1 4-1 TITLE 4 MUNICIPAL PERSONNEL 1 CHAPTER 1. SOCIAL SECURITY. 2. VACATION AND SICK LEAVE. 3. PERSONNEL REGULATIONS. 4. TRAVEL REIMBURSEMENT REGULATIONS. CHAPTER 1 SOCIAL SECURITY SECTION Policy and purpose as to coverage Necessary agreements to be executed Wiholdings from salaries or wages Appropriations for employer's contributions Records and reports to be made Exclusions Policy and purpose as to coverage. It is hereby declared to be e policy and purpose of is municipality to provide for all eligible employees and officials of e municipality, wheer employed in connection wi a governmental or proprietary function, e benefits of e system of federal old age and survivors insurance. In pursuance of said policy, and for at purpose, e municipality shall take such action as may be required by applicable state and federal laws or regulations. (1985 Code, 1-701) Necessary agreements to be executed. The mayor is hereby auorized and directed to execute all e necessary agreements and amendments ereto wi e state executive director of old age insurance, as agent or agency, to secure coverage of employees and officials as provided in e preceding section. (1985 Code, 1-702) Wiholdings from salaries or wages. Wiholdings from e salaries or wages of employees and officials for e purpose provided in e first section of is chapter are hereby auorized to be made in e amounts and at 1 Charter reference Appointment, promotion, suspension, etc.: 19.

There is hereby excluded from is chapter any auority to make any agreement wi respect to any employees rendering services of an emergency nature; to any employees rendering part-time services; to any employee rendering services who are compensated on a fee basis; and to any elective officials rendering legislative or judicial services. (1985 Code, 1-706) 4-2
3 4-3 SECTION Applicability of chapter Vacation leave Sick leave Leave records. CHAPTER 2 VACATION AND SICK LEAVE Applicability of chapter. This chapter shall apply to all full-time municipal officers and employees. (1985 Code, 1-801) Vacation leave. All officers and employees shall be allowed annual vacation leave wi pay after one year of employment. Vacation shall be earned in accordance wi e following schedule: Year of Employment Days Earned Per Mon st 1 rough 5 year 1 6 rough 10 year 1-1/6 11 rough 15 year 1-1/3 16 rough 20 year 1-1/2 Over 20 years 1-2/3 Vacation shall be taken at a time approved by e mayor or such oer officer as he may designate. A maximum of ten (10) days of accrued vacation may be carried forward from one calendar year to anoer. Accrued vacation leave will be paid for upon resignation or termination. (1985 Code, 1-802) Sick leave. All officers and employees shall be entitled to paid sick leave after being employed for a period of ninety (90) days. Sick leave shall be earned at e rate of one-four (1/4) day per week's work or irteen (13) days per year. Only earned sick leave may be taken. Sick leave not used may be carried from one year to e next. Sick leave shall be approved for absence due 1 Charter reference Board may adopt supplementary rules: 20.
4 to illness, bodily injury, exposure to contagious disease, or dea in e immediate family. However, e mayor or his representative may in his discretion require satisfactory evidence at absences are properly chargeable as sick leave and a doctors' certificate will be required for ree (3) days or more sick leave. Accrued sick leave will be traded for vacation leave at e rate of eight (8) days sick leave for one (1) day annual leave upon retirement, resignation, or termination and paid for wi oer accrued annual leave. (1985 Code, 1-803, as amended by Ord. # , Feb. 1995) Leave records. The mayor shall cause to be kept, for each officer and employee, a record currently up to date at all time showing credits earned and leave taken under is chapter. (1985 Code, 1-804) 4-4
5 4-5 CHAPTER 3 PERSONNEL REGULATIONS 1 SECTION Acceptance of gratuities Outside employment Political activity Use of municipal time, facilities, etc Use of position Acceptance of gratuities. No town officer or employee shall accept any money or oer consideration or favor from anyone oer an e municipality for e performance of an act which he would be required or expected to perform in e regular course of his duties; nor shall any officer or employee accept, directly or indirectly, any gift, gratuity, or favor of any kind which might reasonably be interpreted as an attempt to influence his actions wi respect to town business. (1985 Code, 1-901) Outside employment. No full-time officer or employee of e municipality shall accept any outside employment wiout written auorization from e mayor. The mayor shall not grant such auorization if e work is likely to interfere wi e satisfactory performance of e officer's or employee's duties, or is incompatible wi his municipal employment, or is likely to cast discredit upon or create embarrassment for e municipality. (1985 Code, 1-902) Political activity. Municipal officers and employees shall enjoy e same rights of oer citizens of Tennessee to be a candidate for any state or local political office, e right to participate in political activities by supporting or opposing political parties, political candidates, and petitions to governmental entities; provided e city is not required to pay e employee's salary for work not performed for e city. Provided, however, municipal employees shall not be qualified to run for elected office in e city council. The restriction against running for office in e city council shall not apply to elective officials. (1985 Code, 1-903, modified) 1 Charter references Acceptance of free services, etc., prohibited: 24. Political activity: 23.
