Approve and execute four Agreements with Pacific Gas & Electric Company (Principal: Michele Scatena; Location: Sacramento, CA) for the design and construction of the Stanley Boulevard Utility Undergrounding Project (UUD No. 18) in the total amount of$817, a. Agreement Number C-5203, to Perform Tariff Schedule Related Work, which covers the Rule 20B - Underground existing overhead electric facilities in the amount, $782,707.09; b. Agreement Number C-5204, to Perform Tariff Schedule Related Work, which covers the Installation of Streetlight Service Point and/or Circuit in the amount, $2,254.03; c. Agreement Number C-5205, to Perform Tariff Schedule Related Work, which covers the Cost Difference SSIPM in the amount $31,091.62; d. Agreement Number C-5206, to Perform Tariff Schedule Related Work, which covers the Undergrounding of electric facilities on Stanley Boulevard, pursuant to Alameda County UndergroW1d Utility District (UUD No. 18) in the amow1t of$i, Authorize the Auditor-Controller to issue a warrant to Pacific Gas & Electric Company in the amount of $817, ''To Serve and Preserve Our Community"

2 Honorable Board of Supervisors Page 2 June 23,2010 DISCUSSION/SUMMARY: On April 20, 2010, your Board adopted Ordinance No , which established an Underground Utility District (UUD No. 18) for the undergrounding of utility distribution facilities on Stanley Boulevard between the City Limits of Pleasanton and Livennore, Alameda County. Pursuant to Section V of the Ordinance and the Public Utilities Commission (PUC) Rule 20, all costs associated with the undergrounding and conversion of utility service for properties within DUD No. 18, from aerial to underground, will be paid out of the PUC Rule 20 funds andlor by other entities. The estimated cost of the utility undergrounding work by PG&E is $817, The utility undergrounding is expected to begin in summer 2010, and be completed by fall FJNANCING: There will be no Net County Cost as a result of this action. Funding for this project in the amount of $817, is currently budgeted in the proposed FY 2010/11 budget in Road Department, Budget Organization , Account #610290, Professional and Specialized Services Construction Program 50600, Engineering and Construction. PG&E agrees to perform the requested work and furnish all necessary labor, equipment, materials and related facilities required therefor, subject to the following conditions: 1. Where it is necessary to install Special Facilities on Applicant's premises. Applicant hereby grants to PG&E: (a) the right to make such installation on Applicant's premises along the shortest practical route thereon and of sufficient width to provide legal clearance from all structures now or hereafter erected on Applicant's premises tor any facilities of PG&E; and. (b) the right of ingress to and egress from Applicant's premises at all reasonable hours for any purposes reasonably connected with the operation and maintenance or the Special Facilities. 6. As provided in PG&E'sapplicable Electric Rule 14 or Gas Rules 14 and 21, Applicant understands that PG&E does not guarantee electric or gas service to be (ree from outages, interruptions, or curtailments and that the charges for the Special facilities represent the additional cost associated with providing the Special Facilities rather than for a guaranteed level of service or reliability. 7. Upon request of the customer and at the option of PG&E, gas will be delivered at a pressure higher than standard delivery pressure where such higher pressure is available from existing facilities. PG&E. however, retains the right to decrease at any time the higher delivery pressure, as per Rule 2, incorporated into this agreement by reference. Upon completion of requested work, ownership shall vest in PG&E.
