1 YOUR ACCOMMODATION CONTRACT TERMS AND CONDITIONS OF RESIDENCE - INCLUSIVE STUDENT TENANCY FOR SINGLE OCCUPANCY IN SHARED HOUSE LET ROOM BY ROOM Brighton unihomes students and Hastings students living in Havelock Road If accepted, the University s offer of accommodation, these terms and conditions, the Unihome Guide 2015/16, Unihomes Guide to Living in Havelock Road 2015/16, the terms and conditions of Endsleigh Insurance s Block Insurance policy and the Fair Use Policy published by Glide relating to utilities and other services ( or Virgin Media relating to internet (www. virginmedia.com), depending on the provider, will create legally binding obligations between the University and the Student. Please read all of these documents and make sure you understand and agree to all of them before you make a commitment. For students new to the university who have been allocated a room as part of the online application process, the agreement between the university and the student becomes legally binding once the first instalment of rent (due in advance) is paid, the student has confirmed that they have had the opportunity to read these terms and conditions and the university has confirmed the booking by . In the case of returning students the agreement between the university and the student becomes legally binding once the student has confirmed that they have had the opportunity to read these terms and conditions at the point the contract is signed. The agreement is governed by English law which international students may find quite different to the law which applies in their own country. Take advice before making a commitment if you feel you need it. Students in Hastings should contact the accommodation team on telephone number or accomhastings@brighton.ac.uk Accommodation at the Residence as described in the University s offer of Accommodation The house or flat named in the University s offer of Accommodation The fixtures fittings and equipment in the Accommodation The fixtures fittings and equipment at the Residence which are for students use but which are not allocated to any student s room The Accommodation Contents and the Residence Contents Any shared facility such as kitchen, bathroom, common or other room allocated to the Accommodation and those parts of the University s property which are necessary for the purpose of gaining access to the Accommodation The due date(s) for payment of instalments of Rent specified in the University s offer of Accommodation, or such dates as may subsequently be specified in a written payment plan agreed between the University and the Student page 1 of 9

2 Period of residence Rent The Period of Residence specified in the University s offer of accommodation The amount specified in the University s offer of accommodation payable in advance on or before the Payment Date(s). This sum includes the price of the Services Rights (a) to occupy the Accommodation during the Period of Residence (b) to use the Contents (c) to use the Common Parts (d) to use the Services Services (a) insurance of the Residence and of the Student s personal possessions under the University s block insurance policy (b) broadband internet service suitable for the study requirements of the occupiers (c) utilities* including gas, electricity, water supply and drainage (d) a regular cleaning service of Common Parts, fortnightly for Brighton properties and weekly for Havelock Road In these terms and conditions University includes all buildings belonging to the University and not just the main University building whose address is given on the first page of these terms and conditions. The University grants the Rights to the Student for the Period of Residence on these terms and conditions and as set out in the 2015/16 Unihome Guide and in Endsleigh Insurance s Block Insurance policy. The Student agrees to comply with his/her obligations in these documents. *Although utilities are included, a fair usage policy applies to students living in Brighton Unihomes. The University will charge for consumption over the fair usage allowance. 1.0 Student s Obligations 1.1 To pay the Rent to the University in the specified instalments in advance on or before the Payment Date(s) or such other dates as the University may have agreed with the Student in a written payment plan. 1.2 Within 24 hours of the Student taking up occupation, to check the Residence and report any discrepancy or damage to the Unihomes Team on the inventory form provided (if the form is not in the Residence a replacement can be obtained from the Unihomes Team). If the Student does not report any damage, or missing items, at the start of occupancy the Student may not be able to rely on the inventory at a later date to prove that the damage was not the Student s fault. 1.3 To keep the Accommodation, the Accommodation Contents and (jointly with other students) the Residence Contents and the Common Parts in a clean and tidy condition and not to damage them. Advice on cleaning is set out in the 2015/16 Unihome Guide. The University may give the Student written warning if the Accommodation or the Common Parts serving it needs to be cleaner or tidier. If there is no improvement on the date of the follow-up visit specified in the warning notice, the University shall be entitled to hire cleaners to do the work and recover the cost of doing so from the Student (and in the case of the Common Parts, a share of the cost, depending on the number of students entitled to use them). 