3 What is NMVTIS? Established by the Anti Car Theft Act of 1992 (Public Law ), the Anti-Car Theft Improvements Act of 1996 (Public Law ), and its implementing regulations (28 C.F.R. part 25). A system that allows the titling agency to instantly and reliably verify the title history, title brands, and title information on the paper title with the electronic data from the state that issued the title. 3

4 The Role of the American Association of Motor Vehicle Administrators (AAMVA) The Act authorizes the designation of a third-party operator of NMVTIS. Since 1992, AAMVA has acted in this capacity and operates the System today. AAMVA is a nonprofit, tax exempt, educational association representing U.S. and Canadian officials responsible for the administration and enforcement of motor vehicle laws. 4

5 What is the Purpose of NMVTIS was created to: NMVTIS? Provide consumers protection from unsafe vehicles; Protect states and consumers (individual and commercial) from fraud; Prevent the introduction or reintroduction of stolen motor vehicles into interstate commerce; Reduce the use of stolen vehicles for illicit purposes including funding of criminal enterprises. 5

7 The Role of the U.S. Department of Justice (DOJ) Within DOJ, the Bureau of Justice Assistance (BJA) is responsible for overseeing both policy and enforcement elements of the program: BJA coordinates enforcement activities with the Federal Bureau of Investigation, the National Highway Traffic Safety Administration (NHTSA), and state and local law enforcement agencies; BJA works in partnership with the system operator, the American Association of Motor Vehicle Administrators (AAMVA); Coordinates and maintains tools for LE access to NMVTIS. 7

8 The Role of States State titling agencies must perform title verifications, report data and pay user fees to NMVTIS. Each state is required to perform an instant title verification check before issuing a certificate of title for a vehicle that an individual or entity is bringing into the state. States are also required to make selected titling information that they maintain available for use in NMVTIS. States shall provide information on new titles and any updated title information to NMVTIS at least once every 24 hours. Each state is charged annual NMVTIS user fees The date for full compliance by states is January 1,

9 Junkers, Salvage Yards and Insurance Carriers are business entities that are required to report data in 30 days. AAMVA partnered with the private sector to provide multiple reporting methods to meet the business needs of reporting entities. Currently, there are four reporting methods or services available, offering individual VIN and batch reporting options: AAMVA Single VIN Reporting Service AUDATEX The Role of Consolidators, Salvage Junkers and Insurance Carriers AUTO DATA DIRECT, INC. 10 The Role of Consumers NMVTIS information is available to consumers (individual and commercial) in a NMVTIS Vehicle History Report. A NMVTIS Vehicle History Report is intended to only provide data on five key indicators associated with preventing auto fraud and theft. Prior to purchasing a used vehicle, consumers can search NMVTIS to find information on these five key indicators: 1. Current state of title and last title date 2. Brand history 3. Odometer reading 4. Total loss history 5. Salvage history 10

11 The Role of Law Enforcement Law enforcement uses NMVTIS to combat fraud and criminal activities. The LE Access tool is maintain by DOJ. 11

17 Chapter 1 Dealer Assignments Best Practice: Dealer reassignments should accompany the title when a title transfer transactions occurs. However, for NMVTIS, the title number field should always be the title number, not a reassignment document number. Benefit: Consistency among jurisdictions will save time for the jurisdictions and will reduce the misunderstanding of title information. 17

18 Chapter 5 Resolving Vehicles with the Same VIN and Cloned Vehicles Best Practice: Both vehicles should be visually inspected for the hidden VIN. After vehicles are accurately identified, adjust records in NMVTIS to accurately reflect the records. Use the UNDO process to remove inaccurate records to ensure they are not appended to the correct record. Determine true status of in error record or cloned vehicle; add to NMVTIS correctly and apply correct brands Benefit: Data integrity is restored by uniquely identifying the vehicles and applying the appropriate history. 18

19 Best Practice: Chapter 8 Title Transaction Type When considering NMVTIS transactions use the following terms: Duplicate title - replaces the original title because it was either lost, destroyed defaced, stolen or illegible. Corrected title issued when the vehicle information or any other elements on the title have been changed and a new title with the changes is issued. Reissued title reprint of the title with the same title number may be on the same day (paper jam) or an different date. The best practices contains detailed instructions on how to update NMVTIS, what transaction type to use for batch states, on-line states and using state web inquiry for these and other transactions. Benefit: The integrity of NMVTIS data is maintained. Minimizes duplicate entries and complete vehicle history is maintained and not distributed to more than 1 record. 19

20 Chapter 11 Brands on Nontitled Vehicles Best Practice: Jurisdictions that register but do not title certain vehicles should brand the VIN record on NMVTIS as if the vehicle was titled. Jurisdictions that accept a registration as proof of ownership in its titling process, should carry brands forward on that VIN to the new paper title being issued Every jurisdiction should perform a NMVTIS inquiry before issuing any title to verify the current state of record and convey any branding. Benefit: This ensures the integrity if the brand record for a vehicle without regard to the state process of titling or registration as proof of ownership. 20

21 Chapter 13 Recovered Stolen Vehicles Best Practice: Jurisdictions should report brands denoting a stolen vehicle was recovered to ensure that the brand file is updated and reflects all applicable brands. Benefit: Proper reporting and branding leads to less confusion as to the status of a vehicle. Improves data integrity which leads to a better understanding of the value and condition of a vehicle. 21

22 Chapter 20 Batch System Error and Warning (SEW) Messages Best Practice: Understanding the difference between warning and errors is critical. An error means the attempted data change did not take place on the NMVTIS system and correcting the record deserves a high priority from the jurisdiction. A warning means that the record was updated but requires the jurisdiction to review the record. Warnings should be reviewed as resources allow. The NMVTIS State Procedures Manual provides information on the severity of errors and warnings. Benefit: Understanding that correcting errors should be a high priority and reviewing warnings a lower priority, helps jurisdictions to properly manage their workload. Correcting all errors leads to increased data integrity. Reviewing warnings when possible improves data integrity. 22

23 Chapter 22 Keeping Contact Information (Help Desk) Up to Date Best Practice: Jurisdictions should establish help desk support by implementing a group phone number and voic account as well as a group account. If a jurisdiction does not have this capability, then they must keep their help desk contact list up-to-date. To update the contact list send the request to the helpdesk@aamva.org or call , option 1. Benefit: A group phone and account allows for faster responses to other jurisdictions, improving their ability to process titles and to help their customers. Keeping help desk contact information up-to-date, reduces frustration and saves time for your colleagues in other states. 23

24 Chapter 23 Stolen Blank Title Documents Best Practice: Stolen or missing blank title stock should be reported by sending an to AAMVA and AAMVA will communicate the information to all jurisdictions. See very specific instructions in Appendix B on page 52. If the stolen or missing title stock is later recovered, AAMVA should also be notified. Jurisdictions should have a systematic way to identify stolen and missing title stock reported by other jurisdictions; such as system alerts based on the inventory or control numbers. Benefit: Will prevent fraudulent use of stolen title stock when a title application is presented with the stolen title in another state. Promotes consumer protection. 24
