6 Executive Summary Introduction The Clima East Policy Project (hence forward the the Policy Project or the Project ), funded by the European Union (EU), is intended to provide support to the ENP East countries (i.e. Armenia, Azerbaijan, Belarus, Georgia, Moldova, and Ukraine) and the Russian Federation 1 (the Partner Countries/PCs) so that they are more equipped for greenhouse-gas emission reductions and better prepared to deal with climate change impacts. It also aims to facilitate dialogue in this area among the EU and the partner countries. The Policy Project (budget EUR 8.2 million) constitutes one part of a larger 'Clima East package which also includes a Pilots Project (budget EUR 11 million) supporting the development of ecosystems-based approaches to climate change, implemented by UNDP implemented between The Policy Project and the Pilots Project are implemented in close coordination with each other, ensuring that synergies between policy development and planning activity and the experience gained through the Pilots Project are recognised and utilised. Objectives of the Project The specific objective of the Clima East Policy Project is to foster improved climate change policies, strategies and market mechanisms in the Partner Countries that are more in line with the EU acquis, by supporting regional cooperation and improving information-access to EU climate change policies/acquis. This has been structured under a number of Result Areas as set out below. Purpose of this Workplan This Workplan describes the planned national activities for Moldova for the 2015 calendar year for the Project as well as providing a general explanation about the project and its approach. 7 Summary of Project national priority actions for 2015 This document describes the actions planned for 2015 of the Project responding to national priorities, the evolving context of climate change policy and international negotiations with particular focus on the Lima call for climate action, the 2014 signed EU Association Agreements of Moldova, and the principles of the Eastern, multilateral dimension of the European Neighbourhood Policy 4 (ENP). It presents both support that can be given through programmed core activity and also needs which could be addressed through the Expert Facility. (An explanation of the core activities and Expert Facility resources available to the programme is given at section 1.1). Moldova has stated its priority needs as support for preparation for COP, implementation of climate relevant commitments under the Association Agreement, and vulnerability assessment, in the context of support available from other sources on a number of key priorities for climate policy in Moldova A number of key regional action areas can be supported through the core resources of the Clima East project and are summarised below; the underlying national activities are described in the national work programmes. The following graph illustrates the inter-connectivity between the key action areas and the activities of the Expert Facility. The table also shows the mitigation/adaptation balance of these activities. 8 C1 Support for the elaboration of the INDC submissions As key decisions still need to be taken by the Government with respect to INDC development process, it is not yet possible to identify key gaps that will not be covered by other support available and remains premature to identify a specific share of concrete tasks between Clima East/ GEF and others. The Project will support Moldova, if requested, in ensuring timely preparation of its submission that responds to all of the key UNFCCC requirements for INDC through general consultation, review and feedback on draft submission text, and support to developing applications for specific assistance through the Expert Facility or identifying other sources of support where in depth assistance is required beyond the capacity of the Key Expert team. The Project team stands ready to provide support to the Ministry of Environment and/or CCO in coordinating the national INDC formulation processes. The Project will provide support on request with building understanding of INDC requirements through consultations and one or more workshops ensuring broader stakeholder consultations. Support in the INDC field will be provided in close coordination and cooperation with the GEF/UNDP project Preparation of Intended Nationally Determined Contribution (INDC) to the 2015 Agreement under the UNFCCC, and others, to avoid overlap and build synergy. An observation in this regard is that Clima East may be particularly well placed to provide support in areas relating to commitments under the Association Agreement (please see section below). Among the potential areas of support are: Support if requested for one or more national workshop in Chisinau, to raise awareness of the process of INDC formulation in specific sectors and/or to discuss proposed INDC elements emerging during the INDC process prior to governmental decision-making. (Logistical organization and provision of international KE and/or NKE support as suitable.) Analysis or explanatory materials related to the above activity. If requested by the Ministry of Environment, review of draft INDC documentation to advise on general compliance and areas for development Support in identifying specific areas of need for technical assistance on detailed preparation of INDCs in certain sectors or areas, to inform applications for support through Clima East EF, other donors or internal expertise (or direct KE advice where feasible). 