2 Cecil County, Maryland Bid No Purchasing Department 200 Chesapeake Blvd., Suite 1400 Elkton, MD Invitation to Bid Sealed proposals for the purchase and delivery of various types of STONE/AGGREGATE as described in specifications for Cecil County, Maryland, Department of Public Works will be received from qualified bidders until 1:30 p.m. on April 1, 2014 in the Purchasing Department, 200 Chesapeake Blvd, Suite 1400, Elkton, MD The Stone/aggregate shall comply with the conditions and specifications as set forth in the Bid Package. Additional specifications and/or instructions to bidders may also be obtained by ing or calling the Purchasing Department, at Cecil County, Maryland reserves the right to reject any or all bids and to waive technicalities. All bids are based upon budgetary constraints. Electronically submitted bid proposals will not be accepted. Bid proposals are provided on the Cecil County, Maryland web-page ( as a PDF document for all vendors to download. All vendors wishing to submit a proposal shall obtain an original set of documents from the Cecil County Purchasing Department. Changes or addendums to this proposal and or other documents will be posted to the proposal documents on the County web-page and sent directly to vendors who have obtained an original set of proposal documents. The County is not responsible for information obtained from sources outside the Cecil County Purchasing Office, including downloads from the County web-site. Vendors obtaining electronic copies of the proposal documents will be directly responsible for obtaining updates, changes or addendums either from the updated web-page or by contacting the Purchasing Office. All questions or discussions concerning this bid, bid documents, specifications, etc. shall only be coordinated through the Purchasing Office. The County shall not be responsible for information obtained outside the County Purchasing Office concerning this or any other County bid, RFP, solicitation or quote. 3 Cecil County, Maryland Bid 15-02; STONE/AGGREGATE Instructions to Bidders Bids should be mailed, or otherwise hand carried, in order to be received in the office of the Purchasing Department, 200 Chesapeake Blvd, Suite 1400, Elkton prior to 1:30 p.m. on April 1, Bids received after that time will be returned to the bidder unopened. Bids should be submitted in a sealed envelope clearly marked in the lower left hand corner: Stone/Aggregate. Before submitting proposals, bidders should acquaint themselves with all governing laws, ordinances, etc. and otherwise familiarize themselves with all matters, which may affect the bid. The act of submitting a proposal shall be considered as meaning that the bidder has so familiarized themselves; therefore, there shall be no misunderstanding or lack of information. In accordance with Cecil County s Affirmative Action policy against discrimination, no person shall, on the grounds of race, color, creed, religion, sex, age, marital status, national origin, handicap or disability, be excluded from full employment rights in, participation in, be denied the benefits of or be otherwise subjected to discrimination. During the performance of the work and services hereunder, the Contractor, for themselves, their assignees and successors in interest, agrees to comply with all federal, state and local non-discrimination regulations. Chapter 92, section 10 of the Cecil County, Maryland Code entitled Local Preference reads as follows: The County reserves the right to show preference to local bidders in the purchase of supplies, equipment and services. The amount shall not exceed six percent (6%) of the amount bid or quoted and/or $60,000, whichever is less. A local bidder is defined as an individual or business that maintains a place of business or maintains an inventory of merchandise and/or equipment in Cecil County, is licensed by Cecil County and/or the State of Maryland, if required, and is subject to Cecil County real and/or personal property taxes. Any local bidder in default on payment of any county or state tax or license shall not be eligible to receive preference until all taxes or licenses due are paid. One original, one copy and one electronic copy of the bids shall be submitted in a sealed envelope. 3

