6 Case 1 : Supplementarity in using units from MM for the target Reporting requirements: shall in para. 33 of KP Art.7 GLs AI Party shall provide information on how its use of the mechanisms is supplemental to domestic action. Challenge Whether the Party intends to use units, or not? When a Party does not intend to use units for Convention targets, the notion of supplementarity is relevant, or not? How the Party explains that domestic emission reductions are considered more significant than the amount of units used? Comparison is possible? Quantified amount of mechanisms units the Party plans to use VS Check the standard language available in the template. domestic emission reductions
7 Case 1 : Supplementarity in using units from MM for the target Approach Party not intends to use units Requirement of supplementarity is fulfilled. Conclude that the domestic action accounts for the overall effort made to meet its commitment under the Kyoto Protocol, and hence the use of mechanisms is supplemental to domestic action. Recommendation on provision of the information The ERT should not recommend that the Party elaborate further on supplementarity. Party intends to use units Assess: Quantified information on the units planed to be used, Comparison between contribution of units and domestic reductions, How domestic reductions are significant to meet commitment. Reflect the information in the review report Recommend the provision of the information, if applicable
8 Case 2: Steps taken to implement IMO/ICAO decisions Reporting requirement : Shall in paras. 35 of KP Art. 7 GLs AI Party shall identify the steps it has taken to promote and/or implement ICAO/IMO decisions Challenge Parties do not provide the information. Information is not clear. Indicator to satisfy reporting requirement is unclear, e.g., participation in the meetings of ICAO, or regional actions, not domestic actions, is sufficient? Approach Knowledge on decisions of ICAO/IMO is indispensable to review. Any steps/measures implemented to meet requirements of relevant decisions by ICAO and IMO reported? Information on studies to support steps, participation in the meetings, reports/submissions to ICAO and IMO, could be considered. Recommend the provision of information in the report, when applicable.
9 Case 3: Domestic and regional programmes, arrangements and procedures Reporting requirements: shall in paras. 37 and 38 of KP Art. 7 GLs AI Party shall report any relevant information on its domestic and regional legislative arrangements and enforcement and administrative procedures for: meeting its commitments under the Kyoto Protocol, provisions to make those information publicly accessible, coordinating activities relating to participation in the mechanisms. AI Party shall provide a description of any national legislative arrangements and administrative procedures for: seeking to ensure that the implementation of activities Articles 3.3 & 3.4, contributing to the conservation of biodiversity and sustainable use of natural resources. Challenge The level of information reported varies significantly as the reporting requirement is not clear to Parties. Ensuring the consistent approach of the ERTs in assessing completeness and transparency, particularly for the conservation of biodiversity.
10 Case 3: Domestic and regional programmes, arrangements and procedures Approach The ERT should check if Parties clearly describe: what legislation they have in place, procedures for addressing cases of non-compliance, how this legislation is being implemented and enforced, what are the institutions involved, and what coordination mechanisms are established. If all the above information are reported, then the reporting of the Parties is complete and transparent. Otherwise, the ERT may describe "mostly / partially complete and transparent".
11 Case 4 : Information on GHG emissions and trends consistency amongst NC, BR, and NIR Reporting requirements: should in paras. 10 in NC / 2 of BR reporting GLs Information in the BR should be consistent with the most recent annual inventory submission.(dec. 2/CP.17 Annex I) Information in the NC should be consistent with the annual inventory submission of the year in which the NC is submitted, and Any difference should be fully explained. (FCCC/CP/1999/7) Challenge Information in the NC/BR is inconsistent with that in Parties NIRs. Inconsistencies are also observed between NC and BR, due to the revised estimates as a result of the inventory reviews. Gaps may be unavoidable. Approach Ensure Parties report clearly on which inventory submission the relevant chapters in the NC/BR are based. Ensure Parties provide consistent inventory data in the NC/BR based on the latest available official inventory data at the time of their preparation. When inconsistencies do exist, Parties should provide transparently the relevant explanations.
12 Case 5 : Research and Systematic Observation -1- Reporting requirements: shall/should in paras. 58 and 64(d) of NC reporting GLs (FCCC/CP/1999/7) The NC shall also reflect action taken to support related capacitybuilding in developing countries (para 58). Parties should provide information on support for developing countries to establish and maintain observing systems (para 64 (d)). Challenge Interpretation, by the ERT and by the Parties, of reporting requirements are not correct. E.g., the ERT recommends the Party include information on support for the establishment and maintenance of observing systems. Approach The ERT should not confuse the shall requirement of para 58 of the NC guidelines with the should requirement of para 64 of the same guidelines. The two requirements are very different in nature. Para 58 addresses support to DCs in general, and para 64(d) specifically discusses support for the establishment and maintenance of observing systems.
13 Case 6 : Research and Systematic Observation -2- Reporting requirements: shall in para. 58 of NC reporting GLs (FCCC/CP/1999/7) The NC shall address both domestic and international activities (for example, the World Climate Programme, the International Geosphere- Biosphere Programme, the Global Climate Observing System, and the IPCC). Challenge Interpretation by the ERT and the Parties of reporting requirements might not be the same. Approach The ERT should provide a recommendation to address both domestic and international activities. However, the ERT should not provide a recommendation to report specifically on the World Climate Programme, IPCC etc. Parties can choose any other international activities to report on.
