1 City of Asheville Request for Qualifica ons (RFQ): Engineering Services, Construc on Administra on, and Material Tes ng for Pebble Creek Stream Stabiliza on Project To All Interested Par es Date: January 10, 2019 I. GENERAL INFORMATION AND BACKGROUND : The City of Asheville is reques ng the submission of Statement of Qualifica ons from engineering firms to provide professional engineering services, construc on administra on, and material tes ng for Pebble Creek Stream Stabilization Project located in Asheville, NC. This QBS (Qualifica on Based Selec on) process will be u lized, in accordance with Chapter 143, Ar cle 3D of the NC General Statutes, to determine a qualified Firm to complete design and professional services for this project ; in accordance with the included Scope of Services. Submission by a firm to this RFQ does not mean that the firm will be awarded a contract for this project. The City is seeking a firm whose combina on of experience and exper se will provide mely, cost-effec ve and quality driven professional services to the City. II. 2 Format: Interested Firms with relevant experience and qualifica ons should submit three (3) hard copies of their Statement of Qualifica ons (SOQ). One (1) copy in a pdf format, should be ed to the City contact listed below or digital delivery (Dropbox, Google Drive, etc) to mcoates@ashevillenc.gov. Submi als should NOT include: bindings, tabs, covers, 3-ring binders. Submi als should be no more than 10 double-sided pages; 20 pages total, on 8.5x11 paper, stapled in top le corner, single spaced, 10 point font minimum, submission over 20 pages will not be considered. No ques ons will be answered within 7 days of submi al. Each Firm is solely responsible for the mely delivery of its proposal. III. SCOPE OF CONSULTANT SERVICES AND PROPOSED PROJECT: It is the intent of the Public Works Department Stormwater Division to contract with an engineering firm and\or team for professional services. Any firm wishing to be considered must be properly registered and licensed within the state of North Carolina and have a good ethical and professional standing. The City is seeking a team that will provide public engagement, project administra on, detailed design, construc on drawings and specifica ons, cost es mates, bid documents, construc on administra on, and materials tes ng for the Pebble Creek Stream Stabiliza on Project. This project will/may include surveying, watershed modeling, stormwater evalua on and design, structural evalua on and design, geotechnical evalua ons, sidewalk rehabilita on, minor stream restora on, sediment and erosion controls, and permi ng. Generally, consultants shall have the capability to provide, or cause to be provided, public input mee ng coordina on and serve as the lead in these session, design, survey, construc on documents, permi ng, bidding, and construc on administra on services as required for this project. Work may include, but shall not be limited to: detailed plan design, property owner and stakeholder iden fica on, possible right of way or easement acquisi on, prepara on of and acquisi on of all necessary environmental documents and permits, prepara on of construc on documents, and construc on contract administra on required for this project. 2/10

3 Consultants will work with key representa ves of city departments throughout all phases of project development. The an cipated schedule of this project is as follows: Est. Contract Start Date: April 2019 April - May 2019: Begin public engagement process, site survey Summer 2019: Design development, construc on drawings, permi ng Fall 2019: Construc on contract adver sement, bidding, and award Winter 2019: Start of construc on Project Background: The City has an easement along a por on of Dingle Creek that is located between two residen al buildings in the Pebble Creek Drive townhome community. The stream bank is currently comprised of gabion baskets filled with rip rap which are failing causing stream bank erosion and instability. The City wants to ensure the buildings are protected as well as the integrity of the stream. Detailed design for the stabiliza on of the stream while protec ng the buildings is key for the project. Structural integrity of the exis ng buildings must be secured during construc on. The construc on area is extremely limited, therefore, considera on must be given to op ons that are construc ble with the given site constraints and provide safe access to the buildings. Con nuous communica on and updates to project community and other stakeholders will be important throughout this project from design through construc on. IV. CONTENT REQUIREMENTS FOR THE STATEMENT OF QUALIFICATIONS 1. Prime Firm General Information: a. Provide a cover le er/le er of interest that briefly describes the proposing Firm (prime and sub-consultants) and its interest in performing the required profession services. The le er of interest should include the Project Managers background and the understanding of the RFQ and acceptance of the requirements of the RFQ. This is limited to two (2) numbered 8.5 x 11 pages. b. Provide the name of the consultants project manager with address and phone number. This person will be responsible for the execu on of the work and ensuring that adequate personnel and other resources are made available for the project, and who is responsible for the quality and meliness of the Consultant s performance. 2. Prime Firm Experience and Qualifications : a. Describe the prime Firm's unique qualifica ons as they pertain to this type of work. 3/10

