1 GENERAL TERMS AND CONDITIONS FOR HOTEL ACCOMMODATION AND EVENT HOSTING Applicability OPŠTI USLOVI POSLOVANJA HOTELSKOG SMEŠTAJA I ODRŽAVANJA DOGAĐAJA Primena Opštih uslova These General Terms and Conditions shall apply to all services and activities performed and rendered by the Hotel to the Customers within the scope of the Hotel s registered business activities. In the event of any amendments to these General Terms and Conditions, the Hotel shall notify the Customer thereof in writing. If the User does not object to the amendments to the General Terms and Conditions within 14 days of receipt thereof, it shall be deemed to have accepted the amended General Terms and Conditions. Navedeni opšti uslovi poslovanja odnose se na sve usluge i aktivnosti koje Hotel obavlja u okviru svojih registrovanih delatnosti prema Korisnicima usluga. U slučaju izmena i dopuna ovih Opštih uslova poslovanja (dalje: Opšti uslovi ), Hotel je dužan da u pisanoj formi obavesti Korisnika usluga. Ukoliko Korisnik ne ospori izmene Opštih uslova u roku od 14 dana od dana prijema izmena Opštih uslova, smatra se da je pristao na primenu izmenjenih i dopunjenih Opštih uslova poslovanja. The Customer s general terms and conditions shall be incorporated into the Contract with the Hotel only subject to the Hotel s written consent to the application, in part or in whole, of such general terms and conditions. Opšti uslovi poslovanja Korisnika mogu biti sastavni deo ugovora sa Hotelom samo pod uslovom da je Hotel dao pismenu saglasnost na primenu tih uslova u celosti i/ili delimično Conclusion of the Contract The Contract (hereinafter Booking ) shall come into effect when the Hotel has accepted the Customer s booking request. The Hotel shall confirm the Booking in writing, whereby the Contract shall be deemed to have been concluded. If a third party has made the Booking on behalf of the Customer, such party shall be liable to the Hotel jointly and severally with the Customer. Zaključenje ugovora Ugovor (dalje: Rezervacija ) stupa na snagu prihvatanjem rezervacije Korisnika od strane Hotela. Hotel je obavezan da potvrdi rezervaciju u pisanoj formi, čime se smatra da je Ugovor zaključen. Ako treće lice izvrši rezervaciju u ime Korisnika, treće lice je odgovorno Hotelu, zajedno sa Korisnikom u svojstvu solidarnih dužnika Services, Prices, Payment, Invoices The Hotel shall render the services stated in the Booking only if confirmed to the Customer in writing. The Customer shall pay to the Hotel the agreed prices of services as stated in the Booking, as well as any costs of any additional services used by the Customer. This shall also apply to any services rendered by the Hotel to third parties on Customer's instructions. Korisnik je obavezan da plati Hotelu sve ugovorene cene usluga iz Rezervacije, kao i sve druge eventualne usluge koje Korisnik bude koristio. Korisnik je takođe u obavezi da nadoknadi sve druge troškove koje Hotel bude imao prema trećim licima, a po nalogu Korisnika. Ugovorene cene uključuju važeći PDV. Ukoliko se

2 VAT. Should the applicable VAT rate increase or decrease after the conclusion of the Contract, the prices shall be adjusted accordingly. The prices stated in the confirmed Booking may not be changed, unless the period between the Booking and the use of services exceeds four months, in which case the Hotel may change the prices, however not more than 5% of the prices stated in the Booking. The hotel is entitled to increase the prices stated in the Booking in case of increase of municipal duties (visitor s tax, etc.), however not more than 5% of the prices stated in the Booking. The invoices issued by the Hotel shall be due and payable immediately upon receipt without any discounts, unless other payment terms have been expressly agreed. In the event of default in payment for the booked services and any other services rendered by the Hotel, the Hotel may charge the applicable statutory default interest of 10% for legal entities and 5% for natural persons. The Hotel reserves the right to furnish proof of a heavier loss. The subletting and re-letting of allocated Hotel rooms, premises or display cabinets to natural persons is not permissible. The Agency Customer (registered in accordance with the Law on Tourism of the Republic of Serbia) may further allocate Hotel rooms, premises or display cabinets only subject to prior written consent of and/or Contract with the Hotel. Upon conclusion of the Contract Booking confirmation, the Hotel may require from the Customer a reasonable advance payment or security deposit in the form of a credit card guarantee or similar. If the advance payment is not made within the agreed term, the Hotel may cancel the Contract and claim