Please note that Agricultural, Open Space and Conservation Elements will not be heard due to overall scheduling changes. These are tentatively scheduled for August 31, Recommendations for the Board Hearing of July 20, 2010: Staff recommends the following: 1. Take public testimony. 2. Take tentative action (leading to subsequent adoption of the entire General Plan) on the following General Plan components: Public Facilities Element and Safety Element. 3. Continue the updated 2030 General Plan for further deliberations.
2 I. SUMMARY OF THE BOARD HEARING OF JULY 14, 2010 II. A summary of the Board hearing of July 14 th will be provided in the next addendum report. DISCUSSION OF ELEMENTS TO BE REVIEWED Today s hearing will continue the review of the draft General Plan. Each of the topics is discussed below. A. The Public Facilities Element This discussion is a repeat of the July 14 th addendum on this topic The Public Facilities Element was the subject of written comment and discussion during the Planning Commission hearing process. Attachment E Exhibit 2 of the Board report for the hearing of May 12, 2010 includes the Public Facilities Element policies and implementation measures with recommended changes by the Planning Commission. Planning staff will rely primarily on that document for the discussion. Since the Planning Commission responded to public comment and testimony by incorporating changes into the draft Element, it is difficult for Planning staff to identify which policies, if any, may remain the subject of controversy. The Final Environmental Impact Report contains several mitigation measures that need to be addressed as well. Local and Regional Park Acquisition, Development, and Maintenance: One of the mitigation measures suggested changes to the Parks policies and text in the Public Facilities element. This was discussed and recommended by the County Planning Commission. Mitigation Measure PF-1 recommends that the Park District Alternative section of the Public Facilities Element, or similar updated version be adopted. The language in Attachment A of this addendum was added by the County Planning Commission and satisfies the mitigation measure. Waste Water: Mitigation Measures SE-1 and SE-2 suggest modifications to Policy PF-18 and the addition of a new policy to address the needed expansion of the treatment plant to address the combined growth from the various growth strategies. Policy PF-18 was modified by the Planning Commission. The mitigation measure further amends that language, and staff of Planning and DERA have worked together to make a small change to the wording. In addition to modifying PF-18, a new policy is also recommended to be added to this same section. Staff recommends incorporating both the modifications and the new policy into the Public Facilities Element. ad #4 2
3 PF-18 PF-XX B. The Safety Element New development projects which require extension or modification of the trunk or interceptor sewer systems shall be consistent with sewer facility plans and shall participate in established funding mechanisms. The County should discourage development projects that are not consistent with sewer master plans or that rely upon interim sewer facilities, particularly if the costs of those interim facilities may fall on ratepayers. Prior to approval of a specific Commercial Corridor redevelopment project which requires extension or modification of the trunk or interceptor sewer systems, a sewer study and financing mechanism shall be prepared and considered along with the proposed Corridor redevelopment project, in consultation with the Sacramento Area Sewer District. Extension or modification of trunk or interceptor sewer systems that are required for new developments shall be consistent with sewer facility plans and shall participate in an established funding mechanism. New development that will generate wastewater for treatment at the SRWTP shall not be approved if treatment capacity at the SRWTP is not sufficient to allow treatment and disposal of wastewater in compliance with the SRWTP s NPDES Permit. Attachment E Exhibit 9 of the Board report for the hearing of May 12, 2010 includes the Safety Element policies and implementation measures with recommended changes by the Planning Commission. Attachment B to this staff report includes the Safety Element policies and implementation measures with the recommended changes made by reviewers since the Planning Commission s changes were made, as well as the changes recommended by the Planning Commission. We worked closely with Water Resources staff on these modifications. Planning staff will rely primarily on this document for today s discussion. The changes recommended by the Planning Commission mainly dealt with the modifications required by SB 5 (Machado, 2007) and AB 162 (Wolk, 2007). The necessary modifications included additional information regarding flood hazards from local, State and Federal agencies, additional policies addressing the preparedness of local jurisdictions in the event of a flood, and additional flood maps with the latest data from local, State and Federal agencies. In response to preliminary comments from the Central Valley Flood Protection Board (CVFPB), Staff made additional modifications to the Safety Element text and policies, and to the Background to the Safety Element, that provide more specific information about flood protection and the various entities responsible for flood protection within the unincorporated County. Staff also added an appendix to the Safety Element outlining compliance with Government Code Section 65302(g)(2)(A). Additional modifications were made to the Safety Element and ad #4 3
4 Background to update out-of-date text and figures, and two maps (Figures III-4 and III-8) were added to the Background. Figure III-4 depicts the CVFPB designated floodways and Figure III-8 shows which levees are accredited by the Federal Emergency Management Agency (FEMA) as providing 1-percent-annual-chance flood protection. In response to comments received from the Sacramento Area Flood Control Agency (SAFCA), Staff combined Policies SA-6 and SA-14 into a new version of SA-6 (and deleted SA-14) and made other minor modifications to update the text. Staff sent updated versions of the Safety Element and Background to the entities responsible for flood protection in the unincorporated County, including CVFPB, and further comments are expected. Mitigation Measure HY-1 recommends that new residential development in designated floodplain areas affected by the American River levee system needs to be in compliance with the Sacramento County Floodplain Management Ordinance. This policy will ensure that no residence is placed within a flood hazard area. It further ensures that people or structures will not be exposed to a significant risk involving flooding. SA-XX Discretionary residential development within any area identified on the City\County of Sacramento Flood Emergency Evacuation Plan as being inundated by at least 3 feet of water shall be prohibited until the American River levee system is certified to a 200-year standard unless: 1. It is demonstrated to the satisfaction of the Sacramento County Department of Water Resources that the project site is outside the 200-year floodplain. OR 2. The need for this policy is superseded by implementation of legislation or other policy related to this issue, as determined by the Sacramento County Department of Water Resources. III. FUTURE HEARINGS BEFORE THE BOARD OF SUPERVISORS Staff will continue to work with the Clerk of the Board on scheduling future topics at upcoming Board hearings. We will discuss with the Board potential topics for the months of August, September and if necessary into October. The next hearing is tentatively scheduled for July 28, Planning staff will propose we review the Circulation Element. At the last hearing, the Board reviewed a tentative schedule of topics. Noting that this schedule is tentatively only and subject to change, the following is the scheduled discussed at the most recent hearing: ad #4 4

CONCLUSION The Board of Supervisors took tentative action on the Air Quality Element at the last hearing, and continued the Public Facilities Element to today s hearing. After a lengthy discussion, the topic of Growth Management was continued to August 11, The Human Services Element and the Noise Element were continued to August 31, 2010 for report backs. Today s hearing will be focused on a staff request for tentative action on the Public Facilities and Safety Elements. The Public Facilities Element is introduced for the first time. This element was the subject of comment and modifications were made by the Planning Commission. This element includes a major re-write of policies on the provision of parks and recreation facilities and services. Staff is not sure what the focus of public comment might be, if any, given the recommended changes by the Planning Commission to the Public Facilities Element. The Safety Element is also introduced for the first time. Significant changes have been made both before and after the Planning Commission to address regulatory issues. ad #4 5