4 b. Provide a descrip on of the Firm including in-house capabili es and any outsourcing services an cipated. Informa on should include Firm history, names and creden als of principal officers of the Firm, loca on of home and branch offices, honors and awards (if any) and areas of specializa on (if any). 3. Key Team Professionals : a. Provide an organiza onal chart of the design team lis ng the key members that would be directly involved in the project and what role they will perform. b. Provide a descrip on of the qualifica ons and experience of the key individuals from your team who will be ac vely involved in the work (including registra on numbers of landscape architects, engineers, architects, etc.). Include the office loca on in which each key individual is located. Clearly iden fy each key individual s experience with similar type projects, the specific role that individual performed, and the Firm they were employed by at the me of the project work. c. Resumes of team members that will be performing work may also be provided. This is not included in the total allowable number of pages submi ed. 4. Team Relevant Projects / References : List any contracts, currently in progress or performed in the past 5 years comparable to this RFQ, as follows: a. List a maximum of five (5) relevant projects. b. List only projects involving current staff, indicate which team members were actually involved in the project and specify their role. c. List relevant projects in date order with the newest projects listed first. d. Describe in detail the services your Firm & sub-consultants (if any) provided and the outcome of the project (On- me, On-budget, the number of change orders issued). e. Describe any experience in submi ng for development permits and approvals as required by any and all regulatory agencies including but not limited to: Asheville, North Carolina state, and Federal Agencies. f. Provide the client name for whom services were provided and the appropriate individual who may be contacted as a representa ve of each client (include phone number, and address of contact) 5. Project Understanding and Team Approach: a. Provide a descrip on of your understanding of the scope of work and how your team will approach the project. b. Provide a general schedule with an cipated milestones and dura ons.. c. Iden fy key tasks and how they will be handled. d. Explain any an cipated challenges with the project. 4/10

5 e. Provide a descrip on of the ability of the Firm to commit resources necessary to complete this project and the team to perform project tasks on schedule and on budget. 6. Unit Pricing: Provide unit pricing for all posi ons an cipated to be associated with the project. 7. Minority Business Plan: The City of Asheville has adopted a Minority Business Plan to encourage par cipa on by women and minority businesses in the award of contracts. In contrac ng for services, the City asks that in providing qualifica ons for this RFQ, any por on of the work where a subcontractor is necessary must be noted. It is expected that due diligence in outreach to minority and women-owned companies be performed. It is the policy of the City to (1) provide minori es an equal opportunity to par cipate in all aspects of its contrac ng and procurement programs and (2) to prohibit any and all discrimina on against persons or businesses in pursuit of these opportuni es. 8. City Requirements: a. Provide a statement of any legal judgments against your Firm within the last 5 years associated with project performance or professional liability. Upon request the Firm shall provide clarifica on of the judgment. b. Any Firm wishing to be considered must be properly registered with the Secretary of State of North Carolina, and possess appropriate professional licenses and cer fica ons. The contract will be subject to North Carolina law. c. The selected Firm must have the financial ability to undertake the work and assume the liability along with an adequate accoun ng system to iden fy costs chargeable to the project. d. The specific individuals and sub-consultants listed in the proposal and assigned to key posi ons shall not be removed or replaced without the prior wri en approval of the City. e. The selected Firm shall be required to meet the following requirements as a minimum (and may be modified pending the date of the contract): INSURANCE : The Successful Firm ( Firm ) agrees to keep and maintain for the dura on of this Agreement including but not limited to commercial general liability, professional liability, auto liability, workers compensa on, employer s liability, with at least the minimum limits 5/10

