1 KEY CREDIT TERMS FOR THE GE MONEY PLATINUM MASTERCARD The information about the costs of the Card described below is accurate as of February 1, This information may have changed after that date. To find out what may have changed, write to us at P.O. Box , El Paso, TX This application and the Agreement will be governed by federal law and Utah law (to the extent that state law applies). We may, at any time and subject to applicable law, change, add or delete provisions of the Agreement, including increasing rates or fees. We will send you notice of any terms change as required by applicable law. The GE Money Platinum MasterCard is only available to U.S. residents. Annual Percentage Rate ( APR ) for Purchases KEY CREDIT TERMS Premier Accounts: 19.99% Choice Accounts: 26.99% The Purchase APR will apply to Balance Transfers. However, Balance Transfers and Purchases made using Convenience Checks will be included in the Cash Advance Balance and will be subject to the Cash Advance Rate below. APR assigned upon approval. The Prime Rate for a billing cycle is the highest prime loan rate as published in The Wall Street Journal in its Money Rates Section on the last business day of the calendar month preceding the first day of the billing cycle. A limited number of applicants are expected to receive a Premier Account. 1 The Periodic Rates and corresponding APR s for all account balances(including any promotional rates) may be increased if you fail to make a minimum payment to us when due or you make a payment to us that is not honored by your bank. If we increase your Periodic Rate, the new Periodic Rate will be equal to the Penalty Rate. The increased Periodic Rate may apply to your existing balances and future transactions We may also change rates or other terms as provided in the Termination/Change in Terms section of this Agreement.

2 IMPORTANT DISCLOSURES Federal Law requires us to obtain, verify, and record information that identifies you when you open an account. We will use your name, address, date of birth, and other information for this purpose. By submitting this application you agree to the following: I am providing the information in this application to GE Money Bank ( GEMB ). GEMB may provide information about me (even if my application is declined) to its affiliates so that they can create and update their records, and to provide me with service and special offers. GEMB may obtain information from others about me (including requesting reports from consumer reporting agencies and other sources) to evaluate my application, and to review, maintain, or collect my account. I consent to GEMB and any other owner or servicer of my account contacting me about my account, including using any contact information or cell phone numbers I provide, and I consent to the use of any automatic telephone dialing system and/or an artificial or prerecorded voice when contacting me, even if I am charged for the call under my phone plan. I have read and agree to the Key Credit Terms and other disclosures in this application, and I understand that if my application is approved, the credit card agreement ( Agreement ), will be sent to me and will govern my account. Among other things, the Agreement: (1) includes an arbitration provision that may limit my rights unless I reject that provision under the Agreement s instructions; and (2) makes each applicant responsible for paying the entire amount of the credit extended. CONSENT TO ELECTRONIC COMMUNICATIONS By submitting an application online, or signing up for online services ( eservice ), for your GE Money Platinum MasterCard account, you hereby agree to the following and this will constitute your consent ( Consent ) for us to send you electronic communications. 1. Categories of Communications. You understand and agree that GE Money Bank, the issuer of the GE Money Platinum MasterCard Account, our assignees, or other holders of your GE Money Platinum MasterCard ( we or us ) may provide to you by electronic means information regarding your GE Money Platinum MasterCard ( Credit Card Account ), including disclosures required by applicable federal or state law (collectively, Communications ) which may include, but is not limited to, the following: The initial disclosure statement or agreement ( Agreement ) governing the Credit Card Account, including, without limitation, any Truth in Lending Act disclosures; Letters or notices regarding your Credit Card Account, including customer service responses; GE Money Bank s Privacy Policy ( Privacy Policy ) for the Credit Card Account; Other federal and state law disclosures, notices and communications in connection with the application for, the opening of, maintenance of or collection of the Credit Card Account; and Disclosures, Debt Cancellation Agreement and other information related to optional Debt Cancellation products you may elect to purchase. Communications may be sent to your address. Communications may include your name and some information about your Credit Card Account, including your balance or the due date. Electronic Communications may be disclosed to any party with access to your Credit Card Account or account or hardware or software used to view your Credit Card Account or account. 2. Manner of Consent. You acknowledge that by giving your Consent through this website, you demonstrate that you can access information that we may provide to you by posting electronic Communications on a website. 