1 Chapter 5 Assistance with insured vehicles and passengers immobilised as a result of a breakdown or an accident, or the theft of the vehicle (option) If the policyholder takes out this option, this must be expressly stated under the special terms and conditions. 5.1 Vehicle(s) option Special terms and conditions Vehicle registration This option applies only if the vehicle is registered in one of the countries listed below: Belgium, France (including Monaco), Germany, Great-Britain, Italy, Germany, Luxemburg, Netherlands and Spain Causes The services listed under Article apply in case of breakdown, accident, theft, attempted theft or an act of vandalism involving the insured vehicle. You, the insured The natural person defined under Article 1.1 as the habitual driver of the insured vehicle, plus the passengers Coverage Repair service/ towing/ transport of the vehicle in the country of residence (D) 1. If your insured vehicle is immobilised in your country of residence, we organise and pay for sending out a repair technician. If your vehicle cannot be repaired on the spot, we organise the following, at our expense: If your vehicle can be repaired on the day of the call: - the towing of your vehicle to the nearest garage or, if your vehicle is under the manufacturer s guarantee, to the nearest garage for the vehicle make; - the transport of the driver and passengers to the garage where the vehicle has been taken. If your vehicle cannot be repaired on the day of the call: - the towing of your vehicle to the garage you have indicated in your country of residence; - the transfer of the driver and passengers either to the garage where the car has been taken or to your home. 2. If the repair and towing service is organised by you, we will reimburse you the
2 cost of the repair/towing service up to an amount of EUR 200 per breakdown. 3. All parts supplied and the repair work are at your expense Repair service/ towing/transport abroad in case of immobilisation of vehicle for less than one day (E) 1. If your vehicle is immobilised abroad and can be repaired on the same day, we organise and pay for sending out a repair technician. If your vehicle cannot be repaired on the spot, we organise, at our expense: the towing of your vehicle to the nearest garage or, if your vehicle is under the manufacturer s guarantee, to the nearest garage for the vehicle make; the transport of the driver and passengers to the garage where the vehicle has been taken. 2. If the repair and towing service is organised by you, we will reimburse you the cost of the repair/towing service up to an amount of EUR 200 per breakdown. 3. All parts supplied and the repair work are at your expense Sending of spare parts (D/E) We look for and send, at our expense, the parts you need for the smooth running of the insured vehicle if the garage owner cannot find them locally. You must refund us the price, all taxes included (a.t.i.), practised in the country in which we have purchased the parts. All parts ordered must be paid for. If the price of the parts exceeds EUR 500, we will request payment in advance. Non-availability of parts in the country of residence or the cessation of their production by the manufacturer are circumstances of force majeure likely to delay our commitment or make it impossible Accommodation and transport of the driver and passengers while waiting for repairs taking more than one day (E) 1. If your vehicle cannot be repaired on the same day, we offer you the following choice: either we contribute to your hotel expenses for two nights up to an amount of EUR 250, a.t.i. per night and per room, while waiting for the repairs or, if you wish to continue your trip without waiting for the repairs: we organise and pay, up to a maximum of EUR 375 for all the persons concerned (driver and/or passengers): - depending on local availability, a means of transport of your choice to enable the driver and/or passengers to reach their destination, and - the return of the driver to the place where the vehicle is immobilised in order to fetch the repaired vehicle. The above-mentioned services do not apply in the Netherlands, Belgium, Luxembourg, France (including Monaco),Germany,Great Britain, Italy and Spain if you are entitled to a replacement vehicle under Article Once this coverage has been granted, the expenses mentioned under para. 1 shall be paid even if it transpires later that the vehicle could not be repaired Repatriation of a vehicle immobilised for over 72 hours abroad (E)