6 shown below. Firm shall provide evidence of insurance coverage consistent with this requirement prior to contract award. The Firm shall furnish the City with cer ficates of insurance for each type of insurance described herein, with the City listed as Cer ficate Holder and as an addi onal insured on the Contractor s general liability policy. In the event of bodily injury, property damage, or financial loss caused by the Firm s negligent acts or omissions in connec on with Firm s services performed under this Agreement, the Firm s Liability insurance shall be primary with respect to any other insurance which may be available to the City, regardless of how the Other Insurance provisions may read. No work shall be performed un l the Firm has furnished to the City the above referenced cer ficates of insurance and associated endorsements, in a form suitable to the City. Commercial General Liability: $1,000,000 per occurrence Professional Liability: $1,000,000 per claim-made Auto Liability: $1,000,000 combined single limit Workers' Compensa on: Statutory Employer's Liability: $1 00,000 INDEMNIFICATION : The Successful Firm (Firm) shall indemnify, defend and hold harmless the City and its subsidiaries, divisions, officers, directors and employees from all liability, loss, costs, claims, damages, expenses, a orney fees, judgments and awards arising or claimed to have arisen, from any injury caused by, or allegedly caused by, either in whole or in part, any negligent act or omission of the Firm or any employee, agent or assign of the Firm. This provision is not applicable to any claim arising out of or related to any ac ve or primary negligence of or by City, its officers or employees. Nothing herein shall be construed as a waiver on the part of the City to any defense of any claim, including, but not limited to the defense of governmental immunity. E-VERIFY EMPLOYER COMPLIANCE: The Selected Firm and their subcontractors with 25 or more employees as defined in Ar cle 2 of Chapter 64 of the NC General Statutes must comply with E-Verify requirements to contract with governmental units. E-Verify is a Federal program operated by the United States Department of Homeland Security and other federal agencies, or any successor or equivalent program used to verify the work authoriza on of newly hired employees pursuant to federal law. 7 DRUG FREE WORK POLICY: The City of Asheville is a drug-free workplace employer. The Asheville City Council has adopted a policy requiring city construc on and service contractors to provide a drug free workplace in the performance of any city contract. This policy may be viewed at: h p:// cy.aspx. By submi ng a proposal, a prospec ve primary vendor cer fies that it and all sub-vendors will comply with the City of Asheville drug- free workplace requirement. A false cer fica on or the failure to comply with the above drug-free workplace requirements during the performance of contract shall be grounds for suspension, termina on, or debarment. IRAN DIVESTMENT ACT CERTIFICATION: By submi ng a proposal, the Firm cer fies that, as of the date of submission, it is not on the Final Divestment List as created by the State Treasurer pursuant to N.C.G.S In compliance with the requirements of the Iran Divestment Act and N.C. G.S , Firm shall not u lize in the performance of the contract any subcontractor that is iden fied on the Final Divestment List. COMPANIES BOYCOTTING ISRAEL: By submi ng a proposal, the Firm cer fies that, as of the date of submission, it is not on the Companies Boyco ng Israel Final Divestment List as created by the State Treasurer pursuant to N.C.G.S Ownership of Work Products: The City shall have exclusive ownership of all intellectual property rights in all designs, plans and specifica ons, documents and other work product prepared by, for, or under the direc on of the selected Firm pursuant to any contract under this RFQ (collec vely, the Intellectual Property ), including without limita on the right to copy, use, disclose, distribute, and make deriva ons of the Intellectual Property for any purpose or to assign such rights to any third party. The Intellectual Property shall be prepared in the City s name and shall be the sole and exclusive property of the City, whether or not the work contemplated therein is performed. The City will grant the Firm a royalty-free, non-exclusive license to use and copy the Intellectual Property to the extent necessary to perform the contract. V. EVALUATION AND SELECTION PROCEDURE: Evaluation: Evalua on and selec on of Qualified Firms will be based on the general criteria 7/10