3. How to Withdraw Consent. You may not apply online for a Credit Card Account, and you may not register your Credit Card Account for eservice, unless your provide your Consent. After you open a Credit Card Account or register your Credit Card Account for eservice, you may withdraw your Consent by contacting customer service or by writing to P.O. In order to access and retain Communications, you must have: An Internet Browser which supports HTML 4.0 and SSL-encryption, such as Netscape 4.0 or later and Microsoft Internet Explorer 4.0 or later. A means to print or store notices and information through your browser software. A personal computer or equivalent device capable of connecting to the Internet via dial-up, DSL, Cable Modem, Wireless Access Protocol, or equivalent, and that supports the foregoing requirements. 5. Paper Copies of Communications. Upon your request, we will send you a paper copy of the Agreement, the Privacy Policy, Debt Cancellation Agreement and/or other material provided to you electronically pursuant to this Consent. If you would like a paper copy of any of this material (other than the Debt Cancellation Agreement) please write to us at P.O. Communications in Writing. All Communications in either electronic or paper format from us to you will be considered in writing. You should print or download a copy of this Consent, the Agreement, the Privacy Policy, your application, the Debt Cancellation Agreement (if elected) and any other Communication that is important to you for your records. 7. Electronic Signatures. You acknowledge that by clicking on the I Agree, the Submit or similar button on this website, you are indicating your intent to sign the relevant document or record and that this shall constitute your signature. 8. Federal Law. You acknowledge and agree that your Consent is being provided in connection with a transaction affecting interstate commerce that is subject to the federal Electronic Signatures in Global and National Commerce Act, and that you and we both intend that the Act apply to the fullest extent possible to validate our ability to conduct business with you by electronic means.

3 GE MONEY BANK GE MONEY PLATINUM MASTERCARD AGREEMENT 1. GENERAL. This Agreement ( Agreement ) governs your GE Money Platinum MasterCard ( Account ). In this Agreement and in your billing statements ( Statements ), we, us, and our mean GE Money Bank, the bank that issues your Card, located at 170 West Election Drive, Suite 125, Draper, UT or our Affiliates; you and your mean all persons whom we approve to use the Account; and Card means your GE Money Platinum MasterCard Credit Card. The effective date ( Effective Date ) of this Agreement will be the earlier of (i) the date you submit an Account application that is approved by us, or (ii) the first date that you or someone authorized by you uses the Account. Please read and keep this Agreement for your records. 2. USE OF ACCOUNT. A. You may use your Card or Account only for personal, family or household purposes, including to purchase goods or services from any merchant that accepts MasterCard credit cards ( Purchases ). You also may use your Card or Account to obtain cash advances at any institution that accepts the Card or Account, including any Automated Teller Machines ( Cash Advances ). We may, from time to time, allow you to transfer balances from other credit card accounts to this Account ( Balance Transfer ), or to access credit on the Account by writing a convenience check ( Convenience Checks ). Notwithstanding anything to the contrary, the following transactions are treated as Cash Advances: Convenience Checks (including Convenience Checks used to make purchases or Balance Transfers), drafts, money orders, cashier s checks, traveler s checks, electronic or wire transfers, foreign currency or other in-bank transactions, tax payments, lottery tickets or other legalized gambling transactions, court costs, bail bonds, person-to-person payments, fines, and other cash-like transactions. B. Your Card and Account must be used only for lawful transactions. You may not use your Account for internet gambling transactions or to pay amounts you owe us on this Account or any amounts you owe on other accounts you have with us. C. Subject to the terms of this Agreement, you may use your Account for Purchases, including Balance Transfers, up to any credit limit we may establish ( Credit Limit ), and you may use your Account for Cash Advances, including Convenience Checks, up to any cash advance limit we may establish ( Cash Advance Limit ). Your Cash Advance Limit may be a portion of your Credit Limit. D. We may occasionally approve a transaction that causes your Account balance to exceed your Credit Limit without waiving any of our rights under this Agreement. If you exceed your Credit Limit, an overlimit fee may be imposed as set forth in Section 8B. You are required to pay the portion of your balance that exceeds your Credit Limit each month. We may decline to authorize any transaction on your Account, and we may change your Credit Limit and your Cash Advance Limit at any time. 3. PROMISE TO PAY. By using the Account, you agree to be bound by this Agreement. You promise to pay us for all credit that we extend on your Account and all other amounts owed to us under this Agreement. If your Account is a joint Account, each of you: (i) is bound by this Agreement; (ii) may use the Account, up to the Credit Limit or any other Credit Limit we may establish; and (iii) jointly and individually promise to pay us, and may be held liable for, all amounts owed to us on the Account. We also may issue additional cards to other persons you authorize to use your Account if you ask us to do so. However, you and any joint Accountholder are responsible for all charges made by any person(s) authorized to use your Account. You understand and agree that arrangements made among cardholders and