Both these institutions campuses are located across one another. This hostel application form needs to be handed in together with your course registration form. Due to the high demand for hostel accommodation, hostel registrations close on 15 September You need to pay R HOSTEL non-refundable administration/registration fee and hand in a copy of the payment together with this form, or fax the deposit slip to (021) Clearly mark the deposit slip with your name and surname and stipulate what items you are paying. In terms of this contract we take note that late/arrear interest as laid down by the prescribed rate according to the Interest Act may be charged, on any outstanding amounts from the date of which it became due for payment. Administration fees such as warning/suspension letters, debit orders/cheques returned unpaid from the bank, telephone/cell phone and SMS charges will be charged and will vary between rates of R3.00 to R depending on the cost involved. I/We authorize the Academy to draw the administration fees from my/our debit order instruction, without further notification. In the case of an unpaid debit order, the payer authorizes the Academy to debit his/her account on any date that the Academy may choose and/or to double debit his/her account on the next payment date. 5 SECTION 8: TERMS AND CONDITIONS / DE CLARATION 8.1 DURATION OF REGISTRATION CONTRACT This hostel registration contract applies for one year only (2016). An administration/registration fee for each academic year is required to be paid. This fee is non-refundable. IMPORTANT NOTICE: In the event of any cancellation of this contract after 15 January 2016 by the student/co-payer(s), the cancellation penalty amounts to the damages suffered by the Academy, namely the entire balance of the annual hostel fees applicable in terms of the contract. 8.2 APPLICATION DATE AND FEE PAYABLE (NON-REFUNDABLE) The application form must reach the Academy on/before 15 September 2015 as the allocation of rooms take place on this date. The application fee of R is payable when handing in/posting the registration form. The Academy does not guarantee that if the student only applies and pays his/her hostel application/administration fee later than this date that there will be available place in the residence HOSTEL FEES The hostel fees (Addendum A) in this contract are fixed for The Hostel Owners/Academy reserves the right to make changes of these fees in the case where municipal rates and taxes, water and electricity bills increase during the academic year of SHUTTLE FEES The undersigned parties, if making use of the shuttle service, understand that the shuttle service is paid in advance to the supplier and cannot be cancelled for the duration of the year. If cancelled, the undersigned accept that they will be held responsible for the full amount of the annual fee. This fee is subject to change if the service provider for example petrol fee increases, increase their fees FRIDGE FEE Only bar-type sized fridges (Height: 84cm x Width: 46cm x Depth: 50cm) will be allowed. Communal fridges are supplied. Should you bring your own fridge an additional fee of R500 per annum will be levied towards electricity used. All fridges must be equipped with an overflow pan to avoid damage to the floors in the case of the fridge leaking water PARKING Your parking application form must reach our offices on/before 15 September The parking application does not automatically mean that you have been allocated a parking bay. Allocation of parking bays will be confirmed by 15 November EARLY PAYMENT DISCOUNT Discount as per fees list applies (last page of this contract). No variation of the full payment date will take place. 8.5 TRANSFER TO ANOTHER ROOM TYPE Transfer of a student to another room type can only take place if another room type is available and cannot be guaranteed. In the case of a student wishing to transfer from one room type (2 persons per room to 1 person per room), the student must apply to do so within the first 7 working days after classes commenced as per the academic calendar. By not being able to transfer to another room type is not a sufficient reason to cancel the contract. 8.6 REDUCTION IN FEES / ADDITIONAL FEES The student shall not be entitled to any reduction of fees whatsoever in the case of not making use of the facility. In the case where experiential learning / work-integrated learning takes place somewhere else, no reduction in fees take place. If a student decide to reside in the hostel during any college holiday for experiential learning purposes, a fee of R per day is payable in advance. 8.7 NON-PAYMENT IN FEES BARRING FROM HOSTEL The undersigned parties accept that should payments according to this contract not be made for a period of two consecutive months, the student will be barred from living at the residence until fees are paid up to date. Late interest will be charged. The Academy reserves the right to bar students more than once in an academic year from the residence due to no or insufficient payments received. No reduction of fees will take place during this period. 8.8 RIGHTS TO CANCEL / TERMINATE THIS CONTRACT: Cooling off period Students are granted a 7 day cooling-off period, from the application date to cancel his/her registration. The undersigned parties accept that the cooling off period is only valid until 15 January Once the student enrolls after 15 January 2016, the student cannot cancel his/her hostel registration and the cancellation penalty will apply. 6 8.8.2 CANCELLATION OF REGISTRATION AFTER 15 NOVEMBER 2015 The undersigned parties agree and accept that the hostel administration/registration fee of R is non-refundable CANCELLATION AFTER 15 JANUARY 2016 The undersigned parties accept that they will be kept liable for the full annual hostel fee should the applicant cancel his/her registration after 15 January This means that even if no monies were paid over to the Academy, and the student did not cancel on time, the undersigned parties will be kept liable for the full annual hostel fees. The undersigned parties also accept that if the student decides not to reside at the hostel for a part of the year only, that they will be kept liable for the full annual hostel fees CANCELLATION IN WRITING A cancellation will only be accepted if done in writing. The undersigned parties are herewith notified that no verbal agreement with any employee of the Academy is enforced unless the student/parent/principal payer(s) have cancelled in writing and acceptance in writing has been given by the