If the vehicle cannot be repaired abroad within 72 hours (period based on repair technician s estimate) dating from the time of breakdown, we offer you the following choice: either we proceed, at our expense, with the repatriation of your vehicle to the garage that you have indicated near your home or, if you prefer to have it repaired locally, abroad : we put on your disposal a replacement vehicle during 7 days maximum, according to the local disponibility. The costs of the replacement vehicle, the hotel costs, the transportion costs and all other expenses are limited to a maximum of 600 EUR all taxes included. If you are no longer on the spot, we will arrange transportation for you to go and collect your car once it has been repaired. or if you decide to abandon the wrecked vehicle on the spot, we pay for the formalities relating to legal abandonment and defray the storage costs prior to abandonment for a maximum of 10 days. 2. Repatriation of the vehicle as described under para. 1 is not covered if the vehicle is judged to be a total loss (technically unrepairable) the vehicle is considered to be an economical loss (repair costs exceed catalogue value of the car Eurotax quotation list) the repatriation costs exceed the catalogue value (Eurotax - quotation list) or residual value of the vehicle the vehicle is destined to be scrapped. In this case we pay for the formalities relating to legal abandonment Repatriation of the driver and passengers immobilised abroad for over 72 hours (E) If the insured vehicle is covered by one of the services mentioned under Article , we repatriate the driver and/or passengers on the basis of the following options: If they wish to be repatriated without delay, we organise and pay for their transport back to your/their home If they wish to continue their journey and be repatriated later: - we organise and pay for a means of transport of their choice to enable the driver and/or passengers to reach their destination, up to a maximum of EUR 375 for all the persons concerned and - we organise and pay for the return of the driver and/or passengers to your/their home provided that their home is located in one of the countries listed below : Belgium, France (including Monaco), Germany, Great-Britain, Italy, Luxemburg, Netherlands and Spain. The performance to continue your journey does not apply to you if you chose to have your vehicle repaired on the spot, abroad, as described in article Assistance in the event of the theft of the insured vehicle (D/E) 1. If the insured vehicle is stolen while travelling, the driver and passengers are entitled to the following services: if the vehicle is found damaged within 24 hours of the theft being reported to the authorities, and if the driver and passengers wait while the repairs are being made, Article is applicable
4 if the vehicle is not found within 24 hours of the theft being reported to the authorities, we organise and pay for the return of the driver and passengers to their home. Article applies in the case of repatriation from abroad. 2. If the vehicle is stolen while travelling and is found within six months of the date on which the theft was reported to the authorities, you are entitled to the following services: If the insured vehicle is in a roadworthy condition, complies with legal provisions governing traffic on public highways and you are not there to fetch the vehicle, we send a driver. His job is to bring the vehicle to your home by the most direct route. We pay his salary and travelling expenses. Other costs (fuel, tolls, maintenance and repair costs) must be paid by you. If the insured vehicle is found broken down or damaged, we apply the services provided for in similar cases in this chapter (repair technician, towing, sending of parts, repatriation and storage). 3. The services mentioned under paragraphs 1 and 2 do not apply, however, if the vehicle is stolen within a radius of 5 km from your home. The place of the theft is the place mentioned in the statement to the police concerning the theft Storage costs (E) If we transport or repatriate the insured vehicle, we pay the storage costs for it from the day of the request for transport to the day of removal by our carrier Transport/ repatriation of luggage (E) If we organise your return home following the theft or immobilisation of the insured vehicle, the driver and passengers are entitled to the services listed under Article Assistance with trailer or caravan (D/E) We apply the following rules, depending on the circumstances, for trailers for luggage and non-residential caravans mentioned in the special terms and conditions and towed by the insured vehicle during a journey. In every case in which we organise the transport or repatriation of the insured towing vehicle, we tow, transport or repatriate the insured caravan or trailer. We do the same in the case of the theft of the insured towing vehicle or if you decide to abandon the wreck of the insured vehicle. In the event of a breakdown, accident, attempted theft or act of vandalism immobilising the insured caravan or trailer or in the event of the theft of the insured caravan or trailer, the latter is covered by the same assistance services as those provided for the insured towing vehicle (repair technician, towing, sending of parts, repatriation and storage). If the insured non-residential caravan or trailer is found in a roadworthy condition within six months of the date given in the statement of theft made to the authorities and if you are no longer present, we refund: - the fuel and toll costs to go and fetch it - if the distance of the return journey from your home exceeds 600 km, the cost of a hotel room for one night up to a maximum of EUR Transport / repatriation of a yacht (D/E)
