2 Affidavit of Truth The undersigned Affiant, Tex Lee Mason, hereinafter Affiant, does solemnly swear, declare and state as follows: 1. Affiant s usage of the terms I, me, my, our or us refers to Tex Lee Mason ; and that 2. On or about February 4, 2004 I entered into a transaction, with Mortgage Investors Company, identified as Mortgage # , a copy of which is enclosed herewith as exhibit A. 3. The terms and conditions as represented to me, by the representatives of Mortgage Investors Company, is that I would receive a loan of money for $89,850.00; and that 4. In the spirit of the contract, and for equal consideration, I would mortgage a security interest in a Security Instrument for the value of $89,850.00, hereinafter referred to as the Note, a copy of which is enclosed herewith as exhibit B; as well as convey an interest in land located near 806 Ivy Lane, in Hinesville City, Liberty County Georgia to Mortgage Investors Company as a secured Creditor. 5. On or date Mortgage Electronic Registration Systems (MERS) executes an Assignment instrument signed by Assistant Secretary, Dewolfe R Turpeau, III alleging to assign the Mortgage Contract # to ABC Services Bank 6. ABC Services Bank, represents itself to be a servicer of the mortgage contract. Exhibit A. 7. Affiant made payments to, ABC Services Bank from April 4, 2004 to December until December 9, On or about June 1, 2013 Affiant became aware that ABC Services Bank never gave a loan, and that the transactions were funded solely by the securitization of the Affiants security instruments, and that the Mortgage Investors Company, did not lend the Affiant money. 9. ABC Services Bank used false representations intentionally, fraudulently, and deceptively to influence me to enter into the mortgage contract. 10. The Affiant, upon reliance on such false representations, pledged a security interest in the Note, in favor of Mortgage Investors Company 11. The Affiant upon reliance on the false representations mentioned above, has labored over 4000 hours (~$75,040.93) from February of 2004 until February of 2012, in satisfaction of the above fraud based Mortgage contract.