9 C2 Support for the COP Negotiation Clima East will continue to focus on providing support for fuller understanding and discussion of COP issues among relevant Moldovan stakeholders, and more effective preparation, than would otherwise be possible. Workshops, consultations and analytical materials will support the Moldovan Government formulating its negotiation position based on a better understanding of negotiation content and dynamics. One of the core elements of support are the regular regional ADP and COP preparatory workshops, which are designed to facilitate preparations of the appointed COP negotiating teams. The workshops also serve as a platform for a dialogue between Moldova and the EU, as well as for communication among Eastern Neighbourhood countries, coordination in the context of international climate negotiations by discussing key issues of importance to the counties involved. Support to stakeholders more directly involved in COP preparations to access peer experience in other PCs and from the EU, will be accompanied by Clima East s programme of communication activities which will aim to highlight climate issues for wider stakeholders and the areas in which the Project aims to help, and provide specific resources for communicating the critical issues and developments in the countdown to the Paris negotiations for a new agreement at COP in December Activity under C3 will also aim to support wider engagement. 10 C3 Climate Action Mainstreaming In view of the specific support available from other sources for institutionalising mainstreaming of climate issues across governmental policy-making under the NAS and LEDS, Clima East proposes to offer complementary support in 2015 for general awareness-raising of climate issues in sectoral ministries and for the wider public, to build support for technical mainstreaming efforts. Clima East awareness-raising support can highlight the links between domestic climate mainstreaming and delivery of the commitments under the Association Agreement and INDC, but also highlight benefits to sectors. Communication activities with sectoral ministries and other government bodies will highlight the link and relevance of climate change mitigation and/or adaptation activities to their respective sectors, and appropriate EU models brought for information and comparison, under the liaison through C1, C4 and C5 and through appropriate events under the Project s communication activity schedule. If desired, Clima East stands ready to assist with any further work on the LEDS, in cooperation with other lead projects, especially to provide support in incorporation of key issues arising from INDC and Association Agreement commitments. For sub-national (regional; municipal) bodies and specific sectoral bodies (disaster risk reduction; infrastructure etc.) close cooperation is envisaged with Climate Forum East (II) according to its work schedule. One regional meeting is planned bringing together the secretaries/managers of the national climate bodies and other interested in institutionalising mainstreaming of climate policy under the auspices of the Regional Adaptation Conference planned for Q (see C5). Moldova s experience in development of NAS and LEDS will be valuable examples for discussion. ACTIVITIES RESULTS PARTNER COUNTRY OUTCOME TO BE SUPPORTED a) If requested, support in identifying key issues arising from INDC and Association Agreement for revision of the draft LEDS b) The NAS and, subject to EU approval, the revised LEDS will be translated into English, to promote wider dialogue c) Liaison with MoE and other sectoral ministries through other Core actions will be used to highlight key implications for the need and mechanisms for mainstreaming, and appropriate EU examples and experience mobilised. Further discussion to be held with FP on the need for further concerted support for mainstreaming in 2016 through Clima East. d) Support for relevant Moldovan participation at dedicated session on comparative experiences of national coordination committees at the Regional Eco-system based Approaches to Adaptation Conference planned for Q3. e) Response to requests for support to sub-national (regional; municipal) bodies and specific sectoral bodies support in light of CFE II work programme. f) See also wider programme of awareness-raising activity under Communications, and specific integration of EU acquis compliant climate regulations in specific cross-sectoral technical areas, under Expert Facility. Review of LEDS and commentary of areas that may benefit from or require update in light of INDC and Association Agreement commitments English version documents for wider dissemination and discussion Contribution to heightened awareness and interest in cooperation on climate issues and uptake of responsibilities under NAS (under LEDS when passed). Moldovan representatives are able to exchange views and compare needs and