damages. In justified cases (e.g. if the Customer is in arrears with payments or the scope of the Contract - Booking is expanded) the Hotel may demand an increase of the agreed advance payment or security deposit, proportionate to the expected stopa PDV koja se u konkretnom slučaju primenjuje smanji ili poveća nakon zaključenja ugovora, cene će se prilagoditi. Hotel ima pravo na povećanje cena iz Rezervacije, ukoliko se povećaju administrativne naknade (boravišne takse, i dr.) i to najviše do 5% od cene Rezervacije. Hotelski računi se plaćaju odmah po prijemu računa bez umanjenja, osim ako se drugačiji uslovi plaćanja nisu izričito ugovorili. Hotel zadržava pravo da naplati svoja dospela potraživanja u svakom trenutku bez odlaganja prema Korisniku sa računa Korisnika. Za usluge iz Rezervacije kao i za usluge koje Hotel izvrši, a koje ne budu plaćene u roku Hotel ima pravo da naplati zakonsku zateznu kamatu. kao i iznos ugovorene naknade štete od 10% za pravna lica i 5% za fizička lica. Agencija Korisnik, (registrovan u smislu Zakona o turizmu Republike Srbije) može vršiti dalje dodeljivanje soba, prostora Hotela i/ili kabineta samo uz pismenu potvrdu, saglasnost i/ili ugovor dobijen od Hotela. Hotel ima pravo nakon zaključenja ugovora potvrde Rezervacije, da zahteva od Korisnika uplatu odgovarajućeg avansa ili depozita u obliku garancije kreditne kartice ili dr. Ukoliko avans ne bude uplaćen u ugovorenom roku, Hotel može otkazati ugovoreno i tražiti naknadu štete. U opravdanim slučajevima (npr. Korisnik kasni sa isplatama u rokovima ili proširenje obima ugovora - Rezervacije) Hotel ima pravo da zahteva povećanje dogovorenog iznosa avansa ili povećane vrednosti depozita u srazmeri sa

The Hotel reserves the right to require from the Customer a reasonable advance payment or security deposit at the commencement of and throughout the Customer s stay, provided that such advance payment or security deposit has not been already paid in accordance with the Contract Booking. In the event the Hotel cancels the Booking for good cause, the Customer shall be entitled to recovery of any amounts paid with interest and shall waive the right to any damages. očekivanim troškovima usluga Hotela. U slučaju da Hotel iz opravdanih razloga odustane od Rezervacije, Korisnik ima pravo na povraćaj plaćenog iznosa sa kamatom i odriče se prava na naknadu bilo koje štete Room Availability, Delivery and Return The Customer shall not be entitled to the availability and provision of any specific room, unless the Hotel confirms the availability of such particular room in writing. Booked rooms shall be at the Customer s disposal from 14:00 on the day of arrival. The Customer has no right to earlier availability. Guests arriving before 14:00 may occupy their rooms as early as possible, according to availability. If the available rooms are not occupied by the Customer by 18:00 on the day of arrival, the Hotel may let such rooms to other customers, unless the Customer has informed the Hotel of its late arrival in advance and in writing. The Hotel may demand an additional guarantee for late arrivals after 18:00. On the agreed day of departure, the Customer must check out by 12:00 at the latest. After that time, the Hotel may charge 50% of the agreed room rate for late check out until 18:00, and 100% after 18:00. The Hotel reserves the right to claim other damages. Raspoloživost soba, dolazak i odlazak Korisnik ne stiče pravo na dostupnost određenoj sobi, sve dok Hotel u pisanoj formi ne potvrdi raspoloživost/dostupnost takve sobe. Rezervisane sobe su na raspolaganju korisniku od 14:00h na dan dolaska. Korisnik ne može da zahteva dostupnost sobe pre tog vremena. Gosti koji dolaze pre 14:00 mogu da koriste svoje sobe što je ranije moguće, u skladu sa trenutnom dostupnosti sobe. Ukoliko rezervisanu sobu Korisnik ne preuzme do 18:00h na dan najavljenog dolaska, Hotel može izdati te sobe drugim korisnicima, osim ako je Korisnik o svom kašnjenju unapred pismeno obavestio Hotel. Hotel ima pravo da zahteva dodatnu garanciju, plaćanje za period održavanja Rezervacije u periodu posle 18:00 časova. Na ugovoreni dan odlaska, odjava iz Hotela je najkasnije do 12:00h. Posle tog vremena hotel može naplatiti korisniku do 50 % od ugovorene cene sobe za dodatno korišćenje sobe do 18:00h, a 100 % za dodatno korišćenje sobe nakon 18:00h. Hotel zadržava pravo da traži i druge naknade Cancellation of Accommodation Contract Booking by the Customer (cancellation, rescission). The Customer may cancel the Contract Booking only subject to the Hotel s consent. Otkazivanje Ugovora Rezervacije za smeštaj od strane Korisnika (otkazivanje, raskid) Korisnik može otkazati Ugovor Rezervaciju, samo ukoliko se sa tim saglasi Hotel.