4 CECIL COUNTY, MARYLAND BID 15-02; STONE/AGGREGATE GENERAL AND SPECIFIC CONDITIONS I. SCOPE It is the intent and purpose of these specifications to secure bids for various types of: STONE/AGGREGATE. The specifications are not intended to be restrictive to the product of a single manufacturer but are to be based on the specifications within this bid package or similar material provided for consideration as County Approved Equivalent. Vendors may submit proposals for one or more types of STONE/AGGREGATE. Cecil County, Maryland reserves the right to determine acceptability of any product or service being bid and may require demonstrations/samples prior to bid award. II. PRICING Bid prices shall remain firm for one hundred twenty (120) days from the date of the bid. Invoices will be paid for within thirty (30) days of receipt of the invoice and acceptance of the equipment. All contracts and/or quantities are contingent on budgetary constraints. III. TAXES Cecil County, Maryland is exempt from all sales tax and federal excise taxes and such tax will not be allowed or included in the contract price. IV. METHOD OF PURCHASE AND PAYMENT Upon award of the contract, a purchase order will be issued. The Contractor shall submit invoices in duplicate to Cecil County Finance Dept/AP, 200 Chesapeake Blvd., Elkton MD, Copies of invoices may also be sent to the owning/requesting department/division. V. DELIVERY and ACCEPTANCE The material shall be delivered to designated address within the agreed amount of time. Copies of delivery tickets must be left with the designated representative when delivery is made. The purchase order number must appear on the delivery ticket and the invoice. Appropriate Cecil County, Maryland personnel shall inspect the material and sign the delivery ticket. 4

5 Delivery of material is requested to be delivered to the designated location the same day, but no less than 24 hours (division working hours, some departments open six days a week) from order confirmation. Also, we are requesting delivery price by the contractor to designated location within Cecil County and price per ton if County picks up the material. If the awarded contractor cannot meet the quantity or delivery requirements, the County has the right to order the required material from a second contractor. VI. RIGHT TO TERMINATE Cecil County, Maryland reserves the right to terminate this contact by a ten (10) day written notice should the quality of the products become inferior or poor delivery service. VII. QUANTITIES Cecil County, Maryland is estimating that the quantity figures listed in this bid will satisfy the County s requirements for a one year period for the Solid Waste Division and Roads Division. Additional County Divisions may also purchase from the awarded proposal. Therefore; additional quantities may be ordered during the term of the contract at unit prices set forth in the contract. VIII. BASIS OF AWARD The award of the contract will be made to the lowest responsible and most responsive bidder who meets the requirements of the bid and is considered best able to serve the interest of Cecil County, Maryland. The County reserves the right to reject any and/or all bids or to waive any technicalities it deems in the best interest of Cecil County, Maryland. The County shall be able to select material submitted as comparable material based on the specifications provided and approved as County Approved Equivalent. The County intends to award the contract to one contractor, but has the authority to award to multiple vendors as determined by the County. IX. LAWS AND REGULATIONS The Contractor, at all times, shall observe and comply with all federal, state, municipal and/or local laws, ordinances, rules and regulations in any manner affecting the work to be done and all such orders or decrees as may exist at present and those which may be enacted later, of bodies or tribunals having jurisdiction or authority over and shall indemnify and save harmless the Owner and all its officers, agents and employees against any claim or liability arising from or based on the violation of any such laws, ordinances, rules, regulations, order or decree, whether such violations by the Contractor or by any sub- Contractor or any of their agents and/or employees. 5