approaches with other ENI countries, present the progress and experiences of NAS and LEDS. 11 C4 Support for the development of a nation-wide MRV systems Due to existing support for the development of a nationally appropriate MRV system within the framework of the LECB project, Clima East will focus on adding value to that support where requested, particularly in the area of compliance with EU requirements, especially under the Association Agreement. The Project will provide EF support for an approved application on Approximation of the EU Directives from the Annex XII (Chapter 17, Climate Actions) of the Association Agreement between Republic of Moldova and European Union in the national legislation, including Directive 2003/87/EC establishing a scheme for greenhouse gas emission allowance trading within the Community Directive 98/70/EC relating to the quality of petrol and diesel fuels and amending Directive 93/12/EEC as amended by Directives 2000/71/EC, 2003/17/EC and 2009/30/EC and Regulation (EC) 1882/2003 (CEEF MD) In relation to Directive 2003/87/EC this will result in: 1) a report with concrete recommendations on the amendments to the existing legal acts and regulatory acts, and, if appropriate, proposals for new legal or regulatory measures implementing the provisions listed above, proposals of the content for guidelines for industry and/or appropriate methodologies to be used in the implementation of the aforementioned provisions. 2) a clear roadmap/action plan outlining steps to be taken and attributing these actions to the relevant government institutions, or proposals to set up or reform existing institutional framework. At a regional level, Clima East is providing a training package for other PCs to introduce elements of MRV system design process and to deliver a roadmap for its implementation. This will be built on a tried and tested ETS MRV training package sponsored by BMUB (Germany) which was developed in full compliance with the Directive 2003/87/EC and the broader MMR (Monitoring Mechanism Regulation; Regulation No 525/2013). Subject to further discussion on the relation between the proposed training package and the approach and work supported through the LECB project, Moldovan participation is welcomed at the opening regional event for this package, in Kiev in April The project team stands ready to discuss needs for additional expert consultations, events, mentoring (workshops and/or a study tour) on country and sub-regional level, if feasible during 2015, or for consideration for the Workplan during 2016, addressing Moldova s needs in setting up and managing national MRV systems for its large emitters in line with the provisions of EU ETS Directive. Activities listed below illustrate options arising from the approach taken using the BMUB package. ACTIVITIES RESULTS PARTNER COUNTRY OUTCOME TO BE SUPPORTED a) If requested, regional workshop introducing the MRV training module based on BMUB material (Kiev April 2015). The Workshop will informing orientate participants on MRV training & mentoring elements; introduce system design elements and the process of national MRV system development; and define a roadmap template for MRV implementation b) If requested, national MRV (large emitters) consultations Bilateral or, if useful, workshop format consultations on key issues for working with large emitters in Moldovan stakeholders orientated on basic elements of design and development of MRV systems, and template and process for roadmap development. 13 C5 Vulnerability and impact assessment for adaptation planning. The Project aims at supporting the implementation of the Climate Change Adaptation Strategy recently approved by the Government, in coordination with NAS requirements. Under the approved EF Support to climate change vulnerability assessment in Moldova(CEEF MD), following agreement on the ToR and sourcing of experts, Clima East will support the first stages of analysis of appropriate models and tools for the requirements of Moldova, and subsequent training on their utilisation. Activity within the project Workplan will aim to reinforce and amplify the results of this activity, through regional exchange of experience and review of options for improving downscaled data to be used in modelling and assessment activity, in discussion with key providers such as UK Met. Discussion and comparison of approaches between Clima East Partner Countries through planned regional events will be facilitated to provide an information basis to foster the potential development of consistent and mutually understood modelling approaches to address cross-border and common issues. A Study Tour to EU Member States is also planned to discuss their experience in design and implementation of adaptation plans and mobilisation and use of effective data and models for assessment. Finally, Clima East will facilitate inter-sectoral consultations that may foster improved cooperation and data use, under climate mainstreaming (as supported by C3). Reviewing in depth the structures and systems in place to model and analyse vulnerability data and integrate data into national planning. d) Regional Conference on Eco-System based Approaches to Adaptation including sessions on modelling