Accounts are debited on the twenty-fifth (5th) of each month, with reference REIMPAQ. If the approval process is completed by the twentieth (0th) of the current month, the first debit der is raised in the current month. If not, the first payment will be the month thereafter. A debit der cancellation request must be received in writing befe the twentieth (0th) of the current month to cancel the debit der f the next month. 6 Critical enrolment infmation Read the infmation below befe registering f Grades 0. Take note: A computer laptop with internet access a reliable address are essential f learners in the FET Phase as is Impaq s primary means of communication. Entrance examinations: Impaq reserves the right to request that a learner writes an entrance examination to confirm that they comply with the admission requirements. Provisional approval: If a final rept from the previous grade is not available, an application will only be accepted provisionally until a successful valid final rept is submitted to fet@impaq.co.za. The due date f submitting a final rept is the end of February. If the parent/guardian fails to submit a successful valid final rept, the learner s registration may be cancelled. Preliminary approval is granted at Impaq s discretion. After February a final rept is required. Statuty rules f subjects choices: At Impaq, we offer the Academic (General) pathway in the FET Phase, which comprises Grades 0 to. This pathway requires the completion of seven subjects: four compulsy three electives. The same language may not be offered as Home Language First Additional Language. Mathematical Literacy may not be taken together. Learners must select one the other. Consumer Studies Hospitality Studies may not be taken together. Learners may select one the other. is compulsy with Accounting Physical Sciences. Subject changes: All subject changes must be approved befe the quotation will be sent. F approval the parent/guardian is required to provide a letter of motivation explaining the reason f the subject change. The letter must include: Learner s full names ID number, a though motivation a programme outlining the programme to be followed indicating how the subject content f the previous grade will be covered. Approval of any subject change is at Impaq s discretion. A Grade 0 learner may make a maximum of two subject changes on befe 7 June the payment cut-off date is 9 June of the academic year. A Grade learner may make two subject changes on befe 8 March the payment cut-off date is 30 March of the academic year. No subject changes are allowed in the Grade academic year. Registration payment cut-off dates: Grade 0 applications must be submitted by 7 June 08, payments must be finalised by 9 June 08. Grade applications must be submitted by May 08, payments must be finalised by 4 May 08. Grade applications must be submitted by 5 February 08, payments must be finalised by February 08. After the initial cut-off dates an official term rept is required showing their progress up to their registration at Impaq until 3 August. Should the learner be unable to provide an official rept showing their progress up to their registration at Impaq, the learner is required to catch up any wk missed f the grade/year. (Not applicable f Grade.) All examinations are written accding to a set timetable. No extension is granted f any examinations missed. Additional requirements are applicable f Grade registrations. Taking me than seven subjects: If a learner wants to take me than the required seven subjects, they must complete all the required wk, including ptfolio wk, from Grade 0. The learner must pass each additional subject befe they will be allowed to continue with that subject in the next grade. If a learner has already passed Grade, additional subjects are allowed. The Grade 0 material f the subjects must be acquired wked through to give the learner an understing of each subject s fundamental principles. However, it is not a requirement f learners to fmally complete Grades 0 in the said subject through Impaq. 10 9. Stard Agreement (Impaq Onderwysdiens (Pty) Ltd.) Terms Conditions (/3). Impaq Education (Pty) Ltd ( lmpaq ), registration number: 0/0959/07, trading inter alia as Impaq, is a private company that sells educational Products Services (which can be utilised in conjunction with private independent services offered by third parties, such as Tuts), which include but are not limited to educational programmes modules, study material, exams, assignments suppt administration Services (hereinafter referred to as the Products Services ).. F the purposes of this agreement:.. Tut : shall mean any individual independent entity which has been activated on the Impaq system in der to use the Products / Services in the perfmance of private tut services to