other events do not alter or affect your responsibility to make payments to us. 4. PERIODIC FINANCE CHARGES. We calculate the periodic Finance Charge separately for Purchases, Balance Transfers, and Cash Advances. The ANNUAL PERCENTAGE RATE may sometimes be referred to as APR. The Purchase Standard Rate described in Section 4B will apply to your Balance Transfer Balance. However, Balance Transfers or Purchases made by using Convenience Checks will be included in the Cash Advance Balance subject to the Cash Standard Rate described in Section 4C. A. The periodic Finance Charge for a billing period is calculated by applying the applicable daily periodic rate ( Periodic Rate ) to the Account balance subject to periodic Finance Charges for each day in the billing period, and adding together all of those daily Finance Charge amounts. A minimum FINANCE CHARGE of $2.00 will be imposed for each billing period in which your Account is subject to a periodic Finance Charge. B. The Periodic Rate for your Purchase Balance is the purchase standard rate ( Purchase Standard Rate ), unless the Penalty Rate applies as described below. The Purchase Standard Rate for a billing period is the Prime Rate plus 16.74%, times 1/365 for GE Money Platinum MasterCard Premier Account; or the Prime Rate plus 23.74%, times 1/365 for GE Money Platinum MasterCard Choice Account. The Prime Rate for a billing period is the highest bank prime loan rate as published in The Wall Street Journal in its Money Rates section on the last business day of the calendar month preceding the first day of the billing period. As of February 1, 2010, the Purchase Standard Rate for GE Money Platinum MasterCard Premier Account was.05477% (APR 19.99%); and the Purchase Standard Rate for GE Money Platinum MasterCard Choice Account was.07395% (APR 26.99%). C. The Periodic Rate for your Cash Advance Balance is the cash standard rate ( Cash Standard Rate ), unless the Penalty Rate applies as described below. The Cash Standard Rate for a billing period is the Prime Rate plus 23.74%, times 1/365. As of February 1, 2010, the Cash Standard Rate was.07395% (APR 26.99%). D. The Periodic Rates and corresponding APRs for all GE Money Platinum MasterCard Account balances (including any promotional rates) may be increased if you fail to make a minimum payment to us when due or you make a payment to us that is not honored by your bank. The penalty rate ( Penalty Rate ) will be the Prime Rate plus 26.74%, times 1/365. As of February 1, 2010, this Penalty Rate was.08217% (APR 29.99%). If we increase your Periodic Rate, the new Periodic Rate will be equal to the Penalty Rate. The increased Periodic Rate may apply to your existing balances and future transactions. We may also change rates or other terms as provided in the Termination/ Change in Terms section of this Agreement. E. The Periodic Rates and corresponding APRs may vary. If the Prime Rate increases, the Periodic Rates and corresponding APRs may increase, and as a result the periodic Finance Charge, Total Minimum Payment, and number of payments also may increase. Any change in the Periodic Rates will apply to your entire Account balance (unless otherwise specified in any applicable promotional offer that provides for different terms for that promotion). A change in the Prime Rate will take effect on the first day of the billing period after the change. We may select a new interest rate index if the Prime Rate is not available. 5. BALANCE SUBJECT TO PERIODIC FINANCE CHARGE. The balance subject to a periodic Finance Charge is calculated separately for Purchases, Balance Transfers, and Cash Advances. A. Purchases. The Purchase Balance subject to a periodic Finance Charge is the Purchase Daily Balance of the Account. However, Purchases are not included in the Purchase Balance subject to a periodic Finance Charge for a billing period if there is no previous balance on your Account at the beginning of the billing period, including any Special Promotions and Special Promotions balances, ( Previous Balance ), or the sum of your payments and credits posted to your Account by the Payment Due Date is at least equal to the Previous Balance. To determine the Purchase Balance subject to a periodic Finance Charge, we take the prior day s Purchase Balance of your Account, which includes any unpaid periodic Finance Charge on your Purchase Balance and add any new Purchases, including any other debits charged to your Account that day, and subtract any payments and other credits applied to your Purchase Balance that day. For each day we also add any periodic Finance Charges on your Purchase Balance and other Finance Charges and fees (other than Transaction Fees for Cash Advances and Balance Transfers), including any debt cancellation fees, assessed that day on your Account. This gives us the Purchase Daily Balance of the Account. Any Purchase Daily Balance of less than zero will be treated as zero. B. Balance Transfers. The Balance Transfer Balance subject to a periodic Finance Charge is the Balance Transfer Daily Balance of the Account. To determine the Balance Transfer Balance subject to a periodic Finance Charge, we take the prior day s Balance Transfer Balance of your Account, which includes any unpaid periodic Finance Charges on your Balance Transfer Balance, and add any new Balance Transfers, Transaction Fees for Balance Transfers and periodic Finance Charges on your Balance Transfer Balance for that day and subtract any payments and other credits applied to your Balance Transfer Balance that day. This gives us the Balance Transfer Daily Balance of the Account. Any Balance Transfer Daily Balance of less than zero will be treated as zero.