1.4 To report to the Unihomes Team any damage, defect or want of repair at the Residence or any failure of the water, electricity, broadband, telephone or gas supplies as soon as reasonably practicable and in any event within 24 hours of becoming aware of it. To report to the Unihomes Team promptly any fire or accident resulting in injury or resulting in damage to any part of the Residence or to the Contents. To notify the Unihomes Team (in advance, where practicable) if the Residence is likely to be unoccupied for 7 days or more. To report to the Unihomes Team promptly any suspicious circumstances likely to affect the security of any part of the Residence. Where the Student becomes aware of damage to the Residence caused by an intruder, to report the incident to the Unihomes Team as soon as reasonably practicable (and in any event within 24 hours). Nothing in this clause requires the Student to put their personal safety at risk. page 2 of 9

3 1.5 At the end of the Period of Residence to leave the Accommodation and the Residence (in a clean and tidy condition and clear of all rubbish and personal belongings) and to return the keys/passes/fobs for the Accommodation and the Residence to the Unihomes Team. If the Student leaves rubbish in the Accommodation or the Common Parts at the end of the Period of Residence (other than in the normal refuse bin outside the Residence), the University will hire contractors to clear it and will re-charge the cost of removal and disposal to the Student. If rubbish is left in the Common Parts, and the University is unable to identify the person(s) responsible, the contractor s charge will be divided equally among the occupiers who have access to the area concerned, plus an administration fee. The University is entitled to remove any other item left in the Residence by the Student at the end of the Period of Residence and will only attempt to contact the Student to arrange for collection if an item is obviously worth over 50. The Student will be liable for any delivery or storage charges. If the Student cannot be traced, or fails to collect an item within two weeks, the University may dispose of the item in what it considers to be the most appropriate way, without incurring any liability to the Student. 1.6 To allow the University and its appointed contractors, at all reasonable times and after giving reasonable notice, to enter the Accommodation for the purpose of viewing, inspection, maintenance or repair. No notice will be given in an emergency, or where it is necessary to have access because the University (acting reasonably) has serious concerns about the Student s welfare, or needs to investigate or attend to a health and safety matter. No notice will be given where access is required only to the Common Parts, or where the need for repair (or any other matter affecting the suitability of the Accommodation for habitation) was reported by the Student. In other cases the University will aim to give 7 days prior notice for planned maintenance work and 24 hours prior notice for other purposes. As long as the University has given the required notice where applicable THE UNIVERSITY WILL BE ENTITLED TO ENTER WHETHER OR NOT THE STUDENT IS PRESENT. If the Student is not present at the time of the visit, the University will leave a note in the Residence to inform the Student that a visit has taken place. 1.7 To comply with all applicable legislation to avoid the Student s actions or negligence having an adverse effect on the University, on other occupiers of the Residence, or on the owners or occupiers of nearby property. 1.8 To comply with The University s Formal Regulations (supplied to the Student in the Student Handbook 2015/16 and available to view at and not to commit misconduct, as defined in those regulations. To comply with the reasonable requests and directions of the University s accommodation staff. 1.9 To pay to the University all costs reasonably incurred in enforcing the Student s obligations in these terms and conditions or arising from a breach of them (including a proper and reasonable administrative charge for notification of breaches and reminders for payment) Where damage or loss occurs at the Residence and it is not possible for the University (acting reasonably) to ascertain who is at fault, to pay a fair and reasonable proportion of the cost of repairing the damage or reinstating the loss. The University may charge a proper and reasonable administration fee per occupier where the University (in its reasonable discretion) considers it is appropriate to cover its costs of rectifying the damage and collecting payment for it. The Student shall not be required to contribute to loss or damage which (in the University s reasonable opinion) has been caused by an intruder provided that the Student has complied with his/her obligations in these terms and conditions relating to security Promptly to send to the Unihomes Team a copy of any communication the Student receives which is likely to affect the Residence or the Accommodation (such as a notice from the local authority or a letter about the property or the tenancy from a neighbour) Not to alter, add to or do anything which may cause damage to any installation or any equipment in the Residence or which may be a fire risk or in any other way put the health and safety or security of others or the