Learners;.. Account Holder : shall mean the person who has undertaken, both in this agreement in the Application Fm, to make payment of all amounts due to Impaq in respect of Impaq s provision of the Products Services, can also be the Legal Guardian as defined herein;.3. Application Fm shall mean the Application Fm completed by the Legal Guardian/Account Holder f the purposes of this agreement. The Application Fm is linked to, read with, the provisions of this agreement;.4. Impaq Policy : shall mean any policy, regulation, rule similar proclamation regulating any aspect relating to Impak / the Products / Services. The Impaq Policy shall be determined by Impaq, from time to time in its sole absolute discretion upon publication on Impaq s website ( shall substitute replace the parallel / equivalent preceding Impaq Policy (if any). The Impaq Policy is available on Impaq s website incpated herein by reference;.5. Learner : shall mean any Learner who is active on the Impaq system to receive Products / Services;.6. Legal Guardian : shall mean (a) the parent guardian of a Learner; (b) the person who has legal custody of a Learner; (c) the person that undertakes to perfm the duties of a person who is referred to in (a) (b); 3. The Legal Guardian undertakes to ensure compliance with the requirements of the South African Schools Act, 84 of 996 (as Amended) ( the Act ), in particular: 3.. In terms of Section 3 of the Act, it is every Legal Guardian s responsibility to ensure that every Learner f whom he she is responsible attends a school once they reach the appropriate age as such is educated trained; 3.. In terms of Section 5 of the Act, the Legal Guardian of a Learner, of compulsy school-going age who does not attend a public independent school, must apply to the Head of the applicable Department of Education to register such Learner(s) to receive education at home; 3.3. The education provided to the Learner will be of a stard not inferi to the stards provided by public schools; 3.4. The Legal Guardian is also required to ensure that the Learner s progress is assessed in accdance with the applicable laws regulating a Learner s education; 3.5. The Legal Guardian will also be required to comply with all other reasonable conditions set out by the Head of the applicable Department of Education. These conditions may differ in each province. 4. Any Application Fm completed submitted to Impaq by the Legal Guardian/Account Holder shall constitute an offer to Impaq, the agreement between the Legal Guardian/Account Holder Impaq shall be deemed to have been concluded at the time place that it is signed by Impaq s authised representative at its head office. Furtherme: 4.. Impaq shall not be required to provide the Legal Guardian/Account Holder with express acceptance of its offer, tacit acceptance of the offer by the provision of any Products / Services shall constitute acceptance; 4.. No offer shall be considered unless the Legal Guardian/Account Holder complies with the minimum requirements set out in the Application Fm, in this regard, Impaq reserves its right to refuse any offer made; 4.3. The agreement shall subsist f a period of (one) academic year (determined in terms of Impaq s academic calendar) from date of the Learner s activation on the Impaq system, after which the agreement will expire the Account Holder/Legal Guardian may conclude a new agreement with Impaq. 5. The Legal Guardian/Account Holder acknowledges: 5.. The Legal Guardian/Account Holder may enter into a separate agreement with a Tut whereby the Tut makes use of the Products Services, purchased by the Legal Guardian/Account Holder in terms of this agreement, in rendering the Tut s own independent services; 5.. No Tut is authised to conclude an agreement f the provision of Products / the rendering of Services on Impaq s behalf; 5.3. A Tut may not charge accept payment of any kind in respect of the Products Services; 5.4. A Tut s activation on the Impaq system does not imply accreditation with Impaq; 5.5. Impaq does not regulate the services rendered by a Tut, which are private services independent from the Products / Services offered in terms of this agreement; 5.6. Any agreement between the Legal Guardian/Account Holder a Tut shall not be construed as part of this agreement. Impaq shall not be responsible of any agreement entered into between the Legal Guardian/Account Holder a Tut the relationship between the Legal Guardian/Account Holder such Tut will not be regulated by this agreement. 6. The Legal Guardian/Account Holder guarantees undertakes that: 6.. The infmation provided in the Application Fm is both true accurate, this is a material term of the agreement; 6.. If so requested, additional documentation required by Impaq will be the iginal document will be certified as a true copy of the iginal; 6.3. He/she is fully familiar with Impaq s most recent Impaq Policy shall comply with any applicable Impaq Policy. 