jika Pelanggan atau mana-mana pihak sekuriti tersebut melakukan kemungkiran atau melanggar mana-mana instrumen atau perjanjian yang berkaitan dengan mana-mana keterhutangan tersebut. Hak Bank 16. Bank mempunyai hak mengikut budi bicara mutlaknya untuk melakukan perkara berikut pada bila-bila masa jua tanpa mengambil kira sama ada Kemudahan ini telah dikeluarkan atau digunakan:- (a) Mengkaji semula Kemudahan pada bila-bila masa dan dari semasa ke semasa tanpa mengambil kira sama ada kejadian mungkir telah berlaku atau tidak dan apa-apa kajian semula, jika dijalankan, hendaklah dengan cara yang ditentukan sepenuhnya oleh Bank. Apa-apa kelewatan atau pengabaian untuk menjalankan kajian semula tidak boleh ditafsirkan sebagai penepian hak Bank untuk mengkaji semula mahupun menjejaskan hak Bank untuk mendapatkan kembali semua wang yang terhutang. (b) Pada satu-satu masa selepas ini, menarik balik atau tidak menyediakan Kemudahan atau mana-mana bahagiannya apabila berlaku apa-apa peristiwa yang pada pendapat Bank akan menjejaskan dalam apa jua cara kedudukan kewangan Pelanggan dan/atau menghalang pengendalian urusan perniagaan Pelanggan menurut standard dan amalan kewangan, industri atau komersil yang lengkap dan/atau akan membahayakan kedudukan Bank dan/atau yang merupakan kemungkiran berhubung dengan apa jua keperluan Bank pada bila-bila masa dan dari semasa ke semasa dan keputusan Bank adalah muktamad. Bank mempunyai budi bicara mutlak untuk memutuskan tentang pelaksanaan syarat ini (apabila dianggap sesuai). (c) Bank mempunyai hak dan budi bicara mutlak untuk tidak mengeluarkan atau menyediakan Kemudahan atau mana-mana bahagiannya atau menarik balik, menamatkan dan/atau membatalkan Kemudahan ini yang diberikan kepada Pelanggan dengan serta-merta apabila Bank mengetahui bahawa Pelanggan sedang atau telah disiasat atau dikatakan terlibat dalam dan/atau telah melakukan apa-apa aktiviti yang menyalahi undang-undang atau kesalahan jenayah walau apa jua jenis sekalipun atau akan atau dikatakan telah dikenakan apa-apa pendakwaan jenayah dan/atau sabitan dan/atau apa-apa sekuriti berhubung dengan Kemudahan yang dipegang oleh Bank mengalami atau menanggung risiko pembekuan, penyitaan dan pelucuthakan oleh Kerajaan Persekutuan dan/atau pihak berkuasa atau badan kawal selia berkaitan yang lain. Dalam semua perkara, keputusan Bank adalah terakhir dan muktamad. Kadar Faedah 17. Bank berhak untuk mengubah kadar faedah yang ditetapkan dan kadar faedah mungkir pada bila-bila masa dan dari semasa ke semasa mengikut budi bicara mutlaknya dengan memberikan notis dua puluh satu (21) hari kalendar sebelum tarikh semakan berkuat kuasa. Notis Bank tentang perubahan itu boleh diberikan dalam apa jua bentuk, dan boleh diberikan melalui surat kepada Pelanggan atau melalui laman web Bank atau melalui apa-apa cara lain seperti yang mungkin dianggap sesuai oleh Bank. Perubahan tersebut akan berkuat kuasa dari tarikh yang ditetapkan dalam notis Bank dan keputusan Bank berhubung dengan perubahan tersebut dalam kadar yang dinyatakan di atas dan tarikh berkuatkuasanya perubahan tersebut adalah muktamad. Fi dan Caj 18. Pelanggan bersetuju untuk membayar dan membenarkan Bank untuk mendebitkan Akaun Pinjaman Peribadi dan/atau Akaun Deposit dengan fi dan caj berikut:- (a) Fi pembayaran lewat di bawah Fasal 11 di atas. 10