University s or other people s property or the Endsleigh Insurance Block Policy at risk. Common examples include covering smoke detectors, burning candles, failing to ventilate bathrooms and kitchens and use of portable gas or electric heaters, but this is by no means an exhaustive list. The Student must within 3 days of request either provide a safety certificate for, or remove from the Residence, any item which in the University s reasonable opinion, is unsafe otherwise the University may remove it without further notice to the Student, charge any storage costs to the Student, and (unless perishable or illegal) return it to the Student at the end of the Period of Residence. Causing or increasing fire, health and safety or security risks will be treated by the University as a serious breach of these terms and conditions, which could give rise to early termination of the agreement under clause Not at any time to bring a firearm to the Residence. This restriction on firearms applies whether or not the firearm is licensed, and it also applies to imitation firearms. Not to bring any other item to the Residence which could be used as an offensive weapon unless the Student has a valid and lawful reason for having it in his/her possession. page 3 of 9

4 1.14 To comply with the University s policy on smoking (available online: and in particular not to smoke in the Residence or in any other part of the Residence. Smoking in Residences, which are all designated as non-smoking areas of the University, will be treated by the University as a serious breach of these terms and conditions, and persistent breaches could give rise to early termination of the agreement under clause To comply with the University s Drugs and Alcohol Policy (available online: public/documents/staffcentral/doc pdf). Breach of the University s Drug and Alcohol Policy will be treated by the University as a serious breach of these terms and conditions, and could give rise to early termination of the agreement under clause 4.2. NOTE: the University s Drugs and Alcohol policy does involve referral to the police. Convictions and even police cautions for drug-related offences can seriously impair or destroy completely - career prospects in some types of employment, e.g. teaching, health professions Not at any time to leave the Accommodation unoccupied without locking the door and window. Not to leave the Residence main entrance open or to allow anyone to enter who is not a resident, a resident s guest or a representative of the University carrying identification. Nothing in this clause requires the Student to put themselves at any risk if anyone attempts to force entry. In such circumstances, the Student should not resist but should report the incident at the earliest possible opportunity to the Unihomes Team Not to put anything harmful, or which is likely to cause or contribute to blockage, in any pipes or drains Not to remove from, affix to, change, damage, or attempt to repair the structure or decorative finish of any part of the Residence or the Contents Not to bring additional furniture (including items such as fridges, cookers and portable heaters) into the Residence. Students who need to keep medication refrigerated may apply to the Unihomes Team for written permission to keep a fridge in their Accommodation, and this will not be unreasonably withheld Not to use the Accommodation for any purpose other than as a study bedroom and not to use other parts of the Residence for any purpose other than for their designated use Not to share, sub-let or transfer occupancy of the Accommodation or Residence to any person. Unauthorised occupation of the Residence will be treated by the University as a serious breach of these terms and conditions, which could give rise to its early termination of the agreement under clause Not to have any visitors in the Residence after midnight. One overnight guest who must be over the age of 18 is permitted to stay with the Student on the conditions set out in the Unihome Guide 2015/16. An overnight visitor is permitted to stay for no more than 2 consecutive nights in a period of 7 nights. Overnight visitors who stay longer or more frequently will be regarded as unauthorised occupiers Not to cause any nuisance, offence, disruption, harassment, threatening behaviour or persistent disturbance to others. Noise nuisance and anti-social behaviour at any time will be treated as a serious breach of these terms and conditions which could lead to termination of the agreement under clause 4.2. At all times the Student must avoid creating noise at a level which interferes with the comfort, study or sleep of another resident or the occupiers of neighbouring property Not to add to or change the telephone, television or information technology installations in the Residence. This is because the owner of the property pays for the installation. If the Student does not comply with this clause and the owner of the Property or the University incurs charges (including reconnection charges) as a result, the Student will be liable to pay those charges including reconnection charges within 24 days of invoice Not to bring into the Residence any animal unless it is a trained assistance aid for a person with a disability. The Student is requested to notify the University in advance if an assistance animal is needed at the Residence, as adjustments may need to be made to accommodate it and to ensure that other residents are able to live where animals are present. Students will be responsible for the proper care and control of assistance animals and any damage or nuisance which an animal causes If the Student brings any motorised vehicle to the Residence, they must not cause an obstruction or nuisance to other residents in the area by inconsiderate or illegal parking. Students with mobility assistance vehicles should contact the Unihomes Team when booking to ensure the Residence has suitable parking facilities. page 4 of 9

