1 To: From: Airport Commission Airport Staff ITEM 3(b)(i) Subject: Commercial Operations Permit: Elham Sagharchi Date: April 23, 2018 Discussion Attached for your review and consideration, is an Application for Commercial Operations Permit (COP) for Elham Sagharchi. Elham Sagharchi proposes to lease studio space located at 3026 Airport Ave, Santa Monica, #13, Santa Monica, California contingent upon the approval of the COP. The studio space is located within the Santa Monica Art Studios leasehold in a designated non-aviation use area. Elham Sagharchi is a painter. Elham Sagharchi will use the space as a painting studio. Access to the airside is not required. Elham Sagharchi will have one employee based at the site. The overall impacts associated with the use will be minimal and are comparable to those associated with other nearby office tenants. Staff has reviewed the Elham Sagharchi Application for Commercial Operations Permit and has determined that it meets City s requirements. Prior to commencing business activity Elham Sagharchi will be required to obtain a City of Santa Monica Business License and appropriate insurance for the proposed use consistent with established City policy. Recommendation The City Manager can deny, grant conditionally or grant the application and make the appropriate factual and legal determinations for that decision subject to the following restrictions, along with any other restrictions that may be reasonably related to the guidelines set forth in the Municipal Code: 1. The term of the COP shall coincide with the term of the sublease agreement; month-tomonth tenancy, and comply with all terms and conditions set forth in the master lease. 2. The Commercial Operations Permit is site specific to the proposed subleased premises. 3. Unless otherwise directed by the Airport Director or his designee, Elham Sagharchi shall 1

2 park vehicle(s) upon the leasehold space. 4. The COP is specifically issued to Elham Sagharchi. for office use, no other purpose is herein granted. 5. The Applicant s work involves office use; the Applicant is required to adhere to all health and safety laws and regulations and shall operate in a manner that does not interfere with the quiet enjoyment of other nearby tenants. 6. The COP is not transferable or assignable to other individuals, employees or companies. 7. Elham Sagharchi is required to conduct its business activities in accordance with all other applicable City Ordinances, laws, and rules and regulations. 8. The Airport Director must approve any signage. 9. Failure to adhere to the above listed restrictions and conditions shall be considered a material breach of the COP and subject to termination of the COP.