4 C. Cash Advances. The Cash Advance Balance subject to a periodic Finance Charge is the Cash Advance Daily Balance of the Account. To determine the Cash Advance Balance subject to a periodic Finance Charge, we take the prior day s Cash Advance Balance of your Account, which includes any unpaid periodic Finance Charges on your Cash Advance Balance, and add any new Cash Advances, Transaction Fees for Cash Advances and periodic Finance Charges on your Cash Advance Balance for that day and subtract any payments and other credits applied to your Cash Advance Balance that day. This gives us the Cash Advance Daily Balance of the Account. Any Cash Advance Daily Balance of less than zero will be treated as zero. 6. WHEN PERIODIC FINANCE CHARGES BEGIN TO ACCRUE. We calculate when periodic Finance Charges begin to accrue separately for Purchases, Balance Transfers, and Cash Advances. A. Purchases. If there is a Previous Balance on your Statement, Purchases and other related charges will begin to accrue periodic Finance Charges on the later of the transaction date or the first day of the billing period in which the Purchase is posted to your Account. However, if there is no Previous Balance shown on your Statement, or if the sum of all payments and credits posted to your Account by the Payment Due Date is at least equal to the New Balance (including any Special Promotion balances) on your Statement, Purchase Balances will not incur any periodic Finance Charges on the next Statement. To avoid periodic Finance Charges on Purchases on your next Statement, you must pay your entire New Balance, including any Special Promotion balances, by the Payment Due Date shown on your Statement. B. Balance Transfers. Balance Transfers, Transaction Fees for Balance Transfers and other related charges will accrue a periodic Finance Charge from the later of the transaction date or the first day of the billing period in which the Balance Transfer is posted to your Account. There is no period within which you can avoid periodic Finance Charges on Balance Transfers. C. Cash Advances. Cash Advances, Transaction Fees for Cash Advances and other related charges will accrue a periodic Finance Charge from the later of the transaction date or the first day of the billing period in which the Cash Advance is posted to your Account. There is no period within which you can avoid periodic Finance Charges on Cash Advances. 7. PAYMENTS. A. You must pay at least the Total Minimum Payment by 5:00 p.m. (ET) on the Payment Due Date shown on the Statement. You may pay more than the Total Minimum Payment at any time. Your Total Minimum Payment will be the sum of: (a) the greater of (i) $15.00, or (ii) the sum of the Finance Charges, any late fee, any overlimit fee imposed during the current billing period, and 1% of the new balance ( New Balance ) shown on your statement; plus (b) any past due amounts. The Total Minimum Payment will be rounded up to the next whole dollar. However, the Total Minimum Payment is the New Balance if the New Balance is less than $ B. All written communications concerning disputed amounts, including any check or other payment instrument that: (i) indicates that the payment constitutes payment in full or is tendered as full satisfaction of a disputed amount; or (ii) is tendered with other conditions or limitations ( Disputed Payments ), must be mailed or delivered to us at the address for billing inquiries shown on your Statement, not the Payment Address. C. All payments, except Disputed Payments, must be mailed or delivered to us at the address shown on your Statement (the Payment Address ). We may also offer services in which you may pay your bill by telephone ( Pay by Phone ). We may charge fees for these services. Our customer service representatives are instructed to tell you about any fees for Pay by Phone services. Any payments received after 5:00 p.m. (ET) on any day will be credited as of the next day. Credit to your Account may be delayed up to five days if payment: (a) is not received at the Payment Address; (b) is not made in U.S. dollars drawn on a U.S. financial institution located in the U.S.; (c) is not accompanied by the remittance coupon attached to your statement; (d) contains more than one payment or remittance coupon; (e) is not received in the remittance envelope provided; or (f) includes staples, paper clips, tape, a folded check, or correspondence of any type. You understand, that payments may not be made, and may not be deemed received by us, at any location other than the Payment Address or via our Pay by Phone or online payment services, if provided. Although we credit your payments in the manner described above, we may delay restoring credit available on your Account in the amount of your payment. All credits for payments to your Account are subject to final payment by the institution on which the item was drawn. D. We reserve the right to select the method by which your Total Minimum Payments and credits are allocated to your Account in our sole discretion. The payment allocation method that we use may result in higher Finance Charges on your Account or reduced savings attributable to any reduced APR promotion, depending on the types of