tools selection and operationalization, and informing a broader stakeholder group including non-state actors Increased understanding of operationalization of selected assessment models and awareness of experience and approaches being used in other countries to be applied in dialogue with direct support in selection and training trough EF. Assessment of needs and options for improving downscaled models utilised in assessments, and any subsequent work supported in obtaining such models. Improved methodological skills and knowledge for vulnerability assessment and adaptation planning; Contribution to capacity for implementation of NAS and further sectoral strategies and actions planned. e) Review of needs and options for improvement of down-scaled models for use in vulnerability assessment follow-up activity where possible Review and options paper, and possible follow-up work in partnership with key providers of downscaled modelling, aimed at provision of improve down-scaled models. 14 C6 Support for Association Agreement implementation In respect of the Climate Chapter, Clima East activity under C1-5 will address a number of specific targets for cooperation under Article 95 of the Association Agreement: (b) vulnerability and adaptation assessments (C5); (c) a National Strategy for Adaptation to Climate Change (C3 and C5) (e) long-term measures to reduce emissions of greenhouse gases (C1, C4 and CEEF MD) (f) measures to prepare for carbon trading (C4 and CEEF MD); (h) measures to mainstream climate considerations into sector policies (C1 and C3); As noted under C 3, 4 and 5, Moldova is in receipt of support for development and implementation of key climate strategies and policies through other donors, and a key contribution of Clima East will be to help ensure this support is cross-referenced to Association Agreement compliance issues and opportunities. While the activities implemented under C1-5 are not repeated in the Proposed Activities listed below, we highlight their relevance here to clarify in this context the wider activity under the Project of relevance to implementation of the Association Agreement, and enable focussed reporting on this angle of the work. In addition, in respect of Annex XII referenced in the Climate Chapter, Clima East will support approximation of legislation to Directives 2003/87/EC on emissions trading schemes and 98/70/EC on fuel quality through CEEF MD. The project remains open to considering any application for support in addressing approximation tasks in respect of Regulation (EC) No 842/2006 on certain fluorinated greenhouse gases and Regulation (EC) No 1005/2009 on substances that deplete the ozone layer Further, the Project will explore with the Focal Point and, if approved, other governmental stakeholders opportunities for additional support to integrating climate aspects into implementation of Association Agreement obligations in selected other sectors, to align with the aim of climate mainstreaming. Such activities under C6 will be defined together to with respective national entities in charge of AA implementation, if requested, and in close coordination with the EU Delegation. 15 Work Programme 1.1. Approach for Project Delivery The approach to delivery of the Clima East Policy Project is guided by three core requirements, made clear in both the ToR, and subsequent guidance from the EC DEVCO (DG NEAR 7 ) and consultation with Partner Countries - To operate as a regional programme, focusing on joint activities and sharing, exchange of ideas, approaches and results in implementing national actions. - To be genuinely demand led, responding to the needs of Partner Country stakeholders, as identified through research, consultation and on-going dialogue. - To construct activities that lead to identifiable and concrete results for the Partner Countries (PCs). Following project implementation and dialogue with the Partner Countries, a set of activities has been defined at regional level to assist each PC to make progress in the areas it has prioritised for support. Therefore, regional activities are based on converging/synchronous national priorities. Recognising the ongoing need to be flexible to new developments in climate change issues at the international, regional and national level, this Work Programme presents a defined set of Actions for 2015 (See Annex 1). Most areas are likely to benefit from support through the life of the Project, other areas, such as Paris Agreement preparation related ones, are time specific and will change beyond The Project is intended to provide assistance over a wide range of issues. This scope has been structured under a number of Result Areas as set out below. Thus the Project aims to be a resource for Partner Countries, to feed in to their own work towards each of these end results, where relevant. It does not aim to replace national efforts or expertise, in recognition of the fact that only national stakeholders are equipped to achieve these final results in a way which is nationally appropriate, and to create the conditions that sustain the benefits of those changes and improvements. 7 Within the Europen Comission DG Neighborhood and Enlargement Negotiations (NEAR) is repsonsible for the project.