4 In the event of cancellation of the Contract Booking by the Customer, the Hotel shall be entitled to charge not less than 100% of the price stated in the Contract Booking, unless the Hotel confirms in writing that rental of accommodation to other customers is possible. In case of a booking of more than one day, where the Customer fails to arrive on the first day of booking, the Customer shall not be entitled to the booked room without prior consultation with the Hotel. In such case, the Hotel shall be entitled to rent a room to the other Customer to the extent of room availability, and the Customer shall use any room made available by the Hotel. To the extent the Hotel and Customer have agreed in writing upon a date for unilateral cancellation of the Contract free of charge, the Customer may cancel the Contract in accordance with the agreed terms and conditions, in each case without incurring any payments or claims for damages by the Hotel. The Customer s right to cancel the Contract shall expire if he fails to exercise it by the agreed date for cancellation. In the event of Contract cancellation by the Customer, the Customer shall bear full costs of any services performed by third parties and/or special services (e.g. cakes, flowers, etc.) which may have become useless as a result of Contract cancellation. Za slučaj da Korisnik otkaže Ugovor Rezervaciju, Hotel ima pravo da zadrži najmanje 100% od cene iz Ugovora Rezervacije, osim ukoliko pismeno Hotel potvrdi da je u mogućnosti da smeštaj iznajmi drugim korisnicima. U slučaju višednevne rezervacije Korisnik nema pravo na rezervisanu sobu, bez prethodne konsultacije sa Hotelom, ako ne stigne na prvi dan rezervacije. U ovom slučaju, Hotel je ovlašćen da iznajmi predmetnu sobu drugom korisniku, u kom slučaju će Korisnik koristiti sobu koju mu ponudi Hotel i koja je raspoloživa. Ukoliko je Ugovorom, izričito ugovoren rok za jednostrani odustanak (otkaz) od Ugovora, bez naknade između Hotela i Korisnika, Korisnik može odustati od Ugovora prema ugovorenim uslovima, i to uvek bez zahteva za isplatu ili naknadu štete od strane Hotela. Pravo Korisnika da odustane od Ugovora ističe ukoliko ne ostvari svoje pravo u ugovorenom roku za odustanak (otkaz). U slučaju otkaza ugovora od strane Korisnika, Korisnik u celosti snosi troškove usluga izvršenih od strane trećih lica i/ili posebnih usluga drugih davaoca usluga (npr. Kolači, cveće, itd), a koje su neiskorišćene kao posledica neispunjenja ugovora od strane Korisnika Cancellation of Event Contract Booking by the Customer (cancellation, rescission) The Customer may cancel the Contract Booking only subject to the Hotel s consent. If such consent is not given, the Hotel shall be entitled, in case of cancellation, to charge the agreed cost of hire for the event in addition to any other costs of event preparation, in accordance with the following provisions, provided that the rental of premises to other parties is not possible. The Hotel shall be entitled to charge for the conference room and/or conference package: Cancellation fee and period of cancellation shall be agreed depending on each particular proposal. Otkazivanje događaja od strane korisnika (otkazivanje, raskid) Korisnik može otkazati Ugovor Rezervaciju, samo ukoliko se sa tim saglasi Hotel. U suprotnom Hotel ima pravo da u slučaju raskida ugovora naplati od Korisnika ugovorenu cenu zakupa za događaj zajedno za ostalim troškovima pripreme događaja, u skladu sa sledećim odredbama, pod uslovom da Hotel ne može da da u zakup prostor drugom Korisniku. Hotel ima pravo da naplati za konferencijski prostor i/ili konferencijski paket. Visina naknade otkaza i period otkaza se ugovara sa klijentima prema upitu.

