1 BPS MAHILA VISHWAVIDYALAYA KHANPUR KALAN (SONIPAT) NOTICE INVITING APPLICATIONS FOR HOSTEL MESS CONTRACTS THREE IN NUMBERS Applications on the prescribed proforma are invited under sealed cover from experienced contractors (not less than five years) for the academic session , should reach in the office of the undersigned on 18 th of July by 1.p.m. sharp, under all circumstances. The tenders will be opened on 18 th July, 2009 at 3.00 p.m. The allotment for contracts shall be decided after interviewing the contractors and also by considering their past experience. 3 AGREEMENT BOND HOSTEL MESS CONTRACT This agreement is made between Mr. /Ms. S/O /D/O herein called the Contractor as the first party and the Chief Warden. BPS Mahila Vishwavidyalaya Hostel No. as the second party for providing and serving Meals to the residents of the Hostel. TERMS AND CONDITIONS: GENERAL 1. This agreement for BPS Hostel Messes shall be for 11 months. W.e.f. July, 2009 to May, On the condition that the contract shall be for 3 months initially and on satisfactory performance it be extended for the full session. 2. The contractor shall procure the licence issued by the Health Authority, Chandigarh under the prevention of Food. Adulteration Act at his own cost. 3. Mess premises in the hostel with equipment and water supply fixtures shall be provided to the contractor on a payment of Rs. 450/- p.m. as utility charges including rent. The payment should be made by the 10 th of every month. Water in the Canteen and dining area shall be free of charge. Rs. 1000/- p.m. shall be charged as payment for electricity. 4. One/two unfurnished servant quarters shall be provided for the contractor. No servant shall be allowed to stay in the Mess area after duty hours. At the cessation of the contract the contractor shall vacate the premises within two weeks, an extension of a maximum period of 15 days may be granted for which he will be charged. Rs. 400/- for the period. 5. Furniture (chairs, work tables and dining tables) shall be provided by the Hostel. The maintenance and custody of the furniture shall be the responsibility of the Contractor and any loss or damage of the furniture shall be the liability of the Contractor.

4 6. Gas installation and empty gas cylinders shall be provided by the hostel against a cash security of Rs. 5000/-. To get refills of LPG for use shall be entirely the responsibility of the Contractor, its maintenance, repairs and losses for these shall be deducted from the Contractors bill. 7. Cylinders shall not be taken out of the fixed system. For any misuse or malpractice by the Contractor the contract shall be terminated without any notice. Legal action will be taken for any use of kerosene oil stove or any other fuels are prohibited. 8. Utensils for cooking, serving etc shall be supplied by the hostel to the Contractor and have to be returned to the hostel Office at the end of the session. Breakage and loss of these utensils shall be the responsibility of the Contractor and recovery at current rates shall be made from the security deposit of the contractor. The Contractor shall take over all equipment and gadgets after physical verification of the items. 9. The Contractor and the Mess servants shall be responsible for keeping the Mess clean and maintaining hygienic condition. The Mess staff will wear uniform while on duty and use aprons and overalls provided by the contractor. Non compliance of this shall make the Contractor liable for imposition of fine. OBLIGATORY 10. Canteen rates for the full session shall be fixed by the authorities and any revision of the rates shall be made by the authorities. The rates shall be binding on all Contractors. 11. The Contractor shall deposit Rs. 5000/- in cash as security deposit with the hostel for utensils/equipment. The same shall be refundable at the end of the session after final settlement of accounts. 12. A good food, good conduct A security deposit of Rs. 1000/- will be charged which is liable to the forfeited in case of repeated and serious defaults on the part of the Contractor. Decision of the Warden in this regard shall be final. 13. All the material and food articles shall be kept in closed covered containers.

5 14. The authorities or their nominee shall have access to the premises at all times to inspect & see that the agreed conditions are strictly adhered to. 15. Smoking and consumption of alcohol/intoxicants in the premises is strictly prohibited. 16. The Contractor will remain on the premises during working hours only. He shall take permission from the Warden when moving out of station. 17. The Contractor shall not close the Mess without the order of the Warden. Any such misconduct shall be liable to a fine of Rs. 1000/- or less or termination of contract or both. 18. For self-termination of the contract the Contractor shall give a notice of one month in advance, otherwise his security deposit shall be forfeited. 19. The Contractors shall cooperate with the Chief Warden regarding garbage disposal and follow her instructions to ensure proper disposal. 20. Food will not be served to the residents in their rooms by the contractor without Warden s permission. 21. The Contractor will employ one servant for every 50 resident Mess members as well as one cook and one assistant cook. 22. The Contractor shall maintain complete service record and biodata of all employees engaged by him, their photographs, addresses, signatures etc and submit the same to the office of the concerned Warden. 23. The Contractor will employ only persons who are medically fit employees. All employees before being engaged for duty shall undergo a complete medical check-up (urine, stool examination) at M.S.M. Ayurvedic Hospital Khanpur Kalan. 24. Police verification of the Mess employees shall be done by the Contractor with the Police Station Sonipat/Gohana/Khanpur Kalan. The contract will be operative only after the Contractor produces the medical certificate and police verification of all employees of the mess.

6 25. Any change of an employee shall be brought to the notice of the Warden concerned and the Contractor shall get their medical examination and police verification done immediately. 26. General discipline and hostel rules are to be observed by the Contractor and his employees. The Contractor shall be fully responsible for the conduct of his employees. 27. The Contractor shall observe and follow the conditions laid down in labour laws, employment Act and wages Rules etc. 28. The contractor shall use good quality ration items and other materials approved by the hostel authorities. PAYMENT AND DEFAULTERS: 29. The Contractor shall submit the Canteen bill for the residents by the 5 th of every month. The bill shall be prepared as per approved rates. The hostel office shall help in collection of bills and Rs. 3/- per account per month shall be deducted from the bill as collection charges. 30. The Contractor shall not serve food to any outsider except to the guests of bonafide residents. 31. The Contractor shall display the monthly bill of individual residents on the notice Board with entries in terms of amount due from the residents. 32. All the bills shall be cleared by 20 th of every month. 50% of the payment due to the contractor may be made 5 days after the bill is submitted. The defaulters in terms of non-payment of dues by resident shall be notified by the Office every month. 33. The Contractor shall not serve any defaulter for whom the service has been stopped by the Warden. Further bill in respect of defaulter shall not be entertained. 34. Equipment, gadgets, utensils and fixtures in the Mess shall be handed over to the contractor in good condition. Maintenance and proper repair of these items

7 shall be the responsibility of the contractor and expenses incurred on this as well losses shall be recovered from the contractor. 35. The hostel authorities shall prepare the menu every month as per seasonal availability and the same shall be followed unless the warden authorizes change. 36. In case of any dispute the decision of the Chief Warden shall be final. 37. Breach of terms of the contract or unsatisfactory service may lead to imposition of fine, issue of warning and termination of the contract. 38. For violation of any of the obligations and terms mentioned in the contract/agreement the contractor shall be liable to pay fine as imposed from time to time by the hostel authorities which shall not exceed Rs. 500/- at a time.