16 Regional synergies A number of overlaps between the priorities of the Partner Countries have become apparent especially regarding UNFCCC negotiations (INDCs) while the final choices and designs of each country s response to those priority challenges have been naturally tailored to its specific context as reflected in the national work programmes. Resources The Project emphasizes regional best practice sharing and also exchange of experience between the Partner Countries and EU institutions and Member States, but equally focussed on working with PC stakeholders to ensure that practical results are achieved on the ground in each Partner Country. To accommodate these two emphases, the Terms of Reference for Project specify two types of resources within the Project: Core Resources, comprising of the small core team of four Key Experts and resources for the direct costs of a range of regional services and actions and a total a budget for short term expertise over the Project lifetime to support regional events and actions Funding for an Expert Facility, which can be used to mobilise targeted expertise for in depth support to an individual country on a particular task, on the basis of a specific application from the Partner Country stakeholders. (NB. joint applications from more than one country are welcome to the Expert Facility and one such application has been received.) Both types of resource are used together to reinforce the aims of the Project. Thus, the Core Resources in part fund more general information-sharing and training activities, delivered to stakeholders from more than one country. But other regional activities have been designed to build on this general information provision by providing opportunities for the stakeholders of individual Partner Countries to have focussed discussion with and support from relevant experts. The aim is therefore to provide a spectrum of support, from the general to the specific, to make best use of the resources available. General needs are answered cost effectively through joint regional activity, with added value from international exchange of approaches and practice. More specific needs can be defined and discussed through focussed support through the Help Desk function available at the Clima East website and through discussion with the Project Team and other stakeholders. This ensures best value for the Partner Countries from the resources for national-level activity through the Expert Facility, as the tasks to be delivered at national level can be well defined and prepared through those processes that have taken place in the context of regional level actions. 11

17 1.2. Activities under the 2015 National Workplan for Moldova Types of Action In line with the approach set out above, the regional and national Work Programmes include three types of actions: 1. Shared-interest CORE ACTIONS designed to respond to common priorities under the Terms of Reference applicable to multiple countries and were confirmed through the country consultations across most PCs in each technical Result Areas. These are identified as C actions. C actions are defined for each individual country and for the regional level work programme. 18 3. Expert Facility projects are defined during the project duration based on submissions from partner countries. These are identified as EF actions requiring PC applications. This section sets out in detail the planned Core Actions for 2015, noting where appropriate activities foreseen or underway through the Expert Facility which support and complement the aims of the Core Actions Cross-cutting actions remain constant from The tables below therefore present each of the 5 Core Action areas and seek to explain. what is the issue to be addressed, the starting point within the Partner Country and the progress made to date how activities relate to other donors support what will be delivered (Activities and their Outputs) and which processes and results within the Partner Countries they are designed to assist with (Outcomes expected); potential follow-up support 13

19 C1 - INDC Support General Background The COP 20 in Lima ended with a compromise text of the Lima call for climate action. The decision contains in an annex a draft text of the future agreement which will be used as a basis for further negotiations in 2015 leading to the final agreement being adopted in Paris. The decision contains the agreed scope of information on the future contributions, Intended Nationally Determined Contributions (INDCs) which countries will put forward before Paris. The key expectation before the Lima COP was that it would provide guidance to countries on how to prepare their Intended Nationally Determined Contributions (INDCs) to 2015 Agreement; however comprehensive guidance on how to draft an INDC has not been agreed upon. The Lima decision reiterated the invitation from Warsaw to each UNFCCC Party to submit to the Secretariat its INDC towards achieving the objective of the Convention. All INDCs are to be communicated in a clear, transparent and understandable way. Without clarity, transparency and understanding of INDCs it would not be possible to quantify and judge the proposed contributions. However, it is for each Party to decide what these qualifiers mean in their case. The decision specified that the information provided by Parties together with their INDC may include (for each Party to decide) a number of specific types of information. as appropriate in the light of differing national circumstances. Inter alia, countries are invited to provide, if they wish, quantifiable information on the reference point including, as appropriate, a base year, time frame for implementation or period of implementation proposed for their contributions, scope and coverage of proposed INDCs, planning processes, assumptions and methodological approaches, including those for estimating and accounting for anthropogenic GHG emissions, and, as appropriate, removals. All this information refers to mitigation that countries are planning to undertake under 2015 agreement. Although the requirements to include all of this information are not mandatory, they may serve as a basis for comparison based on understanding on how the proposed INDCs contribute to achieving the objective of the Convention as set out in its Article 2 and it is hoped that they will help to create peer pressure between countries to put forward ambitious contributions. Parties are also invited to consider