7. All amendments adjustments that the Legal Guardian/Account Holder wishes to make in respect of the Learner s activation on the Impaq system, must be made in writing within seven (7) calendar days of the date of signature on the Application Fm. Any changes of whatsoever nature by the Legal Guardian/Account Holder in respect of the Learner s activation on the Impaq system shall result in additional costs, which includes but are not limited to the administration costs stipulated in the Impaq Policy. The Legal Guardian/Account Holder hereby confirms that the Learner complies with the prescribed guidelines f activation in terms of the chosen Impaq Products as set out from time to time by Impaq, any external examination Board any applicable regulaty body. If the Learner fails to submit the required proof when requested to do so by Impaq, Impaq may elect to cancel the Learner s activation the prescribed cancellation costs will apply as stipulated in the Impaq Policy. 9. The Legal Guardian/Account Holder is required to familiarise himself/herself with the requirements the rules of every Product Service that is purchased from Impaq, with reference to the appropriate curriculum subjects as well as the minimum requirements f passing the specific programme / subjects. The Legal Guardian/Account Holder is fully responsible f the choice of Product. 0. The Legal Guardian/Account Holder takes full responsibility liability f the application of the Products Services that are purchased. The issuing of the Grade certificate by any external examination Board all costs associated therewith shall be the sole responsibility of the Legal Guardian/Account Holder, unless otherwise agreed.. The deposit any other monies as prescribed in the Application Fm to be paid upfront, must be paid in full befe any Product will be delivered any Service rendered.. In the event the Legal Guardian/Account Holder hereby directs that the appropriate Products are to be sent by courier (as selected) to him/her, the Legal Guardian/ Account Holder is deemed to have appointed the courier supplier as his/her agent f the delivery of the Products. The Legal Guardian/Account Holder hereby indemnifies Impaq against all liability should the courier supplier fail to deliver any all of the Products assumes responsibility to receive the Products during wking hours at the address provided. The Legal Guardian/Account Holder agrees to pay the non-refundable delivery cost cresponding to the selected delivery method. 3. The Legal Guardian/Account Holder is responsible f though checking verifying of the Products from Impaq within seven (7) calendar days from the date of receipt. If the content is incomplete contains errs, the Legal Guardian/Account Holder must infm Impaq accdingly in writing. If no notice is received from the Legal Guardian/Account Holder within the seven (7) day period contemplated above, the Legal Guardian/Account Holder shall to be fully responsible liable f all possible costs that may be incurred in resending Products. 4. All Impaq Products remain the property of Impaq until such Products have been paid f in full. It is understood that Impak is, in respect of the sale of the Products, only selling the right to utilise the intellectual property contained in any Product that it provides, ownership of such intellectual property shall at all times remain vested in Impaq. 5. It is specifically agreed that all rights whatsoever to intellectual property contained in Impaq s Products Services, whether they are capable of registration not, including but not limited to Impaq s name, trading name, educational programmes, study material, examinations, assignments, logo / image, remain the sole property of Impaq. The Legal Guardian/Account Holder acknowledges agrees that it will be liable f any damages incurred by Impaq, alternatively a minimum amount of R (one hundred thous R) in the event that the Legal Guardian/Account Holder copies, reproduces distributes Impaq s Products / study material, allows any other person to do so when under his/her supervision. Impaq also reserves its right to pursue criminal charges against the Legal Guardian/ Account Holder in the event of such infringement. 6. The Legal Guardian/Account Holder may cancel this agreement within seven (7) days from the date of delivery of the Products at the nominated address, without incurring any cancellation fees, provided such Products are sent back to Impaq s distribut, in the iginal packaging, within 4 (fourteen) days from the date of delivery of such Products. Any cancellation outside of the seven (7) day period shall be dealt with in accdance with the Impaq Policy (Changes Cancellations) the Legal Guardian/Account Holder will remain liable f a percentage of the package price, as well as all non-refundable costs. 