5 The total food and beverages turnover shall be calculated based on the number of participants stated in the Contract. If no provisions for total food and beverages turnover were made in the Contract, the lowestpriced 3-course menu of the current all-inclusive rates for events shall serve as a basis for calculation. The costs of food shall then be calculated using the formula: menu price banquet x number of people. The costs of beverages shall equal 50% of the food costs. The Customer reserves the right to prove that the Hotel has incurred no loss as a result of the event cancellation or that the loss incurred by the Hotel was lower than that claimed by the Hotel. Ukupan trošak za hranu i piće se izračunava prema ugovorenom broju učesnika utvrđenom u ugovoru. Ukoliko nije ugovoren ukupan trošak za hranu i piće u ugovoru, kao osnova za naplatu uzeće se najjeftiniji od tri menija iz važeće ponude za događaje sve uključeno u cenu (all inclusive). Račun za hranu će se potom izračunati korišćenjem formule: cena menija, banket x broj ljudi. Račun za piće biće računat u visini polovine od Računa za hranu. Korisnik zadržava pravo da dokaže da Hotel nije pretrpeo nikakav gubitak kao rezultat neodržavanja događaja, odnosno da je šteta koju Hotel trpi manja od naknade štete koji Hotel potražuje Cancellation of Combined Accommodation and Event Contract Booking by the Customer (cancellation, rescission) The Customer may cancel the Contract Booking only subject to the Hotel s consent. Za slučaj da Korisnik otkaže Ugovor Rezervaciju, Hotel ima pravo da zadrži najmanje 100% od cene iz Ugovora Rezervacije, osim ukoliko pismeno Hotel potvrdi da je u mogućnosti da smeštaj i prostor za događaje iznajmi drugim korisnicima. Pravo Korisnika da odustane od Ugovora ističe ukoliko ne ostvari svoje pravo u ugovorenom roku za odustanak (otkaz). U slučaju otkaza ugovora od strane Korisnika, Korisnik u celosti snosi troškove usluga izvršenih od strane trećih lica i/ili posebnih usluga drugih davaoca usluga (npr. kolači, cveće, itd) koje su neiskorišćene kao posledica neispunjenja ugovora od strane Korisnika

6 Commission The Hotel is required to pay contractually agreed commissions for rooms used and for events held in the context of providing room allocations, events and other services. With regard to the cancellation charges under 5. and 6. of the present terms and conditions a commission claim will not be possible. Provizija Hotel je obavezan da plati ugovorene provizije za korišćene sobe kao i za održane događaje u kontekstu pružanja usluga, izdvajanja soba, održavanja događaja i drugih usluga. U odnosu na naknade za otkazivanje definisane u članovima 5. i 6. opštih uslova poslovanja potraživanje provizije nije moguće Contract Cancellation by the Hotel If it has been agreed that the Customer is entitled to cancel the Contract within a certain period without incurring any liabilities, the Hotel shall likewise be entitled to unilaterally cancel the Contract within such period. Raskid ugovora od strane Hotela Ukoliko je Ugovorom izričito predviđeno dogovoreno da korisnik može da raskine ugovor bez naknade u određenom roku, Hotel takođe zadržava pravo da jednostrano raskine ugovor u tom roku. The Hotel shall also be entitled to cancel the Contract if the advance payment agreed or required under these General Terms and Conditions has not been paid by the Customer by the due date. Moreover, the Hotel can claim damages against the Customer. The Hotel is entitled to cancel the Contract with immediate effect in cases where: - force majeure or other circumstances beyond the Hotel s control render performance of the Contract impossible; - rooms or premises are booked on the basis of misleading or false statements made by the Customer; - the Hotel has good reason to believe that the use of Hotel s services might jeopardize the Hotel s smooth operations, security, and/or Hotel s reputation; - the purpose or the cause of stay at the Hotel is illegal; - there is unauthorised sub-letting in breach of these General Terms and Conditions; - the hotel is closed; - proper accommodation and/or proper facilities may not be guaranteed because the hotel is being renovated; - the Customer cancels either accommodation or event in cases where Contract was made in respect of both accommodation and event (Art 7 of General Terms and Conditions). - Bankruptcy or other insolvency proceedings have been initiated against the Customer. Ukoliko ugovoreni avans ili zahtevani avans na osnovu ovih opštih uslova nije uplaćen u roku od strane Korisnika, Hotel ima pravo da