transactions and promotions on your Account, and the timing and amount of your payments. Any payment you make in excess of the required Total Minimum Payment will be allocated to your Account as allowed by applicable law. E. You authorize us to obtain payment electronically for any check or other instrument that you send to us by initiating an ACH (electronic) debit to the account from which your check or instrument is drawn. Your check or instrument will not be returned to you by us or your bank. 8. ADDITIONAL FEES You agree to pay the following fees: A. A Late Payment Fee, if we have not received your Total Minimum Payment by 5:00 p.m. (ET) on the Payment Due Date shown on your Statement. The amount of the Late Payment Fee will be based on your new balance at the time the Late Payment Fee is posted to your Account. An Overlimit Fee of $35.00 for each billing cycle in which your New Balance as shown on your Statement exceeds your Credit Limit if you have requested over-the-credit limit coverage on your Account. C. A Returned Check Fee of $29.00 if any check or other instrument sent to us, or any electronic payment authorization you provide us for payment on your Account, is not honored upon first presentment even if the check, instrument, or electronic payment authorization is later honored. D. A Transaction Fee for each Cash Advance (including any Convenience Check) that posts to your GE Money Platinum MasterCard Account. This fee will be a FINANCE CHARGE equal to the greater of $10.00 or 3% of the amount of the Cash Advance. For Automated Teller Machine ( ATM ) Cash Advances, the amount of the Cash Advance may include a surcharge that the ATM owner imposes. E. A Transaction Fee for each Balance Transfer that posts to your Account will be charged. This fee will be a FINANCE CHARGE equal to 3% of the amount of the Balance Transfer, with a minimum of $5.00. F. A Returned Convenience Check Fee of $29.00 on your Account in the event any Convenience Check on your Account is not honored by us because (i) the portion of your Credit Limit available for Convenience Checks is insufficient to cover the amount of the Convenience Check, (ii) you have filed a petition in bankruptcy, (iii) the Convenience Check has expired, or (iv) your Account has been closed. G. A Stop Payment Fee of $20.00 if we stop payment on any Convenience Check at your request. You may request that we stop payment on a Convenience Check (only before it is negotiated) by notifying us in writing at GE Money Platinum MasterCard, P.O. Box , El Paso, TX , or by calling us at the telephone number on your Statement. If you call and order a stop payment, we must receive written confirmation of the stop payment order from you within fourteen (14) days of the call or the stop payment order will expire. The written stop payment order must include the Convenience Check number, payee, amount and date of the Convenience Check on which payment is to be stopped. A written stop payment order will expire six (6) months after we receive it unless the stop payment order is renewed in writing. 9. FOREIGN TRANSACTION FEE. If you make a transaction with your Card in a currency other than U.S. dollars, MasterCard will convert the transaction amount into U.S. dollars using its currency conversion procedure. Under the currency conversion procedure that MasterCard currently uses, the non-u.s. dollar transaction amount is converted into a U.S. dollar amount by multiplying the transaction amount in the non-u.s. dollar currency by a currency conversion rate. The currency conversion rate that MasterCard typically uses is either a government

5 mandated rate, or a wholesale rate provided to MasterCard. The currency conversion rate that MasterCard uses for a particular transaction is the rate MasterCard uses for the applicable currency when the transaction is processed. This rate may differ from the rate in effect when the transaction occurred or when it was posted to your Account, and may be higher than the rate you could have gotten if you had converted U.S. dollars into the foreign currency. We charge a fee for each transaction that you make in a country other than the United States, whether or not the transaction was in a foreign currency. This fee will be a FINANCE CHARGE equal to 3% of the dollar amount of the foreign transaction. 10. SPECIAL PROMOTIONS. At times, we may offer you special promotions when you use your Account ( Special Promotions ) for certain transactions. These Special Promotions will have some terms that are different from the terms in this Agreement. The provisions of this Agreement apply to any Special Promotion, unless otherwise provided under the terms of the Special Promotion. We may terminate your participation in any Special Promotion and/or apply the Penalty Rate to your Account balances (including Special Promotion balances) if you become more than 60 days late on any payment due on your Account. If this happens, each Special Promotion balance will no longer be subject to the terms of the Special Promotion and will instead be subject to the terms of this Agreement. Please see any Special Promotion advertising (including in-store signs) or other disclosures provided to you for the full terms of any Special Promotion offered. 