8 outlined below. A review commi ee will be composed of City staff and/or key stakeholders that will review each proposal and rate them on a standardized form. The form may consist of the following categories: a. Qualifica ons Of The Firm and Personnel b. Relevant Experience Of The Firm and Key Members (including license) c. Relevant Current/Past Projects d. Past Performance & Client References e. Experience in submi ng for development permits and approvals as required by any and all regulatory agencies including but not limited to: Asheville, North Carolina state, and Federal Agencies. f. Project Understanding and Approach g. Ability of Firm to commit resources and perform work on schedule and on budget h. Par cipa on of Local or Minority Vendors i. Ability to meet City requirements j. Completeness of submi al Selection: Firms will be evaluated and ranked on the basis of their qualifica ons for this project. The selec on commi ee may elect to short-list the top-ranked Firms to conduct wri en or oral discussions with as necessary to determine the best qualified Firm. Selec on for the project will be with the highest-rated Firm as determined solely by the review commi ee based on the best overall qualifica ons that is in the best interest of the City. The City will enter into contract nego a ons with this Firm, if nego a ons fail, the City will terminate such nego a ons and enter into nego a ons with the next best qualified Firm. This process will be repeated as necessary un l an agreement is reached or the City elects to terminate this solicita on. The remaining Firms will not be no fied un l a er the award of the contract. The award of a contract pursuant to this solicita on may require the approval of the City Council. If and when the selected Firm is approved, the City will promptly no fy the successful Firm of the award and will prepare and distribute the necessary documents for execu on, and will then no fy the remaining Firms. VI. City of Asheville reserves the following rights: Modify or cancel the selec on process or schedule at any me. Waive minor irregulari es. Reject any and all responses to this RFQ and to seek new submi als if it is in the best interest of the City to do so. Seek clarifica on or addi onal informa on from responding Firms as it deems necessary to the evalua on of the response. This Request does not obligate the City to enter into an agreement or pay any costs incurred by Firms in prepara on and submission of a statement of 8/10

9 qualifica ons. Upon receipt by the City, each proposal becomes the property of the City. In general, documents that are submi ed as part of the response to this RFQ will become public records, and will be subject to public disclosure. North Carolina General Statutes Sec on and provide a method for protec ng some documents from public disclosure. If the responding Firm follows the procedures prescribed by those statutes and designates a document "confiden al" or "trade secret", the City will withhold the document from public disclosure to the extent that it is en tled or required to do so by applicable law. Any Firm that designates its en re proposal as a trade secret may be disqualified from considera on. In submi ng a proposal, each Firm agrees that the City may reveal any trade secret materials contained in such response to all City staff and City officials involved in the evalua on process and to any outside consultant or other third par es who serve on the evalua on commi ee or who are hired by the City to assist in the evalua on process. If the City determines that a document that the Responder has designated "confiden al" or "trade secret" is not en tled to protec on from public disclosure, the City will provide no ce of that determina on to the contact person designated by the Firm, in any reasonable manner that the City can provide such no ce, at least five business days prior to its public disclosure of the document. If the Firm does not designate anyone to receive such no ce, or if, within five business days a er the designated person receives such no ce, the Firm does not ini ate judicial proceedings to protect the confiden ality of the document, the City will not have any obliga on to withhold the document from public disclosure. By submi ng to the City a document that the Firm designates as "confiden al" or "trade secret", the Firm agrees that in the event a third party brings any ac on against the City or any of its officials or employees to obtain disclosure of the document the Firm will indemnify and hold harmless the City and each organiza on's affected officials and employees from all costs, including a orney's fees, incurred by or assessed against any defendant, of defending against such ac on. The Firm also agrees that at the City's request the Firm will intervene in any such ac on and assume all responsibility for defending against it, and that the Firm s failure to do so will relieve the City of all further obliga ons to protect the confiden ality of the document. Selec on of a Firm by the City in response to this Request for Qualifica ons for professional services does not guarantee these services will be required. The City maintains sole discre on in assigning projects, if any, to the selected Firm(s) throughout the term of the contract. The City, addi onally reserves the right to issue future Request for Qualifica ons, as may be needed and to solicit responses from Firms not selected as part of this process. Firms responding to this request for qualifica ons are no fied of City policy that prohibits contrac ng with persons or Firms who are delinquent in the payment of ad valorem taxes owed to the City of Asheville. 9/10