5 1.27 Not to ride, drive or keep any vehicle (or vehicle parts) in the Residence unless it is a mobility assistance vehicle suitable for such use. Users of mobility assistance vehicles are requested to contact the University in advance as the University may need to make reasonable adjustments to accommodate the vehicle (but this does not impose any obligation on the University if the vehicle cannot reasonably be accommodated) Not to cause any obstruction of the Common Parts. Obstruction of fire escape routes is a criminal offence and will be treated as a serious breach of these terms and conditions and may lead to early termination of the agreement under clause Where the Student becomes aware of damage to the Residence caused by an intruder, to report the incident to the Unihomes Team (or University security in an emergency) as soon as reasonably practicable (and in any event within 48 hours) Where applicable, to pay a proportion of the Council Tax relating to the Residence during the Residence Period. The proportion will be based on the number of non-exempt occupiers in the Residence. The Student will not have any liability under this clause for any period during which they personally are exempt from liability to pay Council Tax. 2.0 University s Obligations 2.1 To provide the Services, subject to these terms and conditions, the Unihome Guides 2015/16 and the Endsleigh Insurance Block policy. The Residence should have working internet access and the charge for this (but not for any calls made) is included in the Rent. Use of Services by Brighton Unihomes students is subject to a fair use policy, available to view at If the internet is provided by Virgin Media use of this service is subject to a fair use policy available to view at The regular cleaning service is subject to staff availability and the University shall not be liable for failing to provide the service in the event of sickness, extreme adverse weather conditions, industrial action or other circumstances beyond its reasonable control. Regular cleaning provided by the University does not relieve the users of Common Parts of their obligation to keep the Common Parts tidy, do their own washing up and wipe down surfaces after use. Cleaning provided by the University is conditional on the cleaners having reasonable access to the Common Parts and may be suspended if the Common Parts within a flat are persistently left untidy. 2.2 No notice will be given where access is required to the Residence in an emergency, or where it is necessary to have access because the University (acting reasonably) has serious concerns about the Student s welfare, or needs to investigate or attend to a health and safety matter. No notice will be given where access is required only to the Common Parts, or where the need for repair (or any other matter affecting the suitability of the Residence for habitation) was reported by the Student. In other cases the University will aim to give the Student at least 7 days notice for planned maintenance and 48 hours notice for other purposes prior to entering the Residence during term-time. As long as the required notice has been given, where applicable, the University will be entitled to enter the Accommodation whether or not the Student is present. 2.3 Not to interrupt the Student s occupation of the Residence more than is reasonably necessary. 2.4 Not to disclose personal information obtained from the Student except as permitted by clause 3.2 of these terms and conditions or where there is serious risk of harm to the Student, to others, or to the University s or another person s property. 2.5 To give a receipt for any of the Student s property which is confiscated in accordance with these terms and conditions To ensure staff are clearly identified, and that any staff or contractors requiring access to the Residence carry and allow the Student to inspect appropriate identification documents. 2.7 To maintain any kitchen facilities in the Residence Common Parts in good order and repair, and keep any equipment there in proper working order. The University will not be liable to repair any item unless the need for repair has been reported to the Unihomes Team or the item was identified during a property management inspection as being in need of repair. page 5 of 9