11 (b) Caj perkhidmatan seperti yang akan ditentukan oleh Bank mengikut budi bicaranya bagi perkhidmatan yang diberikan serta kos dan perbelanjaan yang ditanggung berhubung dengan atau yang timbul daripada: (i) Cek Pelanggan tidak laku untuk membuat pembayaran; atau (ii) Caj perkhidmatan sebanyak RM10.00 untuk setiap cek lepas tarikh yang dikembalikan. (c) Fi guaman (atas dasar rundingan Peguam cara dengan Pelanggan) dan perbelanjaan lain yang ditanggung oleh Bank untuk menguatkuasakan hak dan kelayakannya di bawah Terma dan Syarat ini dan untuk mendapatkan kembali wang yang terhutang oleh Pelanggan kepada Bank di bawah Akaun Pinjaman Peribadinya. (d) Apa-apa f i dan caj lain yang munasabah yang dikenakan oleh Bank bagi perkhidmatan dan kemudahan yang diberikan kepada Pelanggan. 19. Walau apa pun peruntukan di atas, Bank boleh, mengikut budi bicaranya, mengubah kadar f i dan caj tersebut dengan memberikan notis dua puluh satu (21) hari kalendar secara bertulis kepada Pelanggan. Pengubahsuaian Ansuran 20. Pelanggan tidak dibenarkan mengubah tarikh permulaan ansuran bulanan Kemudahan, ansuran bulanan Kemudahan dan tempoh ansuran Kemudahan yang ditetapkan dalam Surat Kelulusan kecuali kebenaran bertulis terlebih dahulu diberikan oleh Bank atau mungkin diberikan tertakluk kepada terma dan syarat seperti yang boleh diputuskan dan dikenakan oleh Bank. Keputusan Bank sama ada untuk memberikan kelulusan atau sebaliknya adalah muktamad dan tidak boleh dipertikaikan atas apa jua sebab sekali pun. 21. Jika dan pada bila-bila masa kadar faedah yang perlu dibayar untuk Kemudahan diubah, Bank boleh, mengikut budi bicara mutlaknya, membuat pelarasan yang perlu mengikut perubahan tersebut sama ada:- (a) dengan mengubah jumlah ansuran bulanan Kemudahan; atau (b) dengan mengubah bilangan baki tempoh ansuran Kemudahan; atau (c) dengan mengubah dalam apa-apa cara lain seperti yang dianggap sesuai oleh Bank. Pembayaran Awal / Pembatalan 22. Pelanggan boleh membuat pembayaran awal sebahagian daripada Jumlah Kemudahan pada bila-bila masa. Apa-apa jumlah yang dibayar awal akan dianggap sebagai ansuran pendahuluan, dan Bank tidak bertanggungjawab untuk membayar apa-apa faedah ke atas ansuran pendahuluan tersebut. Walaupun pembayaran awal dibuat, Pelanggan hendaklah terus membayar Ansuran bulanan Kemudahan yang berkenaan secara tetap dan tepat pada masanya, dan Bank berhak pada bila-bila masa untuk menarik balik Kemudahan jika berlaku kejadian mungkir seperti yang ditetapkan dalam fasal 15. Semua pembayaran awal yang dibuat tidak akan mengurangkan tempoh penuh ansuran Kemudahan atau faedah penuh yang dikenakan. 23. Jika Pelanggan membuat pra-pembayaran penuh atau menyelesaikan sepenuhnya jumlah Kemudahan tersebut sebelum separuh pertama tempoh ansuran Kemudahan tersebut tamat, pihak Bank berhak mengenakan caj sebanyak RM atau jumlah yang bersamaan dengan 3% daripada baki jumlah Kemudahan yang belum dijelaskan, mengikut mana-mana yang lebih tinggi sebagai f i penyelesaian awal. 24. Melainkan dipersetujui sebaliknya oleh Bank, apa-apa jumlah yang diprabayar tidak boleh dikeluarkan semula dan akan digunakan untuk obligasi pembayaran Pelanggan mengikut aturan kematangan secara songsang. Sekiranya jumlah yang diprabayar pada bila-bila masa melebihi jumlah yang dikeluarkan melalui Kemudahan, Bank tidak akan bertanggungan untuk membayar apa-apa faedah kepada Pelanggan. 