6 XII. PERMITS AND LICENSES The Contractor shall procure all permits and licenses, pay all charges and fees and give all notices necessary and incident to the due and lawful prosecution of the work. XIV. TRANSPORTATION Prices quoted shall be net, including all transportation and delivery charges fully prepaid by the seller, f.o.b. destination (designated upon request within Cecil County, Maryland). No additional charges will be allowed (other than the agreed proposal costs) and all vendors certify and warrant that the price offered for f.o.b. destination includes only the actual freight/delivery rate. XV. INSURANCE REQUIREMENTS WORKER S COMPENSATION AND EMPLOYER S LIABILITY INSURANCE (a) The vendor shall take out and maintain during the life of the Contract the Statutory Worker s Compensation and Employer s Liability Insurance for all of his employees to be engaged in work on the project under the Contract. (b) In case any portion of the project is sublet, the vendor shall require all of the sub-contractors similarly to take out and maintain during the entire life of the Contract the Statutory Worker s Compensation and Employer s Liability Insurance for all of their employees to be engaged in work in the project under the Contract. (c) The vendor and/or the sub-contractor shall not begin work until the Contractor has first filed with the County satisfactory evidence that insurance of the above nature is in full force and effect (receipt of Certificate of Insurance naming Cecil County, Maryland as an additional insured). BODILY INJURY, LIABILITY AND PROPERTY DAMAGE LIABILITY INSURANCE The vendor shall take out and maintain during the life of the Contract Bodily Injury Liability and Property Damage Liability Insurance to protect him and any sub-contractor performing work covered by the Contract from claims for damages for personal injury, including accidental death, as well as claims for property damage, which may arise from operations under the Contract, whether such operations be by himself or by any sub-contractor or by anyone directly or indirectly employed by either of them and the amount of such insurance shall not be less than amounts shown in the following chart: 6

7 - General Liability: $2,000,000 Annual Aggregate $1,000,000 Each Occurrence $1,000,000 Products and Completed Operations $1,000,000 Personal Injury and Advertising - Business Auto Liability: $1,000,000 Combined Single Limit - Worker s Compensation: -- Statutory - Excess $1,000,000 Each Occurrence - Professional Liability: $1,000,000 (As Required) Upon award of contract, the Contractor shall provide a copy of a Certificate(s) of Insurance, with the Cecil County, Maryland named as an Additional Insured to liability coverage on the certificate(s), for the duration of the contract. NOTICE OF CANCELLATION Commercial General Liability Insurance, Automobile Liability Insurance and Workers Compensation insurance, as described above shall include an endorsement stating the following: "Thirty (30) days advance written notice of cancellation, non-renewal, reduction and/or material change shall be sent to: Cecil County, Maryland, Attn: Purchasing Department, 200 Chesapeake Blvd., Suite 1400, Elkton, MD " Prior to starting performance of the contract and for each extension of the contract, a certificate of insurance shall be furnished to the County. Insurance companies providing insurance shall be acceptable to the County. The contractor shall obtain at its own cost and keep in force and in effect during the term of the contract. The proposer shall provide a Certificate of Insurance prior to award of this contract. XVI CONTRACT TERM: The contract/agreement term shall begin at the final execution of contract/agreement documents through June 30, The County has the authority to re-bid the contract/agreement if an agreement cannot be completed between the County and the contractor. Cecil County, Maryland intends that the contractor awarded a contract, will perform the work commencing upon the date specified in the Notice to Proceed or notification of award and terminate upon expiration or completion of the project or product delivery, unless terminated by the County with the delivery of written notification of contract termination. All contracts extending beyond the County s fiscal year (June 30 th annually) shall be subject to budget appropriation. In the event the on-going contract does not acquire funding to continue, the awarded contractor shall be notified in writing at the earliest possible date and contract termination shall be coordinated. XVII SPECIFICATIONS: 7