7. The Legal Guardian/Account Holder acknowledges that he/she is fully responsible f all fees costs with regard to the Products Services provided by Impaq accepts the responsibility to pay the full fees related administration costs on/befe the prescribed dates. 8. If the Legal Guardian the Account Holder differ, the Legal Guardian the Account Holder hereby undertake to be jointly severally liable f the payment of all amounts that are, will be, payable to Impaq. The Account Holder may not be changed until such time as all amounts owing to Impaq by the current Account Holder are paid in full. 9. Impaq retains the right to cancel an application / to refuse to supply any Product Service, including but not limited to access to assessments, access to the my.impaq ptal as well as administration suppt services, in the event: 9.. The Account Holder fails to make payment in terms of this agreement; 9.. The Account Holder owes any money to Impaq in respect of a Learner s previous registration; 9.3. The Legal Guardian/Account Holder is in breach of any terms conditions of the agreement. 0. A certificate under the h of the financial manager of Impaq its nominee (whose appointment as such it shall not be necessary to prove) stating the indebtedness of the Legal Guardian/Account Holder to Impaq in respect of all amounts due in terms of this agreement the Application Fm, shall serve as prima facie proof of such indebtedness f the purpose of any legal proceedings.. Impaq, any of its duly authised representatives, may cede assign the rights contained herein at any time to any third party without the pri consent of the Legal Guardian/Account Holder. The rights obtained by the Legal Guardian/Account Holder in terms of this agreement may not be ceded assigned without Impaq s pri written consent.. The physical address the address (if any) that the Legal Guardian/Account Holder supplies in the Application Fm is his/her address f the purposes of delivery of legal notices any communication with regard to this agreement. The Legal Guardian/Account Holder undertakes to infm Impak in writing by means of prepaid registered post, fax of any change of address. Impaq shall be entitled to affix notices to the physical premises in the event the recipient is not present such affixing shall be sufficient Service. 3. The Legal Guardian/Account Holder hereby agrees that the law of the Republic of South Africa shall govern this agreement, further agrees to the jurisdiction of the Magistrate s Court acknowledges that he/she will be liable f all legal costs, including costs on an attney--client scale, if the amounts due f the Products Services are not paid timeously accding to the payment method chosen in the Application Fm. 4. The Account Holder hereby renounces any benefits to which it may be entitled to in law, without limiting the extent of the afegoing, the benefits of no value received, revision of accounts, non numerata pecuniae (that no money was paid to the Account Holder), non causa debeti (that there does not exist valid grounds f the debt/s) erre calculi (that there was a mistake in the calculation of any outsting amount), revision of accounts, the meaning effect of which the Account Holder understs acknowledges that he/she is fully acquainted with. No variations amendments to this agreement, waiver of any rights cancellation thereof will be valid unless placed in writing signed by both the Legal Guardian/Account Holder Impaq, its duly authised representative. Impaq, its directs, employees, service providers will not be responsible f any direct, indirect consequential losses suffered by the Legal Guardian/Account Holder Learner, including death, injury of whatsoever nature, losses of profits data delays, whether on the basis of contract delict, that arise from the use of Impaq s Products / Services, when used as a home-schooling product via a Tut in any other manner whatsoever. 8. The Legal Guardian/Account Holder hereby consents authises Impaq as well as Impaq s nominee agent to carry out any necessary credit checks searches at any credit bureau similar tracing facility, to verify the Legal Guardian/Account Holder s personal account details, with the purpose of establishing the Legal Guardian/Account Holder s creditwthiness contact infmation. Impaq retains the right to disclose any the financial accounting infmation pertaining to the Legal Guardian/Account Holder to the Tut to any Impaq agent cessionary. 9. In this agreement reference to one gender shall include the other gender, reference to a legal person shall include natural persons trusts vice versa, reference to the singular shall include the plural vice versa.