communicating their undertakings in adaptation planning or consider including an adaptation component in their INDCs. This should be interpreted that countries submitting their INDC on mitigation may also add an adaptation component to their INDC. Adaptation component of INDC differs from the mitigation component insofar that only the mitigation component will be considered under the aggregate effect of the INDCs communicated by Parties by 1 October It is expected that national INDC submissions will reach the UNFCCC Secretariat by 1 October 2015 allowing for establishing the aggregate effects of the INDCs before the Paris COP. Current status and related activity in Partner Country Proposed Clima East Contribution Current situation in Partner Country: Following Parliamentary elections in November 2014, the new Government was appointed in Moldova in February The Ministry of Environment (MoE) will continue to be responsible for the Climate Change issues. Within the Ministry of Environment (MoE), the UNDP co-financed and staffed Climate Change Office (CCO) is responsible for the activities related to preparation of National Communications (NCs), National Inventory Reports and National Greenhouse Gas Inventories. The Monitoring and Assessment Department, Ministry of Environment is responsible for various aspects of climate and air quality policy formulation. The MoE Monitoring and Assessment Department together with the Climate Change Office is likely to have the central role in INDC formulation and development. No formal decision has yet been taken by the Moldovan Government on the process or preparation of INDC and the new Minister has just recently started executing his duties. Given the GEF support for INDC implemented through the UNDP, is likely that the UNDP CCO will have a crucial role in INDC formulation. 14

20 In the view of the above, Moldova is unlikely to be in position to prepare and communicate its INDC to the UNFCCCC Secretariat by the first quarter of 2015, as the Lima Decision invites. However, submission by 1 October 2015 is possible. Needs: Given the current situation, Moldova faces a challenge to develop a detailed, justified and meaningful INDC and submit it to the UNFCCC Secretariat by 1 October 2015, and to meet this challenge the authorities will require support from qualified experts. In this regard, the assistance of Clima East Project could be essential for timely preparation of INDC. In the period , Moldova developed the LEDS which contains sectoral mitigation scenarios and recommendations that are relevant for INDC formulation. The LEDS process covers all key emitting sectors of the country. However, the LEDS process was designed without considering the INDC content in general and the INDC timeline in particular, therefore some coordination is still needed between LEDS and INDC processes. The INDC content formulation will require technical expertise ensuring the correctness of historic, present and future domestic factors covering the entirety of issues defining GHG emissions. A key additional area of concern is the structuring and presentation of the INDC in line with the international expectations and best practices as well as the requirements of the UNFCCC Secretariat compilation of INDC submission. As the Lima decision has provided limited guidance on the content, structure and formulation of INDCs, this aspect requires international liaison and a dynamic up-take of emerging international best practice on the structuring of INDC. The new Government may require guidance on how best to establish an INDC development process and how the necessary content could be built from existing elements such as the LEDS given the very limited time available. Moreover, the CCOs historic role on reporting (NCs, BUR) as compared to the decision-focus of the INDCs may require an entirely different approach engaging the decisionmakers and enabling an ambitious and realistic INDC emerging under the newly sworn in Government. Action covered by other projects/donors: The GEF funds a dedicated project to provide support in this task: Republic of Moldova Preparation of intended nationally determined contribution (INDC) to the 2015 Agreement under the United Nations Framework Convention on Climate Change (UNFCCC). This project will support the Republic of Moldova to prepare and submit its INDC to the 2015 UNFCCC Agreement and to have institutional arrangements in place that support the INDC process. The GEF support focusses on both the INDC process and content elements. The Low-Emission Capacity Building Project Republic of Moldova (LECB) Project funded by the EU and implemented by the UNDP is also undertaking relevant activities. Its scope is to increase institutional capacities to provide appropriate mechanisms of support and coordination when addressing climate risks, to strengthen the technical knowledge in order to better understand and make use of climate information, and increasing relevant data and access to data for planning and decision-making. As the LECB ToR formulation occurred before the Warsaw COP decision on INDCs, however the project has no specific deliverables designed for and in line with INDC requirements. Various adaptation related projects mostly implemented by UNDP and one by the Austrian Development Agency are under way and they can provide important input into the adaptation part of the INDC, should the country decide to include adaptation elements. Summary of proposed contribution and added value by Clima East: As key decisions still need to be taken by the Government with respect to INDC development process, it is not yet possible to identify key gaps that will not be covered by other support available and remains premature to identify a specific share of concrete tasks between Clima East/ GEF and others. The Project will support Moldova, if requested, in ensuring timely preparation of its submission that responds to all of the key UNFCCC requirements for INDC through general consultation, review and feedback on draft submission text, and support to developing applications for specific assistance through the Expert Facility or identifying other sources of support where in depth assistance is required beyond the capacity of the Key Expert team. The Project team stands ready to provide support to the Ministry of Environment and/or CCO in coordinating the national INDC formulation processes. The Project will provide support on request with building understanding 15