raskine ugovor. Pored toga, Hotel može da zahteva naknadu štete od Korisnika. Hotel ima pravo da raskine ugovor sa trenutnim dejstvom, u slučaju: - više sile ili drugih okolnosti za koje Hotel nije odgovoran, a koje onemogućavaju ispunjenje ugovora. - kada su sobe i druge prostorije rezervisane koristeći se pogrešnim ili lažnim izjavama Korisnika - opravdane pretpostavke da upotreba hotelskih usluga može ugroziti nesmetan rad poslovanja, bezbednost i/ili štetiti ugledu Hotela. - da je cilj ili razlog boravka u Hotelu nezakonit; - neovlašćen podzakup suprotno ovim Opštim uslovima poslovanja; - zatvaranja Hotela; - renoviranja Hotela, a da se ne može garantovati odgovarajući smeštaj u odgovarajućim objektima; - da Korisnik odustane od smeštaja ili od organizacije događaja, a ugovoren je istovremeni smeštaj i organizacija događaja (član 7 Opštih uslova). - pokretanja stečajnog ili drugog postupku likvidacije Korisnika.

7 Contract Booking may by cancelled by mutual consent based on the Customer s statement in writing and the Hotel s written consent. Ugovor Rezervacija mogu biti sporazumno otkazani na osnovu pismene izjave Korisnika i saglasnosti Hotela Number of Participants, Changes in Number of Participants and in Event Location. If the number of participants registered by the Customer changes by more than 5%, the Hotel catering department must be notified thereof in writing no less than 7 days before commencement of the event. This change shall be acknowledged by the Hotel when the invoice is issued. An increase in the number of participants of more than 5% requires a written consent of the Hotel. In the event of any increase in the number of participants, the invoice shall reflect the actual number of participants. If the number of participants changes by more than 10%, the Hotel may change the confirmed venue, provided that the size of the new venue is appropriate for the final number of registered participants and that the venue is adequately equipped. If necessary, the Hotel may move the booked event to another venue of the same value. If the agreed start and end times of the event change without the prior written consent of the Hotel, the Hotel may charge additional services in accordance with the Hotel Pricelist and the Law of Contracts and Torts, unless the Hotel is at fault. If the event continues after midnight, the Hotel may charge 1.50 per guest and hour including VAT. The agreed number of participants shall be the basis for the calculation. Always applies selling exchange rate of the NBS on the date of calculation. Displays shall not be allowed in the Hotel foyer and lobby. The prior written consent of the Hotel is required to place advertising material. Broj učesnika, promena broja učesnika i promena lokacije događaja. Odeljenje keteringa Hotela mora biti pismeno obavešteno u slučaju promene broja učesnika događaja, prijavljenih od strane Korisnika ukoliko broj učesnika bude povećan za više od 5% i to najkasnije sedam dana pre početka događaja, što će Hotel evidentirati prilikom izdavanja računa. Povećanje broja učesnika veće od 5% zahteva pismenu saglasnost Hotela. U svakom slučaju povećanja broja učenika, kao osnov za račun će se koristiti stvarni broj učesnika. Ukoliko se broj učesnika povećava na više od 10%, Hotel ima pravo da izvrši zamenu ugovorenih prostorija, pod uslovom da je veličina novih prostorija odgovarajuća za konačan broj prijavljenih učesnika i da su prostorije odgovarajuće opremljene. Ukoliko je to potrebno, Hotel ima pravo da izmesti ugovoreni događaj u drugu prostoriju iste vrednosti. Ukoliko se ugovoreno vreme početka i završetka događaja menja bez prethodne pismene saglasnosti Hotela, Hotel može naplatiti dodatne troškove angažovanja u skladu sa Cenovnikom Hotela i odredbama važeće Zakona o obligacionim odnosima, osim ukoliko je Hotel odgovoran za promenu vremena. Ukoliko događaj traje posle ponoći, Hotel ima pravo da naplati 1,50 eura po gostu i satu, uključujući PDV. Dogovoreni potvrđeni broj učesnika je osnov za obračun. Uvek važi prodajni kurs NBS na dan obračuna. Reklamiranje je zabranjeno u foajeu i holu Hotela. Za postavljanje reklamnog materijala potrebno je prethodno pisano odobrenje Hotela Own Food and Beverages Sopstvena hrana i piće

