4 PART D TANZANIA CIVIL SERVICE AGREEMENT FOR AN ADVANCE/LOAN FOR THE PURCHASE OF A MOTOR VEHICLE/ CYCLE. Agreement made this / / (D/M/Y) Between (Full name and designation ).. (Hereinafter called the Borrower on the one part) and the Government of Tanzania (hereinafter called the Government) on the other part, whereby it is agreed as follows:- (1) The borrower agrees to purchase a motor cycle/vehicle (Make and Type of Vehicle.) of a value not less than the amount to be advanced by the Government. (2) The Government agrees to advance/loan to the borrower a sum of TShs. (3) The borrower agrees to repay the sum advanced/loan together with the service charge of 3% upon the said sum as and when directed by the Government. (4) The borrower agrees to repay the loan between...../..(month/year) and../...(month/year) (5) The borrower agrees to provide information to the Public Service Advances Fund if salary deduction for the advances/loan recovery does not start/stop contrary to agreement stated above. (6) The borrower hereby agrees to be held responsible for failure to repay the sum advanced within the prescribed repayment period. A penalty of 5% shall be charged for any late loan recovery. (7) The borrower hereby agrees:- (a) (b) not to sell, transfer or dispose in any other way of his property in the said motor cycle/ vehicle without permission in writing of the Government, until the whole of the sum advanced and service charge due thereon has been repaid; to take out a policy of insurance on the said motor cycle/vehicle for a sum not less than the amount advanced and then owing and for the period during which the sum advanced is directed to be repaid, in respect of the following risks:- 3

5 (a) Accident (by road, rail or steamer) theft, fire, Third Party risks (unlimited). (b) To execute an instrument of chattels transfer under the Transfer ordinance (Cap.210) in favour of the Government if and when required to do so by the Accountant General; (c) Not to take the said motor cycle/vehicle out of Tanzania without the approval of the Accountant General. (8) If the borrower shall die or leave the service of the Government before the sum advanced by the Government is repaid in full together will any service charge due and owing thereon, then and in that case the whole of the balance of the said sum and service charge shall be forthwith payable by the borrower or his executors or administrators, as the case may be.... 6 PART E TANZANIA CIVIL SERVICE Chattels Transfer Ordinance (Cap.210) (MOTOR VEHICLE / CYCLE). FOR USED MOTOR VEHICLE/CYCLE ONLY INSTRUMENT (Section 22) I.of (a) (hereinafter called the Grantor) being the owner of the Chattels mentioned in the Schedule hereto, in consideration of the sum of shillings.. Lent and advanced to me by the Government of Tanzania (hereinafter called the Grantee) hereby assign and transfer the same to the said Government of Tanzania by way of Mortgage to secure the payment of the said sum of Shillings with service charge thereon at..per centum in the meantime and so long as the same or any part thereof remains unpaid, in monthly installments of Shillings (b). Commencing with the month of 20. or such sums as the Grantee may from time to time direct. Provided always that in the event of the death of the grantee or the termination of his services with the grantee or the receipt or the giving of notice of such termination by the grantee before the loan and the service charge accrued due thereon, be repaid in full then and in any such event the whole of balance of the loan then outstanding and all service charge accrued due thereon, be repaid in full; Then the whole of the balance the loan then outstanding and all service charges accrued due thereon shall be paid to the grantee forthwith. (a) State residence and occupation; (b) The amounts inserted here must be the monthly principal and service charge installment combined. 5

7 The Guarantor hereby further agrees: - (i) (ii) (iii) (iv) (v) (vi) That the grantee may deduct from the grantor s salary and other emoluments the installments and moneys payable by way of repayment of the loan and service charge or otherwise under this instrument. To insure the vehicle and at all times while this instrument remains in force to keep the vehicle insured against loss or damage by accident (by road, rail, or steamer), theft or fire such insurance to be effected in the name of the grantee and to be for an amount no less than the amount of the principal and service charge at any time outstanding under this instrument and, at the request of the grantee, to hand over to and deposit with the grantee the policy of such insurance, and produce and deliver to the grantee the receptor receipts for the annual or other premiums payable on account thereof and to lay out and expend all moneys received under such insurance in the event of loss or damage by accident (by road, rail or steamer), theft or fire, so far as the same extend in making good such loss or damage, or if the grantee so elects in discharging the loan, provided that, if default be made in observance or performance of this covenant, the grantee may, without prejudice to and concurrently with the powers granted to the grantee by this instrument or otherwise by law, insure the vehicle and keep it insured as aforesaid, and may forthwith recover the costs and charges of such insurance from the grantor in like manner as if the same had been advanced by way of loan on the security of this instrument. To insure and at all times while this instrument remains in force to keep the vehicle insured against third party risks (unlimited); To register this instrument according to law, and if reasonably called upon to do so by the Government, renew the registration thereof within the time fixed by law; To defray the cost of the stamp duty for this instrument and the registration fee thereof and all other costs, fees and duties incurred in and necessary to the registration thereof and the preparation of affidavits therefore or otherwise incidental thereto; If and when necessary to defray the cost of the stamp duty required for a memorandum of satisfaction in respect of this instrument and all costs and fees connected with filing such memorandum; 6

8 (vii) Not to remove or attempt to remove or cause the removal of the motor vehicle/cycle out of the United Republic without the consent in writing of the grantee.