6 3.0 Other conditions 3.1 The Student is responsible for the conduct of any invited visitor(s). 3.2 The Student hereby authorises the University to use his/her personal data for all lawful purposes in connection with their agreement (including debt recovery, crime prevention, the University s Block Policy with Endsleigh Insurance, measuring satisfaction, trying to achieve an appropriate student mix in the Residence, allocating rooms or where there is a serious risk of harm to the Student or to others or to the University s or others property) and all matters arising from the Student s membership of the University or of a partner college. If at the end of the Period of Residence the University is reasonably satisfied that the Student has not paid their share of the utility bills for the Residence, the Student hereby authorises the University to release the Student s contact details to the utility provider or the other occupiers for the purpose of obtaining money that is due. 3.3 The University s liability for loss or damage to person or property is excluded unless the loss or damage is caused by the University s negligence, breach of a statutory obligation, a breach of its obligations in these terms and conditions or the authorised actions of its employees. Personal belongings left at the Residence are at the Student s own risk. Although the Student s personal belongings are insured under the Endsleigh Insurance Block Policy that insurance is subject to the conditions, exclusions, limitations and excesses of the policy. Top-up insurance cover is available direct from Endsleigh, and details of how to arrange this are given on the Endsleigh web-site The University is not liable for any failure in the provision of lighting, heating, water supply or any telecommunications service where the failure is due to a reason outside the University s reasonable control. The University is not liable for any failure in the provision of any Service or equipment, for whatever cause, unless the failure is for a continuous period of more than 48 hours after the University becomes aware of it. 3.4 The University may delay the repair of any damage which the Student or other occupiers cause until the Student and/or the other occupiers pay for it, or until the cost is met by insurance. The University will not delay repair if the repair is necessary in order to make the Residence or the Accommodation safe. If the University carries out a repair, it may still charge the person(s) responsible for the damage retrospectively. In deciding whether to claim against insurance, the University will do what is reasonable in the circumstances. If the University claims against insurance, the person(s) responsible for the damage will be liable to pay any excess. The Student will normally be liable to pay the whole of the policy excess if the damage is to the Accommodation, and a reasonable share of the excess if the damage is to the Common Parts. As students have collective responsibility for the shared areas of the Residence, You may have to contribute to the insurance excess for damage to the Common Parts even if you did not personally cause the damage. 3.5 The University may temporarily suspend use of the Common Parts, to allow professional cleaning to be carried out. If the University does this, it will not withdraw essential services from the Accommodation, such as electricity and water supply. The University may give users of the Common Parts written warning if the users need to keep the Common Parts cleaner or tidier. If there is no improvement on the date of the follow-up visit specified in the notice, the University shall be entitled to hire cleaners to do such additional work as is reasonably necessary to restore the Common Parts to the condition they should be in. If the University does this, the University shall be entitled to recover the additional cost of cleaning from the users. The Student will pay a fair and reasonable proportion of such costs (calculated on the basis of the number of students entitled to use the Common Parts concerned). The University will suspend use of the Common Parts only so long as is necessary for cleaning, but it will not provide alternative Common Parts during that time. 3.6 The agreement between the University and the Student does not affect the disciplinary powers of the University or of any partner college of the University. A breach of the Student s obligations in these terms and conditions shall be treated as a breach of the University s Formal Regulations and be subject to the University s disciplinary procedures (www. studentcentral.ac.uk). Where the Student is a member of a partner college, the Student is nevertheless subject to the University s Formal Regulations, in addition to being subject to the partner college s regulations. The University may take disciplinary action itself against a partner college student who is in breach of his or her obligations in these terms and conditions and/or refer the matter to the partner college for such action as it deems appropriate. If the University (or the partner college, where appropriate) takes disciplinary action against the Student in relation to an accommodation matter, and the disciplinary action results in the Student being liable to pay a fine, the University shall invoice the Student for the amount of the fine. 3.7 During the Period of Residence the University is entitled, at the Student s expense, to remove from the Accommodation or other parts of the Residence any article which constitutes an obstruction or a fire or health or safety risk or which is on display and likely to give serious offence to other people but (unless perishable) will if requested return it to the Student on the termination of the agreement. page 6 of 9