8 All materials to be furnished under the term of this contract shall meet the requirements as set forth in Section 901 of the Maryland Department of Transportation, State Highway Administration, Standard Specifications for Construction and Materials, dated 2008 as amended to date; or AASHTO M-43 (Sizes of Aggregate for Road & Bridge Construction) from latest edition of Transportation Materials and Methods of Sampling and Testing. XVIII QUALITY CONTROL The Stone/aggregate Products provided by Supplier shall not contain asbestos in an amount greater than the standards established under current OSHA and Mining Safety and Health Administration (MSHA) for exposure and emission limits. For each size, shape or type of stone/aggregate for which supplier has submitted a bid, supplier shall attach a laboratory analysis report which follows the protocols set forth in Section (a) of Chapter 40 of the Code of Federal Regulations and is performed by a laboratory that is accredited by the United States Department of Commerce, National Institute of Standards and Technology, National Voluntary Laboratory Accreditation Program, as described in the Federal Register (52 F.R , September 3, 1987). The laboratory shall provide a statement verifying: a bulk sample of a specified size and type of stone/aggregate was analyzed; the sampling protocol utilized; a statement verifying that the person who performed the analysis was properly trained in the use of the methodology which meets the requirements of Section (a); the date when the bulk sample was taken; and the date when the analysis was performed. XIX SOURCE OF SUPPLY AND QUALITY OF MATERIALS A. The bidder shall submit a complete statement of origin, composition, and manufacture of any or all materials to be supplied under this contract in a document separate and distinct from the bid, together with material samples if requested, which samples may be subjected to examinations and tests by the Cecil County representative in order to determine their quality. Your attention is drawn to the fact that materials furnished under this contract must be in compliance with Access to Information about Hazardous and Toxic Substances Act dated July, 1985 and which is a part of the Maryland Occupational Safety and Health (MOSH) Law. B. The materials and their sources of supply shall be approved by the Cecil County representative prior to the award, and the contract Awarding Authority shall have the right to reject a bid if the materials and the sources of supply for same have not first been approved as set forth herein. C. The Cecil County representative may reject the materials or the sources of supply for same if said materials or sources of supply have not had a satisfactory record of performance. 8

9 D. Materials furnished shall comply with the requirements set forth herein, and if it is found after trials that sources of supply previously approved do not produce a uniform and satisfactory product or if the product from any source proves unacceptable at any time, the Contractor shall furnish materials from other approved sources. XX QUARRY LOCATION Bidders must indicate in their bids the name and street address for each quarry supplying crushed aggregates. XXI METHOD OF PURCHASE AND DELIVERIES A. Upon award of contract(s), a Purchase Order will be given to the contractor for crushed aggregates or stone (material) requirements during the term of the contract per current fiscal year. B. When delivery is required, contractor shall be notified by Cecil County representative of quantity required and when and where to make delivery of materials. Such notification shall reference the aforementioned purchase order. Deliveries shall be made in accordance with the procedures established by the County. C. Materials shall be delivered between the hours of 7 am and 3pm unless specifically requested otherwise. D. No material shall be accepted unless same has been weighted and said weights verified in writing by the Cecil County representative. The right is reserved by Cecil County representative at all times to enter the contractor s facilities and to weigh the aggregates to be supplied and check all applicable weights at any time or any point. E. Contractor shall make crushed aggregates deliveries within twenty-four (24) hours after notification to do so. If the contractor fails to delivery material as ordered or if the material delivered are not of acceptable quality, Cecil County reserves the right to go into open market and purchase such stone/aggregate at the market price and if the market prices plus other associated costs, including hauling are greater than bid prices specified in the contract, the excess cost shall be deducted from any monies that may be due the contractor. F. Should the County require aggregates to be delivered by the contractor to any of its area yards or to a particular job site; the County will pay the contractor at the haul rate per ton mile set forth in the contractor s bid/contract. 9