8 Only the Hotel shall provide food and beverages for events. Any exceptions to this rule shall require a prior written consent of the Hotel. In such cases, a contribution to the overheads (corkage fee) shall be charged. The Customer shall be fully liable for its own food and beverages and the Hotel shall be released of any claims by third parties in that respect. The Hotel assumes no liability for the shelf life of the food which is brought into the Hotel after an event at the Hotel or taken outside the Hotel for private consumption. Hotel jedini obezbeđuje hranu i piće za potrebe događaja. Za eventualne izuzetke od navedenog, potrebna je pismena saglasnost Hotela. U tom slučaju, naplaćivaće se iznos za pokrivanje troškova usluživanja. Korisnik je u potpunosti odgovoran za sopstvenu hranu i piće i Hotel je u ovom pogledu oslobođen svih zahteva trećih lica. Hotel ne preuzima odgovornost za rok trajanja hrane koja je doneta u Hotel nakon događaja u Hotelu ili koja je izneta iz Hotela za privatnu konzumaciju Technical Equipment and Connections To the extent that the Hotel procures technical and other equipment for the Customer at the latter s instigation, it does so on behalf and for the account of the Customer. The Customer shall be liable for careful handling and proper return of the equipment. The Hotel shall be released of any claims by third parties arising from provision of such equipment. Use by the Customer of its own technical equipment shall be subject to a prior written consent of the Hotel. Any malfunctions or damages to the Hotel s technical equipment caused by the use of such equipment shall be removed at the Customer s expense, unless the Hotel is at fault. The Hotel may charge a flat fee for the electricity costs incurred through use of such equipment. The customer may use its own telephone, fax and data transfer equipment subject to the Hotel s written consent. The Hotel may charge a connection fee. Failures in the technical or other equipment provided by the Hotel shall be removed as soon as reasonably possible. The Customer may not withhold or reduce payments unless the Hotel was responsible for such failures. Tehnička oprema i povezivanje Ukoliko Hotel za potrebe i na zahtev Korisnika nabavlja tehničku i drugu opremu, on to čini u ime i za račun Korisnika. Korisnik je odgovoran za rukovanje i povraćaj u ispravnom stanju opreme sa dužnom pažnjom. Hotel je oslobođen svih potraživanja trećih lica za ustupanje ove opreme. Upotreba sopstvene tehničke opreme od strane Korisnika, zahteva prethodnu pismenu saglasnost Hotela. Poremećaji u radu ili oštećenja tehničke opreme Hotela prouzrokovane korišćenjem ove opreme biće o trošku Korisnika otklonjene, osim u slučaju krivice Hotela. Hotel može uključiti i naplatiti paušalne troškove za napajanje koji nastanu usled upotrebe takve opreme. Korisnik ima pravo da koristi sopstveni telefon, faks i tehniku za prenos podataka uz pismenu saglasnost Hotela. Hotel može naplaćivati naknadu za navedenu uslugu konekcije. Propusti u tehničkoj i drugoj opremi koju obezbeđuje Hotel biće otklonjeni u razumnom roku. Korisnik nema pravo da zadrži deo cene iz fakture niti da zahteva umanjenje, osim ukoliko Hotel nije odgovaran za tehničke nedostatke. If the Hotel s technical equipment remains unused because the Customer commissioned an external technology company, the Hotel may claim compensation for lost revenue. 9 Music Shows, Art Exhibitions If the rights of third parties are affected by events (copyrights, etc.), the Customer shall obtain appropriate permissions at its own cost before the event is held and pay any fees which may arise directly therefrom. Should any fees or claims for damages be made by third parties in respect of the above, the Hotel shall be relieved from any liability. The Customer shall bear all costs and other liabilities relating to engagement of artists in the events hosted at the Hotel. The Hotel shall have no liability whatsoever within the terms of this Clause. According to the law of OFPS, article 125 about the author rights event Customer is covering expenses of Phonograms according to the special tariffs: Tariff number 19 Fashion Shows, Miss Selection and other similar events at RSD 18, Tariff number 20 Dinner events, graduation evenings, weddings, birthday parties, New Year Eve and other celebrations at RSD 9, Tariff number 21 Public manifestations and presentations (cultural, political and commercial) at RSD 8, If the Hotel should engage artists for the Customer, the Customer shall bear all costs of the engagement of the artists, as well as any other costs, fees and liabilities towards the state authorities and other agencies. Muzički program, umetničke izložbe Ukoliko su prava trećih lica ugrožena događajima (autorska prava itd), Korisnik je dužan da o svom trošku pribavi odgovarajuće dozvole pre održavanja manifestacije, kao i da plati takse koje direktno