Completion of a survey will not improve any entrant s chance of winning. Eligibility: The America s Test Kitchen Equipment Giveaway Sweepstakes (the Promotion ) is open to legal residents of the United States and the District of Columbia 21 years of age and older at the time the promotion begins. The Promotion is void where prohibited or restricted by law or regulations. Employees, contractors, officers, & directors of America s Test Kitchen (the Sponsor ), their related brands, subsidiaries, affiliates and their immediate family/household members are ineligible. Promotion is subject to applicable federal, state, provincial and local laws and regulations, and void where prohibited, including, but not limited to, Puerto Rico, U.S. Virgin Islands, and U.S. military installations located in foreign countries. Promotional Period: Promotion runs from January 1, 2017 ( ) to December 31, 2017 (11:59 PM ) (the Promotional Period ). Agreement to the Official Rules: By participating in the Promotion, entrant warrants that s/he fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor, which are final and binding. There are twelve (12) Phases detailed below in the Prizes, Number of Prizes, and Approximate Retail Value ( ARV ) summary. Entries are limited to one (1) entry per individual per Phase. Entries completed using the Survey method will be valid for the respective Phase only to the extent that the Survey is completed and submitted no later than the respective End Time for each Phase. Proof of or online submission is not considered proof of delivery or receipt. All entries become the property of America s Test Kitchen. Entries limited to one (1) entry per individual per Phase. Any entry that is duplicative of an online entry by the same individual will be discarded. All mail-in entries must be handwritten. All mail-in entries must be postmarked no later than the respective End Time for each Phase and received within seven (7) days of the postmark date. No entries from a respective Entry Period will be rolled over as a valid entry in a subsequent Entry Period. All entries become the exclusive property of America s Test Kitchen, and none will be acknowledged or returned. Winners are responsible for all federal, state and local taxes, if any, associated with installation, acceptance, or use of the Prize. Prizes are provided "as is" and without any warranty of any kind. Prizes are nontransferable. No transfer or substitution of prizes (or any portion thereof) or cash alternative permitted, except the Sponsor reserves the right to substitute a prize of equal or greater value in the event the advertised prize is unavailable. Limit one (1) prize per individual. Shipping and handling for all prizes to the winners residential address in the United States will be paid for by Sponsor. Odds: Odds of winning depend on the number of eligible entries received. Winner Selection and Notification: Potential winners will be selected in a random drawing to be held on a monthly basis in Brookline, MA, from among all eligible entries received. All results of the selections are final and binding, subject to these Official Rules. In the event a winning entry is discovered to be invalid for any reason whatsoever or the person who submitted the winning entry fails to comply with these Official Rules prior to delivery of the Prize, the Prize may be forfeited and awarded to an alternate winner. If by reason of a printing, computer or other error, more prizes are claimed than the number set forth in these Official Rules, all persons making purportedly valid claims will be included in a computerized random selection to award the advertised number of Prizes available. No more than the advertised number of Prizes will be awarded. Notice to Winner: Attempts to notify potential winners will be made by U.S. mail and/or by within seven (7) days of the winners selection. Sponsor is not responsible for lost, stolen, late or misdirected mail or delivery or communication problems of any kind. If unable to make contact with the winner within seven (7) days after Sponsor first attempts to notify the winner, or if the winner fails to claim the prize within

4 seven (7) days after Sponsor first attempts to notify the winner, the Prize may be forfeited and awarded to an alternate winner. Prize winners may be required to sign, notarize and return an Affidavit of Eligibility and Liability/Publicity Release (except where prohibited by law) and provide any additional information (such as social security number), that may be required by the Sponsor. Potential winners must return all such required documents within (30) thirty days following attempted notification or Prize may be forfeited and an alternate winner selected. Publicity: Except where prohibited, participation in the Promotion constitutes an entrant's consent for the Sponsor, and the Sponsor's designees to use entrant's name, likeness, voice, opinions, biographical information, and city and state of residence for advertising, trade, publicity and/or promotional purposes in any media, including the World Wide Web, without review, notification, or approval and without further compensation. General Conditions: This sweepstakes is governed by the laws of the United States. All taxes on prizes are the sole responsibility of winners. Sponsor reserves the right to suspend or cancel the Sweepstakes or modify these Official Rules as necessary for any reason or as required by applicable law. Entries not in compliance with these Official Rules are disqualified. Sponsor shall have the absolute right to determine if an entry is in compliance with these Official Rules without notice to the person attempting to enter. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to any entry, the authorized account holder of the address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an address by an Internet access provider, online service provider, or other organization responsible for assigning addresses for the domain associated with the submitted address. A potential winner may be required to show proof of being the authorized account holder. Sponsor assumes no responsibility for undeliverable s resulting from any form of active or passive filtering by an entrant's Internet service provider and or client or for insufficient space in entrant's account to receive . Disputes/Choice of Law: Except where prohibited, each entrant agrees that this Promotion shall be governed by, and construed in accordance with, the laws of the State of Massachusetts, without giving effect to any choice of law or conflict of law rules. Sponsor reserves the right to take such action as it deems necessary to enforce these Official Rules and ensure the fair operation of this Promotion, including without limitation barring entrants who do not comply with these Official Rules. By entering, entrants consent to the

5 jurisdiction and venue of the appropriate federal, state and local courts located in Massachusetts for any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded. Limitations of Liability/Release: By entering the Promotion, each participant warrants that he or she has read and agrees to abide by these Official Rules and that he or she is not prohibited from participating in the Promotion. The Released Parties are not responsible for any incorrect or inaccurate information, whether caused by website users, any of the equipment or programming associated with or utilized in the Promotion, or any technical or human error which may occur in the processing of submissions to the Promotion. The Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, , players or browsers, whether on account of technical problems, traffic congestion on the Internet or at any website, or on account of any combination of the foregoing. The Released Parties are not responsible for any injury or damage to participants or to any computer related to or resulting from participating or downloading materials in this Promotion. If, for any reason, the Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Released Parties which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Released Parties reserve the right at their sole discretion to cancel, terminate, modify or suspend the Promotion and select a winner from among all eligible entries received prior to the cancellation.