10 G. The contractor shall furnish a delivery ticket for each truck load of material received by the County. The ticket, at the time of delivery shall be signed by the County Representative and shall show weight of the vehicle before loading and gross weight after loading and net weight of materials delivered as well as the agency receiving material. XXII INSPECTION A. The Director of the Department of Public Works or an authorized representative shall decide all questions as to the quality and acceptability of aggregate furnished and shall decide all questions as to the interpretation of the specification. B. The Director Public Works shall appoint such persons as deemed necessary to properly inspect and test the materials and/or products furnished or to be furnished and to see that the same strictly corresponds with the specifications. C. The contractor shall supply certified test reports no more than three months old showing that the materials referenced comply with the specifications as referenced in this document. After award and the entire length of the contract the contractor shall at his own expense provide certified quarterly (every 3 months) quality control reports showing that the materials continue to meet or exceed the standards contained herein. D. If additional sampling and testing of material are required it shall be accomplished in accordance with standard sampling and testing methods, as direct by Cecil County representative by and at the expense of the County. Frequency of sampling shall be at the discretion of the Cecil County representative. Samples shall be taken by a representative of the County. E. All aggregates furnished which are not in accordance with these specifications shall be considered defective and all such material whether in place or not shall be removed within twenty-four (24) hours at the expense of the Contractor unless otherwise specified by the Cecil County representative or in case of failure to do so the material shall be removed the County and cost of this removal will be deducted from any monies due or which may become due the contractor. F. When it is found that aggregates do not comply with the gradation requirements and removal return to the contractor are not feasible deduction shall be made from the contract price as follows: 1. For each one percent (1%) of material or fraction thereof that is oversize (larger than sieve size permitted by gradation chart) and retained on the sieve indicated one hundred percent (100%) passing a deduction of one percent (1%) shall be applied to the net price per ton of material. 10

11 2. For each one percent (1%) of material or fraction there of that is undersize (smaller than sieve size permitted by gradation chart) and passing the sieve indicating zero percent (0%) passing a deduction of one percent (1%) shall be applied to the net price per ton of material. 3. No deduction shall be applied to the net price per ton of material until the total deviation from the gradation requirements exceeds one and onehalf percent (1½ %). G. When it is found that under Bid Item Nos. 4 & 5 as listed on Attachment #1 that washed aggregates do not comply with the impurity requirements and removal and return to the Contractor are not feasible, deductions shall be made from the contract price as follows: XXIII PAYMENT - When impurities exceed one and one-half (1½ %) payment of the contract price per ton will be reduce by ten percent (10%) plus a further reduction of one percent (1%) for each additional one tenth of one percent (0.1%) or fraction thereof. The basis of payment for the material shall be as furnished and shall be the number of tons received by the County. All invoices must be a separate bill for each agency purchase order with a duplicate copy of the delivery tickets attached. Payment to the contractor shall be made within thirty (30) days upon receipt of invoice for deliveries received and accepted. XXIV CONTRACTOR S PAYMENT In case any direct or indirect injury or damage is done to public or private property by or because of the work or in consequence of any act or omission on the part of the contractor his/her employee or agents the contractor shall at his/her own cost and expense restore such property or make good such damage or injury. If the contractor fails to repair, rebuild, or otherwise restore damaged property, Cecil County, Maryland may proceed to repair, rebuild or otherwise restore such property as may be necessary and the cost there of will be deducted from any monies due or to become due the contractor under the contract; or Cecil County, Maryland may deduct from monies due the contractor under the contract a sum sufficient to reimburse the owner of the property damaged or injured. 11

13 LOCAL CONTRACTORS PREFERENCE Chapter 92, Section 10, Cecil County, Maryland Code entitled Local Preference reads as follows: The County reserves the right to show preference to local bidders in the purchase of supplies, equipment and services. Bidders are cautioned to note the specific and several requirements that may qualify a bidder for local preference consideration. No bidder should assume, regardless of whether the bidder qualifies under the definition of Local Bidder that Cecil County, Maryland would grant preference on this contract to any bidder. Cecil County, Maryland reserves the right to do so under Chapter 92, Section 10 of the Cecil County, Maryland Code but is not bound to do so under any circumstance, regardless of precedent. Any bidder that wishes to be considered a Local Bidder in Cecil County, Maryland they shall submit with the bid any and all documentation that proves that the bidder, identified by name in the submitted bid, meets the definition of Local Bidder. Neither Cecil County, Maryland nor the Procurement officer shall be bound by any information or documentation provided by the bidder after opening of the bids. However, the County reserves all rights to investigate a bidder s potential qualification as a Local Bidder and use any relevant information in its determination of a bidder s qualification under the definition, regardless of when it is obtained. 13