11. TERMINATION/CHANGE IN TERMS. You may terminate your Account at any time by providing us written notice. We may, at any time and subject to applicable law, change, add or delete provisions of this Agreement ( Terms Change ) or terminate your Account. We may terminate your right to make future purchases or change your Credit Limit or any Cash Advance Limit at any time. We will apply any Terms Change to your Account as allowed by applicable law. We will send you notice of any Terms Change as required by applicable law. Upon any termination of your Account, you remain obligated to repay the balance of your Account and this Agreement will continue to apply until you do so. 12. DEFAULT. Subject to the limitations of applicable law, we may declare you in default if you: (i) fail to make at least the Total Minimum Payment when due; (ii) violate any other term of this Agreement; or (iii) become the subject of a bankruptcy or insolvency proceeding. After your default or your death, and subject to the limitations of applicable law, we may: (i) reduce your Credit Limit or Cash Advance Limit on your Account; (ii) terminate your Account; (iii) require immediate payment of your entire Account balance; (iv) terminate any Special Promotion and convert any balance on such Promotion to the standard terms and conditions of the Account; (v) bring an action to collect all amounts owed; and/or (vi) take any action allowed by law. If, after your default, we refer your Account for collection to an attorney who is not our salaried employee, you will pay, to the extent permitted by applicable law, our collection costs, including court costs and reasonable attorneys fees. 13. LIABILITY FOR UNAUTHORIZED USE. The Card is issued to you by us at your request and you agree to destroy it upon demand. You will have zero liability in the event of unauthorized use of your Account as long as you keep your Account in good standing, you have exercised reasonable care in safeguarding your Card(s), checks, Account number, and other Account access devices, and you have not reported two or more unauthorized events in the past twelve (12) months. You may be liable for up to $50.00 for the unauthorized use of the Card if the appropriate conditions noted above have not been met. You agree to promptly notify us if your Card is lost or stolen, or if there is possible unauthorized use of your Card by writing to GE Money Bank, P.O. Box , El Paso, TX You will not be liable for unauthorized use that occurs after you notify us of the loss, theft, or possible unauthorized use. If you orally give us notice concerning loss or theft, we may request you to confirm it in writing. You agree that unauthorized use does not include use by a person to whom you have given authority to use the Account or Card and that you will be liable for all use by such a person. To terminate that authority, you must notify us at GE Money Bank, P.O. Box , El Paso, TX CREDIT REPORTS AND ACCOUNT INFORMATION. You give us permission to request information and to make whatever inquiries we consider necessary and appropriate (including obtaining information from third parties and requesting consumer reports from consumer reporting agencies) for the purpose of considering your application for this Account and subsequently, in connection with any updates, renewals or extensions of credit or reviewing or collecting your Account. You also authorize us to report information concerning you or your Account, including information about your performance under this Agreement, to consumer reporting agencies and others who may properly receive such information. If you believe that we have reported inaccurate information about you to a consumer reporting agency, please contact us at GE Money Platinum MasterCard, P.O. Box , El Paso, TX In doing so, please identify the inaccurate information and tell us why you believe it is incorrect. If you have a copy of the credit report that includes the inaccurate information, please include a copy of that report. You are hereby notified that a negative credit report reflecting on your credit record may be submitted to a consumer reporting agency if you fail to fulfill the terms of this Agreement. 15. USE OF INFORMATION ABOUT YOU AND YOUR ACCOUNT/CONSENT TO COMMUNICATIONS. You agree to the use of information about you and your Account as described in the Privacy Policy. The Privacy Policy is a part of this Agreement and is enclosed or attached hereto. You consent for us to contact you using all media, and for all purposes (including collection purposes), using all contact information you provide to us. You agree that we may use automated equipment to dial your telephone number or to deliver messages to you. You may limit this consent based on the options we may provide to you by calling customer service. Any charges for contacting you which may be billed to you by your communications carrier are your responsibility. 16. TELEPHONE MONITORING. To ensure that you receive accurate and courteous customer service, your telephone calls with us may be monitored by our employees or agents and you agree to any such monitoring. 