25. Setelah Bank meluluskan permohonan Pelanggan, Bank akan mengeluarkan jumlah Kemudahan ke dalam Akaun Deposit perseorangan/peribadi Pelanggan. Akaun bersama tidak dibenarkan untuk Kemudahan ini. Pendedahan 26. Pelanggan dengan ini memberi kuasa kepada Bank dan/atau pegawai-pegawainya untuk:- (a) menggunakan, mendedahkan, memberitahu atau memaklumkan apa-apa maklumat berhubung dengan Akaun Pinjaman Peribadinya untuk tujuan atau berkaitan dengan apa-apa tindakan atau prosiding yang diambil untuk tujuan mendapatkan kembali wang yang terhutang dan perlu dibayar oleh Pelanggan kepada Bank di bawah terma dan syarat ini. (b) mendedahkan apa-apa maklumat berkaitan dengan kedudukan kredit Pelanggan kepada mana-mana Bank dan/atau institusi kewangan lain seperti yang diperlukan dalam cara dan setakat yang Bank anggap perlu berkaitan dengan pertanyaan-pertanyaan sedemikian dan untuk mendedahkan nombor akaun kepada mana-mana individu/pihak lain yang berkepentingan. (c) mendedahkan maklumat kepada Bank Negara Malaysia mengenai Kemudahan Pelanggan atau Akaun Pelanggan, seperti yang mungkin diperlukan, sama ada menurut undang-undang atau selainnya. Bank tidak akan bertanggungjawab secara langsung atau tidak langsung terhadap Pelanggan atau mana-mana pihak lain berhubung dengan pendedahan tersebut. Hak Untuk Menolak-Selesaikan dan Penyatuan 27. Bank boleh pada bila-bila masa dan tanpa memberikan sebarang alasan dalam notis tujuh (7) hari kalendar, menolak-selesaikan atau memindahkan apa-apa wang yang berada pada kredit dalam akaun Pelanggan bersama Maybank walau apa pun jenisnya dan di mana jua lokasinya untuk mengurangkan dan/atau menjelaskan apa-apa jumlah yang perlu dibayar kepada Bank di bawah terma dan syarat ini Kemungkiran Silang 28. Bank mempunyai hak untuk membatalkan atau menarik balik dan menuntut pembayaran semula kesemua jumlah tertunggak dan patut dibayar berhubung kemudahan-kemudahan lain yang telah diberikan kepada Pelanggan oleh Bank termasuk tetapi tidak terhad kepada kemudahan kredit/caj kad dengan Bank sekiranya kejadian mungkir berlaku atau diisytiharkan terhadap Pelanggan selaras dengan peruntukan klausa 14 di sini tanpa mengambil kira sama ada kemudahan-kemudahan lain tersebut termasuk tetapi tidak terhad kepada kad kredit/caj, dikendalikan dengan baik. Pindaan Terma dan Syarat 29. Penggunaan Kemudahan adalah tertakluk kepada terma dan syarat yang terkandung dalam perjanjian ini. Bank berhak pada bila-bila masa dan dengan memberikan notis dua puluh satu (21) hari terlebih dahulu atau dengan cara lain kepada Pelanggan, untuk menambah, mengubah, menggugurkan, mengubah suai, menukar atau mengubah semua atau mana-mana terma dan syarat tersebut atau menggantikan keseluruhan atau sebahagian daripada Kemudahan dengan skim lain, sama ada setara atau tidak, atau untuk menarik balik Kemudahan keseluruhannya. Jika ada, pemberitahuan tentang perubahan tersebut boleh dibuat dalam apa jua bentuk, dan boleh diberikan melalui surat kepada Pelanggan atau melalui laman web Bank atau melalui apa-apa cara lain yang dianggap sesuai oleh Bank. Kelulusan Kemudahan 30. Kelulusan permohonan bergantung pada pelaksanaan, penyerahan dan penyempurnaan dokumen yang diperlukan oleh Bank. Bank boleh menolak permohonan untuk Kemudahan tanpa memberikan apa-apa sebab. 31. Bank boleh, mengikut budi bicara tunggalnya, meluluskan permohonan untuk jumlah Kemudahan dan tempoh ansuran Kemudahan yang ditetapkan oleh Pelanggan atau jumlah Kemudahan yang lebih rendah dan/atau tempoh ansuran Kemudahan yang lebih pendek seperti yang dianggap sesuai oleh Bank. Bank tidak berkewajipan untuk memaklumkan atau memberitahu Pelanggan tentang jumlah Kemudahan yang lebih rendah dan/atau tempoh ansuran Kemudahan yang lebih pendek itu sebelum Kemudahan diluluskan. 