1 GENERAL PROVISIONS AND BUSINESS REGULATIONS BY COMPANY Auto Centar Šibenik d.o.o. INTRODUCTORY PROVISIONS Article 1. Services user hereafter ( Passenger ; Client ) means the person who uses the company s website of the company Auto Centar Šibenik d.o.o. with a fee, or the person who orders the services of the company personally or by phone, or any visitor to our website that fills out the electronic form for ordering services/ transfers ( hereafter : form for ordering ). The user of the service/ passenger enters into a mandatory relationship with the company either by filling out the form for ordering service/ transfer, either by using the services provided by the company. THE MEANING OF THE EXPRESSION Article 2. The company - Auto Centar Šibenik d.o.o. Service user ; Client ; Passenger represents an adult who uses the company s services with a fee for the service provided. Service means a trip organized by or for a company account, ordered by or for a client s account. The service consists of transportation services, and other specially ordered activities accompanied by an expert guide, as well as mediation when negotiating the above-mentioned client account services. Vehicle means a car, a van, a minibus or a bus. Transfer transport of limited number of passengers depending on the type of vehicle, the service user receives the driver who carries the inscription with the name of the service user, and leads to the agreed address, destination. Vehicle rental means the provision of land and sea transport services by the company as a rental vehicle with the driver.

2 The main passenger means the person whose name is first mentioned on the order form and the same person is an adult of age of 18 ( eighteen) years of age. By the act of booking a company service, the main passenger accepts these general terms and conditions. The main passenger is the person responsible for paying the entire amount of compensation received from the ordered and/ or executed services/ transfers, which includes possible insurance premiums and cancellation fees. A person who has not reached the age of 18 or for another reason has no statutory right of representation can not take over the main passenger obligations. The main passenger accepts the obligation to complete and correct the data of other passengers on all the ordered services, which includes notice of any changes made after the original order. The main passenger confirms that all passengers accept these general terms and conditions. The main passenger is the only person who can make changes or additions to the services ordered. This provision shall be deemed unenforceable in the case of death or injury of the main passenger, in which case we will accept written instructions for cancellation or modification of order by other passengers or legal representative of the original main passenger. Partner means an external service provider from which the company for its account, orders the provision of services or activities forming an integral part of the service. Partner may have its own terms and conditions ( partner terms ). Confirmation or voucher means a document confirming the order of the service, which contains all the details specified in the order form unless it is otherwise stated, which we send you via , or you are handed over personally after printing through our computer system. NATURE AND SCOPE OF THE COMPANY SERVICE Article 3. The company provides services consisting of organizing travel in the form of renting a vehicle with a driver or a transfer. The company provides a car rental service if a transfer to a car service customer who is contracted with the passenger/ main passenger. In particular, they are contracted to participate in various transfer activities or expert guides services, which are ordered by the express wish of the service user.

3 Various pre-defined additional services may be listed in the order form together with the price list if they are available and relate to the selected service. The company is authorized to charge the service/ transfer. No one has the right on behalf of the company to request an overcharge or change the terms of service/ transfer expect in cases when is expressly provided under the terms of this ordinance. SERVICE USER/ PASSENGER Article 4. Service user/ passenger is every adult who is holder of rights and obligations within the borders of the Republic of Croatia, and as such a person is able to enter into legally binding agreements in their own name and on behalf of other passengers. Juveniles or children can use the services of the company just with their parents or the legal guardian. TAKING AND LEAVING SERVICE USER/ PASSENGER AT THE DESTINATION Article 5. Unless otherwise stated, all services will start and end at a predetermined location ( starting point) entered in the order form. The takeover and retrieve addresses must be entered legibly and clearly in the form of recorded addresses that unambiguously point to the geographic location within the area of the desired destination. Local names, abbreviations or descriptions are allowed only as a companion to a formal registered address for the purpose of facilitating. The company excludes any liability for delays or cancellations caused by the incorrect addresses listed.