17. CONSENT TO ELECTRONIC DISCLOSURES. When you applied for this GE Money Platinum MasterCard Account, you agreed to receive Electronic Communications from us regarding your GE Money Platinum MasterCard Account, which may include disclosures required by applicable federal or state law (collectively, Communications ). These Communications include the Agreement, Statements and Privacy Policy, including, without limitation, any Truth in Lending Act disclosures and other federal and state law disclosures, notices and communications in connection with the application for, the opening of, maintenance or collection of a GE Money Platinum MasterCard Account. Communications may be sent to your address. Communications may include your name and some information about your GE Money Platinum MasterCard Account, including your balance or the due date for your payment. Electronic Communications may be disclosed to any party with access to your GE Money Platinum MasterCard Account or account or hardware or software used to view your GE Money Platinum MasterCard Account or account. At our option, we may provide you with paper Communications, such as paper Statements. In addition, if we provide you with paper Statements, we may switch to providing you with electronic Statements instead upon notice to you, unless you have withdrawn your consent to receive Electronic Communications as set forth below. You may withdraw your consent to receive electronic Communications and elect to receive paper Communications by writing to P.O. Box , El Paso, TX However, if you do so, we may close your GE Money Platinum MasterCard Account Line to future Purchases and Cash Advances and you will be required to pay off any balances under the terms that apply to your GE Money Platinum MasterCard Account at the time you withdraw your consent. 18. JOINT ACCOUNTS. If this is a joint Account, each of you will be jointly and individually responsible for your obligations under this Agreement. Notice to one of you will be considered to be notice to both of you; and we can rely on instructions from one of you, even if we receive inconsistent instructions from the other person. 19. WAIVER. We may, in our sole discretion, choose not to exercise any right under this Agreement, including the right to impose the full amount of any charge, without waiving that right. Any waiver of a right by us must be in writing and signed by us. Except as we may agree in a signed writing, we will not waive any rights if we (a) accept a late or partial payment, (b) accept a check or other payment marked payment in full or tendered with other conditions or limitations, (c) extend the due date of any payment due under this Agreement, and/or (d) release any collateral or person responsible for your obligations under this Agreement. 20. CHANGE OF ADDRESS/PHONE NUMBER. You will notify us promptly if you change your address and or your phone number(s). We may send Statements and other notices to your address in our records until we have a reasonable opportunity to update our records with any new address for you. 21. ARBITRATION PROVISION. Please read this arbitration provision carefully. IT PROVIDES THAT ANY PAST, PRESENT OR FUTURE LEGAL DISPUTE OR CLAIM OF ANY KIND, INCLUDING STATUTORY AND COMMON LAW CLAIMS AND CLAIMS FOR EQUITABLE RELIEF, THAT RELATES IN ANY WAY TO YOUR ACCOUNT, CARD OR YOUR RELATIONSHIP WITH US ( CLAIM ) WILL BE RESOLVED BY BINDING ARBITRATION IF EITHER YOU, WE, OR GE MONEY PLATINUM MASTERCARD ELECT TO ARBITRATE. Right to Reject Arbitration: You may reject this arbitration provision, in which event neither you nor We will have the right to require arbitration. Rejection will not affect any other aspect of these terms. To reject the arbitration provision, you must send Us a notice within 60 days after you open your Account. This arbitration provision covers all Claims, except that We will not elect to arbitrate an individual Claim brought by you in small claims court or its equivalent, unless that Claim is transferred, removed, or appealed to a different court. The arbitrator s decision will be final and binding except for: (1) any appeal right under the FAA; and (2) any party may appeal decisions relating to Claims of more than $100,000 to a three-arbitrator panel appointed by the administrator, which will reconsider all over again any aspect of the appealed award. If you appeal, We will consider in good faith a request that We pay any additional fees of the administrator or arbitrator. This arbitration provision will survive the termination of your Account and the Card and will remain in force no matter what happens to you or your Account. In case of any conflict or inconsistency, this Agreement controls over any rules and procedures of the arbitration administrator. 