iz toga proizlaze. Hotel je oslobođen odgovornosti u slučaju da treća lica podnesu zahtev za naknadu štete i plaćanje taksi zbog gore navedenih razloga. Korisnik snosi sve troškove i druge obaveze za učešće umetnika na događajima organizovanim u Hotelu. Hotel nema bilo koju obavezu u smislu ovog člana. U skladu sa zakonom o autorskim pravima i srodnim pravima, prema članu 125 Korisnik snosi sve troškove fonograma prema sledećim uslovima: Tarifni broj 19 Modne revije, izbori za mis i slično po ceni od RSD 18, Tarifni broj 20 Zabave, maturske večeri, brucošijade, svadbe, rođendani, proslave nove godine po ceni od RSD 9, Tarifni broj 21 Javne manifestacije i prezentacije (kulturne, politicke i privredne) po ceni od 8, Ukoliko Hotel za potrebe Korisnika angažuje umetnike, svi troškovi za učešće umetnika i svi drugi troškovi, takse i druge obaveze prema državnim organima i drugim organizacijama padaju na teret Korisnika Decoration Material, Exhibits for Events Decoration material, exhibits and other personal items belonging to the Customer and/or third parties, used by the Customer at the Hotel, shall be kept in the Hotel premises at the Customer s own risk. The Hotel assumes no liability for loss, destruction or damage to such items, except in cases of gross negligence or intent on part of the Hotel and/or its staff. 10 associated with the loss of life, bodily harm or injury to health. Likewise exempt from the release from liability are all instances where, due to specific circumstances of the individual case, safekeeping items constitutes a duty whose performance is essential to proper contract performance and whose fulfilment the Customer is entitled to expect (material contractual duty). Any decoration material used by the Customer must comply with the fire protection regulations in terms of its manufacture and use. The Hotel may require submission of official proof of such conformity. Where no such proof is furnished, the Hotel may remove and store any such material at the Customer s expense. The installation and arrangement of items on walls and ceilings shall be subject to a prior written consent of the Hotel. Any exhibits or other items brought along by the Customer shall be removed without undue delay after the end of the event. If the Customer fails to do so, the Hotel may remove and store such items at the Customer's expense. If such items should remain at the event premises, the Hotel may charge the agreed price of hire of such premises for the period such items remain. The Customer shall observe environmental protection measures and the Hotel rules relating to environmental protection. Otherwise, the Customer shall be held liable for any violation of environmental protection regulations. smrti, telesne povrede ili narušenja zdravlja. Dekoracijski materijal koji upotrebljava Korisnik mora biti proizveden i korišćen u skladu sa propisima o zaštiti od požara. Hotel ima pravo da o tome zahteva zvaničnu potvrdu. Ukoliko se Korisnik ne povinuje ovom zahtevu Hotela, Hotel ima pravo da ukloni i uskladišti dekoracijski materijal o trošku Korisnika. Pismena saglasnost Hotela je neophodna za instaliranje i postavljanje predmeta na zidove i plafone. Svi izložbeni ili drugi predmeti doneti od strane Korisnika ili učesnika događaja moraju biti uklonjeni odmah nakon završetka događaja. Ukoliko Korisnik ne ispuni svoju obavezu i ne ukloni odmah predmete, Hotel ima pravo da ih sam ukloni i uskladišti o trošku Korisnika. Ukoliko navedeni predmeti ostanu u prostorijama za događaje, Hotel može naplatiti ugovorenu cenu smeštaja u sobi za period trajanja u kome predmeti ostanu u sobi. Korisnik je dužan da preduzima mere zaštite životne sredine i da poštuje pravila Hotela koja se odnose na zaštitu životne sredine, u suprotnom Korisnik je odgovoran za kršenje propisa o zaštititi životne sredine Customer s Liability The Customer shall be liable for any damage to the Hotel building and equipment caused by the Customer, participants in and visitors of the event organised by the Customer, the Customer s staff or other third parties working at the event. The Hotel may require the Customer to furnish adequate collaterals (such as deposits, guarantees, insurance policies, etc). Odgovornost Korisnika Korisnik odgovara za svu štetu na hotelskoj zgradi i opremi koja je izazvana od strane Korisnika, učesnika i posetioca manifestacije u organizaciji Korisnika, osoblja Korisnika ili trećih lica koja rade na tome. Hotel radi zaštite od odgovornosti može od Korisnika zahtevati sredstva obezbeđenja (depozite, garancije, osiguranja i sl.)