4 In case the starting and destination addresses are in the pedestrian zone, we are only obliged to provide the service to the nearest available vehicle access location. The company fails to respond to any loss or inconvenience that may arise from the stated circumstances of an undefined or inaccessible address. Company employee/ driver will wait for the service user at the starting point of the signed start point. In the event of a difficulty encountering a driver encounter, the service user is obligated to call the customer support department. In the event that you do not do so, rather than ordering an alternative transport service, the company or partner will be considered to be fully exempt from any contractual, actual or legal obligation or liability towards the user of the service. If the service user is not at the destination at the scheduled start of the service/ transfer, nor will you reach the destination for the next 30 minutes, or at the time you contact the office of the company either by telephone, or via , it will be deemed not to have appeared ( no show), and the service user will be charged for all the services/ transfers he has ordered. If the service provider fails to comply with the terms of the contract, he or she shall be entitled to claim the right to a refund. The company undertakes to take all actions to comply with the agreed time of arrival and departure in accordance with the order form and the information provided on our website, all the above terms and durations are non binding estimates. PERSONAL LUGGAGE Article 6. Each passenger has the right to one travel bag or suitcase and one item of hand luggage, such as purse. The longest side of the travel bag or suitcase can be dimensions up to 69 centimetre/ 27 inch. Sides of hand luggage can be up to 55,40 or 24 centimetre each/ 22,16 or 10 inch. The user of service is obliged to announce the bigger pieces of luggage in advance in order to secure the necessary place. The user of the service is aware that additional and/ or larger pieces of luggage will mean additional costs, in accordance with our current price lists.

5 Unless otherwise stated in the order form, the cost of transporting the personal luggage in accordance with the provisions of this article is included in the price. The user of the service is aware that if he has an unusually large amount of luggage per person or has any doubt about the vehicle s capacity, they will contact the company and provide a list of all luggage pieces with dimensions and weights. The company is not required to provide unreported luggage if there are insufficient seats in the vehicle. TRANSPORT OF CHILDREN Article 7. The legal provisions of the road traffic safety act stipulate that passengers must be tied to the car seat belt, the child is counted as an adult. Children can not use service of transfer without an adult. Children s car seats are available on request, and children up to 5 years of age are required to have a child seat, and the customer is obliged to emphasize when booking. If children are in need of out- standard seating, the service provider is obliged to emphasize it in advance and ask when ordering the service from the company. PERSONS WITH SPECIAL NEEDS Article 8. People with disabilities who use a wheelchair and have the need outside the standard seats the user of the service is obliged to emphasize it in advance and ask when ordering the service from the company.

6 TRANSPORT OF ANIMALS Article 9. With the exception of trained dog guides, we are able to transport animals only if they are placed in suitable containers, such as crates or cages, and in case the main passenger has requested a written permit for transporting the animals before the start of the transfer. ROUTE OF TRAVEL Article 10. We reserve the right to change the route if a contracted route entails problems or disruptions caused by elemental disasters, car accidents. The geographical maps on our website are in this sense illustrations. RESERVATION, ORDRRING AND FULFILLMENT OF THR TRANSPORT SERVICE Article 11. The transfer reservation must be completed at least 48 hours before the start of the transfer. If the user of the service wishes to reserve the transfer within 48 hours is obligated to contact the company employee only who will send the final confirmation by or in writing. Article 12. The client orders transportation services from one of our website, via phone, or personal arrival at the offices of the company.

7 The employee of the company will send a confirmation of the received transport/transfer via as soon as your application is processed. Article 13. The client/ main passenger is responsible for providing and completing the required information in the form, and the accuracy of all the details of the order, and paying the full amount of the fee in accordance with the content of the order form. Article 14. Our company s obligation to provide you with transportation services begins with the issuance of a certificate. Confirmation of receipt obligates user of the service to pay the service in accordance with the order form. Digital records from our servers will be considered as proof that you have received this certificate, or confirmation. The obligation of the service user to the company ceases with the end of the journey and arrival at the destination, or its cancellation in accordance with Article 16. The service user is required to keep the receipt confirmation from the company during the service or transfer period. PAYING THE SERVICE Article 15. To the users of the services the company allows payment by cash, bank transfer, cards ( Maestro, Visa, MasterCard) and via PayPal online payment service. The costs incurred by the company for the account and the cost of the service/ passenger s use, which are not part of the offer of the transport, the user agrees to settle them in cash upon presentation of the invoice by the driver/ employee of the company.