Financial Director. An may be sent to info@prestigeacademy.co.za or fax to (021) EARLY EXIT FROM THE HOSTEL OR ABSCONDING AFTER STUDENT COMMENCED WITH RESIDING AT THE HOSTEL The undersigned parties agree that the student and payer(s) will be held liable for the full annual hostel fee in the event of the student choosing to not reside in the hostel for the entire academic year, but only part of the year. It is agreed by the parties that this clause will only be waved in the case of the student passing away SUITABLE PREMISES The student/parents/payer(s) may view the hostel premises on official open days and during the winter workshop. The Hostel premises are situated at 7 and 9 Maree Street, Bellville. It is the responsibility of the student/parents/principal payer(s) to make sure that they are satisfied with the hostel facilities and location thereof. By not visiting the hostel premises before the contract is signed, is not a sufficient reason to waive any of these cancellation clauses whatsoever. 8.9 INTEREST All fees are payable in full by 15 January If the fees could not be settled by 15 January 2016, the student/payer(s) may approach the Academy in order to negotiate in respect of the provision of credit and the terms of such credit agreement. No annual interest is included in the hostel monthly payment. In the event that installments are not paid on due date, interest in terms of the Prescribed Rate of interest Act, will be applicable (currently 9% p.a.). In this regard, students/co-payers are warned to apply for student bank loans, immediately on receipt of the acceptance letter from the Academy, as late payment of such bank loans to the Academy is not an excuse/defense against interest charged METHOD OF PAYMENT & CASH DEPOSIT FEES It is advisable to all students paying off their hostel account over 11 months to the Academy, to make use of the debit order system. No cash over the counter at the bank or the Academy will be accepted due to large cash deposit fees. Fees must be paid via EFT, or per cheque at the bank counter. A debit order system (see page 4) is available for clients that do not have electronic banking or cheque book facilities. Cash deposit fees will be charged at ABSA s cash handling fee EXTRAORDINARY EVENT In the case of any circumstance or an extraordinary event beyond the Academy s or Hostel Premises owners control, such as war, strike, riot, crime or act of God (e.g. flood, earthquake, etc.) the Academy shall be entitled to temporarily close the residence affected thereby. In this event the student shall not by reason of such suspension or closure be entitled to terminate this agreement or claim a refund, fees paid or a reduction on fees payable or any compensation from the Academy. The Academy will as soon as possible transfer students to another building or repair damages in the current building(s) to continue with residing at the hostel INDEMNITY IMPORTANT NOTICE: The student acknowledges that he/she may be exposed to risks in the event of induction, workshops, training, field trips, camps, physical sport activities, travelling, etc. The student and the undersigned payer(s) hereby waive all claims against the Academy owners and employees for any damages or loss suffered while the student is, or as the result of being, a student of this Institution resulting in death, mental harm or arising from physical injury, or illness suffered by the student or any other person. Such consequences include any loss, destruction of or damage to any property belonging to the student or any other person howsoever the damage or loss is caused by, but is not limited to, the negligence of the Academy or any official employee or representative of this institution INDUCTION The student has the right to voluntarily take part in the induction at the hostel building. Induction takes place in an orderly manner for example, braai s, dance, camp, concerts, etc. No additional fee is paid for induction. The fire drill at the hostel building is compulsory and takes place during a late night drill. The induction policy is available at the Rector s office. 7 8.14 DECLARATION IMPORTANT NOTICE The student and undersigned payer(s) understand, accept and agree: that the Academy shall have the right to summarily terminate the student s program and/or accommodation and expel him/her from the residence should the undersigned parties breach any aforesaid undertakings or by reason of disciplinary actions taken. The undersigned parties understand that they will be kept liable for the annual hostel fee even if the student has been expelled; give permission to the Academy officials to do the necessary credit checks for credit arrangements over 11 months; that the information in this application form/registration contract is complete and correct; undertake to comply with all the rules and regulations, including the disciplinary rules and any amendments thereof as published from time to time and to acquaint the undersigned parties with all the provisions thereof. The student/payer(s) declare by signing hereunder that they have studied the residence fees and accept these fees, the terms and conditions thereof. SURETY AND CO-PRINCIPAL DEBTORS The student and account payer(s) bind themselves to the Academy, jointly and severally, as co-sureties and co-principal debtors for the payment of all fees and other charges due by them to the Academy in terms of this contract. The Academy shall be entitled to institute any legal proceedings which may arise out of or in connection with this contract in any Magistrates Court having competent jurisdiction in respect of the surety s person, notwithstanding the fact that the claim or value of the matter in dispute might exceed the jurisdiction of such Magistrates Court in respect of the cause of action. Costs: Legal costs to be awarded to any party to this contract in the event of legal proceedings in respect of a cause of action arising from this contract, will be calculated on the attorney and client scale of fees and will include collection and tracing charges in enforcing the obligations of any of the parties to this agreement..... 10 APPLICATION FOR FRIDGE: 2016 Please complete the form and return on/before the 15 September 2015 Although the Hostel is equipped with various Fridge/Freezer facilities, we get many requests from parents/students to bring a separate fridge. However, it is not always guaranteed that the room has sufficient space to keep a fridge and an alternative area will then be provided to keep the fridge. Guidelines for application: 1.