6 Use of municipal time, facilities, etc. No municipal officer or employee shall use or auorize e use of municipal time, facilities, equipment, or supplies for private gain or advantage to himself or any oer private person or group. Provided, however, at is prohibition shall not apply where e governing body has auorized e use of such time, facilities, equipment, or supplies, and e municipality is paid at such rates as are normally charged by private sources for comparable services. (1985 Code, 1-904) Use of position. No municipal officer or employee shall make or attempt to make private purchases, for cash or oerwise, in e name of e municipality, nor shall he oerwise use or attempt to use his position to secure unwarranted privileges or exemptions for himself or oers. (1985 Code, 1-905) 4-6
7 4-7 CHAPTER 4 TRAVEL REIMBURSEMENT REGULATIONS SECTION Enforcement Travel policy Travel reimbursement rate schedule Administrative procedures Enforcement. The chief administrative officer (CAO) of e town or his or her designee shall be responsible for e enforcement of ese travel regulations. (Ord. # , Aug. 1993) Travel policy. (1) In e interpretation and application of is chapter, e term "traveler" or "auorized traveler" means any elected or appointed municipal officer or employee, including members of municipal boards and committees appointed by e mayor or e municipal governing body, and e employees of such boards and committees who are traveling on official municipal business and whose travel was auorized in accordance wi is chapter. "Auorized traveler" shall not include e spouse, children, oer relatives, friends, or companions accompanying e auorized traveler on town business, unless e person(s) oerwise qualifies as an auorized traveler under is chapter. (2) Auorized travelers are entitled to reimbursement of certain expenditures incurred while traveling on official business for e town. Reimbursable expenses shall include expenses for transportation; lodging; meals; registration fees for conferences, conventions, and seminars; and oer actual and necessary expenses related to official business as determined by e CAO. Under certain conditions, entertainment expenses may be eligible for reimbursement. (3) Auorized travelers can request eier a travel advance for e projected cost of auorized travel, or advance billing directly to e town for registration fees, air fares, meals, lodging, conferences, and similar expenses. Travel advance requests aren't considered documentation of travel expenses. If travel advances exceed documented expenses, e traveler must immediately reimburse e town. It will be e responsibility of e CAO to initiate action to recover any undocumented travel advances. (4) Travel advances are available only for special travel and only after completion and approval of e travel auorization form. (5) The travel expense reimbursement form will be used to document all expense claims.
8 (6) To qualify for reimbursement, travel expenses must be: (a) directly related to e conduct of e town business for which travel was auorized, and (b) actual, reasonable, and necessary under e circumstances. The CAO may make exceptions for unusual circumstances. Expenses considered excessive won't be allowed. (7) Claims of $5 or more for travel expense reimbursement must be supported by e original paid receipt for lodging, vehicle rental, phone call, public carrier travel, conference fee, and oer reimbursable costs. (8) Any person attempting to defraud e town or misuse town travel funds is subject to legal action for recovery of fraudulent travel claims and/or advances. (9) Mileage and motel expenses incurred wiin e town aren't ordinarily considered eligible expenses for reimbursement. (Ord. # , Aug. 1993) Travel reimbursement rate schedules. Auorized travelers shall be reimbursed according to e actual cost not to exceed State of Tennessee travel regulations rates. The municipality may pay directly to e provider for expenses such as meals, lodging, and registration fees for conferences, conventions, seminars, and oer education programs. (Ord. # , Aug. 1993) Administrative procedures. The town adopts and incorporates by reference--as if fully set out herein--e administrative procedures submitted by MTAS to, and approved by letter by, e Comptroller of e Treasury, State of Tennessee, in June A copy of e administrative procedures is on file in e office of e city recorder. This chapter shall take effect upon its final reading by e municipal governing body. It shall cover all travel and expenses occurring on or after July 1, (Ord. # , Aug. 1993) 4-8