8 Service users can make the following payment methods: - Pre payment advance and difference to the full cost of the day-transfer service to the driver - Full price pre-payment - Full payment of the service on the day of transfer We reserve the right to refuse all requests for the use of payment methods other than the payment methods chosen when making an order. CANCELLATION OF RESERVATION Article 16. By cancelling the booking service/ transfer within 48 hours of service/ transfer, the customer will not be refunded the paid amount. By cancelling the service/ transfer reservations for more than 2 days and less than 14 days from service/ transfer, and if the service provider was paid 30% of the total transfer price, the amount will not be refunded. By cancelling the service/ transfer reservations for more than 2 days and less than 14 days from service/ transfer, and if the user has paid the full amount of transfer, the full amount returned will be refunded by 20 euros. By cancelling the service/ transfer reservations more than 14 days from the execution of the service/ transfer, the company undertakes to pay the amount paid, whether in part or in full amount. HIGHER FORCE Article 17. The company is exempt from liability and is not held liable under these general terms and conditions if the company or any of its agents, or a partner in the fulfilment of his/her

9 obligation, is unable to meet the obligations assumed due to the consequence of the force that would arise after the reservation/ transfer service. Under the higher force is considered an external event that could not be foreseen, avoided or remedied, nor by reasonable treatment prevented their effect. In accordance with the provisions of paragraphs 1 and 2 of this article, force majeure, thunderstorms, landslides, floods, fires, wars, terrorist attacks, extraordinary state decisions, strikes, and other events that can not be influenced are considered by force. RIGHTS AND OBLIGATIONS OF THE USER/ PASSENGER Article 18. It is strictly forbidding disturbing and deconcentrating driver when driving. The user of the service/ passenger for the duration of the driving or transfer is obliged to obey the laws and regulations of the Republic of Croatia and to comply with the provisions of these general terms and conditions, as well as the oral instructions and warnings of the driver. The user of the service/ passenger for the duration of the driving or transfer is obliged to possess all valid documents proving his identity, as well as necessary documents, which they would have to give to officials and various supervisors during the journey/ transfer. The se user of the service/ passenger agrees to plan by himself their arrival at the airport/ ferry at least 2 hours before boarding the aeroplane/ boat or hydrofoil. The user of the service/ passenger accepts all the responsibilities for possible missing of the flights or similar problems due to delays in the destination or insufficient time for transfer to the airport/ ferry. Upon receipt of a driving/ transfer certificate, the user of the service will be referred to the driving/ transfer cancellation conditions specified in Article 16. The user of the service/ passenger responsible is considered in causing the accident, causing injury, loss or damage to property caused by inappropriate behaviour, including behaviour influenced by substances of any kind, including prescription medicines used for medical purposes. The user of the service/ passenger, if he/ she has booked a service consisting of a return journey, may cancel each one of his or her two rides individually.

10 RIGHTS AND OBLIGATIONS OF THE COMPANY Article 19. The company commits the contracted service/ transfer to be accountable and professionally in accordance with the transport customs and norms and in accordance with the applicable regulations and laws of the Republic of Croatia. The company ensures the correctness of the vehicle and that it is secured in accordance with the laws of the Republic of Croatia. The user of the service/ passenger is insured for the duration of the transfer. The company undertakes to make a ride/ transfer on the received form of booking the service user in a quality and professional manner. The company has the exclusive right of denial of service to the service user/ passenger if - It thinks that they are not in condition to travel and/ or use the services they have ordered - It thinks that with its actions could cause discomfort to other passengers, drivers or bring anyone in danger or cause property damage If the driver/ employee of the company inspects arrival at the scheduled destination of departure and start of service, that the user of the service/ passenger can seriously harm the driver or the property of the company or the vehicle, the user of the service may in such circumstances be canceled without the right to refund or claim any compensation. LEGAL OFFENSE OF THE GENERAL TERMS AND CONDITIONS Article 20. By filling out the order form and using the service/ transfer you acknowledge that you have read, understand and accept all items contained in these general terms and conditions and on the other order form. The service/ transfer order form will be considered as an inseparable part of these general terms and conditions and as such is a legally valid document.

11 The user of the service/ passenger is obliged to accept the full text of these general terms and conditions and fully comply with it. The company indicates that it will not provide any services to clients who have not adhered to these general terms and conditions, including the order form. For any ambiguity and clarification regarding the content in these general terms and conditions or the order form, we will tell you to contact the company by or by phone. FINAL PROVISIONS Article 21. In case of any objection, the user of the service/ passenger is obliged to obtain and present evidence in support of his claim and caused damages. The objection must be filled within 48 hours of the submission of the complaint. The company will not consider a groundless and untimely complaint. The company undertakes to base and timely complaints to consider and make a decision on the complaint within 30 days Article 22. In cases where the user of the service is entitled to a refund of the amount paid or the amount or the paid amount on any ground, the company undertakes to make a refund within 30 days. Article 23. All issues arising between the service user and the company will be sought to resolve the matter first by peaceful agreement outside the court. If the dispute is not solved by peaceful means, the Municipal Court in Šibenik is competent.