22. GOVERNING LAW. Except as provided in the arbitration provision, this Agreement and your Account and any claim, dispute or controversy arising from or relating to this Agreement or your Account, whether based on contract, tort, fraud and other intentional torts, statute, common law and/or equity, are governed by and construed in accordance with federal law, and to the extent that state law applies, the laws of the State of Utah (without regard to internal principles of conflicts of law). The legality, enforceability and interpretation of this Agreement and the amounts contracted for, charged and received under this Agreement will be governed by such laws. This Agreement is entered into between you and us in Utah. We make decisions about granting credit to you from, extend credit to you under this agreement from, and accept your payments in Utah. 23. ASSIGNMENT. We may sell, assign or transfer any of our rights or obligations under this Agreement or your Account, including our rights to payments, without prior notice to you. You may not sell, assign or transfer any of your rights or obligations under this Agreement or your Account. 24. SEVERABILITY. If any provision of this Agreement is determined to be void or unenforceable under applicable law, all other provisions of this Agreement shall still be valid and enforceable. 25. ENTIRE AGREEMENT. This Agreement, together with any application you signed or otherwise submitted in connection with the Account (which is hereby incorporated by reference in this Agreement), constitutes the entire Agreement between you and us relating to your Account and supersedes any other prior or contemporaneous agreement between you and us relating to your Account. This Agreement may not be amended except in accordance with the provisions of this Agreement. STATE NOTICES NEW JERSEY RESIDENTS: Because certain provisions of this Agreement are subject to applicable laws, they may be void, unenforceable or inapplicable in some jurisdictions. None of these provisions, however, is void, unenforceable or inapplicable in New Jersey. WISCONSIN RESIDENTS: No provision of a marital property agreement, a unilateral Statement under sec Wis. Stats., or a court decree under sec Wis. Stats., adversely affects the interest of the creditor unless the creditor, prior to the time credit is granted, is furnished a copy of the agreement, Statement or decree or has actual knowledge of the adverse provision when the obligation to the creditor is incurred. 7 Notice: The following is important information regarding your right to dispute billing errors. YOUR BILLING RIGHTS KEEP THIS NOTICE FOR FUTURE USE This notice contains important information about your rights and our responsibilities under the Fair Credit Billing Act. Notify Us in Case of Errors or Questions About Your Bill If you think your bill is wrong, or if you need more information about a transaction on your bill, write us on a separate sheet at the address shown on your Statement under billing inquiries. Write to us as soon as possible. We must hear from you no later than 60 days after we sent you the first bill on which the error or problem appeared. You can telephone us, but doing so will not preserve your rights. In your letter, give us the following information: Your name and GE Money Platinum MasterCard Account number. The dollar amount of the suspected error. Describe the error and explain, if you can, why you believe there is an error. If you need more information, describe the item you are not sure about. Your Rights and Our Responsibilities After We Receive Your Written Notice We must acknowledge your letter within 30 days, unless we have corrected the error by then. Within 90 days, we must either correct the error or explain why we believe the bill was correct. After we receive your letter, we cannot try to collect any amount you question, or report you as delinquent. We can continue to bill you for the amount you question, including finance charges, and we can apply any unpaid amount against your Credit Limit. You do not have to pay any questioned amount while we are investigating, but you are still obligated to pay the parts of your bill that are not in question. If we find that we made a mistake on your bill, you will not have to pay any finance charges related to any questioned amount. If we didn t make a mistake, you may have to pay finance charges, and you will have to make up any missed payments on the questioned amount. In either case, we will send you a statement of the amount you owe and the date that it is due. If you fail to pay the amount that we think you owe, we may report you as delinquent. However, if our explanation does not satisfy you and you write to us within ten days telling us that you still refuse to pay, we must tell anyone we report you to that you have a question about your bill. If we don t follow these rules, we can t collect the first $50.00 of the questioned amount, even if your bill was correct. Special Rule for Credit Card Purchases If you have a problem with the quality of property or services that you purchased with a credit card, and you have tried in good faith to correct the problem with the merchant, you may have the right not to pay the remaining amount due on the property or services. GE MONEY PLATINUM MASTERCARD REWARDS PROGRAM TERMS These are the terms and conditions for the GE Money Platinum MasterCard Rewards Program. 1. DEFINITIONS: As used herein, the following terms will have the following meanings: Account means the GE Money Platinum MasterCard account Bank means GE Money Bank. Cardholder means the person to whom the Account was issued. Program means the GE Money Platinum MasterCard Rewards program.