5 We organise and pay for the transport/repatriation of a yacht mentioned in the special terms and conditions and towed by the insured vehicle under the following terms and conditions and in the following circumstances: 1 Conditions - the dimensions of the boat must not exceed 6 metres in length, 2.5 metres in width and 2 metres in height - the boat trailer must be capable, both technically and legally, of supporting the boat. If the boat trailer does not meet this condition or if it has been stolen, we cannot transport your boat unless you provide us with a replacement trailer. 2 Circumstances - if you are transported or repatriated for medical reasons that prevent you from driving the towing vehicle, and if no other insured person accompanying you can drive it in your place. - if the boat trailer or the towing vehicle is transported or repatriated by us - in the event of the theft of the towing vehicle or if you abandon the wreck of the insured vehicle. 5.2 Replacement vehicle Special conditions of application Vehicle registration This article applies only if the vehicle is registered in the Netherlands, Belgium, Luxembourg, France (including Monaco), Italy, Germany, Great Britain, Italy and Spain and provided that you have subscribed to the basic option mentioned under Article 5.1. You, the insured By derogation from the definition given under Article 1.1, the insured in this case is the natural person who is the habitual driver of the insured vehicle, the holder of a driving licence and over 21 years of age. Domicile Contrary to the definitions given in Articles 1.1 and 1.2.1, your home must be located in one of the following countries for the purposes of applying Article 5.2.2: Netherlands, Belgium, Luxembourg, France (including Monaco) Germany, Great Britain, Italy or Spain Replacement vehicle coverage Replacement vehicle in case of breakdown or accident (D) 1. By derogation from Article para.1, the following coverage applies. If your insured vehicle is immobilised following a breakdown or accident in your country of residence, we organise and pay for: the sending out of a repair technician and, if necessary, the towing of the vehicle to the nearest garage or, if your vehicle is under the manufacturer s guarantee, to the nearest garage for the vehicle make
6 the transport of the driver and passengers to the garage where the vehicle has been taken. If the immobilised vehicle cannot be repaired within two hours of the arrival of our repair technician, we organise and pay for: the transport of your vehicle to the garage you have indicated in your country of residence the provision of a replacement vehicle for a maximum of 120 consecutive hours. The replacement vehicle is provided only while the insured vehicle is immobilised. It is covered by a comprehensive insurance policy, for which you must pay the excess. You must agree to comply with the hire company s general conditions (deposit, age limits, etc.). 2. A replacement vehicle will not be provided in the following cases: immobilisation as a result of failure to maintain the vehicle concerned or to cover the period during which normal maintenance is being carried out if the habitual driver of the immobilised vehicle has not yet reached the age of 21 if you have not called us for the repair/towing of the immobilised vehicle at the time of immobilisation Replacement vehicle in case of theft of vehicle (D) 1 If your insured vehicle is stolen in your country of residence, we organise and pay for a replacement vehicle for a maximum of 120 consecutive hours starting from the date the theft is reported to the authorities, provided that the vehicle is not found in a roadworthy condition before the expiry of this period. The replacement vehicle is covered by a comprehensive insurance policy, for which you must pay the excess. You must agree to comply with the hire company s general conditions (deposit, age limit, etc.). 2 A replacement vehicle will not be provided in the following cases: if the habitual driver of the stolen vehicle has not yet reached the age of 21 if you have not reported the theft to the police and do not communicate to us the reference number of the statement drawn up Replacement vehicle in event of attempted theft or acts of vandalism (D) If the insured vehicle is immobilised following an attempted theft or act of vandalism, or a fire in the vehicle in your country of residence, or following damage to your home (fire, water damage, storm, explosion, hail, flooding), we organise and pay for the provision of a replacement vehicle for a maximum of 120 consecutive hours dating from the day of the damage. The replacement vehicle is provided only for the period during which the insured vehicle is immobilised. It is covered by a comprehensive insurance policy, for which you must pay the excess. You must agree to comply with the hire company s general conditions (deposit, age limit, etc.).