7 3.8 The agreement is not for an assured shorthold tenancy. It is for a student tenancy under paragraph 8 of Schedule 1 to the Housing Act Notices relating to the agreement must (unless the Student has a disability which prevents them from giving written notice) be in writing (which includes ) and the University s address is given on the first page of these terms and conditions. This is the address to be used for service of any proceedings on the University. The University may serve any formal notice on the Student by leaving it at the Residence (unless the University is aware that the Student has ceased to occupy the Accommodation) or by first-class post to the Student s last-known address These terms and conditions are not intended to confer any benefit on any person other than the Student and the University These terms and conditions, the policies referred to in them, the Unihome Guides 2015/16 and the terms and conditions of Endsleigh Insurance s Block Policy contain all the terms agreed to by the University and the Student regarding the Residence at the time the agreement comes into effect and any variation to the terms will only be effective if agreed between the Student and a member of the Unihomes Team. The University will confirm any agreed variation to the Student in writing at the time the variation is made If for any reason beyond the University s control the Accommodation is not ready for occupation at the start of the Period of Residence (for example, if a prior occupier has refused to leave, or if the Accommodation needs work carrying out to it) the University will offer the Student comparable alternative accommodation and the Student will accept it (provided it is comparable or better). Where the alternative accommodation is in, or within half a mile of, the same Residence as the Accommodation, and of the same or better type, and in good repair and condition, it shall be regarded as comparable and suitable, and shall not constitute a variation to what the University agreed to provide. 4.0 Termination of the Agreement 4.1 (a) Unless the Student has made arrangements with the University for late arrival the agreement will automatically terminate if the Student has not taken up residence within the first seven days of the Period of Residence. The Student will be liable for the Rent up to and including that date; (b) If the Student has made arrangements with the University for late arrival but has not taken up residence by the agreed late arrival date, the agreement will automatically terminate on the agreed late arrival date, and the Student will be liable for the Rent up to and including that date; 4.2 The University may terminate the agreement at any time by serving a notice to determine (sometimes referred to as a termination notice or notice to quit) on the Student if: (a) any payment is overdue by 14 days or more or (b) the Student is in serious or persistent breach of any of the Student s obligations or (c) the Student does not have status as a student of the University (d) In the reasonable opinion of the University the health or behaviour of the Student constitutes a serious risk to him/ herself or others or the University s or another person s property 4.3 The University entered into the agreement with the Student on the basis that the Student undertook a legally binding commitment for the full Period of Residence. The University is prepared to agree to the Student terminating their agreement early, but only if the Student first complies with ALL the conditions listed below at (a) to (d) in this clause. The Student will remain liable for the Rent until all the conditions have been satisfied. The four conditions, all of which must be satisfied, are: (a) the Student has completed and handed in a University Residence Termination Form (available from the Unihomes Team) notifying the University that s/he wishes to leave; and (b the Student makes payment for, or puts right, to the University s reasonable satisfaction, all breaches (if any) of the Student s obligations in these terms and conditions; and (c) a replacement student (who is reasonably satisfactory to the University as a tenant and who is not already a tenant of the University) enters into an agreement with the University (the University will assist the Student in finding a replacement, but does not guarantee it will be able to find one); and (d) the Student pays a fee (of 50 where the University finds a replacement student or of 25 where the Student finds the replacement student) towards the University s costs of administration and inspecting and cleaning the Accommodation. Conditions (b) to (d) in this clause shall not apply if the Student is able to show that the reason for termination is a serious or persistent breach of the University s obligations in these terms and conditions or because the Student is prevented from continuing their studies or incapable of independent living because of a disability. page 7 of 9