32. Pelanggan dengan ini memperakui bahawa penerimaan permohonan Kemudahan tersebut oleh pihak Bank telah disempurnakan sebaik sahaja pihak Bank mengeluarkan Surat Kelulusan untuk terma-terma yang terkandung di dalamnya dan mengkreditkan jumlah Kemudahan yang diluluskan ke dalam Akaun Deposit yang dinyatakan oleh Pelanggan tanpa mengambil kira jumlah kemudahan dalam Akaun Deposit tersebut kekal atau masih tidak digunapakai. Apa-apa perbezaan dalam jumlah Kemudahan dan/atau tempoh ansuran Kemudahan yang dipohon dan seterusnya diluluskan tidak akan memberi kesan kepada kesahan terma-terma dan Pelanggan dianggap telah menerima kewangan untuk jumlah Kemudahan seperti yang diluluskan oleh pihak Bank. Penghantaran permohonan untuk Kemudahan dan pengeluaran Surat Kelulusan dengan ini dianggap sebagai satu perjanjian dari Pelanggan untuk meminjam dan pihak Bank untuk menyediakan Kemudahan tersebut menurut terma-terma yang terkandung dalam permohonan, Surat Kelulusan dan terma-terma yang terkandung di sini dan tiada lain-lain dokumen rasmi lanjut diperlukan untuk disempurnakan di antara Pelanggan dan pihak Bank. 11

12 Pengiraan Ansuran 33. Ansuran Bulanan Kemudahan adalah dikira berdasarkan formula:- [(P* *N) + P]/n, di mana, P = Jumlah Pokok yang Dipinjam I = Kadar Faedah setahun N = Jumlah bilangan ansuran dalam Tahun n = Jumlah bilangan ansuran dalam Bulan Penyampaian Proses Undang-undang 34. Semua Pihak dengan ini bersetuju bahawa penyampaian apa-apa Writ Saman atau apa-apa proses undang-undang berhubung dengan apa-apa tuntutan yang timbul daripada atau berkaitan dengan terma dan syarat ini boleh dilaksanakan dengan menyerahkan satu salinan apa-apa Writ Saman atau apa-apa proses undang-undang tersebut melalui pos berdaftar prabayar dan satu salinannya melalui pos biasa ke alamat Pelanggan yang dinyatakan dalam borang permohonan Kemudahan atau ke alamat lain seumpamanya seperti yang dimaklumkan oleh Pelanggan kepada Bank dari semasa ke semasa. Sijil Keberhutangan 35. Perakuan yang ditandatangani oleh pegawai Bank mengenai jumlah keberhutangan pada masa tertentu dan terhutang kepada Bank oleh Pelanggan hendaklah menjadi keterangan atau bukti muktamad bahawa jumlah yang dinyatakan di dalamnya adalah terhutang dan kena dibayar oleh Pelanggan kepada Bank. Pelantikan Ejen-Ejen 36. Sebagai tambahan kepada dan tanpa menjejaskan haknya di bawah terma dan syarat ini, Bank berhak mengikut budi bicara tunggalnya, dan apabila dianggapnya perlu dengan memberikan notis tujuh (7) hari kalendar kepada Pelanggan, untuk melantik dan memberi kuasa kepada ejen pilihannya dan bagi pihaknya semata-mata bagi tujuan mendapatkan kembali apa-apa atau semua wang yang terhutang dan perlu dibayar oleh Pelanggan kepada Bank di bawah terma dan syarat ini. Pelanggan dengan ini membenarkan Bank untuk mendedahkan sebarang maklumat yang bekaitan dengan Pelanggan dan Akaun Pinjaman Peribadinya kepada mana-mana ejen yang dilantik untuk tujuan memungut semula wang yang dihutang dan perlu dibayar oleh Pelanggan di bawah terma dan syarat ini. Tanggung Rugi 37. Bank tidak akan bertanggungjawab bagi dan menaf ikan semua liabiliti dalam apa-apa tindakan, tuntutan, kerugian, ganti rugi, kos, caj dan perbelanjaan yang mungkin dialami, ditanggung oleh atau dikenakan kepada Pelanggan akibat penglibatannya dalam Kemudahan. Undang-undang 38. Kemudahan ini dikawal oleh dan ditafsirkan menurut undang-undang Malaysia dan semua pihak dalam dokumen ini dengan ini bersetuju untuk mematuhi bidang kuasa tidak eksklusif Mahkamah Malaysia di Kuala Lumpur atau mahkamah dengan bidang kuasa kompeten lain seumpamanya seperti yang Bank boleh mengikut budi bicara tunggalnya memilih untuk mematuhinya dan seterusnya bersetuju bahawa penyampaian apa-apa proses undang-undang boleh dilaksanakan mengikut cara yang dinyatakan di sini.