11 Defects, Customer s Obligation to Cooperate In the event of any defects, breach of any rights, etc, the Customer shall promptly notify the Hotel thereof, so that the Hotel may remove the defect or make the agreed service available as soon as possible. Where this is not be possible, due to the nature of the defect or other justified circumstances, notification of defects must nevertheless be made to the Hotel on return of the rooms at the latest. The Customer shall make all efforts to prevent, minimise or contribute to removal of the damage. Obaveza obaveštavanja Za svako oštećenje, povredu prava i sl. Korisnik je dužan odmah da obavesti Hotel kako bi Hotel bio u prilici da u što kraćem roku otkloni kvar ili da obezbedi ugovorenu uslugu. Ukoliko zbog prirode nedostatka ili drugih opravdanih razloga to nije moguće, obaveštenje o nedostatku mora u svakom slučaju biti učinjeno Hotelu, odmah nakon saznanja, odnosno najkasnije prilikom odjave sobe. Korisnik je dužan da preduzme sve radnje da spreči, umanji i doprinese otklanjanju oštećenja (štete) Hotel s Liability The Hotel shall perform its contractual obligations with the due diligence of a prudent businessperson. The Hotel s liability shall be governed by these General Terms and Conditions and the applicable laws of the Republic of Serbia. The Hotel shall be liable for the items brought along by the Customer according to the legal provisions of the Republic of Serbia. Insofar as Customer is allowed to store items in the Hotel garage or parking lot, etc, this shall not constitute a safekeeping agreement. Odgovornost Hotela Hotel ima obavezu da izvršava svoje ugovorne obaveze savesno i pažnjom dobrog privrednika. Hotel odgovara u skladu sa ovim Opštim uslovima i važećim zakonima Republike Srbije. Hotel snosi odgovornost za stvari koje je Korisnik doneo u skladu sa zakonskim odredbama Republike Srbije. Ukoliko je Korisniku omogućeno da smesti stvari u garaži hotela, na parkingu hotela ili sl., neće se zaključiti nikakav ugovor kojim se podrazumeva čuvanje tih stvari od strane Hotela. Na sve što nije predviđeno ovim Opštim uslovima, primenjivaće se važeći propisi Republike Srbije Final Provisions Any amendments to the Contract on accommodation and/or events shall be in writing. A waiver of this requirement shall also be in writing. The place of performance and payment shall be the registered office of the Hotel. If any disputes should arise, the case in dispute shall be referred to the court having the jurisdiction over the Hotel s registered office. The laws of the Republic of Serbia shall apply Završne odredbe Izmene i dodaci ugovora o smeštaju i događajima moraju biti u pisanom obliku. Odricanje od obaveze sastavljanja pisanog ugovora takođe mora biti u pisanom obliku. Mesto izvršenja i sve isplate će se vršiti u registrovanom sedištu Hotela. Za sve eventualne sporove ugovara se nadležnost suda prema registrovanom sedištu Hotela. Ugovara se isključivo primena Zakona Republike

12 exclusively. The UN Convention on Contracts for the International Sale of Goods and provisions on conflict of laws shall not apply. Should individual provisions of the Contract on accommodation and events or individual provisions of these General Terms and Conditions for hotel accommodation and event hosting become invalid, the validity of the remaining provisions shall remain unaffected thereby.