8 4.4 The Student may apply to transfer to another room in the Residence or at another University residence but the Student must first: (a) apply to the University for a transfer; and (b) if a transfer is granted, enter into a new agreement for the new accommodation; and (c) pay to the University a 25 administration fee; and (d) have complied with their obligations in these terms and conditions in all important respects. 4.5 The University will make vacated rooms available to other students for room transfers, but transfers will not be treated as replacements for the purpose of satisfying the obligation to find a replacement set out in condition 4.3(c). Refunds of Rent will only be given where the empty place in the Residence caused by the Student s early departure has been filled and there is no loss to the University. The University shall be entitled to fill any rooms which are already vacant before allocating people on its waiting list to the Accommodation. 4.6 If the agreement is terminated early by either the University or the Student the University will refund a fair proportion of prepaid Rent (after making any proper deductions to cover its losses). Any refund will be made as soon as possible after the termination of the agreement becomes effective (this means after all the conditions in clause 4.3 have been met). Pre-paid Rent will only be refunded for the period where the empty place in the Residence caused by the Student s early departure has been filled and there is no loss to the University (unless the Student is able to show that the reason for termination is a serious or persistent breach of the University s obligations in these terms and conditions or because the Student is prevented from continuing their studies or independent living because of a disability). 4.7 (a) The University reserves the right to relocate the Student to comparable alternative accommodation during the Period of Residence where it is reasonable to do so (for example if a person with a disability needs an adapted room). Unless the reason for relocation is because the Student is in breach of one or more of their obligations in these terms and conditions the Student will have the right to terminate their agreement (without having to comply with the conditions in clause 4.3, and without compensation) as an alternative to relocating; (b) Where the University relocates the Student because the Student is in breach of one or more of their obligations in these terms and conditions the Student shall pay the University an administration fee of The University s acceptance of the keys at any time shall not in itself be effective to terminate the agreement while any part of the Period of Residence remains unexpired. 4.9 Many contracts have a cooling-off period in which the customer can cancel the contract without penalty. There is no cooling-off period for the Student s contract relating to the Accommodation (see regulations 2(a) and 6(1)(d) of the Consumer Contracts (Information, Cancellation and Additional Payments) Regulations 2013, available to view at The Student s contract will be binding when the University sends the Student an confirming that the booking process for the Accommodation has been completed. Once that has been sent, the Student will only be entitled to end the Accommodation contract early as permitted by clause Consumer Protection 5.1 The name of the supplier of the Accommodation is the University of Brighton. Its address for all matters in connection with the contract for the Accommodation, including the service of proceedings and complaints is: (a) For Brighton students: The Accommodation Service, The Manor House, Moulsecoomb Place, Brighton, BN2 4GA. (b) For Hastings students: Accommodation Services, Priory Square, Priory Street, Hastings, TN34 1EA. 5.2 The University will be supplying a furnished study bedroom in a shared house or flat, with lighting, heating and water supply, as described in the University s offer of accommodation to the Student for the period specified in that offer. 5.3 The price of the Accommodation is stated in the University s offer letter to the Student. This includes the services described on the first page of these terms and conditions. 5.4 The University s VAT registration number is GB The arrangements for payment are set out in the University s offer letter to the Student. page 8 of 9

9 5.6 (a) If the Accommodation was allocated as part of the online application process, the agreement between the University and the Student becomes legally binding once the first instalment of rent (due in advance) is paid, the Student has confirmed that they have had the opportunity to read these terms and conditions, and the University has confirmed the booking by . (b) If the Student is a returning student the agreement between the University and the Student becomes legally binding once the Student has confirmed that they have had the opportunity to read these terms and conditions at the point the contract is signed. 5.7 The offer of accommodation and the price remain valid until the deadline stated in the University s offer of accommodation. If the offer is accepted before the deadline expires, the price remains valid throughout the Period of Residence. If the offer of accommodation is not accepted by the deadline, the offer will automatically lapse. 5.8 The minimum duration of the agreement is for the Period of Residence, unless the University or the Student exercises their rights to terminate early, as set out in, and in accordance with, these terms and conditions. 5.9 Whilst the University has offered the Student a place in the Residence, and will try to locate the Student there, the University does not guarantee that the named Accommodation will be available in all cases and if the named Accommodation is not available, the University will offer the Student alternative accommodation of an equivalent or better quality at the same price or give the Student the right to cancel the agreement without charge The University subscribes to the Universities UK/Student Accommodation Code dated 17 August END OF TERMS AND CONDITIONS page 9 of 9
